<section id="H50D26EDBF3104ECB8DA97535702160E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Abuse, Fraud, and Exploitation by Governing Unaccredited Representatives Defrauding Veterans Act of 2026</short-title></quote> or the <quote><short-title>SAFEGUARD Veterans Act of 2026</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HAC340DB258454279A3326F1FD3B964FC"><enum>2.</enum><header>Reinstatement of penalties for charging veterans unauthorized fees relating to claims for benefits under laws administered by the Secretary of Veterans Affairs</header> <subsection commented="no" display-inline="no-display-inline" id="HFACB394C0FD743459A302FCAABFF4EA4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5905 of title 38, United States Code, is amended—</text> 
<paragraph id="H72EAA000E4594230A64B4C17F206EBE4"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Penalty</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Penalties</header-in-text></quote>;</text></paragraph> <paragraph id="HE5986757B3CA4B9C8145338719D87BA5"><enum>(2)</enum><text>by striking <quote>Whoever</quote> and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H8DA5924A4E6E4334A9A53EB36A7CBDBF"> 
<subsection commented="no" display-inline="no-display-inline" id="H3EAAC0D4CD3A42648232496FCC10BD36"><enum>(a)</enum><header>Withholding of benefits</header><text>Whoever</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H66CA208EA5844A3DB0888C1A606FF88B"><enum>(3)</enum><text>by adding at the end the following new subsections:</text> 
<quoted-block display-inline="no-display-inline" id="H38823AD04F4D4B6AB85FADF9FB390B3A" style="USC"> 
<subsection id="H19122AF566F148DF854349BEACFE2A51"><enum>(b)</enum><header>Charging of unauthorized fees</header><text display-inline="yes-display-inline">Except as provided in sections 5904 and 1984 of this title, whoever solicits, contracts for, charges, or receives, or attempts to contract for, charge, or receive, any fee or compensation with respect to the preparation, presentation, or prosecution of any claim for a benefit under laws administered by the Secretary shall be—</text> <paragraph commented="no" display-inline="no-display-inline" id="HD8742E590E4748578102036533C7E4D5"><enum>(1)</enum><text display-inline="yes-display-inline">fined as provided in title 18, or imprisoned not more than one year, or both; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE95E7987432C4D908AB114D2C479E7BB"><enum>(2)</enum><text display-inline="yes-display-inline">barred from recognition under this chapter by the Secretary as an agent or attorney for the preparation, presentation, or prosecution of a claim under laws administered by the Secretary—</text> <subparagraph id="H81F51272C22D48B78EDD004F7FAE40B7"><enum>(A)</enum><text>for a period of one year beginning on the date of the first violation; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4B0DF86DA4754522AE60301A9929605F"><enum>(B)</enum><text>for a period of 10 years beginning on the date of each subsequent violation.</text></subparagraph></paragraph></subsection> <subsection id="H6D31E9818116494C8906093F12E96400"><enum>(c)</enum><header>Recognition required</header><text>No person may assist a claimant in the preparation, presentation, or prosecution of a claim under a law administered by the Secretary, unless—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4FB6C78B494A4CC7A469468811769A4C"><enum>(1)</enum><text display-inline="yes-display-inline">recognized by the Secretary under this chapter as an agent or attorney for such purposes; or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H342AC190ACEB46A2B9E834EAB44CE560"><enum>(2)</enum><text display-inline="yes-display-inline">acting under direct supervision of an agent or attorney described in paragraph (1).</text></paragraph></subsection> 
<subsection id="HBA6AE95C50744114B0A900984BEBA92F"><enum>(d)</enum><header>Definition of preparation, presentation, or prosecution</header><text>In this section, the term <term>preparation, presentation, or prosecution</term>—</text> <paragraph commented="no" display-inline="no-display-inline" id="H46BDE85113884BC7A2100B6396F57CB0"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), means any act associated with filing a claim or appeal for a benefit under a law administrated by the Secretary; and</text></paragraph> 
