<section id="HD143954B0F674B5790A889CBC4302826" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Marcus’s Law</short-title></quote>.</text></section> <section id="HEBE43C332B8F4D1189886BCC6A259CDA" section-type="subsequent-section"><enum>2.</enum><header>Requiring electrocardiograms and echocardiograms for high school students participating in athletic contests</header> <subsection id="H4AD8BA68B38C40369546D83C2CEC4FD5"><enum>(a)</enum><header>Electrocardiogram and echocardiogram required</header> <paragraph id="H6A3085643B5240B6AD069E7582D13A93"><enum>(1)</enum><header>In general</header><text>Beginning with school year 2026–2027 and in accordance with paragraph (2) and subject to paragraph (3), a local educational agency that receives funds under an applicable program shall require students served by such agency in grades 9 through 12 to receive medical screening prior to participating in an athletic contest for the first time.</text> </paragraph> 
<paragraph id="HBFF29D32DBB1401C8B519EEB9FAD6639"><enum>(2)</enum><header>Period</header><text display-inline="yes-display-inline">A student described in paragraph (1) may receive medical screening in accordance with such paragraph at any point during the period—</text> <subparagraph id="HE8C29D24502B48D5979F9684638178D1"><enum>(A)</enum><text>beginning on the date that is the first day of the school year in which such student begins grade 9; and</text></subparagraph> 
<subparagraph id="HF6958AD0EE7948D7AB923FABC53E017D"><enum>(B)</enum><text>ending on the date that is 1 day prior to the first time such student participates in an athletic contest at any point during grades 9 through 12.</text></subparagraph></paragraph> <paragraph id="HD8384B2C85684894BCCDF9553BA5BBA7"><enum>(3)</enum><header>Partnerships</header> <subparagraph id="HFC3685EA8044481C88A7F6A476E1E9FA"><enum>(A)</enum><header>In general</header><text>By not later than the first day of the first sports season that begins after the date of the enactment of this section, a local educational agency described in paragraph (1) shall enter into a partnership with a public or private entity to offer medical screenings required under this section at a cost of $20 or less per student.</text></subparagraph> 
<subparagraph id="H92BDC4AD63594DBE8964F6562680A25A"><enum>(B)</enum><header>Waiver</header> 
<clause id="HE72D07E04ACD4871854A6743E5B32746"><enum>(i)</enum><header>In general</header><text>If a local educational agency is unable to enter into a partnership described in subparagraph (A) with respect to a sports season, such agency shall submit to the Secretary such information as the Secretary may require in order to demonstrate attempts by such agency to enter into such a partnership.</text></clause> <clause id="H2B6C711EA5614B949F18F6CC5C205E57"><enum>(ii)</enum><header>Determination</header><text display-inline="yes-display-inline">If the Secretary determines, based on the information submitted under clause (i), that a local educational agency made sufficient attempts to enter into a partnership described in subparagraph (A), the Secretary shall waive the requirement under paragraph (1) for such agency with respect to the sports season described in clause (i).</text> </clause> 
<clause id="HB975557A35D349839CCF58DE28A00478"><enum>(iii)</enum><header>Subsequent sports season</header><text display-inline="yes-display-inline">A local educational agency that receives a waiver under clause (ii) shall attempt to enter into a partnership described in subparagraph (A) that begins not later than the first day of the sports season immediately following the sports season for which the waiver applies.</text></clause> </subparagraph></paragraph></subsection> <subsection id="HE16A9859B0D84E0D8ECFA2916E757B3A"><enum>(b)</enum><header>Religious and medical exemptions</header><text display-inline="yes-display-inline">A local educational agency described in subsection (a)(1) may not require medical screening with respect to any student—</text> 
<paragraph id="H4470BD3C47064AE595DCFD86D8B61E8A"><enum>(1)</enum><text display-inline="yes-display-inline">for whom such medical screening conflicts with the religious tenets and practices of such student or their parent; or</text></paragraph> <paragraph id="HD061D3ACB80F45A2A793E602C4B5D5A4"> <enum>(2)</enum> <text>who provides documentation from a physician describing why such student should not participate in such medical screening; or</text>
                </paragraph> </subsection> 
<subsection id="HC915DB12979D45879245D1102FA240F3"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H12F5EC8A6C5F4C2A889C801486E4D739"><enum>(1)</enum><header>Applicable program</header><text>The term <term>applicable program</term> has the meaning given such term in section 400(c) of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1221">20 U.S.C. 1221(c)</external-xref>).</text></paragraph> 
<paragraph id="H82ABB934A2694F21B7E840ABE761C5FA"><enum>(2)</enum><header>Athletic contest</header><text>The term <term>athletic contest</term> means a competitive event where athletes or teams compete on behalf of a secondary school, including a game, match, meet, or tournament.</text></paragraph> <paragraph id="HE640F6A773394C8FB0B0837EECF3E950"><enum>(3)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>local educational agency</term> and <term>parent</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> 
<paragraph id="H6BFD2D86ED4A43D280F227A34C58C11A"><enum>(4)</enum><header>Medical screening</header><text display-inline="yes-display-inline">The term <term>medical screening</term> means an electrocardiogram and echocardiogram.</text></paragraph> </subsection></section> </legis-body></bill>
