Diplomatic Reserve Corps Pilot Program.</toc-entry></toc></subsection></section><section id="HC195EEC9F377476FB427BF939E9AE4FB"><enum>2.</enum><header>Reference</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section, chapter, title, or other provision, the reference shall be considered to be made to a section, chapter, title, or other provision, respectively, of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3901">22 U.S.C. 3901 et seq.</external-xref>).</text></section><section id="H75DE9B9D9C494AF2A25637D70A0F07A4"><enum>3.</enum><header>Effect of amendments on conforming changes to tables of contents</header><text display-inline="no-display-inline">When an amendment in this Act to the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3901">22 U.S.C. 3901 et seq.</external-xref>) adds a section or larger organizational unit to the Act, repeals or transfers a section or larger organizational unit in the Act, or amends the designation or heading of a section or larger organizational unit in the Act, that amendment also shall have the effect of amending any table of contents or similar tabular entries in the Act to alter the table to conform to the changes made by the amendment.</text></section><title id="HD4D10EDD58EA4C8A83373C465510EE20"><enum>I</enum><header>General provisions</header><section id="HF7B55120AB754AF4A2CEC3667F56210D"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 102 (<external-xref legal-doc="usc" parsable-cite="usc/22/3902">22 U.S.C. 3902</external-xref>) is amended—</text><paragraph id="HC137710D1332440591CAE0DDA128CA20"><enum>(1)</enum><text>by redesignating paragraphs (3) through (12) as paragraphs (4) through (13), respectively; and</text></paragraph><paragraph id="H47D96732738544B7B275FA24AA246E9B"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="H9E77B8808B0149249669DA068AA572DF" display-inline="no-display-inline"><paragraph id="HCDFBFDD22BDA43218F93B3DE4961FAC9"><enum>(3)</enum><text display-inline="yes-display-inline"><quote>appropriate congressional committees</quote> means—</text><subparagraph id="H5F0375694482497BA1871708AB17935B"><enum>(A)</enum><text>the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph><subparagraph id="H6A1D2CB5BDD740E181C4442C25BA3058"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0C918FB6E029451DADA347C0AEEA447C"><enum>102.</enum><header>Returning policy execution to diplomatic efforts</header><text display-inline="no-display-inline">Section 104 (<external-xref legal-doc="usc" parsable-cite="usc/22/3904">22 U.S.C. 3904</external-xref>) is amended—</text><paragraph id="HA1CBFBEC09074723824C6E9055AAB167"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC07C2EF22E28451EAFBA41644AEC50D5"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H21C8CD18EA3D47EC84064A6A081C7985"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H152C469166894DBD85C38787FED1C9F5" display-inline="no-display-inline"><paragraph id="HCC1D09DAFE4248778F033CB24A6A58F7"><enum>(4)</enum><text display-inline="yes-display-inline">implement and execute the foreign policy of the United States through the conduct of diplomacy, the management of programs, and the advancement of United States interests consistent with policies established by the President and Secretary in accordance with this Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0F595E12EBC94D97B38C49887EBB07A6"><enum>103.</enum><header>Recruiting from nontraditional institutions of higher education</header><text display-inline="no-display-inline">Section 105 (<external-xref legal-doc="usc" parsable-cite="usc/22/3905">22 U.S.C. 3905</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2E271D50F6294C55BDF488D9A6A4D7D6" display-inline="no-display-inline"><subsection id="H444C16C89E8445D08E46D7BBB7CD0AAD"><enum>(f)</enum><header>Recruiting from nontraditional institutions of higher education</header><paragraph id="H3495C6AD586F472E826C68C7EA9DBC40"><enum>(1)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the Service should actively recruit candidates from nontraditional institutions of higher education, including community colleges, junior colleges, career and technical colleges, and other open-access or workforce-oriented institutions.</text></paragraph><paragraph id="HD03AA996FB014CC2B64EE7A0D35DE542"><enum>(2)</enum><header>Outreach</header><text>The Secretary should ensure that outreach, information sessions, and preparation resources related to the Foreign Service officer selection process and other entry programs are regularly conducted at nontraditional institutions of higher education. In carrying out this subsection, the Secretary may—</text><subparagraph id="H95028C5C4843407E8F8CCB55AAB9130D"><enum>(A)</enum><text>partner, where appropriate, with institutional career centers, faculty, and student organizations to expand awareness of Service careers;</text></subparagraph><subparagraph id="H1E3C58AAC2CC427FA208A1CDA842BDC0"><enum>(B)</enum><text>leverage digital and hybrid outreach methods to reach students and alumni who may not be geographically near current recruitment hubs; and</text></subparagraph><subparagraph id="H7728E581F3F9474BBD56EE808050BBAD"><enum>(C)</enum><text>collaborate with other Federal departments and agencies engaged in workforce outreach at nontraditional institutions of higher education.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H504FB266BE084FF6A8B403955C53A6DC"><enum>II</enum><header>Management of Service</header><section id="HFCC7335CED2E4D15887936711A9DC156"><enum>201.</enum><header>Expeditionary diplomacy</header><text display-inline="no-display-inline">Section 207 (<external-xref legal-doc="usc" parsable-cite="usc/22/3927">22 U.S.C. 3927</external-xref>) is amended—</text><paragraph id="H4E1D787F93C84A53A9D8F57AB3BA62B5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="H6701DA69F446442194E7251D25D716EF"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H86A9718AF0CB45EB8B6C131D77DA6522"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H47E26777268F4141B892D83F1F510573"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H7AB1B59B727F44A1B435C58704A15EC7" display-inline="no-display-inline"><paragraph id="HD1D7BBB679C847148491F408D06E21CF"><enum>(3)</enum><text display-inline="yes-display-inline">shall exercise appropriate and effective risk management practices to encourage each relevant Government executive branch employee in such foreign country to regularly and meaningfully engage in expeditionary diplomacy with the population of such country.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H935B2406A7AD491E99DD9D003C0AAB00"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HAD1361A0CCA6476B873599D6A33A733F" display-inline="no-display-inline"><subsection id="H5CAB0E26251B47E394971162881A0C34"><enum>(e)</enum><header>Tiger Team</header><paragraph id="H625D40B373064E79A99DCD7CF4DDBFAA" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Establishment</header><text>Not later than 90 days after the date of the enactment of this subsection, the Secretary shall establish a team (to be known as the <quote>Tiger Team</quote>) to provide to the Secretary a plan to achieve the following:</text><subparagraph id="H6F0DE1BF0C6244788CD33DE8B70EE98B" commented="no"><enum>(A)</enum><text>Improve the capability, and willingness, of chiefs of mission, Regional Security Officers, and Regional Medical Officers to approve expeditionary diplomacy.</text></subparagraph><subparagraph id="H06EBA32B46C4499AB04790357FDF49B1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Improve the capability, and willingness, of members of the Foreign Service to regularly practice expeditionary diplomacy.</text></subparagraph></paragraph><paragraph id="HA04311005712477DAFF0546A2798AFDA" commented="no"><enum>(2)</enum><header>Composition</header><text display-inline="yes-display-inline">The Tiger Team shall consist of the following individuals from the Department, to be appointed by the Secretary:</text><subparagraph id="H6B516B52D5864230AB5042833B7346AA" commented="no"><enum>(A)</enum><text>A senior-level officer or employee who shall—</text><clause id="HC02832AA746B4019B2815895AB26E589" commented="no"><enum>(i)</enum><text>serve as the <quote>Tiger Team Leader</quote>;</text></clause><clause id="HA098786935C740849A10A7349BEB32E7" commented="no"><enum>(ii)</enum><text>be accountable for the activities of the Tiger Team under this subsection; and</text></clause><clause id="H845EC826E765434DAC81821AAB004B78" commented="no"><enum>(iii)</enum><text>not serve concurrently in another assignment or position at the Department during their tenure as Tiger Team Leader.</text></clause></subparagraph><subparagraph id="HA1C51AF11812421C8FCB5A2505C6B24F" commented="no"><enum>(B)</enum><text>Not less than one officer or employee from each of the following offices:</text><clause id="HB9FADA0A40E7454B81858CB1B1013019" commented="no" display-inline="no-display-inline"> <enum>(i)</enum> <text>The Under Secretary for Political Affairs;</text>
                                    </clause><clause id="HF2D05F6778EF484A80D5E14E59BF8CC1" commented="no">
                                        <enum>(ii)</enum>
 <text>The Bureau of Diplomatic Security;</text> </clause><clause id="H09AAAA65196E47AA9898D103BD217BB6" commented="no"><enum>(iii)</enum><text>The Bureau of Administration;</text></clause><clause id="H13946915863E405D9D2EA012A6EEBA64" commented="no"><enum>(iv)</enum><text>The Bureau of Diplomatic Technology;</text></clause><clause id="H2A51E41D1204442CB66290FAF7B3FD09" commented="no"><enum>(v)</enum><text>The Bureau of Human Resources;</text></clause><clause id="HAC0785B28A6641FC9930F2FB8621C5AB" commented="no"><enum>(vi)</enum><text>The Bureau of Medical Services; and</text></clause><clause id="H0B60ADE66A0C4229AE5A34801767712D" commented="no"><enum>(vii)</enum><text>The Bureau of Overseas Building Operations.</text></clause></subparagraph><subparagraph id="HC7C45266CBE64ACEABD91E8929CA1229" commented="no"><enum>(C)</enum><text>Not less than one individual who has international development experience and expertise;</text></subparagraph></paragraph><paragraph id="HA4515F87CEC14A7BADF6A8FB7E651365" commented="no"><enum>(3)</enum><header>Congressional notification</header><text>Not later than 90 days after the date of the enactment of this subsection, the Secretary shall notify Congress of the names and titles of the appointed to the Tiger Team under paragraph (2).</text></paragraph><paragraph id="HFF6EAC921E78436B871FE0278B623A42" commented="no"><enum>(4)</enum><header>Plan for expeditionary diplomacy</header><subparagraph id="H0D0588C9B3DD426796F1EAFCE4A1B74D" commented="no"><enum>(A)</enum><header>In general</header><text>The plan required to be submitted by the Tiger Team shall include the following:</text><clause id="H3E1625FCC847438D9EFA607E3571A610" commented="no"><enum>(i)</enum><text>A description of the manner in which the Secretary, working through the Tiger Team, shall—</text><subclause id="H5DEDF612A2D040B0ABEC445A4789A6F0" commented="no"><enum>(I)</enum><text>assess the current state of the Department’s ability and willingness to practice expeditionary diplomacy;</text></subclause><subclause id="H125DB2E465724D50894D2A058D402968" commented="no"><enum>(II)</enum><text>review previous and current Department efforts and historical recommendation reports, external and internal, on expeditionary diplomacy;</text></subclause><subclause id="H174E780F63EC4628A4C3D1C4CCDDF22C" commented="no"><enum>(III)</enum><text>assess the current challenges experienced by the Department, chiefs of mission, and members of the Service in practicing expeditionary diplomacy; and</text></subclause><subclause id="H89D6CB50D9AF413FBBD2D3C17037E645" commented="no"><enum>(IV)</enum><text>produce policy, regulations, and legislative recommendations to address such challenges.</text></subclause></clause><clause id="H9A1F66A009784EDDB2C7D3D0C5950BA8" commented="no"><enum>(ii)</enum><text>A timeline for implementing, carrying out, and completing this plan by the date required under subparagraph (B).</text></clause><clause id="H142F7EADBBD246C89A84D08B36B8897D" commented="no"><enum>(iii)</enum><text>A description of the additional funding, personnel, or other resources of the Department required to carry out the plan, including any modification of applicable statutory or administrative authorities.