<section id="H7FFC0B43523D4D68B4DB72ED1AA4AD80" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicaid Financing Clarification Act of 2026</short-title></quote>.</text></section> <section id="H46677683CBFB496DA008E56B91CFA1D9"><enum>2.</enum><header>Clarifying the intent of Congress with regards to Medicaid financing policies</header> <subsection id="H2EE81CE07221430ABBB703E648BC69DD"> <enum>(a)</enum> <header>State plans for medical assistance</header> <text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended in paragraph (2) by inserting <quote>, including public funds transferred from or certified by political subdivisions,</quote> after <quote>from local sources</quote>.</text>
            </subsection> 
<subsection id="H562BDF6D9C76437B8D74A32F1D49EAB2"><enum>(b)</enum><header>Definitions</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by adding at the end the following new subsections:</text> <quoted-block id="H05E348F9866F4BBDB4D75A529F3C14B7" style="OLC"> <subsection id="HCBCED8CEAF9841E29F9C72479EA5C503"><enum>(ll)</enum><header>Public funds</header><text>For purposes of sections 1902(a)(2) and 1903(w), <quote>public funds</quote> means State and local funds in the possession of a political subdivision or public agency, including tax revenues, appropriations, fees, grants, earned interest, fines, sale or lease of public resources, legal settlements and judgments, revenue from bond issuances, tobacco settlement funds, and patient care revenues. Federal funds may not be used as public funds unless authorized by Federal law to be used as matching funds for other Federal funds.</text></subsection>

                        <enum>(mm)</enum>
                        <header>Political subdivision</header>
 <text display-inline="yes-display-inline">For purposes of subsections (cc) and (ll) of this section and subsection 1902(a)(2), a <quote>political subdivision</quote> is a separate legal entity of a State which has specific governmental functions. A political subdivision may include a county, city, town, village, district, non-State governmental entity, or other unit of local government in a State.</text>
                    </subsection> 
<subsection id="H187D0B2FC557416292BEC6D0AE87C71C"><enum>(nn)</enum><header>Public agency</header><text display-inline="yes-display-inline">For purposes of subsection (ll) of this section and subsections 1902(a)(2) and 1903(w), a <quote>public agency</quote> is a unit of government, including a State or any political subdivision thereof.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
