<section id="HDB378F59ADC842578C9B0915CE060B92" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HCBS Anti-Fraud Reporting Act of 2026</short-title></quote>.</text></section> <section id="H648ECA82F77B46429D814DFD0D40DCA0"><enum>2.</enum><header>Requiring States to report on anti-fraud measures relating to home and community-based services furnished under the Medicaid program</header><text display-inline="no-display-inline">Section 1915(c)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)(2)</external-xref>) is amended—</text> 
<paragraph id="H4A9A67818EAA4E439B65286F205BB111"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H7F1918C910134C1EBDE15EBF9EFD0EFA"><enum>(2)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HBCE64345152D4EE1BC6372503C9807C7"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7E42F26228B942EEA31DC3966F51F295"> <subparagraph id="H37B997F19C4244DEBC6BB4CDDBB56A13" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">with respect to 2026 and each subsequent year, the State will report to the Secretary on—</text> 
<clause id="HCA0C0B61294649B7A60272B0AC45E985"><enum>(i)</enum><text>any waste, fraud, or abuse detected by the State relating to services furnished under such waiver; and</text></clause> <clause id="H5F5B32DEB5F74B72AD6FC2F7228EFED3"><enum>(ii)</enum><text>efforts taken by the State to prevent such waste, fraud, and abuse.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