</text></clause></subparagraph><subparagraph id="H777EEAE40B5B4C2EA0A1D899788CD36D" commented="no"><enum>(B)</enum><header>Implementation</header><text>The Secretary shall implement to the plan under this paragraph not later than the date that is 12 months after the date of the enactment of this subsection.</text></subparagraph></paragraph><paragraph id="HC5697E69ADFE4B73B3F4DCFF4EA6835F" commented="no"><enum>(5)</enum><header>Report</header><subparagraph id="H2898B20A45B44412A64E20C2FA7AFEFD" commented="no"><enum>(A)</enum><header>In general</header><text>Not later than two years after the date of the enactment of this subsection, the Tiger Team shall submit to the appropriate congressional committees a report on the activities of the Tiger Team undertaken pursuant to this subsection. The report shall include the following:</text><clause id="HC25EEE7266464208B349A270C82C0E12" commented="no"><enum>(i)</enum><text>A description of the challenges related to expeditionary diplomacy identified, including challenges identified by the Comptroller General of the United States.</text></clause><clause id="H673AF9151E2848FC9CD7B3B16A03F923" commented="no"><enum>(ii)</enum><text>A id="H1F97B433CBFB487ABE1F37C736A0E086" commented="no"><enum>(iii)</enum><text>A timeline for the implementation of such recommendations.</text></clause><clause id="H7E246F2DC30C48B1B17377611B49C386" commented="no"><enum>(iv)</enum><text>A designation of an office responsible for monitoring the implementation of such recommendations following the termination of the Tiger Team pursuant to paragraph (6).</text></clause></subparagraph><subparagraph id="HC01F0B8DD28B4549B28FF4D7C988DE62" commented="no"><enum>(B)</enum><header>Implementation</header><text>For the period of 90 days after the date on which the report is submitted, the Tiger Team shall oversee and monitor the implementation of recommendations submitted in such report.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline"><section id="H26EC80A12A5346379DCD1D568F51B405"><enum>212.</enum><header>Cybersecurity, technology governance, and operational coordination</header><subsection id="H8B89FD2A20E74BE288FA70A093277857"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish and maintain a cybersecurity and technology governance framework to support Service operations at United States missions abroad, including unified authority, accountability, and coordination for the protection of information systems, data, and mission technology.</text></subsection><subsection id="HF9516EEBF9224A9E96250475A26D41D2"><enum>(b)</enum><header>Roles and responsibilities</header><text>The framework required under subsection (a) should—</text><paragraph id="H7283C545E17848A19D534DCD8762FA8B"><enum>(1)</enum><text>delineate the roles and responsibilities of the Bureau of Diplomatic Technology, the Bureau of Diplomatic Security, regional bureaus, and chiefs of mission with respect to—</text><subparagraph id="HF29FD0584B08454E933F6F9006044F0C"><enum>(A)</enum><text>cybersecurity policy and standards;</text></subparagraph><subparagraph id="H54FFEFB03FFB4AFE87582ACD1D96E29F"><enum>(B)</enum><text>operational cybersecurity implementation;</text></subparagraph><subparagraph id="HEEE9532D17674A33AFE1F8DF5920DEC9"><enum>(C)</enum><text>technology lifecycle management, including hardware accountability and supply chain risk;</text></subparagraph><subparagraph id="HEC53679D1FD14ED2A34BB1A32C19D9EB"><enum>(D)</enum><text>artificial intelligence governance and risk management;</text></subparagraph><subparagraph id="H2AE9B15B8629437C8FA7A2887DF07578"><enum>(E)</enum><text>incident detection and response;</text></subparagraph><subparagraph id="H2375C09B266B4C0FBF76B02C6BAD7ADD"><enum>(F)</enum><text>vulnerability management; and</text></subparagraph><subparagraph id="H90D227D4664247708C779FAF50F81EC6"><enum>(G)</enum><text>risk mitigation and reporting;</text></subparagraph></paragraph><paragraph id="H2644F896445A4CBCBED9B3E039A4835E"><enum>(2)</enum><text>establish clear lines of authority for cybersecurity and technology incident response and escalation, including at a post abroad;</text></paragraph><paragraph id="HA18DD28F836A4ED8B113B43E421F7182"><enum>(3)</enum><text>require coordination mechanisms between the Bureau of Diplomatic Technology and the Bureau of Diplomatic Security to ensure integration of cyber, physical, personnel, and supply chain security measures; and</text></paragraph><paragraph id="HC3CDE36445904A7AAA47551839C7A49A"><enum>(4)</enum><text>ensure that a chief of mission is informed of, and accountable for, the cybersecurity and technology posture at the post of such chief of mission, consistent with section 207.</text></paragraph></subsection><subsection id="H30BCE9DA0FD74B0082CAE3FE05ECB4A7"><enum>(c)</enum><header>Secure hardware and supply chain protections</header><text>The Secretary shall ensure the implementation of policies governing—</text><paragraph id="H5212E63106114F9DA6A2A17EE4D38B69"><enum>(1)</enum><text>inventory control and accountability of Government-issued hardware at a United States mission abroad;</text></paragraph><paragraph id="H8F22BA3909AD47E480DAB973822AA62F"><enum>(2)</enum><text>mitigation of foreign supply chain risks at United States missions abroad;</text></paragraph><paragraph id="H365EBB1B9A6C4071B76EE8DF847B7846"><enum>(3)</enum><text>inspection and validation of equipment before deployment at United States missions abroad; and</text></paragraph><paragraph id="HB90E5BE2B63D47BD9702EA7BF2683D56"><enum>(4)</enum><text>procedures for handling equipment that is compromised or suspected to be compromised at United States missions abroad.</text></paragraph></subsection><subsection id="H68F917F532274F9B9030D248ACFB8744"><enum>(d)</enum><header>Incident response protocols</header><text>The Secretary shall ensure the development and implementation of standardized cybersecurity and technology incident response protocols for United States missions abroad, including defined reporting timelines and inter-bureau coordination requirements.</text></subsection><subsection id="HC055D896077846E385F7EE637A321FB1"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit the authority of a chief of mission under section 207 with respect to oversight of cybersecurity and technology posture at a United States mission abroad.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H84FF25DE2EFB419CA8D0778A3D4A034C"><enum>III</enum><header>Appointments</header><section id="HB460994384E94FC2B87081334E9B65B5"><enum>301.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">Section 304 (<external-xref legal-doc="usc" parsable-cite="usc/22/3944">22 U.S.C. 3944</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD220801CB1144A6FA9F46FCC2B918775" display-inline="no-display-inline"><subsection id="HF7B4A710FF7347438112D0023F14836D"><enum>(c)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text><paragraph id="HA9672A2C6BE94F4EA71D9B909C9AE93E"> <enum>(1)</enum> <text>detailed knowledge and requisite experience formulating and executing United States foreign policy, including a working understanding of Department operations and procedures, is vital for chiefs of mission, Assistant Secretaries of State, and other senior officials at the Department to successfully advance United States national security, and for managing the Federal workforce, in order to effectively assert and expand United States competitiveness and leadership abroad; and</text>
                        </paragraph><paragraph id="H4EC6311F88D44701A97B139374029C5B">
                            <enum>(2)</enum>
 <text>the People’s Republic of China and other adversaries are rapidly expanding their global diplomatic presences and it is imperative that the Department is appropriately staffed by empowered, nonpartisan foreign policy professionals and thoroughly qualified and vetted political appointees, who work together to protect United States citizens and advance United States interests across the globe.</text>
 </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5ACF154867B04FE097D48CB02D058111"><enum>302.</enum><header>Foreign Service Pathway for Veterans Program</header><text display-inline="no-display-inline">Chapter 3 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/3941">22 U.S.C. 3941 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H028D6BC12769479FBF1D845E879943D7" display-inline="no-display-inline"><section id="H4448035C654E423686A124E81CB1C577"><enum>313.</enum><header>Foreign Service Pathway for Veterans Program</header><subsection id="H236D60BDE7574AC4B6FE1C776B0A73D3"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program, to be known as the <quote>Veterans and Foreign Service Pathway Program</quote>, to recruit, prepare, and support qualified individuals for service in the Service.</text></subsection><subsection id="HCF36510528BA4C4D80DE626DCB8CE520"><enum>(b)</enum><header>Eligibility</header><text>The program required by subsection (a) shall be open to—</text><paragraph id="HC076085C1EB046CBA7AC0B29F6223A8A"><enum>(1)</enum><text>veterans, as such term is defined in section 2108 of title 5, United States Code;</text></paragraph><paragraph id="H58A860884EA2445AA2A3ED3720DBA7D6"><enum>(2)</enum><text display-inline="yes-display-inline">members of the Armed Forces who are within one year of separation, retirement, or release from active duty in the Armed Forces.</text></paragraph></subsection><subsection id="HCF5B63A461A24EC4AEF90ECDB5B4769D"> <enum>(c)</enum> <header>Matters To be included</header> <text>The program required by subsection (a) shall include—</text>
                            <paragraph id="HF3D7F98D051B4831AC995DEF316A0403">
                                <enum>(1)</enum>
 <text>targeted recruitment aligned to Service career tracks, including Diplomatic Security, security engineering, cybersecurity, medical, and other roles;</text>
                            </paragraph>
                            <paragraph id="H7801D89506BA45D6A509FD3E75BB4026">
                                <enum>(2)</enum>
 <text>mentorship and preparatory training for the Service application and assessment process;</text>
                            </paragraph>
                            <paragraph id="H47E757C081F14F36AECF26ADA976C085">
                                <enum>(3)</enum>
 <text>coordination with relevant Department offices to facilitate candidate readiness for Service entry requirements;</text>
                            </paragraph>
                            <paragraph id="HE5F1C8FE5F91410C8991AB08E699F044">
                                <enum>(4)</enum>
 <text>outreach and engagement with military installations and transition programs; and</text>
                            </paragraph>
                            <paragraph id="HF905DDC8463F47C8BA528F1963B4CBCE">
                                <enum>(5)</enum>
 <text>coordination with existing fellowship and recruitment programs of the Department, including the Veterans Innovation Partnership Fellowship, to support pathways to Service employment.</text>
                            </paragraph>
