<section id="HB7F8B2FD7A614397B5E512B5CAC48586" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal Remedies Act of 2026</short-title></quote>.</text></section> <section id="HEC48D064B5F642D9B624FE39E77A9447"><enum>2.</enum><header>Equalization of remedies</header><text display-inline="no-display-inline">Section 1977A of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>) is amended—</text> 
<paragraph id="H06A2CCEF7D2041D18F7786073AEA61D6"><enum>(1)</enum><text>by amending (b)(3) to read as follows:</text> <quoted-block style="OLC" id="H9C88A64427F9421296E5B738FAD18CC8" display-inline="no-display-inline"> <paragraph id="H9E4A0ED8184B4F8BADD06E53E9C62C15"><enum>(3)</enum><header>losses</header><text display-inline="yes-display-inline">Compensatory damages are available under this section for past and future pecuniary losses, emotional pain, suffering, inconvenience, mental anguish, loss of enjoyment of life, and other non-pecuniary losses.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>

                <enum>(2)</enum>
 <text display-inline="yes-display-inline">in subsection (c) by striking <quote>section—</quote> and all that follows through the period at the end, and inserting <quote>section, any party may demand a jury trial.</quote>.</text>

<section id="HAF343AB6935B462FB9BBCD4A402284CC"><enum>3.</enum><header>Compensatory and punitive damages available for age discrimination</header><text display-inline="no-display-inline">Section 7(b) of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/626">29 U.S.C. 626(b)</external-xref>) is amended—</text> <paragraph id="H7FD008ED717E4987975856625948FA70"><enum>(1)</enum><text>by striking <quote>The</quote> and all that follows through the 3d sentence and inserting the following:</text>

<quoted-block-continuation-text quoted-block-continuation-text-level="section">Except as otherwise provided in another subsection of this section, or section 9 of this Act, the powers, remedies, and procedures set forth in sections 705, 706, 707, 709, and 710 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-4">42 U.S.C. 2000e–4</external-xref>, 2000e–5, 2000e–6, 2000e–8, and 2000e–9) shall be the powers, remedies, and procedures this Act provides to the Commission, to the Attorney General, or to any person alleging discrimination on the basis of age in violation of sections 4 and 15 of this Act, or regulations promulgated under section 9 of this Act.</quoted-block-continuation-text><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCEE326ACC88B4A6FB0C5597155A4D688"><enum>(2)</enum><text>in the 4th sentence by striking <quote>or enforcing the liability for amounts deemed to be unpaid minimum wages or unpaid overtime compensation under this section</quote> and inserting <quote>and including any type of legal or equitable relief available under title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>)</quote>.</text></paragraph></section> </legis-body></bill>
