<section id="HCF7004BDF68C4FCD9F4376ED638497F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Toxic Chemicals in Food Packaging Act of 2026</short-title></quote>.</text></section> <section id="H912D0CD3EA03422B98B267DE8C22100D"><enum>2.</enum><header>Substances deemed unsafe for use as food contact substances</header> <subsection id="H6606AECE10004CF49DF5DDB1015E54C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 409 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/348">21 U.S.C. 348</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HC66D943BED98491F83A8048AD01E8A6A"><enum>(l)</enum><header>Substances deemed unsafe for use as food contact substances</header> 
<paragraph id="H0D1C07F4B662441091BA239F75817422"><enum>(1)</enum><header>In general</header><text>For purposes of this section and section 402(a)(2)(C), the following are deemed to be unsafe for use as food contact substances:</text> <subparagraph id="H2C689BE1647246A499AD4C10F1FE6068"><enum>(A)</enum><text>Any chemical belonging to the class of ortho-phthalates.</text></subparagraph> 
<subparagraph id="H37CA02F562034AC69B4414EC075915F9"><enum>(B)</enum><text>Any chemical belonging to the class of PFAS.</text></subparagraph> <subparagraph id="H3C96492B715D4D25A028E42897E72A1E"><enum>(C)</enum><text>Bisphenol A, B, S, F, or AF or related compounds.</text></subparagraph> 
<subparagraph id="H16D2076920A34A3B87E42A8168DCBF85"><enum>(D)</enum><text>Acrolein.</text></subparagraph> <subparagraph id="HA0A686CE65CE46B1ACCC1BE98E919B50"><enum>(E)</enum><text>Acrylamide.</text></subparagraph> 
<subparagraph id="HF4CBBCBA62F94ACC925DA84E59F8E785"><enum>(F)</enum><text>BHA (tert-Butyl-4-hydroxyanisole).</text></subparagraph> <subparagraph id="H96DF767AC0F2421CA61BE0947E916A1A"><enum>(G)</enum><text>Chlorinated paraffins.</text></subparagraph> 
<subparagraph id="HA326ED5893A24BA387C16CFC58D9A9DB"><enum>(H)</enum><text>1,4-Dioxane.</text></subparagraph> <subparagraph id="HB96039C6ADC8434B8339518396A4F1B9"><enum>(I)</enum><text>Asbestos.</text></subparagraph> 
<subparagraph id="HC0F0E5B7D7A643A4AE308B2DB013C5D8"><enum>(J)</enum><text>Benzene.</text></subparagraph> <subparagraph id="H827874563692454A8F42D5E236C09B0A"><enum>(K)</enum><text>Chloroform.</text></subparagraph> 
<subparagraph id="H6C4CBE165AC7437B80F699860975D75A"><enum>(L)</enum><text>Methylene chloride.</text></subparagraph> <subparagraph id="H98F8D9C956C64B0982070F38A9E6F1C8"><enum>(M)</enum><text>Ethylene oxide.</text></subparagraph> 
<subparagraph id="HE60EECA40B4A49F9A3462D0D2F7130EC"><enum>(N)</enum><text>Formaldehyde.</text></subparagraph> <subparagraph id="HCB4432D7058E4C8EA506EEEBE0DBAF81"><enum>(O)</enum><text>Styrene polymers.</text></subparagraph> </paragraph> 
<paragraph id="H7DC40F164C8A4115BFD4C9F4F2F3C239"><enum>(2)</enum><header>Alternative substances</header><text>In acting in response to any petition under this section to establish safety with respect to a food contact substance that the Secretary determines to be an alternative to a substance listed in paragraph (1), in addition to the criteria under subsection (c), the Secretary shall consider potential adverse effects of exposure to the substance on vulnerable populations.</text></paragraph> <paragraph id="HA437714E52484EF6A8A513032D503406"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<subparagraph id="HD938278103014A6B9A34528C3BFA1F08"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>ortho-phthalates</term> means a class of chemicals that are non-polymeric esters of ortho-phthalic acid.</text></subparagraph> <subparagraph id="H58DE61B4D8CC46A0A6F8171503451EFF"><enum>(B)</enum><text>The term <term>PFAS</term> means a perfluoroalkyl substance or a polyfluoroalkyl substance that contains at least 1 fully fluorinated methyl or methylene carbon atom.</text></subparagraph> 