 </subsection><subsection id="H581EE7B607BD4EE9AA2C720D294AADF5"><enum>(d)</enum><header>Streamlined accession pilot program</header><paragraph id="HD85D2AA1A53C4CD386F1C9306B11DAC9"><enum>(1)</enum><header>In general</header><text>The Secretary is authorized to establish a pilot program to recruit and appoint qualified individuals described in subsection (b) into designated Service positions through streamlined hiring procedures.</text></paragraph><paragraph id="H903800C2C9364601905981CBFA175DD9"><enum>(2)</enum><header>Covered positions</header><text>The Secretary shall designate positions eligible under the pilot program, which may include the following:</text><subparagraph id="H93BED676F231462E8A2DF902C743FEEE"><enum>(A)</enum><text>Diplomatic Security special agent positions.</text></subparagraph><subparagraph id="H1117C0C3E04D4AA4ADE48DE56B9FAF1B"><enum>(B)</enum><text>Diplomatic courier positions capped at 10 percent annually.</text></subparagraph><subparagraph id="HCF778FE56CEA4911A3680CB5EC5ACC14"><enum>(C)</enum><text>Security engineering officer and security technical specialist positions.</text></subparagraph><subparagraph id="H0CE27020486A4156905E0192FB4D1646"><enum>(D)</enum><text>Cybersecurity and technology-related positions.</text></subparagraph><subparagraph id="H1394425D88E742DEB2FFFEAB5173610E"><enum>(E)</enum><text>Other Service positions identified by the Secretary as critical to mission readiness.</text></subparagraph></paragraph></subsection><subsection id="H1163A1F4234748FCABCB8B49EA90D8FD"><enum>(e)</enum><header>Requirements</header><text>The pilot program shall—</text><paragraph id="HC5B4DD14B41249EC83636FAEABF3CDF4"><enum>(1)</enum><text>maintain all applicable merit-based hiring principles and qualification standards; and</text></paragraph><paragraph id="HECD11D4A77A646CE95BE98646D993CE2"><enum>(2)</enum><text>provide for expedited processing, assessment, and onboarding of candidates.</text></paragraph></subsection><subsection id="H8BCC60247C8045A5860B9686C0E68C17"><enum>(f)</enum><header>Coordination with Department of Defense transition programs</header><text>The Secretary, in coordination with the Secretary of Defense, shall—</text><paragraph id="HFE8EF9A49CCD4F5B89BBF36BA73CBF44"><enum>(1)</enum><text display-inline="yes-display-inline">integrate information on Service career opportunities, including Diplomatic Security roles, into the curricula and materials of the Transition Assistance Program of the Department of Defense;</text></paragraph><paragraph id="HEF19E21AEA234A27BAC99F913DEAF951"><enum>(2)</enum><text>conduct regular outreach to transitioning servicemembers at military installations; and</text></paragraph><paragraph id="H0DD692A2E904498B85D6EE1B213E2C76"><enum>(3)</enum><text>develop and maintain military occupational specialty crosswalks aligned to Service career tracks.</text></paragraph></subsection><subsection id="HA5B038368B4F479CB8120C60096A2B59"><enum>(g)</enum><header>Sunset</header><text>The pilot program shall terminate on the date that is five years after the date of enactment of this section.</text></subsection><subsection id="H7B1121CCF00B4E9FA2FBC60C447AD933"><enum>(h)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to alter or diminish existing Service hiring standards or the authority of the Secretary to determine qualifications for appointment.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H2B0CCE95F37746119808292BE0CA49CA"><enum>303.</enum><header>Commitment in hiring process relating to participation in the Foreign Service fellowship program</header><text display-inline="no-display-inline">Chapter 3 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/3941">22 U.S.C. 3941 et seq.</external-xref>), as amended by section 302, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H1C16BCCDFE1E4AC2A33557B11F6DB315" display-inline="no-display-inline"><section id="HA232D24204FA43368516AF48A6812F41"><enum>314.</enum><header>Commitment in hiring process relating to participation in the Foreign Service fellowship program</header><subsection id="H5E29C3AC847346C3B44DB646B434F754"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, with consideration of Department needs, shall assess the fitness and suitability for hire of any individual who—</text><paragraph id="HB8EC1A5A0A83445BA7078DDC3EC50DB6"><enum>(1)</enum><text>was selected for participation in a Foreign Service fellowship program administered or funded by the Department; and</text></paragraph><paragraph id="H4FBFA7D8BD6C4C2A9AA11369CABEAA2D"><enum>(2)</enum><text>has successfully completed all educational and programmatic requirements of such fellowship program.</text></paragraph></subsection><subsection id="H65A9BDB0DA384B4F8D8B9E40E6C42EBC"><enum>(b)</enum><header>Eligibility for appointment</header><text>An individual described in subsection (a) shall remain eligible for appointment as a Service officer, subject to—</text><paragraph id="H9FAE6D98A4F14768A660A51E209E14F8"><enum>(1)</enum><text>successful completion of applicable security, medical, and suitability requirements; and</text></paragraph><paragraph id="HFD9F76C3170C48208D2B6A209A524458"><enum>(2)</enum><text>satisfaction of the appointment standards set forth in this Act.</text></paragraph></subsection><subsection id="H4AC634E2775549869DD49F3897FAE8B3"><enum>(c)</enum><header>Prohibition on arbitrary withdrawal</header><text display-inline="yes-display-inline">The Secretary shall assess the fitness and suitability for service of any individual described in subsection (a) without regard to—</text><paragraph id="HFDD1FFB9E05E4B79BA670BF3D88AEB83"><enum>(1)</enum><text>changes in workforce planning, hiring targets, or staffing levels; or</text></paragraph><paragraph id="HEAA2758CD3374DE9A42FA2632FE67C7A"><enum>(2)</enum><text>administrative or policy changes occurring after the individual’s selection for the fellowship program.</text></paragraph></subsection><subsection id="HA665263C86744060AA9A67620639D94A"><enum>(d)</enum><header>Prioritizing department needs</header><text display-inline="yes-display-inline">In all cases of hiring of individuals described in subsection (a), the Secretary—</text><paragraph id="H0EDEAA58FC094F32978BD8D39B3223C7"><enum>(1)</enum><text>shall make final hiring decisions based on the utility of the hire to the Department’s mission; and</text></paragraph><paragraph id="H5E45B311AD1240D79F2583923D1E5E43"><enum>(2)</enum><text>shall weigh favorably the prior military service and other relevant experiences of such individuals with respect to fitness for service.</text></paragraph></subsection><subsection id="HE65502102E2749AE9E7B6A69C9D08FA7"><enum>(e)</enum><header>Timing of appointment</header><text>The Secretary shall consider for appointment all eligible individuals described in subsection (a) not later than 12 months after completion of the fellowship’s educational requirements, unless the individual—</text><paragraph id="H993607908C8E441C958D38D62329EAE3"><enum>(1)</enum><text>requests a deferral; or</text></paragraph><paragraph id="H4B7D3E7756C743339E83A82F05BD0DA0"><enum>(2)</enum><text>is temporarily ineligible due to pending security, medical, or suitability determinations.</text></paragraph></subsection><subsection id="H8D10C3C2D51C4150A468F5E8BABEA2CD"><enum>(f)</enum><header>Notification and reporting</header><text display-inline="yes-display-inline">If the Secretary delays the assessment of the fitness and suitability for hire of an eligible individual described in subsection (a) beyond the period specified in subsection (f), the Secretary shall—</text><paragraph id="H0AD434063EBE4D34B9111C4FB4D23559"><enum>(1)</enum><text>provide written notice to the individual describing the reason for the delay not later than 15 days after the date on which the delay begins; and</text></paragraph><paragraph id="H494F1CB0CF194E7DBE97C86B714C3970"><enum>(2)</enum><text>provide written notice to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives describing the reason for the delay not later than 30 days after the date on which the delay begins.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H8366AE48959B4C50A3828AE66F98D418"><enum>IV</enum><header>Classification of Positions and Assignments</header><section id="H5FF60E1E0C584A61B37B747393C4C59A"><enum>401.</enum><header>Protection of external training, education, and details</header><text display-inline="no-display-inline">Chapter 5 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/3981">22 U.S.C. 3981 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H3DDFD1F3B3784C529109E41F160AC868" display-inline="no-display-inline"><section id="H17DA1FE2FEAA409ABDF2B269E96EBDBB"><enum>506.</enum><header>Protection of external training, education, and details</header><subsection id="HA29FF888E7FC4F71BA1834D8CAC669FA"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="HD63CCCBA0106402484E5BE5FB521F088"><enum>(1)</enum><text display-inline="yes-display-inline">the term ‘external training or education’ means training, education, or fellowship programs conducted by entities other than foreign affairs agencies, including—</text><subparagraph id="H6F6BFC0CD60849C0BD32C6E96FC347C0"><enum>(A)</enum><text>other Federal departments or agencies;</text></subparagraph><subparagraph id="H44876CE42E3D4E3B89BE7901B94128A7"><enum>(B)</enum><text>the Legislative branch;</text></subparagraph><subparagraph id="HF24D5B509E514D41991F0AC6FCE49538"><enum>(C)</enum><text>State, local, Tribal, or territorial governments;</text></subparagraph><subparagraph id="H27A25F732AE84DA78D3C393D06711ECC"><enum>(D)</enum><text>international organizations;</text></subparagraph><subparagraph id="H0B7AD4C47DBA41E29EE6BAB027070A41"><enum>(E)</enum><text>accredited academic institutions; and</text></subparagraph><subparagraph id="HE6FF855357DE4D81BBB40A8D027CDD59"><enum>(F)</enum><text>other entities approved by the head of the foreign affairs agency concerned; and</text></subparagraph></paragraph><paragraph id="H103077771C114460941FBD062D8784E5"><enum>(2)</enum><text>the term ‘external detail’ means a temporary assignment, fellowship, or detail to an entity described in paragraph (1).</text></paragraph></subsection><subsection id="H417EAE084870404BA39B19BEB710A991"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">A member of the Service may, with the approval of the head of the foreign affairs agency concerned, participate in external training, education, or details when such participation is determined to be in the interest of the United States.</text></subsection><subsection id="H087DAC6AD35743278C9257CE2BAD6C50"><enum>(c)</enum><header>Uniform career protections</header><text>A member of the Service participating in an approved external training, education, or detail—</text><paragraph id="H79ADB7780BF649E9876A63BB88E0FE32"><enum>(1)</enum><text>shall retain Service status, grade, and appointment;</text></paragraph><paragraph id="HD0885A807D224962BC5FB3147CE69BBC"><enum>(2)</enum><text>shall continue to accrue time-in-class, time-in-service, tenure eligibility, and retirement credit as if serving in a domestic assignment or an assignment in a foreign country;</text></paragraph><paragraph id="H63F2CC0D475D47CCB06FD1E595F4B3F6"><enum>(3)</enum><text>shall remain fully eligible for promotion, pay increases, tenure, and awards on the same basis as members not on such assignments;</text></paragraph><paragraph id="HC29E26B350D745E59D8F1989F291E144"><enum>(4)</enum><text>shall not be disadvantaged in assignments, bidding, performance evaluations, or career progression solely because of such participation; and</text></paragraph><paragraph id="HE1B020F783CE4450984ADB21A8E57E0D"><enum>(5)</enum><text>shall not be required to resign, accept a limited appointment, or otherwise relinquish Service status as a condition of participation.</text></paragraph></subsection><subsection id="H50791162E86144998776DC4CB2EAF61B"><enum>(d)</enum><header>Performance evaluation requirements</header><text>Each foreign affairs agency shall ensure that members on approved external training or detail receive—</text><paragraph id="HD56E257040F043BD91C876BF42204902"><enum>(1)</enum><text>timely and meaningful performance evaluations;</text></paragraph><paragraph id="H1DFB977116EB457EAD721ABE5019A1A9"><enum>(2)</enum><text>evaluation standards and promotion precepts that recognize the nature and value of external service; and</text></paragraph><paragraph id="HF898612899DF49EF978123FCFC64307D"><enum>(3)</enum><text>written guidance to supervisors outside foreign affairs agencies regarding evaluation responsibilities.</text></paragraph></subsection><subsection id="HC61789CB99504D8B9EAB9F1B11DC5496"><enum>(e)</enum><header>Reentry and assignment rights</header><text>Upon completion of an approved external training or detail, a member—</text><paragraph id="H79A2223ED8414E169DE22AE945411659"><enum>(1)</enum><text>shall be eligible for reassignment to positions consistent with the member’s grade and professional qualifications; and</text></paragraph><paragraph id="HCC319B25AF28438BB7D1BD83385FBDDC"><enum>(2)</enum><text>shall not be required to compete for reentry into the Service or otherwise be treated as a new entrant.