<section id="HD494B37BC1404F42965178EB35835548" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing International Surrogacy Exploitation Act</short-title></quote>.</text></section> 
<section id="HD8F49B57583B4C49B04A60675F7DE2D1"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="H85D73ED3A0C9476C92BD804DFFBA7E18"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are to—</text> <paragraph id="H589DD4442411466FBAA18043AD4A9EFE"><enum>(1)</enum><text>invalidate surrogate parentage contracts between prospective parents with citizenship or permanent residence in a foreign country and a surrogate mother in the United States; and</text></paragraph> 
<paragraph id="HA0DE25968E8C4DE9BAC0E5A0F9C5A3CD"><enum>(2)</enum><text>impose criminal penalties on surrogacy brokers who commercially facilitate such invalid agreements.</text></paragraph></subsection> <subsection id="H5CF96EE8ADA14167B89A495A62CE420B" commented="no"><enum>(b)</enum><header>Findings</header><text>Congress finds as follows:</text> 
<paragraph id="H075664F57A384068999C587C3EE7C6BD" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Currently, unrestricted surrogacies allow foreign nationals, including those residing in adversarial countries to the United States, to obtain a surrogate mother transported to or residing in the United States for the purpose of giving birth to a child.</text></paragraph> <paragraph id="H7B209BFB6B2340C2A36B2C5625204F0F" commented="no"><enum>(2)</enum><text>Upon receiving automatic United States citizenship, many infants born through an international surrogate contract are flown to adversarial countries to be raised abroad by their respective parent(s).</text></paragraph> 
<paragraph id="HCEEE7B939F3D4A28A2869DCEA5081635" commented="no"><enum>(3)</enum><text>Children born through an international surrogate contract remain eligible to vote in United States elections, access sensitive government positions, and eventually sponsor their respective parents for immigrant visas once they turn 21 years old.</text></paragraph> <paragraph id="HB2BE90120558421ABB0FF6833F0FAD76" commented="no"><enum>(4)</enum><text>In the current unregulated environment, even foreign nationals in countries friendly to the United States are still susceptible to bribery and influence from adversarial countries' efforts to disrupt United States national security.</text></paragraph> 
<paragraph id="HE51F3B10D5BD4820B3419CD253F73D1F" commented="no"><enum>(5)</enum><text>Recent reporting has shown more than 107 Chinese-owned surrogacy agencies are currently operating in Southern California.</text></paragraph> <paragraph id="H84134B5070554F3ABC8ACF4BC10E8809" commented="no"><enum>(6)</enum><text>Many countries, including Australia, Brazil, Britain, Canada, China, Denmark, France, Germany, India, Italy, Nepal, New Zealand, Portugal, Spain, Thailand, and Taiwan, have banned international commercial surrogacy altogether.</text></paragraph></subsection></section> 
<section id="H9CE9BBE77F33475F9AC7849417A4C8A4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HF2E5CBFA214240F1821A75E13A476021"> <enum>(1)</enum> <header>Foreign national</header> <text>The term <term>foreign national</term> means an alien (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)).</text>
            </paragraph> 
<paragraph id="HF5B52253856440D193558FF94CDE3451"><enum>(2)</enum><header>Immigration laws</header><text>The term <term>immigration laws</term> has the meaning given such term in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph> <paragraph id="H82157FF88AD648B4B50C403C1CC680B5"><enum>(3)</enum><header>Prospective parent</header><text>The term <term>prospective parent</term> means an individual who, directly or indirectly, enters into a surrogacy agreement to become the legal or custodial parent of a child birthed by a surrogate parent.</text></paragraph> 
<paragraph id="HAFE6C62BE27442BBB0FF3F99DC07C100"><enum>(4)</enum><header>Surrogacy agreement</header> 
<subparagraph id="H80159B6D32B84CD6A28FCA9F4AE7D00D" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text>The term <term>surrogacy agreement</term> means a contract, agreement, or arrangement, without regard to whether it is oral or written or is direct or brokered, between 1 or more prospective parents and a surrogate parent, under which the surrogate parent agrees to become pregnant and give birth to a child, and, subject to subparagraph (B), to relinquish all parental rights and responsibilities to the prospective parent or parents.</text></subparagraph> <subparagraph id="H85F7D239BA0B4A69A892696A4FCD1CC8"><enum>(B)</enum><header>Presumption</header><text display-inline="yes-display-inline">With respect to a surrogacy agreement under which a surrogacy parent agrees to become pregnant and give birth to a child, that does not expressly address parental or custodial rights, there shall be a presumption that—</text> 