<subparagraph id="H2220CE83FA82401EB8316B9173DD0923"><enum>(C)</enum><text>The term <term>vulnerable population</term> means a human population that is subject to the potential for disproportionate exposure to, or the potential for disproportionate adverse effect from exposure to, a chemical substance or mixture, including—</text> <clause id="H5569A5BDA34F4898A122B5CF669832C4"><enum>(i)</enum><text>infants, children, and adolescents;</text></clause> 
<clause id="H2EF0DFD2C8C3463CB0319EF8D1AFA914"><enum>(ii)</enum><text>pregnant women;</text></clause> <clause id="HB4828B8F4FD34C3E8B125107686D0DFC"><enum>(iii)</enum><text>the elderly;</text></clause> 
<clause id="HE70D987EF7794DBDB21EDDAA3D533B39"><enum>(iv)</enum><text>individuals with preexisting medical conditions;</text></clause> <clause id="H4C4802C88A984AC2B470270F59F2A9F7"><enum>(v)</enum><text>workers who may be exposed to chemical substances and mixtures;</text></clause> 
<clause id="H01CB2873754D48EDB7E65E46F1A89AC7"><enum>(vi)</enum><text>residents in communities subject to disproportionate exposures; and</text></clause> <clause id="HA928993764B34B0DA6B4D2BD12D098EA"><enum>(vii)</enum><text>members of any other appropriate population identified by the Secretary.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBB78FE22A36D48D1A0910687F495E2C3"><enum>(b)</enum><header>Preservation of State and local authority</header><text display-inline="yes-display-inline">Section 409 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/348">21 U.S.C. 348</external-xref>) is amended further by adding at the end the following:</text> <quoted-block style="OLC" id="H21626D3F19D24CEC9471820FD7658D3D" display-inline="no-display-inline"> <subsection id="H1117FFFC04144E75BC44EDAAD251DAC8"><enum>(m)</enum><header>Preservation of State and local authority</header> <paragraph id="H7248FCF6528B41C599AA1D9FCFFBDE2F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section, or any rule promulgated under this section, shall be construed to limit the authority of a State or political subdivision of a State to enact, adopt, promulgate, and enforce any law, rule, regulation, ordinance, or other measure with respect to any food additive that is in addition to, or more stringent than, requirements established under this section, including a law, rule, regulation, ordinance, or other measure relating to—</text> 
<subparagraph id="H921C97CF3415401183088A9E7C4EB307"><enum>(A)</enum><text>the prohibition of the use of any substance as a food additive; and</text></subparagraph> <subparagraph id="H38087D65294E47FD973E430BD4E64026"><enum>(B)</enum><text>the manufacture, distribution, sale, or use of any food containing a food additive regulated under this section.</text></subparagraph></paragraph> 
<paragraph id="H419C3CDCE622476392BE4E7C332A505B"><enum>(2)</enum><header>Rule of construction regarding State and local law</header><text display-inline="yes-display-inline">No provision of this section relating to food additives shall be construed to modify or otherwise affect any action or the liability of any person under the law of any State or political subdivision of a State.</text></paragraph> <paragraph id="H1AD4A06AF4A549139C98162F4F38CBD3"><enum>(3)</enum><header>Food additive defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>food additive</term> includes a food additive that is a food contact substance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H21ACAAD26E8D41189D8E66EF831486CA"><enum>(c)</enum><header>Delayed applicability</header><text display-inline="yes-display-inline">Section 409(l) of the Federal Food, Drug, and Cosmetic Act, as added by subsections (a), applies beginning on the date that is 2 years after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