</text></paragraph></subsection><subsection id="H88E03EA4CCCE42ACB3AF940DE4CD953E"><enum>(f)</enum><header>Limitation on waivers</header><text>The protections of this section may not be waived except by statute.</text></subsection><subsection id="HBCCCEF5D9DEE46588BF5ACEFFA61FB1F"><enum>(g)</enum><header>Regulations</header><text>Not later than one year after the date of the enactment of this section, the head of each foreign affairs agency—</text><paragraph id="HA4FE0F66C30E45CEA7FA721EABDCDC66"><enum>(1)</enum><text>shall issue regulations implementing this section, which shall be consistent across agencies to the maximum extent practicable.</text></paragraph><paragraph id="H2C5A8C6AD73645DC9A48BC70F9940F4B"><enum>(2)</enum><text>shall revise applicable regulations, evaluation precepts, and personnel policies to ensure full implementation of this section.</text></paragraph></subsection><subsection id="H30CDA0F71B4A4899B66A244768D7B150"><enum>(h)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to conflict with the requirements of section 504 or the regulations to implement such section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H4CE8501D52D44FE4911C50A7C7398544"><enum>V</enum><header>Promotion and retention</header><section id="HF32D14F4AAC44226BA4711E8F747934D"><enum>501.</enum><header>Joint duty requirement</header><text display-inline="no-display-inline">Section 601(c) (<external-xref legal-doc="usc" parsable-cite="usc/22/4001">22 U.S.C. 4001(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H7B0BF18D9A024C0C8451B5B7C930B259" display-inline="no-display-inline"><paragraph id="HF88DAEECB91346998D8159E5A7903F7E" indent="up1"><enum>(7)</enum><header>Promotions</header><subparagraph id="H4145349CFC554F34831BE61F59896BC6"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">The opening of a promotion window, on or after the date that is five years after the date of enactment of this paragraph, of any Service officer, appointed under section 302(a)(1), who has general responsibility for carrying out the functions of the Service to the Senior Foreign Service should be contingent upon such individual completing at least one joint duty assignment.</text>
 </subparagraph><subparagraph id="HC4B9F7F2538B4DEAB84E7CD6F4FBACB5"><enum>(B)</enum><header>Exceptions</header><text>The Secretary may—</text><clause id="H15535387ED684B30824EA8DA37DCAF9C"><enum>(i)</enum><text>identify circumstances under which the requirements under subparagraph (A) shall not apply, which may include that the individual proposed for promotion to the Senior Foreign Service—</text><subclause id="H6D84FFBEA2B4476EB0A2E7BB93C6D440"><enum>(I)</enum><text>has met all other requirements applicable to such promotion; and</text></subclause><subclause id="HB66CB08683E3430A893BCE9C408C5502"><enum>(II)</enum><text>was unable to complete a joint duty assignment because there was not a reasonable opportunity for such individual to be assigned to such a position; and</text></subclause></clause><clause id="HA55CF5E3C0194C76975777B39C08516B"> <enum>(ii)</enum> <text display-inline="yes-display-inline">exempt Foreign Service Medical Specialists who entered as a FS–01 rank and serve as a Regional Medical Officer from the requirements under subparagraph (A).</text>
 </clause></subparagraph><subparagraph id="HE6FCC8B1DD914B11883B198D51E7557F"><enum>(C)</enum><header>Joint duty assignment defined</header><text>In this paragraph, the term <quote>joint duty assignment</quote> means a tour of duty of not less than 12 months in—</text><clause id="HE54CA1DE8FF24D8AB9C7008E278477A1"><enum>(i)</enum><text>a Federal department or agency other than the Department;</text></clause><clause id="HFB2722E7D673418F964C38B20426714B"><enum>(ii)</enum><text>the Congress, pursuant to a fellowship or detail program approved by the Secretary;</text></clause><clause id="H70E37B3A3BBE472FB5B83E16F4A55354"><enum>(iii)</enum><text>an international organization of which the United States is a member, pursuant to a fellowship or detail program approved by the Secretary; or</text></clause><clause id="HA7437EEF186C45E69F6ABA13563DEEB7"><enum>(iv)</enum><text>a State or local government.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBEFC2EE383FE4ED3A4A651AACFCB6C7E"><enum>502.</enum><header>Timely publication and congressional notification of tenure and promotion lists</header><text display-inline="no-display-inline">Section 601 (<external-xref legal-doc="usc" parsable-cite="usc/22/4001">22 U.S.C. 4001</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1E1CB70C2EBF48B6A6A509DA1D8646E5" display-inline="no-display-inline"><subsection id="HEC8D1A11979A4A948E2A978967DAAE53"><enum>(d)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 90 days after the conclusion of any Service tenure or promotion board whose recommendations require the advice and consent of the Senate, the Secretary—</text><paragraph id="H3CA49C19E63545499E5CFA1C3550BF2C"><enum>(1)</enum><text>should finalize the list of Service members recommended for tenure as well as Service officers and specialists recommended for promotion to and within the Senior Foreign Service; and</text></paragraph><paragraph id="HBDFCEF26AA99443787FAAC9630894F35"><enum>(2)</enum><text>transmit such list to the President for nomination consideration to the Senate.</text></paragraph></subsection><subsection id="H5FED361CC9F74FB0AACE4676DB43EF3E"><enum>(e)</enum><header>Expedient processing</header><text>It is the sense of Congress that the Secretary should ensure that the administrative review, clearance, and transmission of tenure and promotion recommendations are conducted in an expeditious manner, and that no avoidable administrative delay prevents compliance with the deadline established under subsection (a).</text></subsection><subsection id="H1DD1FE10D2454ECDBFC1251E5B9383DA"><enum>(f)</enum><header>Limited exceptions</header><text>The Secretary may delay publication of an individual name beyond the period specified in subsection (a) only if the delay is necessary due to an ongoing disciplinary, suitability, or security investigation; and the affected officer is provided written notice of the reason for such delay. Any delay under this subsection should be limited to the minimum period necessary and shall not affect the publication of the remaining list.</text></subsection><subsection id="H1F17F89E3ED046AA9669CC585F162AFE"><enum>(g)</enum><header>Accountability</header><text>If the Secretary fails to meet the requirements of subsection (a), the Secretary shall, not later than 30 days after the expiration of the deadline, provide a briefing to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives on the reasons for the failure to meet such requirements and corrective actions taken to prevent future delays.</text></subsection><subsection id="H99FADF05F6764DAFA9025F114BB468CD"><enum>(h)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to alter the constitutional role of the Senate in providing advice and consent.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H59676AC2304A4B6BAA9E1A5B6729AEAF"><enum>503.</enum><header>Matters relating to recruitment process of public members of the Foreign Service selection boards</header><subsection id="HC20D7F23B7E14B8CA19537977E953E50"><enum>(a)</enum><header>Prohibition on nepotism</header><text display-inline="yes-display-inline">Section 602 (<external-xref legal-doc="usc" parsable-cite="usc/22/4002">22 U.S.C. 4002</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H5D9B4E4C306E42ED8B0CE144A0A56BF4" display-inline="no-display-inline"><subsection id="H39959737C8354A30AE5113853AA3A380"><enum>(d)</enum><header>Prohibition on nepotism in recruitment process</header><paragraph id="H93495F1E5FE041E7B898C997FD571200"><enum>(1)</enum><header>In general</header><text>No employee of the Department who is involved in, or has influence over, the recruitment, evaluation, or selection of public members of selection boards established under this section may refer, recommend, or otherwise facilitate the consideration of any individual with whom such employee has a personal connection.</text></paragraph><paragraph id="H9E049134DA924E1FB5E2CFD39DF20E33"><enum>(2)</enum><header>Personal connection defined</header><text>In this section, the term <quote>personal connection</quote>, with respect to an employee, includes—</text><subparagraph id="HD9C0A14271884127AB78E2CBF95712DF"><enum>(A)</enum><text>a family member, including a spouse, domestic partner, parent, child, sibling, or any individual related by blood, marriage, or adoption, to the employee; and</text></subparagraph><subparagraph id="HE07AAD07B05A47138D7948377DB925C3"><enum>(B)</enum><text>any individual with whom the employee has a close personal relationship, including a friend, former colleague, or any other relationship that could reasonably give rise to an appearance of favoritism or bias.</text></subparagraph></paragraph><paragraph id="H7C4959EFDF7242959E33519242C2F541"><enum>(3)</enum><header>Disclosure</header><subparagraph id="H030C2E0E7E754AA7800E7B818B6A21F9"><enum>(A)</enum><header>In general</header><text>Any Office of Performance Evaluation employee or other personnel described in subsection (a) who becomes aware that an applicant for service as a public member of a selection board established under this section has a personal connection to such employee shall—</text><clause id="H29D9BB0F775A49F2A7DB4ACE92578158"><enum>(i)</enum><text>promptly disclose such relationship in writing to the Director of the Office of Performance Evaluation; and</text></clause><clause id="HD9B264BF373B469F82A0023BAE4BC927"><enum>(ii)</enum><text>recuse himself or herself from any further involvement in the recruitment, evaluation, or selection of that applicant.</text></clause></subparagraph><subparagraph id="HA7E06B6024F34C1E8A4517472F47C933"><enum>(B)</enum><header>Recordkeeping</header><text>The Department shall maintain written records of all disclosures and recusals made under this paragraph.</text></subparagraph></paragraph><paragraph id="HAD9CA17DD5F147C2B83967E4E92582AD"><enum>(4)</enum><header>Prohibition</header><text>No applicant for service as a public member of a selection board established under this section may advance to the interview or selection stage if such applicant was referred, recommended, or otherwise introduced into the applicant pool by an employee in violation of this subsection.</text></paragraph><paragraph id="HEAD5AFE85B604E56A16293D4FDA91775"><enum>(5)</enum><header>Administrative discipline</header><text>Any employee who knowingly violates the terms and conditions of this subsection shall be subject to appropriate administrative discipline, in accordance with applicable law and regulations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H73E9BD93F5B44719A2930042ED03DB87"><enum>(b)</enum><header>Clarification of recruitment sources</header><paragraph id="H87988DCA3B894645A6FFE315068F1891"><enum>(1)</enum><header>In general</header><text>Section 602 (<external-xref legal-doc="usc" parsable-cite="usc/22/4002">22 U.S.C. 4002</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H0679D57CBF914759B6A57B354300E8A9" display-inline="no-display-inline"><subsection id="H0FC6D7933EAA4A5788554E886D85ED93"><enum>(e)</enum><header>Clarification of recruitment sources</header><paragraph id="H961D5A5AEEA044809DF5355B75463057"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized to revise and standardize all contract request memoranda used for the appointment of public members to selection boards established under this section to ensure accuracy, transparency, and accountability in the recruitment process.</text></paragraph><paragraph id="HFD39153906A6414696BBEA0802AF90F2"><enum>(2)</enum><header>Matters to be included</header><text>Each contract request memorandum described in paragraph (1) shall include—</text><subparagraph id="H48F69ED5BB584D9998F87F884FAFC737"><enum>(A)</enum><text>a clear description of the recruitment process through which the individual was identified and selected;</text></subparagraph><subparagraph id="H6FF922EB1D3F42C7A74C82AA7F34D23E"><enum>(B)</enum><text>the specific recruitment source of the individual, including whether the individual was identified through formal outreach, open application, or word-of-mouth referral;</text></subparagraph><subparagraph id="HFCE694F15B784DAD90BA063B7D5AB974"><enum>(C)</enum><text>the name and position of any Department employee or other individual who referred, recommended, or otherwise facilitated the individual’s entry into the recruitment process; and</text></subparagraph><subparagraph id="H41884A0E83FE445DAB239F0F83F9CA1C"><enum>(D)</enum><text>any relevant documentation required under Department policies governing recruitment and selection.