<section id="HD6AC18A4EAA841039C41842C493DC7C6" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Student Privacy Act</short-title></quote>.</text></section> 
<section id="H4A17FD4F8F974D5F8E51CFB8B936A31E"><enum>2.</enum><header>Protection of personally identifiable information</header><text display-inline="no-display-inline">Part G of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088 et seq.</external-xref>) is amended by adding at the end the following new section:</text> <quoted-block style="OLC" id="H39A354C9CE8648DCA6AF068C15B83854" display-inline="no-display-inline"> <section id="H99F25C671E794B95931D91CFCF9F7965"><enum>494A.</enum><header>Prohibition on use of personally identifiable information for immigration enforcement purposes</header> <subsection id="HA08CC7EBB75C4A639F272D973D74A45F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and except as provided in subsection (b), no Federal student aid information may be—</text> 
<paragraph id="H57F7DDF9803A49E29D8608C5A209E46D" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">shared with or used by the Department of Homeland Security, any other Federal agency that has immigration enforcement authority, or a State or local agency that has in effect an agreement with the Department of Homeland Security under section 287(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357</external-xref>) for the purposes of immigration enforcement; or</text></paragraph> <paragraph id="H64DFFBA5FB6840EB9A30E629A17E218C"><enum>(2)</enum><text display-inline="yes-display-inline">treated as information subject to disclosure under section 642 of the Omnibus Consolidated Appropriations Act, 1997 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>).</text></paragraph></subsection> 
<subsection id="H17D36AB6E829401D96EA792F33916107"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The prohibition under subsection (a) shall not apply to Federal student aid information—</text> <paragraph id="H13B5C8524CB7445FB85929D0531501CF"><enum>(1)</enum><text>required to be disclosed pursuant to a court order issued in connection with the commission of a Federal or State criminal offense alleged to have been committed by the student; or</text></paragraph> 
<paragraph id="HE43F4B3E440E4BF4B7B4409DDC1E2C8A"><enum>(2)</enum><text>subject to subsection (c), in a case in which the student or contributor individual has voluntarily and expressly consented to the disclosure of such information to an agency described in subsection (a)(1).</text></paragraph></subsection> <subsection id="HFC1E9380BCB9400CADF840C320EC1932"><enum>(c)</enum><header>Prohibition on coercion</header><text>The exception under subsection (b)(2) shall not apply in a case in which an agency described in subsection (a)(1)—</text> 
<paragraph id="HB7607244A60D468A9A515197F27961A5"><enum>(1)</enum><text>requested that a student or contributor individual consent to the disclosure of Federal student aid information; or</text></paragraph> <paragraph id="HE3D02BE043354D21B7D96D38BF1BC170"><enum>(2)</enum><text>coerced or otherwise pressured a student or contributor individual to consent to such disclosure.</text></paragraph></subsection> 
<subsection id="HD8E087687D23439B801A30D0FD943A78"><enum>(d)</enum><header>Reporting to Congress</header><text display-inline="yes-display-inline">In the event the Secretary discloses or learns of a disclosure of Federal student aid information in violation of this section, the Secretary shall submit to Congress a report that describes the circumstances of such disclosure, the nature of the information disclosed, and any steps taken to remedy the disclosure.</text></subsection> <subsection id="HDB44D4F8286245CCA90D7B2D0F5462D8"><enum>(e)</enum><header>Relationship to other law</header><text>This section supercedes any contrary provision of Federal, State, or local law to the extent such law would authorize disclosure of Federal student aid information in violation of this section.</text></subsection> 
<subsection id="H7F490EC0E7254DD8877BC4B1E85B628B"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9B5076F343CA4542AE21B40952BBB9E3"><enum>(1)</enum><header>Contributor individual</header><text display-inline="yes-display-inline">The term <quote>contributor individual</quote> means any individual (including a spouse or parent of a student or borrower) whose financial information, including tax return information, is required to be provided on an application for any program, activity, or benefit under this title.</text></paragraph>
<paragraph id="HF9AA4CCAABF3476EAED60D55CEED0C5B"><enum>(2)</enum><header>Federal student aid information</header><text display-inline="yes-display-inline">The term <term>Federal student aid information</term> means any personally identifiable information (as that term is used in section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; commonly known as the Family Educational Rights and Privacy Act of 1974)) about a student or other contributor individual that is submitted or used in connection with a determination of initial or continuing eligibility for any program, activity, or benefit under this title.</text></paragraph> <paragraph id="H7A798D1D75424E2FAE2329D8C83359F5"><enum>(3)</enum><header>Immigration enforcement</header><text>The term <term>immigration enforcement</term> means an apprehension, an arrest, an interview, a request for identification, a search, or surveillance for the purposes of enforcing the immigration laws.</text> </paragraph> 
<paragraph id="H1655AEA3252242DC838D5A97A2191696"><enum>(4)</enum><header>Immigration laws</header><text display-inline="yes-display-inline">The term <term>immigration laws</term> has the meaning given the term in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
