<section id="H009A429DD93A4EC99B688361EFB91CFB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seaport Security Act of 2026</short-title></quote>.</text></section> <section id="H1481FCAF62A7488AA6BED91DBDB28B77"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H1F60DF0B782249409E5A299CCF43DFC8"><enum>(1)</enum><text>drone technology has the potential to revolutionize commerce, military operations, law enforcement, and numerous industries throughout the United States;</text></paragraph> <paragraph id="HE002A28FF9BE42C2A041A2E9278D3B8A"><enum>(2)</enum><text>drone technology also presents a significant potential danger to public safety and national security;</text></paragraph> 
<paragraph id="H7108DE47DA2D4EB398E69B6CB424F021"><enum>(3)</enum><text>drone technology is increasingly being deployed for criminal purposes, including drug trafficking, human trafficking, smuggling, and illegal reconnaissance;</text></paragraph> <paragraph id="HC196BC25232448E9BAFE790934A12D0C"><enum>(4)</enum><text>seaports in the United States are a potential target for unmanned aircraft and drones;</text></paragraph> 
<paragraph id="HAB0F3063DB654F3E9AF6A0D46FBC6B6D"><enum>(5)</enum><text>a drone attack on a seaport would pose a serious threat to the national and economic security of the United States;</text></paragraph> <paragraph id="HFC5F505E8DC24D32B2E5A769A0BBD215"><enum>(6)</enum><text>there are over 300 seaports in the United States which collectively handle 2.6 billion tons of cargo and 26 million cruise ship passengers each year; and</text></paragraph> 
<paragraph id="HF07C7841F3044F82A57AA93A92AFA8BB"><enum>(7)</enum><text>current Federal law does not provide sufficient protection for seaports from drone attacks.</text></paragraph></section> <section id="H62B11E8BC68D41C182AC0E55C6CE0FD4"><enum>3.</enum><header>Restriction on unmanned aircraft at seaports</header> <subsection commented="no" display-inline="no-display-inline" id="HAA35A7C0422D43789427AB56FCA98ADE"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">Chapter 2</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H8BAB58E513494FBBAAF4170D78F520F5"><enum>(1)</enum><text>in section 31(b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HCAF5C00112034AA69E90AC7FE002EBDD"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and <quote>special</quote></quote> and inserting <quote><quote>special</quote></quote>;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7E4339C045B445AA989855379089CD04"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote><term>unmanned aircraft</term>, and <term>unmanned aircraft system</term></quote> before <quote>have the meanings</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HED1DC50B71AE4A278FF7438F59A8206D"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting <quote>, 44801,</quote> before <quote>and 46501</quote>;</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9308063256BD47A2887632611CD90770"><enum>(2)</enum><text display-inline="yes-display-inline">in section 40A(c)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HA0DEA75885C7410C8968CB18B3152FFA"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (1); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H783E81FB2D8B408E81FAECF5F67F8B78"><enum>(B)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (1) and (2), respectively; and</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8C96E9A8B38248089D79585664188A53"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<section id="H68BAC6F321A0437A872A3D0576EFA7E4"><enum>40B.</enum><header>Operation of unauthorized unmanned aircraft over seaports</header> 
<subsection id="HEB08150E3F554B5798E390305AB19D68"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HD8C98CC5231E4C2F97F6A48FC61AE3D9"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Aviation Administration.</text></paragraph> 
<paragraph id="HF031B2028F3A4F2BAC4D6926D2E5E8E4"><enum>(2)</enum><header>Covered airspace</header><text>The term <term>covered airspace</term> means—</text> <subparagraph id="H368FBEF2FF474CCF84EE3F6E900EFA91"><enum>(A)</enum><text>the airspace above a seaport extending from the surface up to 1,000 feet above ground level; and</text></subparagraph> 
<subparagraph id="H29FD537F5B4545DBB01C30CC2DD10FC2"><enum>(B)</enum><text>any additional lateral or vertical airspace designated by the Administrator, as necessary to protect maritime infrastructure at a seaport.</text></subparagraph></paragraph> <paragraph id="H959196BA85EB464B948B0130EF46EA5E"><enum>(3)</enum><header>Multi-day cruise passengers</header><text>The term <term>multi-day cruise passengers</term> means individuals who embark on a cruise itinerary from a seaport lasting more than one calendar day requiring overnight accommodations aboard the vessel.</text></paragraph> 