</text></subparagraph></paragraph><paragraph id="H28735B4CC89048C4AED558EDAC3FA7BA"><enum>(3)</enum><header>Additional matters to be included</header><text>Each contract request memorandum described in paragraph (1) shall also include a signed written certification from the individual identified as the recruitment source stating that, to the best of that individual’s knowledge, the individual selected for appointment—</text><subparagraph id="H6B98803DF40C457B97F27131ACF5602B"><enum>(A)</enum><text>is not a family member; and</text></subparagraph><subparagraph id="H3C4C74411BF343BE8FF7BBE440F8FB45"><enum>(B)</enum><text>does not have a close personal relationship that could reasonably give rise to an appearance of favoritism or bias.</text></subparagraph></paragraph><paragraph id="HC53912B693B04BF4B2BA1465E803F239"><enum>(4)</enum><header>Forms and procedures</header><text>The Secretary shall establish standardized forms and procedures for the certification required under paragraph (3).</text></paragraph><paragraph id="H2706D46D11B843E58852F7DC11E27223"><enum>(5)</enum><header>Limitation</header><text>No contract for service as a public member of a selection board established under this section may be approved or executed unless the contract request memorandum complies with the requirements of this subsection.</text></paragraph><paragraph id="HA978ED3680534F61BC5F7659584B0130"><enum>(6)</enum><header>Recordkeeping</header><text>The Department—</text><subparagraph id="H348C09B6F58944E1987A9F4DDC7DD525"><enum>(A)</enum><text>shall retain all contract request memoranda and associated certifications required under this subsection for three years; and</text></subparagraph><subparagraph id="H87B714B97B494A9BB7A52767696E14D2"><enum>(B)</enum><text>shall make such records available for review by appropriate oversight entities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2281B5DCE12E4FC9BD5C21262B1A9353"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">Subsection (e) of section 602 (<external-xref legal-doc="usc" parsable-cite="usc/22/4002">22 U.S.C. 4002</external-xref>), as added by paragraph (1), shall apply to all contract request memoranda described in such subsection that are prepared on or after the date that is 180 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H368BD8B891824054B3DCA132D586B3DD"> <enum>(c)</enum> <header>Internal controls for word-of-Mouth referrals</header> <paragraph id="H9010EE62EAEF4DD19E9F335A3ED2C1BC"> <enum>(1)</enum> <header>In general</header> <text>Section 602 (<external-xref legal-doc="usc" parsable-cite="usc/22/4002">22 U.S.C. 4002</external-xref>), as amended by subsections (a) and (b), is further amended by adding at the end the following:</text>

                                    <header>Policy</header>
 <text display-inline="yes-display-inline">The Director General of the Service, acting through the Office of Performance Evaluation, shall establish and implement a standardized, transparent, and consistently applied policy governing the use of <quote>word-of-mouth referrals</quote> in the recruitment of public members for selection boards established under this section.</text>
                                </paragraph>
                                <paragraph id="HCED5C1692B20438B87FDB61D32D2A570">
                                    <enum>(2)</enum>
                                    <header>Matters to be included</header>
 <text>The policy required by paragraph (1) shall—</text> <subparagraph id="HEA2C2F1659A34B01915A4DDC1E884D79"> <enum>(A)</enum> <text>define the term <quote>word-of-mouth referral</quote> to include any informal or direct communication by Department personnel to an individual encouraging or inviting that individual to apply for service as a public member;</text>
                                    </subparagraph>
                                    <subparagraph id="HBD894388DD844D998D06F9CDB6C6C9C1">
                                        <enum>(B)</enum>
 <text>establish uniform procedures governing when and how such referrals may be made;</text>
                                    </subparagraph>
                                    <subparagraph id="H31B5C38167284721A1BB6F24D294AC84">
                                        <enum>(C)</enum>
 <text>ensure that such referrals are conducted in a manner consistent with merit-based selection principles and applicable ethics requirements; and</text>
                                    </subparagraph>
                                    <subparagraph id="HF7AD7956E71842B2BED50A4546517F25">
                                        <enum>(D)</enum>
 <text>prohibit the use of informal referrals in a manner that circumvents established recruitment or outreach processes.</text>
                                    </subparagraph>
                                </paragraph>
                                <paragraph id="HD04598CBCF724FF4B2939314E4216E34">
                                    <enum>(3)</enum>
                                    <header>Documentation</header>
 <text>The Assistant Secretary shall require that all word-of-mouth referrals be documented in writing. Such documentation shall include—</text>
                                    <subparagraph id="HE21DEA0DC21349BA8562422E5CE2C6E6">
                                        <enum>(A)</enum>
 <text>the name of the Department employee making the referral;</text>
                                    </subparagraph>
                                    <subparagraph id="HE1E9CA53191A4AE9B0FA9E5C5F830ADD">
                                        <enum>(B)</enum>
 <text>the name of the individual referred;</text> </subparagraph> <subparagraph id="H548E966C011646DCAA7A44F268DBA09B"> <enum>(C)</enum> <text>the date and method of communication; and</text>
                                    </subparagraph>
                                    <subparagraph id="H06BE116561E54A1FAB601E11105F34C9">
                                        <enum>(D)</enum>
 <text>a brief description of the nature of communication, including whether the individual was encouraged or invited to apply.</text>
                                    </subparagraph>
                                </paragraph>
                                <paragraph id="HCA1F38D02D60472D900AEF1C5DC9BFD5">
                                    <enum>(4)</enum>
                                    <header>Limitation</header>
 <text>No individual may advance in the recruitment process for service as a public member for a selection board established under this section unless the documentation required under this subsection has been completed and retained.</text>
                                </paragraph>
                                <paragraph id="H9E549F297773420EA29A062906DD8689">
                                    <enum>(5)</enum>
                                    <header>Recordkeeping</header>
 <text>The Department shall maintain records of all word-of-mouth referrals in a centralized system to ensure transparency, accountability, and auditability for not less than three years, which shall be made available for review upon request by appropriate oversight entities.</text>
                                </paragraph>
                            </subsection>

                    </paragraph>

                        <enum>(2)</enum>
                        <header>Effective date</header>
 <text display-inline="yes-display-inline">Subsection (f) of section 602 (<external-xref legal-doc="usc" parsable-cite="usc/22/4002">22 U.S.C. 4002</external-xref>), as added by paragraph (1), shall take effect on the date that is 180 days after the date of the enactment of this Act.</text>
                    </paragraph>

or</quote>; and</text></paragraph><paragraph id="HD61A389A26054B4F9CC0F67CD50628B2"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HBC8119E731F443498568A8C1EFAB0851" display-inline="no-display-inline"><paragraph id="H7EDABB37A703448CAD1F03901DCE4B54"><enum>(10)</enum><text display-inline="yes-display-inline">experience with the Legislative branch, including fellowships in a congressional office or committee, or within the Bureau of Legislative Affairs of the Department.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H51244A3DE3664BC28C0ED590D51EBE91"><enum>VI</enum><header>Career development, training, and orientation</header><section id="H271D740F7778415ABA892A51D0E72A69"><enum>601.</enum><header>Access to Information Center</header><text display-inline="no-display-inline">Section 701 (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HA87B7825272340A2B3A1A4E8D76C991F" display-inline="no-display-inline"><subsection id="HE5CBD18588FC41F49C868DBB32361CA3"><enum>(h)</enum><header>Access to Information Center</header><paragraph id="H5012B82F3E004F0AB07A127D336FDBA0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Overseas Briefing Center, in coordination with the Director of the National Foreign Affairs Training Center, shall provide the appropriate congressional committees with access to the Information Center and its materials, including digital and physical materials.</text></paragraph><paragraph id="H8230A2028192456EA10A55510B34A01B"><enum>(2)</enum><header>Scheduling options</header><text>Not later than two days after a request by the appropriate congressional committees for access to the Information Center and its materials under paragraph (1), the Director of the Overseas Briefing Center, in coordination with the Bureau of Legislative Affairs of the Department, shall provide to the congressional committees a list of options to schedule such access on a timely basis.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB497A46831944B2B8185DFD180DAA053"><enum>602.</enum><header>List of critical foreign languages</header><subsection id="H0C6FF6F98E9B4D56BB4623E2BCF5451D"><enum>(a)</enum><header>In general</header><text>Section 701 (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021</external-xref>), as amended by section 601, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H02BF2CB6D699407CBC6CE229195B40A1" display-inline="no-display-inline"><subsection id="H1B9D714BAE53430DAC75AD565FD0EF49"><enum>(i)</enum><header>List of critical foreign languages</header><paragraph id="HDF5025CA58D84408906DE13115A12C15"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this subsection, and not less frequently than once every three years thereafter, the Secretary should designate, and make available to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate, a list of critical foreign languages for purposes of this Act.</text></paragraph><paragraph id="HCF4B8B49ED944021BD6CCD82216AD6B5"><enum>(2)</enum><header>Matters to be included</header><text>For each critical foreign language designated pursuant to paragraph (1), the Secretary shall include information in the list describing—</text><subparagraph id="HF9FB03D8DC0B47CFBFEB13ACF7A54724"><enum>(A)</enum><text>minimum tested levels at which a member of the Service shall be considered to be proficient in the language; and</text></subparagraph><subparagraph id="HCB527C587C024456932471BAD1A9ED87"><enum>(B)</enum><text>criteria for determining positions for which such critical foreign language capability is mission essential.</text></subparagraph></paragraph><paragraph id="H0921EEB6B5A340AE9F88BD2155E050F8"><enum>(3)</enum><header>Coordination</header><text>In carrying out this subsection, the Secretary shall, to the maximum extent practicable, coordinate with the heads of other Federal departments and agencies that maintain foreign language capabilities, in order to promote interoperability, avoid duplication, and achieve cost savings to the taxpayer.