                  United States Patent and Trademark Office to require disclosures in patent
                  applications regarding ties to the People’s Republic of China and other foreign

<section id="H7074BB94D3514B91855111DAE1515DE9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Adversary Patent Disclosure Act</short-title></quote>.</text></section> <section id="H2209C6B2B83943DAA17962592EA62633"><enum>2.</enum><header>Disclosures in patent applications regarding ties to the People’s Republic of China and other foreign adversaries</header> <subsection id="H729E8C97791C45938BC9564D08F318B0"><enum>(a)</enum><header>Disclosures in patent applications regarding Ties to People’s Republic of China and other foreign adversaries</header><text>Section 111 of title 35, United States Code, is amended by adding at the end the following:</text>

<subsection id="HF7B8D4059AD3401DABC08BAC1C86A0E0"><enum>(d)</enum><header>Disclosures regarding ties to people’s republic of china and other foreign adversaries</header> 
<paragraph id="HADFC83D2F21F47E9865689DAAAFC875A"><enum>(1)</enum><header>Disclosure</header><text display-inline="yes-display-inline">The Director shall require each person submitting an application for patent under subsection (a), or a provisional application for a patent under subsection (b), to disclose in the application the identity of each person with an ownership interest in the invention being claimed that in the 5 years before submitting such application—</text> <subparagraph id="HADCB899C50DB44F693326293F893F16E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">was employed by an entity subject to ownership or control by a foreign adversary;</text></subparagraph> 
<subparagraph id="H3B64FB962F2F4B64A47D7E6824595EF8" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">received funding from a state-affiliated research fund or talent recruitment program associated with a foreign adversary; or</text></subparagraph> <subparagraph id="HEDF16832CA8649C281CE1D6FC37FD972"><enum>(C)</enum><text display-inline="yes-display-inline">received any other financial incentive from a foreign adversary related to the application, grant, or enforcement of a patent.</text></subparagraph></paragraph> 
<paragraph id="H8498421611FB418A9EE93434E8B2961C" commented="no"><enum>(2)</enum><header>Request for true copies</header> 
<subparagraph id="HC867ABBB6A9F49A785B9A6AA184DB1EC" commented="no"><enum>(A)</enum><header>In general</header><text>After reviewing any disclosure made by an applicant in accordance with paragraph (1), the Director may (as the Director determines appropriate) request such applicant provide true copies of any contractual or financial obligation or other agreement specific to such disclosure.</text></subparagraph> <subparagraph id="H4961001420744B3C904FFCBDF9F30C81" commented="no"><enum>(B)</enum><header>Confidentiality</header><text>Any true copy provided to the Director under subparagraph (A) may be kept confidential and separate from the file wrapper of the patent application.</text></subparagraph></paragraph> 
<paragraph id="HC2A110F98D6F494AA12F7165C2728220" commented="no"><enum>(3)</enum><header>Exemption</header><text>Any applicant who is a small business concern and is subject to disclosures pursuant to subsection (g) or (o) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) shall be exempt from making the disclosure required by paragraph (1).</text></paragraph> <paragraph id="HA34A4A592D4A4795AEB9A2AB10B1C22B" commented="no"><enum>(4)</enum><header>Foreign adversary defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>foreign adversary</term> means—</text> 
<subparagraph id="HC3A3FB59FEAA4570969B7F1B21C78B17" commented="no"><enum>(A)</enum><text>the People’s Republic of China, including all Special Administrative Regions;</text></subparagraph> <subparagraph id="H736E8FA4120745E494ABD2F679557786" commented="no"><enum>(B)</enum><text>the Republic of Cuba;</text></subparagraph> 
<subparagraph id="HC31AD81441FB430FBADA82148BCFE317" commented="no"><enum>(C)</enum><text>the Islamic Republic of Iran;</text></subparagraph> <subparagraph id="H2D1F2DC5AD2C4AD5ACA063B2113431DF" commented="no"><enum>(D)</enum><text>the Democratic People’s Republic of Korea; and</text></subparagraph> 
<subparagraph id="H875A47360AA942C08243FB980BC61EB9" commented="no"><enum>(E)</enum><text>the Russian Federation.</text></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> </legis-body></bill>