<clause id="H23AAAE86C33A48EFB33BE96504E5BB13"><enum>(i)</enum><text>the surrogate parent has agreed to relinquish her parental or custodial rights; and</text></clause> <clause id="H460230A6472841DCB25F3FF26BF3244A"><enum>(ii)</enum><text>the contract, agreement, or arrangement is a surrogacy agreement if the contract, agreement, or arrangement is with one or more prospective parents who is a foreign national.</text></clause></subparagraph></paragraph> 
<paragraph id="HD81C834B142E4998883F43125758D313"><enum>(5)</enum><header>Surrogacy broker</header><text>The term <term>surrogacy broker</term> means any individual or entity that induces, arranges, procures, facilitates, or otherwise assists in the formation or execution of a surrogacy agreement.</text></paragraph> <paragraph id="HABA0767AE77D4431849A44EF1087A8A2"><enum>(6)</enum><header>Surrogate parent</header><text>The term <term>surrogate parent</term> means a person who agrees to become pregnant and give birth to a child, and to relinquish all parental rights and responsibilities to another person under the terms of a surrogacy agreement.</text></paragraph></section> 
<section id="H9F267BE2C9744C06A64976265EC201A0"><enum>4.</enum><header>Certain international surrogate parentage contracts void and unenforceable</header> 
<subsection id="HC5B874742F5448C59D3A070F4A98A01D"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), a surrogacy agreement shall be void and unenforceable if the agreement is between a surrogate parent who is in the United States at the time of birth or who is a citizen or lawful permanent resident of the United States and—</text> <paragraph id="HFD51484BBBBC43D5BF11A0BD97CCE2F6"><enum>(1)</enum><text>a prospective parent who is a foreign national; or</text></paragraph> 
<paragraph id="H2BB28741AC59455F9DB9318DB005F7BC"><enum>(2)</enum><text display-inline="yes-display-inline">a surrogacy broker that arranges a surrogacy agreement with a prospective parent who is a foreign national.</text></paragraph></subsection> <subsection id="HE6185ADC3CF64EE7A135DA612DFD26CC"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not invalidate a surrogacy agreement between a surrogate parent and 2 prospective parents, if—</text> 
<paragraph id="H4F0521E7B47847E1BC24A02F34237AD6"><enum>(1)</enum><text>the 2 prospective parents are legally married; and</text></paragraph> <paragraph id="H4D2B82207A56437C9AAC674967DC32AF"><enum>(2)</enum><text>at least 1 prospective parent is a citizen or lawful permanent resident of the United States.</text></paragraph></subsection></section> 
<section id="HE093FCA889C04C8199EF7C9BF453735C"><enum>5.</enum><header>Commercial facilitation of foreign surrogacy prohibited; penalty</header><text display-inline="no-display-inline">A surrogacy broker who knowingly or recklessly induces, arranges, procures, facilitates, or otherwise assists in the formation or execution of a surrogacy agreement that is void and unenforceable under section 4 shall be fined under title 18, United States Code, imprisoned for not more than 10 years, or both.</text></section> <section id="HB3606BDB992E424BA30E92FD2B4A081A"><enum>6.</enum><header>Custody of child when international surrogate parentage contracts are void and unenforceable</header><text display-inline="no-display-inline">Legal custody of a child born pursuant to a surrogacy agreement that is void and unenforceable under section 4 shall be decided based on a determination of the best interests of the child under the law of the State where the surrogate parent resides, with no effect given to the surrogacy agreement or any other purported agreement, contract, or understanding concerning the custody of the child.</text> </section> 
<section id="H59008EA01C1C4150BDC7F053DEED421C"><enum>7.</enum><header>Limitation on eligibility for immigration benefits</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a foreign national who is a parent of a citizen of the United States born pursuant to a surrogacy agreement that is unenforceable under section 4, may not, by virtue of their parentage of such citizen, be accorded any right, privilege, or status under the immigration laws.</text> </section> <section id="HAB2638848AE3475C938E26CD96B39A30"><enum>8.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act shall apply with respect to surrogacy agreements entered into on or after the date of enactment of this Act.</text></section>