</text></paragraph><paragraph id="HA8E168B340D2497BAC5EF98D2CF915F1"><enum>(4)</enum><header>Workforce planning</header><text display-inline="yes-display-inline">The Secretary should incorporate critical foreign language capability planning into the career development, training, and assignment processes under this chapter, including through—</text><subparagraph id="H9CDEB5F973614CE089625067E80506DB"><enum>(A)</enum><text>the use of training at the National Foreign Affairs Training Center;</text></subparagraph><subparagraph id="H2C032011027145A0BB67F5A2BA47BA10"><enum>(B)</enum><text>the use of limited noncareer appointments and recall and reappointment authorities under sections 308 and 309 to address temporary or surge requirements; and</text></subparagraph><subparagraph id="HBBE2FBB5CE5B4162A023389549F17A93"><enum>(C)</enum><text>the development of a surge reserve of rehired officers and other appropriately cleared individuals with critical foreign language capabilities who may be activated rapidly in response to crises.</text></subparagraph></paragraph><paragraph id="H378B95E02CE149F6B1460FE57501AC24"><enum>(5)</enum><header>Critical foreign language defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>critical foreign language</quote> means a foreign language identified by the Secretary, in consultation with the heads of other Federal departments and agencies, as appropriate—</text><subparagraph id="HB33079A857B84174B24EE9F66B1CAF18"><enum>(A)</enum><text>as essential to the protection of United States national security interests, United States economic prosperity, and the protection of United States citizens abroad;</text></subparagraph><subparagraph id="H4836EB03EFB94DB4871FAE5E93596B8B"><enum>(B)</enum><text>with respect to which required levels of proficiency are limited in the United States workforce relative to strategic needs and operational demand; and</text></subparagraph><subparagraph id="H5C55590FA23646C4844C0609F8E9A2B6"> <enum>(C)</enum> <text>as corresponding to category I, II, III, or IV languages, as specified in section 3911.2 of volume 3 of the Foreign Affairs Manual (3 FAM 3911.2) or successor guidance, encompassing difficult, hard, and super hard languages that are less commonly taught or studied in the United States.</text>
 </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9112A7D557DB4655A236C4BDF9A5B23E"><enum>(b)</enum><header>Critical foreign language requirement</header><text display-inline="yes-display-inline">Section 702 (<external-xref legal-doc="usc" parsable-cite="usc/22/4022">22 U.S.C. 4022</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H6741B7D458724DCF9FAA66B63C16BA47" display-inline="no-display-inline"><subsection id="H30A07C4326C445B993B5F2DE830EFBB0"><enum>(c)</enum><header>Critical foreign language requirement</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall ensure that policies for the instruction, testing, and use of foreign languages explicitly support the preservation of capabilities with respect to critical foreign languages identified pursuant to section 701(i).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBF48C0F45CE54FD4B35958958BB02DB1"><enum>603.</enum><header>Use of world language skills</header><subsection id="H18B816BD352D4DDAB756531760E1DC81"><enum>(a)</enum><header>In general</header><text>Section 702 (<external-xref legal-doc="usc" parsable-cite="usc/22/4022">22 U.S.C. 4022</external-xref>), as amended by section 602(b), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HECE6D71ABAB74C2CBD110DF59890A235" display-inline="no-display-inline"><subsection id="H2AEA608824524B608D3B19D809E10E0B"><enum>(d)</enum><header>Use of world language skills</header><paragraph id="HD703905590B3431BAF6792AA75D10BA2"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Any member of the Service who undergoes full-time, Department-funded language training for a period exceeding six months shall be required to serve no fewer than three consecutive tours in positions for which proficiency in such language is a documented requirement for the position.</text></paragraph><paragraph id="H6D2909BD25FF4B1192E1D5113B24D6B8"><enum>(2)</enum><header>Timing of assignments</header><text>The requirement under paragraph (1) shall commence with the first assignment immediately following the completion of the language training and shall continue without interruption, except as provided in paragraph (3).</text></paragraph><paragraph id="HA0FF6D4B24AD448B8382282177BA49E4"><enum>(3)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">The Secretary may waive the requirement under paragraph (1) with respect to a member of the Service only if the Secretary certifies to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate that—</text><subparagraph id="HAC7EA90F64144D6F8DA435987814C5AB"><enum>(A)</enum><text>the member has developed a medical condition preventing service at the required posts;</text></subparagraph><subparagraph id="HB685306A9D37428F9077ABC2C407445C"><enum>(B)</enum><text>the member is assigned to a position of higher priority; or</text></subparagraph><subparagraph id="H06C80809D3D54F2CAA901185200D4641"><enum>(C)</enum><text>there is no vacant position for which the member is qualified where the language skill is required.</text></subparagraph></paragraph><paragraph id="HC82A9899553244EFB2694AE84D64E1FC"> <enum>(4)</enum> <header>Consecutive tours defined</header> <text display-inline="yes-display-inline">The term <quote>consecutive tours</quote> refers to sequential assignments either overseas at posts where the trained language is the primary local or official language, or domestic assignments where the primary duties involve direct use of the trained language or the trained language is helpful to the completion of domestic assignment duties.</text>
 </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE86067C50F4E4103BF7912890756D187"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to any member of the Service who begins language training on or after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section><section id="HBB55EB8CF1F2448DABA7258873401783"><enum>604.</enum><header>Diplomatic security fellowship program</header><text display-inline="no-display-inline">Section 703 (<external-xref legal-doc="usc" parsable-cite="usc/22/4023">22 U.S.C. 4023</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD922F8529E7444A89B5422682A062BBB" display-inline="no-display-inline"><subsection id="H470D483ED6D348B4A79426E2CA7EAC5F"><enum>(f)</enum><header>Diplomatic security fellowship program</header><paragraph id="HC4562FEA49AB47A88B4C309CFB563AEE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant Secretary for Diplomatic Security, shall administer a fellowship program to recruit, retain, train, and prepare qualified individuals for service within the Bureau of Diplomatic Security.</text></paragraph><paragraph id="H7E761BD1D3AB4846BD42B1031A79EA3B"><enum>(2)</enum><header>Objectives</header><text>The objectives of the fellowship program established under paragraph (1) shall be—</text><subparagraph id="HDD6E259BF7BC4AF3AA9554E30D3F6297"><enum>(A)</enum><text>to leverage specialized skills relevant to the diplomatic security mission;</text></subparagraph><subparagraph id="H9F89405824C04CE4A8786EB6BE57993B"><enum>(B)</enum><text>to provide structured training and mentorship for fellows; and</text></subparagraph><subparagraph id="HE5597C5F2CB149DFBBD5FBF686F19D6D"><enum>(C)</enum><text>to support recruitment into a position within the Bureau of Diplomatic Security through the existing competitive hiring processes of the Department.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H695BFF93FC374CAAAE676A58E1B95C6F"><enum>605.</enum><header>Bureau of African Affairs staffing</header><text display-inline="no-display-inline">Section 703 (<external-xref legal-doc="usc" parsable-cite="usc/22/4023">22 U.S.C. 4023</external-xref>), as amended by section 604, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HAD27590432BE47D495F2FE566E7C4A2C" display-inline="no-display-inline"><subsection id="H23D263C687124E5CABEA9A96A6A71303"><enum>(g)</enum><header>Bureau of African Affairs staffing</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Assistant Secretaries for Human Resources and for African Affairs, shall establish a program to facilitate and expedite the hiring of qualified individuals with expertise on African countries into the Service to fill positions at missions under the authority of the Bureau of African Affairs and domestic positions under the Bureau of African Affairs.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8EEB57142E49462B82C750D515E7006C" commented="no"><enum>606.</enum><header>Contracting Officer’s Representative and Agreement Officer’s representative training</header><text display-inline="no-display-inline">Section 704 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4024">22 U.S.C. 4024</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H85F01968D8264AD18A58ADA5631E0A85" display-inline="no-display-inline"><subsection id="H60B8FB2FAF834318A4662761562ADD10" commented="no"><enum>(d)</enum><header>Contracting officer’s representative and agreement officer’s representative training</header><paragraph id="HBAF1472A55144354988A744B80D756D2"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Under Secretary for Foreign Assistance, is authorized to establish a program to recruit, train, and retain personnel serving as Contracting Officer’s Representatives and Agreement Officer’s Representatives for the Department, to ensure that the Bureau has sufficient personnel with the skills and expertise necessary to plan, implement, and manage United States foreign assistance operations and programs.</text></paragraph><paragraph id="H785E73800AA5433FA6C848D141B764E9" commented="no"><enum>(2)</enum><header>Training</header><text display-inline="yes-display-inline">Personnel recruited, trained, or retained under the program authorized by paragraph (1) shall receive training necessary to effectively oversee and administer foreign assistance instruments and disaster assistance operations, which may include training in procurement, grants and cooperative agreement oversight, logistics, financial management, monitoring and evaluation, and emergency response operations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3034C49202C24257BDAAC97E70B51CCE"><enum>607.</enum><header>Training for Foreign Service Officers</header><subsection id="HC3FED28756E844CDA5BC8A4DB39D4C9F"><enum>(a)</enum><header>Antisemitism training</header><text display-inline="yes-display-inline">Section 708(a) (<external-xref legal-doc="usc" parsable-cite="usc/22/4028">22 U.S.C. 4028(a)</external-xref>) is amended—</text><paragraph id="HD7090BC4A7E141B9BC3EFDA80EFBC66A"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by inserting before the semicolon <quote>, including instruction on identifying and addressing antisemitism, including contemporary forms of antisemitism and Holocaust distortion and denial</quote>; and</text></paragraph><paragraph id="H53EBA9409EE54A00A01DCB9317D42770"><enum>(2)</enum><text>in paragraph (2)(B), in the first sentence, by inserting <quote>, the Office of the Special Envoy to Monitor and Combat Antisemitism, the Office of the Special Envoy for Holocaust Issues,</quote> after <quote>Training Center</quote>.</text></paragraph></subsection><subsection id="H2AB17E5131BB44BE8CAA972D95BE4F14"><enum>(b)</enum><header>AUKUS training</header><text display-inline="yes-display-inline">Section 708 (<external-xref legal-doc="usc" parsable-cite="usc/22/4028">22 U.S.C. 4028</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H49E44B07C2DD43C0BD4522B5318CE6A4" display-inline="no-display-inline"><subsection id="HEA51E937FB5B48D9BA3C77B22D14EF2F"> <enum>(f)</enum> <header>AUKUS training</header> <text display-inline="yes-display-inline">The Secretary, with the assistance of other relevant Federal officials, shall ensure that any member of the Service who is assigned to a position in Australia or the United Kingdom or that may be called upon to work on issues related to the enhanced trilateral security partnership between Australia, the United Kingdom, and the United States (referred to as the <quote>AUKUS partnership</quote>, as that term is defined in section 1321(2) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/10401">22 U.S.C. 10401(2)</external-xref>)) have access to training and briefings needed to coordinate on the AUKUS partnership, including training on—</text>

