            on actions taken by executive branch employees to censor lawful speech, and for other

<section id="H28D52B35236042828FA476CCC3305397" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountability for Government Censorship Act</short-title></quote>.</text></section> <section id="H861BD3E151FE4757B4BE982D1D0FB802"><enum>2.</enum><header>Reports on Federal agency communications with platforms regarding censorship of speech</header> <subsection id="H07447251E2F44057B7D9DEA6DB349930"><enum>(a)</enum><header>Agency report to OMB</header> <paragraph id="H69DB359976D8475B979A1B9A367F8344"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the head of each agency shall submit a report to the Director of the Office of Management and Budget listing each instance during the 5-year period immediately preceding the date of enactment of this Act that an officer or employee of the agency communicated with a platform (including an interactive computer service) that is not owned and operated by the Federal Government for the purposes of—</text> 
<subparagraph id="H1B871113793246F99B6DEA3F676F0563"><enum>(A)</enum><text>removing or suppressing lawful speech, in whole or in part, from or on any platform;</text></subparagraph> <subparagraph id="H3051615C00FC4765BDBC5FABA17F9104"><enum>(B)</enum><text>adding any disclaimer, information, or other alert to lawful speech expressed on any platform; or</text></subparagraph> 
<subparagraph id="HD8D3A40460764B68A99025C5E77CC105"><enum>(C)</enum><text>removing or restricting the access of any person or entity to any platform.</text></subparagraph></paragraph> <paragraph id="HB066FE30588C4C6C82FC935D7509393A"><enum>(2)</enum><header>Additional information</header><text>With respect to any communication listed pursuant to paragraph (1), the head of the agency shall include the following information:</text> 
<subparagraph id="H611DB0C711D946B4AEFC8E2DF4E28FD5"><enum>(A)</enum><text>The name of the sub-agency, bureau, or office at which the officer or employee is employed.</text></subparagraph> <subparagraph id="HE72147BF820B4CFFA9567845CC2B5911"><enum>(B)</enum><text>The name of any officer or employee involved in the communication, including their position and direct supervisor or supervisors.</text></subparagraph> 
<subparagraph id="H01C8536615034D8C95154F418D786C31"><enum>(C)</enum><text display-inline="yes-display-inline">The statutory authority for making the communication (if any), and if no such authority exists, an explanation for why the agency viewed it in their authority to take the action.</text></subparagraph> <subparagraph id="H90259B3BBE5D4EA0A593DFED5337378E"><enum>(D)</enum><text>The name of the platform that received the communication, including the name and positions of employees of the platform that were specifically communicated with.</text></subparagraph> 
<subparagraph id="H3233D6FB4FF14068A86E54055DD9D6A9"><enum>(E)</enum><text>A written justification summarizing and explaining the purpose for taking the communication.</text></subparagraph> <subparagraph id="HDA92E4B8248940CCB2967FA42A547F65"><enum>(F)</enum><text>A written summary of the outcome of the communication.</text></subparagraph> 
<subparagraph id="H376908A3E4174B5F8E20397CE18CE5EF"><enum>(G)</enum><text>A list of any other agency that was involved in, consulted with, or otherwise coordinated on the communication.</text></subparagraph></paragraph> <paragraph id="HCC9E1AB85ED44322B6696F55279035CF"><enum>(3)</enum><header>Certification of no communications</header><text>If an officer or employee of an agency has not engaged in a communication described under paragraph (1) during such 5-year period, the head of that agency shall submit to the Director a certification to that effect not later than 90 days after the date of enactment of this Act.</text></paragraph></subsection> 
<subsection id="H5E6DF4CA9DD049C092E6A7CE92993BE5"><enum>(b)</enum><header>OMB report to Congress</header> 
<paragraph id="H1131E729FB1B444FBC26D2D0EEA23EC4"><enum>(1)</enum><header>In general</header><text>Not later than 210 days after the date of enactment of this Act, the Director shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives a report, which may include a classified annex, that includes—</text> <subparagraph id="HF22986F626C642278A79E4FC30556383"><enum>(A)</enum><text>the information on communications submitted to the Director by any agency pursuant to subsection (a); and</text></subparagraph> 
<subparagraph id="H9E1615EE46DE44B29D75928A7F7BCD15"><enum>(B)</enum><text>a summary of the agency communications reported under subsection (a) organized by platform (including an interactive computer service) that received such communications.</text></subparagraph></paragraph> <paragraph id="H1306DE6CE8AE4F6D935185D6BB684BCB"><enum>(2)</enum><header>Unclassified form</header><text display-inline="yes-display-inline">The information included in the report submitted by the Director listing communications under subsection (a), descriptions of such communications under each of subparagraphs (A) through (D) of subsection (a)(2), and the summary under paragraph (1)(B) of this paragraph may not be included in any classified annex and shall be submitted in unclassified form.</text></paragraph></subsection> 
<subsection id="HE6F9E3FF67A14153B159A8C28239E2D0"><enum>(c)</enum><header>Inspectors General review and enforcement</header> 
<paragraph id="H9DF02B3E02AC4C32AB70EB37DB105221"><enum>(1)</enum><header>In general</header><text>Not later than 210 days after the date of enactment of this Act, each Inspector General of an agency that submits a report or certification to the Director under subsection (a) shall conduct a review of the agency’s compliance with the requirements of this Act and submit a report on such compliance to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives.</text></paragraph> <paragraph id="H11FFD6EDE73F467886FA0556076A34D9"><enum>(2)</enum><header>Congressional briefing for agencies found to be noncompliant</header><text>An agency required to submit a report or certification to the Director under subsection (a) that is found by the agency’s Inspector General to be noncompliant with the requirements of this Act shall brief the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives not later than 60 days after the committee receives an Inspector General report on an agency’s compliance.</text></paragraph></subsection> 
<subsection id="HCAE89A86F7E14050BB8AF1CD63B76DC7"><enum>(d)</enum><header>Definitions</header><text>In this Act—</text> <paragraph id="HD9E27696C2E64C40A6E8BD65A617B4AF"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given that term in section 551(1) of title 5, United States Code, and includes any office within the Executive Office of the President;</text></paragraph> 
<paragraph id="H7D9C043C35044877915B7E068ED8137E"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Office of Management and Budget; and</text></paragraph> <paragraph id="H96F6F4020CD54EFF89BCB3414B721772"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>interactive computer service</term> has the meaning given that term in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></paragraph></subsection></section>
