<section id="H26FB03C28FCD423C83CD36163D8F093C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right to Trial Act</short-title></quote>. </text></section> <section id="H84A05C979C614C8C9A6C857FC3A886E4"><enum>2.</enum><header>Factors for consideration when imposing a sentence; authority to deviate from statutory minimum</header> <subsection id="H53933EF29E2A4464AD802F7CF9D5A899"><enum>(a)</enum><header>Factors</header><text display-inline="yes-display-inline">Section 3553(a) of title 18, United States Code, is amended—</text>
<paragraph id="H0E06054BDACB48F482DA53ED6C11828E"><enum>(1)</enum><text>in paragraph (5)(B), by striking the period and inserting a semicolon;</text></paragraph> <paragraph id="HA614B56A8E084B35A25FA556053F3100"><enum>(2)</enum><text>in paragraph (6), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph>
<paragraph id="HBE26602B9ECB4602BED9931E0E3FF658"><enum>(3)</enum><text>in paragraph (7), by striking the period and inserting a semicolon; and</text></paragraph> <paragraph id="HEFBF99663111411A9EE86CC67F0B9B3E"><enum>(4)</enum><text>by adding at the end the following:</text>

<paragraph id="H7D3CA5D89DEC4A2189AD1FB986FC4A90"><enum>(8)</enum><text display-inline="yes-display-inline">the need to protect the constitutional right to a trial, including by prohibiting impairment of such a right in any case in which an increased sentence is threatened or imposed based on a defendant’s decision to go to trial and not accept a plea offer;</text></paragraph> <paragraph id="HB533B4A9B3C846858B148C1023D6E9ED"><enum>(9)</enum><text display-inline="yes-display-inline">in the case of—</text>
<subparagraph id="HDFD21C5391C241C9B50631C6E26C94BD"><enum>(A)</enum><text>crimes involving similarly situated codefendants or group conduct, the plea offer, if applicable, and each sentence (and anticipated sentence) of any similarly situated codefendant or similarly situated other person charged in the same or related offense who pled guilty; and</text></subparagraph> <subparagraph id="HAC44F9B005AA4840A715EC75A56F0C6E"><enum>(B)</enum><text display-inline="yes-display-inline">crimes not involving codefendants or group conduct, the plea agreements and the sentences for similarly situated defendants who pled guilty to similar offenses; and</text></subparagraph></paragraph>
<paragraph id="HD3CCB4512EF146E98CCB0762422C62B1"><enum>(10)</enum><text>whether imposition of a statutory minimum sentence would constitute a penalty for asserting the constitutional right to a trial, thereby warranting imposition of a sentence below the statutory minimum.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HC575270A9B734A10AC79DE37876594E1"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 3553(e) of title 18, United States Code, is amended by inserting after <quote>committed an offense.</quote> the following: <quote>The court shall have the authority to impose a sentence below a level established by statute as a minimum sentence so as to protect the constitutional right to trial.</quote></text></subsection></section>