                                <enum>(1)</enum>
 <text>Australia, United Kingdom, and United States governance infrastructure and policies related to the sale, development, production, and co-production of advanced defense technology;</text>
                            </paragraph>

                                <enum>(2)</enum>
 <text>overview of AUKUS security pact Pillar I and Pillar II technologies, capabilities, and their strategic impetus; and</text>
                            </paragraph>
                            <paragraph id="H802AC2EF3A5D4AFE92941EE1E227AFEC">
                                <enum>(3)</enum>
 <text>workforce challenges and needs in the host country related to the AUKUS partnership.</text>
                            </paragraph>
 </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFE7F9D9593C04D4E97CE5C7A6C2129F3"><enum>(c)</enum><header>International narcotics and law enforcement training</header><text display-inline="yes-display-inline">Section 708 (<external-xref legal-doc="usc" parsable-cite="usc/22/4028">22 U.S.C. 4028</external-xref>), as amended by subsection (b), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H23E13EEF06C644C980B1D42167E95157" display-inline="no-display-inline"><subsection id="H236DCD7E071A4C499CAA283D4B043338"><enum>(g)</enum><header>International narcotics and law enforcement training</header><paragraph id="H90F0DA23B0524D6BB93462925EEA4DB1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Assistant Secretary for International Narcotics and Law Enforcement Affairs (INL) and such other officials as the Secretary considers appropriate, may establish training courses on—</text><subparagraph id="HBC950D099ED243DFA1E2BE0F6CE798F0"> <enum>(A)</enum> <text>international narcotics control, including the mechanisms, legal authorities, and programmatic requirements applicable to assistance provided under INL’s statutory authorities relating to international narcotics control and law enforcement assistance;</text>
 </subparagraph><subparagraph id="H3D8100E2548C4AA9BECEBB0E3E0E5B76"><enum>(B)</enum><text>international law enforcement cooperation, including the use of bilateral and multilateral legal assistance frameworks;</text></subparagraph><subparagraph id="H2780A08E3A434AE9AAB21295F9F415EB"><enum>(C)</enum><text>countering transnational organized crime, money laundering, and other tools of illicit finance; and</text></subparagraph><subparagraph id="HB797324CF13A4809825D6AEDB9C1E60A"><enum>(D)</enum><text>anti-corruption efforts, including most effective methods of countering corruption and promoting the rule-of-law abroad.</text></subparagraph></paragraph><paragraph id="HA6E3D7B17A4645EC918E56004EC1B98C"><enum>(2)</enum><header>Required training</header><text>Any member of the Service who is directly responsible for the administration, oversight, or management of assistance described in paragraph (1)(A) should receive training in the areas described in paragraph (1) prior to the beginning of service in such assignment or, if receiving such training prior to the beginning of service is not practicable, not later than one year after beginning such assignment.</text></paragraph><paragraph id="HF958684437F7422BBCAECDF666353D09"><enum>(3)</enum><header>Consultation</header><text>In developing the curriculum required under paragraph (1), the Secretary shall consult with—</text><subparagraph id="HEF1BE4FD7C784DE7A86B73A44DF15B19"><enum>(A)</enum><text>the Bureau of International Narcotics and Law Enforcement Affairs;</text></subparagraph><subparagraph id="HE039BE5AFDEF4F6CA6F215C2DC3F803A"><enum>(B)</enum><text>the Office of the Legal Adviser; and</text></subparagraph><subparagraph id="H959A7B514710427FB4EADFEBE68BF77F"><enum>(C)</enum><text>other relevant bureaus and offices of the Department as the Secretary determines appropriate.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H96044FF2C2CF4DFC9B2E89FEA3FB9820"><enum>(d)</enum><header>Foreign scam syndicates training</header><text display-inline="yes-display-inline">Section 708 (<external-xref legal-doc="usc" parsable-cite="usc/22/4028">22 U.S.C. 4028</external-xref>), as amended by subsections (b) and (c), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HEEB59561A4B942ABB8637A615B825391" display-inline="no-display-inline"><subsection id="H6283043549D542E2AA1B709D851BF9A6"><enum>(h)</enum><header>Foreign scam syndicates training</header><paragraph id="HD1F465F785AE409395F4D91705BF1ED9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may establish training for chiefs of mission, deputy chiefs of mission, and Foreign Service officers who will be assigned to a country that, as determined by the Secretary, is home to significant online scam activity targeting Americans, on appropriate training on matters related to online scam activity.</text></paragraph><paragraph id="H37C558FF51DF422EA38CFA377DAD52F2"><enum>(2)</enum><header>Matters to be included</header><text>The training required under paragraph (1)—</text><subparagraph id="HF38099DF179941C9BFDC01312F867665"><enum>(A)</enum><text>should address—</text><clause id="H814FDDFA552949E1829EE61B151F68EE"><enum>(i)</enum><text>transnational criminal organizations conducting the scams;</text></clause><clause id="HEB27253D8C4340279EFBAD3C47CC9DA8"><enum>(ii)</enum><text>online scam centers and human trafficking inside such centers; and</text></clause><clause id="H56A702A8D97E43A9A8B378ED28570307"><enum>(iii)</enum><text>foreign government complicity and corruption; and</text></clause></subparagraph><subparagraph id="H61CBE07A070044FCA40AD6E6DE50EF35"><enum>(B)</enum><text>should identify diplomatic methods to identify, prevent, and respond to such activities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H013F2EA4B95D4BECB56ABDBDC25257F8"><enum>(e)</enum><header>Training for chiefs of mission on defense cooperation authorities</header><text>Section 708 (<external-xref legal-doc="usc" parsable-cite="usc/22/4028">22 U.S.C. 4028</external-xref>), as amended by subsections (b), (c), and (d), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H566ACC3600EA41F382BD1E18905CAF42" display-inline="no-display-inline"><subsection id="H519CA9AC5295414AB670453DCE6AA5B1"><enum>(i)</enum><header>Training for chiefs of mission on defense cooperation authorities</header><paragraph id="HE78314A8F2E14E5698BC7CDD41D7D613"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a training course for chiefs of mission on the authorities, requirements, and limitations applicable to defense cooperation programs that do not fall under the authority of the chief of mission.</text></paragraph><paragraph id="H28C42EA282D249B4BE235A2CCB65D6AF"><enum>(2)</enum><header>Matters to be included</header><text>The training course required under paragraph (1) shall include instruction on—</text><subparagraph id="HA4A62A05C5F64A5DA307932A2EA49A41"><enum>(A)</enum><text>the role of the chief of mission in providing concurrence for programs conducted under the authorities described in paragraph (1), including the scope of the chief of mission’s role and procedures to request information from the Department of Defense prior to providing or withholding such concurrence;</text></subparagraph><subparagraph id="HB25B1C2C62CB413999B6808C2FAC3370"><enum>(B)</enum><text>the foreign policy implications of defense cooperation programs, including risks of mission creep and adverse effects on bilateral relationships; and</text></subparagraph><subparagraph id="H48DC7D6CF2314294BDCC9764A8A46FE5"><enum>(C)</enum><text>the relationship between defense cooperation programs and the chief of mission’s responsibility for the direction, coordination, and supervision of all United States Government Executive branch activities, operations, and employees in the country to which such chief of mission exercises authority, pursuant to section 207.</text></subparagraph></paragraph><paragraph id="H4B62E3C8B6FA4174B3188691D62D075E"><enum>(3)</enum><header>Pre-assignment training</header><text>Any chief of mission assigned to a post at which a defense cooperation program described in paragraph (1) is in effect or proposed, as determined by the Secretary, should complete the training course established under paragraph (1) prior to the beginning of service at such post or, if completing such training prior to the beginning of service is not practicable, not later than 180 days after beginning such service.</text></paragraph><paragraph id="H777277A54976485EBAEEC752FA944D46"><enum>(4)</enum><header>Consultation</header><text>In developing the curriculum required under paragraph (2), the Secretary shall consult with—</text><subparagraph id="H0FE79283BBA3447D9778BFDCE394FB78"><enum>(A)</enum><text>the Office of the Legal Adviser of the Department;</text></subparagraph><subparagraph id="H5DF1B33FEB454E5DBB41A47D923D8502"><enum>(B)</enum><text>the Bureau of Political-Military Affairs of the Department; and</text></subparagraph><subparagraph id="HA431473E94C74018B9751763CE1D3B1D"><enum>(C)</enum><text>other offices and bureaus of the Department, as appropriate.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3B62F82F11FB498A98137624C540D4E7"><enum>(f)</enum><header>Clerical amendment</header><text>The table of contents in section 2 is amended by inserting after the item relating to section 707 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9826866BC75E43CCAA9746944F8E7972"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 708. and</text></subparagraph><subparagraph id="H10B649C92399472995F672810F78669B"><enum>(C)</enum><text>shall be a mandatory and institutionalized component of Service career development.</text></subparagraph></paragraph></subsection><subsection id="H571C77814984437A88577431B137E3D1"><enum>(b)</enum><header>Protected training periods</header><paragraph id="HB444CE0C04A5417C85D96C858895E4D7"><enum>(1)</enum><header>In general</header><text>The Secretary shall ensure that protected training periods are built into the assignment and promotion cycle of members of the Service to permit completion of required training.</text></paragraph><paragraph id="H4DB6CB4CCA314586A47FE4A9A500A1A2"><enum>(2)</enum><header>Matters to be included</header><text>Protected training periods required by paragraph (1)—</text><subparagraph id="HBA7C0B8B8297481B81B77C70D2B69277"><enum>(A)</enum><text>shall be treated as a standard component of service;</text></subparagraph><subparagraph id="H4655298C0BAC4DCAB0CADBE43449A469"><enum>(B)</enum><text>shall not be contingent solely upon post-level staffing flexibility; and</text></subparagraph><subparagraph id="H71A62B335C884F1FB072A8DAB1D66177"><enum>(C)</enum><text>shall be structured to ensure that operational demands do not routinely preclude required training.</text></subparagraph></paragraph><paragraph id="H9D71E75B08714F8986A46A13408E869E"><enum>(3)</enum><header>Coordination</header><text>The Department shall plan workforce and assignment cycles to accommodate protected training periods required by paragraph (1) in a manner comparable to professional military education models within the Armed Forces.</text></paragraph></subsection><subsection id="H8FE78804192243D9A004308686F7FE3F"><enum>(c)</enum><header>Scope of training</header><text display-inline="yes-display-inline">Training under the structured training framework established under subsection (a) and protected training periods under subsection (b) may include instruction in—</text><paragraph id="H9FFDC0AAB4A74465B902BDA1230BA28F"><enum>(1)</enum><text>national security, diplomatic security, and counterintelligence;</text></paragraph><paragraph id="H6F582500DEBC4D6490E7420B290E0BAB"><enum>(2)</enum><text>cybersecurity, emerging technologies, and artificial intelligence;</text></paragraph><paragraph id="HBA52282417E24504907D2D93C9275218"><enum>(3)</enum><text>economic statecraft, sanctions, export controls, and trade policy;</text></paragraph><paragraph id="HD44D0EA6B78D40639CFCFB643880678A"><enum>(4)</enum><text>energy security and strategic resources;</text></paragraph><paragraph id="H3920381C03B4441F8B8C2F671288A6C5"><enum>(5)</enum><text>interagency coordination and crisis response;</text></paragraph><paragraph id="H87A09FFA4E304E3FB007666FEF09F262"><enum>(6)</enum><text>Fellowship opportunity outside of the Department;</text></paragraph><paragraph id="HD483BBCEA6EA497CA3103C8946BBBA6C"><enum>(7)</enum><text>leadership and management; and</text></paragraph><paragraph id="H22A01BFC35A247C1A95CC68E2B0FC662"><enum>(8)</enum><text>such other subjects as the Secretary determines appropriate.