<paragraph id="H925F709A3DDB4F4C989C9B6976DE2373"><enum>(2)</enum><text>does not include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF0E12C1F8D904AA1B0DD6C9D0BFEF06E"><enum>(A)</enum><text display-inline="yes-display-inline">the provision of a medical opinion or completion of a disability benefits questionnaire by a private sector medical professional; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4239918BED1F4B328ACFD4EB14998E82"><enum>(B)</enum><text display-inline="yes-display-inline">the preparation of an expert opinion in support of a claim or appeal.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H35ECC2AFD1474AAC93A7D4B0828D57FD"><enum>(b)</enum><header>Proposed rule</header><text>Not later than 90 days after the date of the enactment of this Act, the General Counsel of the Department of Veterans Affairs shall initiate a rulemaking process for purposes of administering section 5905 of such title and defining <term>preparation, presentation, or prosecution</term>, as amended by subsection (a).</text></subsection> 
<subsection id="H77B0C4D69C20497982508D3614F5237A"><enum>(c)</enum><header>Effect on State law</header><text>The provisions of section 5905, as amended by subsection (a), shall supersede any provisions of the law of any State or Freely Associated State relating to the recognition of an individual as an agent or attorney for the preparation, presentation, or prosecution of a claim under a law administered by the Secretary of Veterans Affairs, including with respect to provisions of law regarding fee agreements or authority to charge for such services.</text></subsection> <subsection id="H583449AB6F9443F88C5D597ABA935961"><enum>(d)</enum><header>Submission to Congress</header><text>The Secretary shall include in documents submitted to Congress in support of the President’s budget submitted pursuant to section 1105 of title 31, United States Code, detailed estimates of the sums and staffing necessary to administer <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/59">chapter 59</external-xref> of title 38, United States Code.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB045DDC0C6D7451F918AA1926AA71056"><enum>(e)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 59 of such title is amended by striking the item relating to section 5905 and insert the following new item:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H29C731A26E394D07BA9A9C2F0F18EEFD"> <toc> <toc-entry level="section" bold="off">5905. Penalties for certain acts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H73DDD400F7C54B359C08BA5E09AE85C2"><enum>3.</enum><header>Promotion of assistance from persons recognized by the Secretary of Veterans Affairs for individuals who file certain claims under laws administered by the Secretary</header> <subsection id="H427215B329F74361908B4BA07F01F68C"><enum>(a)</enum><header>Notice to claimants of available assistance from recognized persons</header><text>Section 5103A of title 38, United States Code, is amended—</text> 
<paragraph id="H952BED4A4AA64C0696EFD554ACB78E44"><enum>(1)</enum><text>by redesignating subsections (g) through (i) as subsections (i) through (k), respectively;</text></paragraph> <paragraph id="H4FE2FC62B48C476C9B46ECFCCAF6C0C3"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsections:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H46634945ACC44A878F6096327560C9DC"> 
<subsection id="H110CBEC175F643F98BC58AAA31965343"><enum>(g)</enum><header>Notice regarding availability of representation</header><text>Upon receipt of an initial claim by a claimant not represented by an accredited person, the Secretary shall provide notice to the claimant that—</text> <paragraph id="H4AB28C4355794C39B69BE96FB3787B2F"><enum>(1)</enum><text>provides the website address of the online tool maintained under subsection (h); and</text></paragraph> 
<paragraph id="HE33BE5E0074A40038F891A86321EFB0E"><enum>(2)</enum><text>provides the website address of an appropriate and publicly accessible website of the Department through which a claimant may report—</text> <subparagraph id="H1116AC80960D4B2EA2CF4104F9528B7F"><enum>(A)</enum><text>a person, who is not an accredited person, who represented the claimant; and</text></subparagraph> 
<subparagraph id="HCD462900AD3C4F7A965257769C081C8E"><enum>(B)</enum><text>any fee charged by such person for such representation.</text></subparagraph></paragraph></subsection> <subsection id="HCF63B1B05F674BABA4BF014727655F79"><enum>(h)</enum><header>Online list of accredited, suspended, or excluded persons</header> <paragraph commented="no" display-inline="yes-display-inline" id="HB6E341AE513144AE9E8C6CC297FA564D"><enum>(1)</enum><text>The Secretary shall maintain an online tool that allows a claimant to search a list of accredited persons and persons who are suspended or excluded.</text></paragraph> 