<paragraph id="H89268D9288644FC39C061FD99D26BC54"><enum>(4)</enum><header>Seaport</header><text>The term <term>seaport</term> means all piers, wharves, docks, and similar structures adjacent to any waters subject to the jurisdiction of the United States, to which a vessel may be secured, including areas of land, water, or land and water under and in immediate proximity to such structures, buildings on or contiguous to such structures, and the equipment and materials on such structures or in such buildings, and which handle at least one million tons of commercial or military cargo annually or routinely process multi-day cruise passengers.</text></paragraph></subsection> <subsection id="HFDD638C60E234087A9F1538B8D363529"><enum>(b)</enum><header>Prohibited operations</header><text>Except as authorized under subsection (c), no person may operate an unmanned aircraft or unmanned aircraft system within covered airspace.</text></subsection> 
<subsection id="H2A2B8036D109457DAA2CBA4AD96541DF"><enum>(c)</enum><header>Authorized operations</header><text>The prohibition in subsection (b) shall not apply to operations—</text> <paragraph id="H1752102FC3FD434393EC2F42DBA7A603"><enum>(1)</enum><text>conducted by the Department of Homeland Security, the Department of Defense, or any other Federal agency under statutory authority;</text></paragraph> 
<paragraph id="H030928DBB79B4CC5AD6DB8C163DAF199"><enum>(2)</enum><text>conducted by State or local law enforcement with prior notification to the Federal Aviation Administration and the Coast Guard;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H689A6A8DFDFD4AAE9844C55C5B83B327"><enum>(3)</enum><text display-inline="yes-display-inline">conducted by a seaport, or a contracted entity, for operational, safety, or security purposes with notice to the Federal Aviation Administration and the Coast Guard;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCEDBBFB739B94AB39466DE4BE298B5CF"><enum>(4)</enum><text>authorized under a waiver issued by the Administrator; or</text></paragraph> <paragraph id="HD3319DDE471A43208AD4D7996DCDF0C0"><enum>(5)</enum><text>necessary to respond to an emergency involving an immediate threat to human life or property, provided that the operator notifies the Federal Aviation Administration and the Coast Guard as soon as practicable.</text></paragraph></subsection> 
<subsection id="HDB92CEF656E648A2B1898A9F30B5A40B"><enum>(d)</enum><header>Interference with port security</header><text>No person may operate an unmanned aircraft or unmanned aircraft system in a manner that interferes with, interrupts, or degrades the security, operations, communications, or navigational systems of a seaport, regardless of altitude.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HAEE55A31DCDE4AAA8CE1D626F467AA26"><enum>(e)</enum><header>Enforcement</header><text>The Federal Aviation Administration and seaports are authorized to detect, mitigate, seize, and disable any unmanned aircraft operating in covered airspace (other than unmanned aircraft operating in accordance with subsection (c)).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1EE18B7D7983496C8D151CECF877DAE0"><enum>(f)</enum><header>Civil penalties</header><text display-inline="yes-display-inline">A person who violates this section shall be subject to a civil penalty not to exceed $25,000 per violation, and the unmanned aircraft involved may be seized or forfeited.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HD50691224B804E6CAC14605F4D3F301B"><enum>(g)</enum><header>Criminal penalties</header><text display-inline="yes-display-inline">A person who willfully violates subsection (b) or (d)—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HAEE2EEC4803040EF816103B329A03AC6"><enum>(1)</enum><text display-inline="yes-display-inline">shall be subject to a fine under this title, imprisoned for not more than 2 years, or both; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5750B697BB5C465D9113DBF99BC38DB3"><enum>(2)</enum><text display-inline="yes-display-inline">if the violation is committed with the intent to surveil, damage, disrupt, or facilitate criminal or terrorist activity, shall be subject to a fine under this title, imprisoned for not more than 10 years, or both.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7DC4A0BD0ECC4DF29D142F7A57CAD1F3"><enum>(h)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall issue regulations to implement this section, including designation of covered airspaces and appropriate notification procedures.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H315C256FE1854630998E4D187056B79E"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">chapter 2</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