<paragraph id="H38ED5778723D49FB9656DA07B0459E6F" indent="up1"><enum>(2)</enum><text>The Secretary shall ensure that the list required by paragraph (1) is current at least once each calendar quarter.</text></paragraph> <paragraph id="H4265A9E62D3143AC9044F894358D9A62" indent="up1"><enum>(3)</enum><text>The Secretary shall ensure that the online tool required by paragraph (1) is easily accessible to a claimant.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H94D3848C6D434111803D37D18C5067A7"><enum>(3)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H1A0A98B48CB1413984A5C487787112AE"> <subsection id="HA38AA30956384A3B9557BE5123F2924B"><enum>(l)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H25E6A16A4882432F8FAB1FCFF340B241"><enum>(1)</enum><text>The term <term>accredited person</term> means—</text> <subparagraph id="H0DABD3FD216C41208CC5802F41E634F3"><enum>(A)</enum><text>a veterans service organization recognized under section 5902 of this title; or</text></subparagraph> 
<subparagraph id="H3E5A66D83EA64F0C940C97E98F6D6F7D"><enum>(B)</enum><text>an individual recognized under section 5904 of this title.</text></subparagraph></paragraph> <paragraph id="H22A315FD78454652B404B4F4C8C7F161"><enum>(2)</enum><text>The term <term>represent</term> means to prepare, present, or prosecute a claim under a law administered by the Secretary on behalf of a claimant.</text></paragraph> 
<paragraph id="HA968E916AF7443388C714D57972B3BD7"><enum>(3)</enum><text>The term <term>suspended or excluded</term> with respect to a person means the Secretary has suspended or excluded the person from practice before the Department under sections 5904(b) and 5905(b) of this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H378B5B8B076A43669A9F68301F42373D"><enum>(b)</enum><header>Online information regarding persons that assist claimants</header> <paragraph commented="no" display-inline="no-display-inline" id="HF446AA8B45EC40ED8D39F37486E651EF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall include, in each website portal of the Department of Veterans Affairs through which an individual may file a claim for a benefit administered by the Secretary, a warning regarding fees an agent or attorney may charge such individual for assistance in filing such claim.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H977387350CF948789979D59C9AD7E417"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">A warning under paragraph (1) shall include the following:</text> <subparagraph id="H3AC83DAE93A3454DBEE4B8FC2CBA7BEE"><enum>(A)</enum><text>A link to the online tool maintained under subsection (h) of section 5103A of such title, as amended by subsection (a).</text></subparagraph> 
<subparagraph id="H7C6DFEA1CD73458D8F5B42D89D42F16C"><enum>(B)</enum><text>A link to the website of the Department described in subsection (g)(2) of such section, as amended by subsection (a).</text></subparagraph></paragraph></subsection> <subsection id="H7909859A24124BB792B17C6C83B89AD2"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall—</text> 
<paragraph id="H9E71829B56A54EA482C31CA4136057DF"><enum>(1)</enum><text>complete a review of the regulations, processes, and procedures of the Department of Veterans Affairs that pertain to recognition under section 5904 of title 38, United States Code;</text></paragraph> <paragraph id="H656C927CD65E491682094D44F87F3F97"><enum>(2)</enum><text>develop recommendations for legislative or administrative action to improve such regulations, processes, and procedures; and</text></paragraph> 
<paragraph id="HF8E6A833DE1445EDA45F45EA749A204D"><enum>(3)</enum><text>submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report containing the findings of the Secretary with respect to the review completed under paragraph (1) and the recommendations developed under paragraph (2).</text></paragraph></subsection></section> <section id="H0B905F80243D4269B563733D112D4576" section-type="subsequent-section"><enum>4.</enum><header>Improve warnings about potential predatory practices regarding agents and attorneys for veterans claims</header> <subsection commented="no" display-inline="no-display-inline" id="H4595137BA861499184A1E355B2417793"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5901(b) of title 38, United States Code, is amended—</text> 
<paragraph id="H7D2919F0BD0A4053B8A326E0B0323958"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7BE924F49CAC467B823D06C5F4AD786C"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter before subparagraph (A) by striking <quote>, each time a claimant under a law administered by the Secretary logs in to a website or online tool of the Department, such website or online tool issues to the claimant</quote> and inserting <quote>each public-facing website and online tool of the Department issues</quote>;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1B8805525F2C46B6BAC4D2A053849210"><enum>(B)</enum><text>in subparagraph (A), by inserting <quote>, including individuals lacking recognition by the Secretary as described in subsection (a)</quote> after <quote>chapter</quote>;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H180D222D3AD644A39309BFDD4DED6196"><enum>(C)</enum><text>in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE517188D2E034F9792830CB5EBB1BAC0"><enum>(D)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HABE7CD2C30474238BA449A978AA57955"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H863DC03284274768AB1676F8671BAE1C"> 
<subparagraph id="H5C59CB16739C40CA97F3ABE59CED0F6F" indent="up1"><enum>(E)</enum><text>a message discouraging veterans from sharing their Department account log-in credentials or bank account log-in credentials, such as usernames or passwords, with anyone.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5116C7E0BB994B85BF086833A1AFEB71"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H4FE795DCB49C4549A60C21053A638784"> 
<paragraph commented="no" display-inline="no-display-inline" id="HE7644D26827E415BBE35C75E56C6C6CE" indent="up1"><enum>(3)</enum><text>The Secretary shall carry out this subsection by acting through the Chief Veterans Experience Officer.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H43F2EA7DBECE45718C7459A3C30EECA0" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="H49E685D07FC849FAA31D300770B71E97"><enum>5.</enum><header>Gathering information about persons charging for assistance or coaching with filing claims</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs shall take such actions as may be necessary to ensure that on any form that is used by the Department of Veterans Affairs to accept a claim for a benefit under a law administered by the Secretary includes—</text> <paragraph commented="no" display-inline="no-display-inline" id="HBED9D4280656456EB794C545C327C183"><enum>(1)</enum><text display-inline="yes-display-inline">a question regarding whether the claimant was charged for assistance or coaching by any person when gathering information or filing the claim; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA554EB14EA854221B281E321D4C13009"><enum>(2)</enum><text display-inline="yes-display-inline">an option to name the person who provided such assistance or coaching.</text></paragraph></section> <section id="HFA0876DC095E4E3FBD3E07C7D1211FF8"><enum>6.</enum><header>Department of Veterans Affairs accreditation system</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs shall establish a system for the purposes of recognition of persons under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/59">chapter 59</external-xref> of title 38, United States Code, that—</text> 
<paragraph id="H97D64F29F9A04B6384AF8062306868A4"><enum>(1)</enum><text>has 99.9 percent uptime, responsive, and accessible;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H50D397AB83334C7198C6740F38887CF7"><enum>(2)</enum><text display-inline="yes-display-inline">enables agents and attorneys to certify that they have met the requirements for recognition under such chapter;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCE97E67EF8D64C929878E45E64D65F80"><enum>(3)</enum><text display-inline="yes-display-inline">enables clients of agents and attorneys recognized under such chapter to file complaints regarding such agents and attorneys and to report violations described in paragraphs (1) through (9) of section 5904(b) and section 5905(b) of such title; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF788944F30274E02AE08276799655F7C"><enum>(4)</enum><text display-inline="yes-display-inline">is integrated with systems used to administer section 3 of this Act and the amendments made by that section.</text></paragraph></section> 
<section id="H6D39FBCDDD814D1F8EF3D668DD51BB91"><enum>7.</enum><header>Restrictions on the use of automated telephone equipment</header><text display-inline="no-display-inline">Section 227(b)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)(1)</external-xref>) is amended—</text> <paragraph id="HDEC8158BEC8E4B7185B1DB383F586E98"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="HAB4CBFC7E07148C58B2BC17568133D1C"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="HA2A1B16F9FE345689F3CF6946126048F"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H7968C06CA7F040B3947AC82497948BAC" display-inline="no-display-inline" style="OLC"> 
<subparagraph id="H12CEFE54BEA14B788EAF3BB6F8EF5ADD"><enum>(E)</enum><text display-inline="yes-display-inline">to make any call to a telephone number assigned to a Federal department or agency if such call is made by means of equipment that—</text> <clause id="H13F06EDD5FDA4F01BDFDA905A79A81B6"><enum>(i)</enum><text>has the capacity, without further human intervention after initial activation—</text> 
<subclause id="HCFB72776265641DD9402927B9A7A6C93"><enum>(I)</enum><text>to make a series of repeated calls to such number; and</text></subclause> <subclause id="H782DA76DE4124E4580330A7B3ACDBC90"><enum>(II)</enum><text>to provide and receive information by means of such calls; and</text></subclause></clause>