</text></paragraph></subsection><subsection id="H4120A1030BF74D54B5559886487FCA76" commented="no"><enum>(d)</enum><header>Career stage training</header><text display-inline="yes-display-inline">Training under the structured training framework established under subsection (a) and protected training periods under subsection (b) may include instruction in the following:</text><paragraph id="HBB3ABDD56A714073B332692446F137B5" commented="no"><enum>(1)</enum><text>Entry-level: cohesion and rotations.</text></paragraph><paragraph id="HA0F14DBBE1194B18B63BE8140946F683" commented="no"><enum>(2)</enum><text>Mid-level: leadership and interagency exposure.</text></paragraph><paragraph id="H27D311AD7BFD44E4958432990D117CF3" commented="no"><enum>(3)</enum><text>Pre-senior: professional development tours.</text></paragraph><paragraph id="HB4142588948D447A82D06D98E6B22689" commented="no"><enum>(4)</enum><text>Senior: capstone training.</text></paragraph></subsection><subsection id="H78D8EC3295614A518B70144BFA539362"><enum>(e)</enum><header>Evaluation metrics</header><text display-inline="yes-display-inline">The Secretary—</text><paragraph id="HA0C491CE44BB4DB9B6A9C8DEB770DC87"><enum>(1)</enum><text>shall establish metrics for evaluating the completion and effectiveness of training under the structured training framework established under subsection (a) and protected training periods under subsection (b); and</text></paragraph><paragraph id="H7B3F7902829545BC8E241B311FFCFC47"><enum>(2)</enum><text>shall ensure that instructors of such training certify such training for members of the Service upon satisfactory completion of such training.</text></paragraph></subsection><subsection id="HA93AAAEB97464086A836E0A48E7B4A0F" commented="no"><enum>(f)</enum><header>Strategic planning training</header><text>Establish National Foreign Affairs Training Center curriculum within one year including best practices, challenges, and simulations.</text></subsection><subsection id="HB6979F306E66441CBAD58BEFC405A471"><enum>(g)</enum><header>Periodic review and update</header><text display-inline="yes-display-inline">The Secretary shall periodically review and update requirements for training under the structured training framework established under subsection (a) and protected training periods under subsection (b) every four years to ensure responsiveness to changes in the global operating environment.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H85154C0B1C75419ABBB4AC1CC1C0190A"><enum>(b)</enum><header>Promotion eligibility and training requirement</header><text>Section 601(c) (<external-xref legal-doc="usc" parsable-cite="usc/22/4001">22 U.S.C. 4001(c)</external-xref>), as amended by section 501, is further amended by adding at the following:</text><quoted-block style="OLC" id="HA2C729E377A0495692D68D6B7A81700A" display-inline="no-display-inline"><paragraph id="H03285532299E47BF90A171D613669A6C"><enum>(8)</enum><header>Promotion eligibility and training requirement</header><subparagraph id="HE0919013E3854959891300B27930CB99"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A member of the Service shall not be eligible for promotion to any class above FS–03 or into the Senior Foreign Service unless—</text><clause id="H2C62EB5B31AA45FC8BB5663FFD635BA7"><enum>(i)</enum><text>the member has completed the applicable training requirements established under section 710; and</text></clause><clause id="H9C9B1213487E47E3A1292DCD762609E6"><enum>(ii)</enum><text>the completion of such training requirements is certified by the Director General of the Service prior to consideration by a promotion board with respect to the proposed promotion.</text></clause></subparagraph><subparagraph id="H6520685E816F4D478CE7D4CEECB74DDD"><enum>(B)</enum><header>Waiver authority</header><text>The Secretary may waive the requirements of subparagraph (A) with respect to a member of the Service in the case of extraordinary circumstances if the Secretary approves such waiver in writing. The Secretary may not delegate the waiver authority under this subparagraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0BCF82C3D7EA450DA95CC1966513C0C7"><enum>610.</enum><header>Leadership training</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608 and 609, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H7721AB54F3594D49AE1369B9AC7BF56E" display-inline="no-display-inline"><section id="H39E47C5B4EDF42D093C510F25B4A393C"><enum>711.</enum><header>Leadership training</header><subsection id="HC9738A27065B4C21AEB3F30B78E93346"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text><paragraph id="HE6A720AF56A84A22AE0BA088A665C9A4"><enum>(1)</enum><text>effective leadership, including the management of personnel and resources, is essential to the execution of United States foreign policy and the management of United States missions abroad;</text></paragraph><paragraph id="HC5EBDFC54AB644AB96E62910975065AB"><enum>(2)</enum><text>Foreign Service Officers frequently assume supervisory and managerial responsibilities in complex, high-risk environments; and</text></paragraph><paragraph id="H4C2CEF7959934AB58EE07BF99AACE30A"><enum>(3)</enum><text>mandatory leadership and management preparation enhances mission performance, accountability, workforce morale, and the responsible stewardship of public resources.</text></paragraph></subsection><subsection id="H6FDF013B0F1947CE9B5E9FBC05025273"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Members of the Service shall receive appropriate and comprehensive leadership training, including personnel and resource management, prior to assuming a leadership assignment, including any Service position of a duration of not less than one month that includes supervisory, managerial, executive, or chief-of-section authority over not fewer than one United States Government employee, eligible family member employed at the mission, or locally employed staff person.</text></subsection><subsection id="HF76BFAF5F2844F01A29ED8D580D50AA1"><enum>(c)</enum><header>Requirement</header><text>A member of the Service may not assume a leadership position as described in subsection (b) unless such a member has successfully completed the leadership and management training required under subsection (d) within the preceding three years.</text></subsection><subsection id="HCAB8F373DBB8413AA1361353E2CF2870"><enum>(d)</enum><header>Leadership and management training</header><paragraph id="H5BE64D31C9E24D3FA9ACBAD0EA0F11D6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the National Foreign Affairs Training Center, shall establish a curriculum for tiered joint leadership and management training requirements appropriate to—</text><subparagraph id="HB8ABA707CA6D4C1FB8A3F7F3DE1E5DB7"><enum>(A)</enum><text>first-time supervisors;</text></subparagraph><subparagraph id="H249C97538BFB4E6E9B740C4AE5F9B8E1"><enum>(B)</enum><text>mid-level managers;</text></subparagraph><subparagraph id="HAC2E22DF90E846C488397BDE38F44E03"><enum>(C)</enum><text>senior leaders, including Deputy Chiefs of Mission, Chiefs of Mission, and Principal Officers; and</text></subparagraph><subparagraph id="H8BD516A05A06416ABC5E11CDABD17F03"><enum>(D)</enum><text>any other category the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="HE07CB52E6AB445C08F346FB2CCDD846F"><enum>(2)</enum><header>Duration</header><text>The leadership and management training required under paragraph (1) shall, at minimum, consist of at least one month of training per tier.</text></paragraph><paragraph id="H2E377D8246E444FABABDB59149715DBD"><enum>(3)</enum><header>Frequency and capacity</header><text display-inline="yes-display-inline">The Secretary shall ensure that leadership and management training required under paragraph (1) is made available with sufficient frequency and capacity to prevent undue delay in assignments.</text></paragraph></subsection><subsection id="HB1D78A5FBB80424D9876541F82C24263"><enum>(e)</enum><header>Waiver authority</header><paragraph id="H65631C4A33C646BA951226DE062C0E8B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may waive the leadership and management training required under subsection (d) on a temporary basis in emergent circumstances where a member of the Service must assume a supervisory, managerial, or leadership position immediately to ensure continuity of operations.</text></paragraph><paragraph id="HA7A741493D214575B392752D57A20580"><enum>(2)</enum><header>Short-term waiver</header><text>A waiver issued under paragraph (1) may permit a member of the Service to serve in a position described in paragraph (1) for a period not to exceed 30 days without having completed the required training.</text></paragraph><paragraph id="HCA26E6055D7141158392D9D2323D70E8"><enum>(3)</enum><header>Extended temporary service</header><text>In cases in which a member of the Service is expected to serve in a position described in paragraph (1) for a period exceeding 30 days, the chief of mission and the Director General of the Service shall coordinate to ensure that the member is scheduled to complete the required training for the position within a reasonable amount of time, not to exceed the date that is 60 days after the date on which the member assumes such position.</text></paragraph><paragraph id="HBCEF73ABE2A248B8B9054D00E3A41C93"><enum>(4)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">Not later than 15 days after issuing a waiver under paragraph (1), the Secretary shall notify the appropriate congressional committees of such waiver, including the justification for the waiver and the expected duration of the assignment.</text></paragraph></subsection><subsection id="H37FF134C51C24AFF809D51D8013EDDB5" commented="no"><enum>(f)</enum><header>Sunset</header><text display-inline="yes-display-inline">This section shall take effect on the date that is 180 days after the enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H109D112ED56E47D6AC845C9A2E10A2CB"><enum>611.</enum><header>Training relating to critical minerals</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, and 610, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H8D5C5518C0D8419D89CB26053A3D0F0B" display-inline="no-display-inline"><section id="H3DF42CCC4EF6447F83D4656FBB112715"><enum>712.</enum><header>Training relating to critical minerals</header><subsection id="H1CEC058B49564227ADAD1CE2A7675F45"><enum>(a)</enum><header>People’s Republic of China</header><paragraph id="H490417DAA08E4FCF9447E09B596901F9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Under Secretary for Economic Affairs and the Director of the George P. Shultz National Foreign Affairs Training Center, shall establish an academic program focused on global supply chains and their relation to strategic competition with the People’s Republic of China.</text></paragraph><paragraph id="H470E1C3D67AC49788A50FFF13CAC9B73"><enum>(2)</enum><header>Training requirements</header><text>The academic program established under paragraph (1) shall be mandatory for—</text><subparagraph id="H084B800F9EA3433EBCCCDC8FA011429D"><enum>(A)</enum><text>entry-level Service officers identified as Economic Officers prior to the end of the second tour in the Department; and</text></subparagraph><subparagraph id="H0527D520A9874D84BEA7B6DBA55EDC1B"><enum>(B)</enum><text>Service officers identified as Economic Officers prior to deployment at a United States presence post abroad to fill a billet where the primary focus of the portfolio will be critical minerals or energy.</text></subparagraph></paragraph><paragraph id="H32436FA9DD46440898BCA4C03454CF4E"><enum>(3)</enum><header>Contents</header><text>The academic program established under paragraph (1) shall include the following:</text><subparagraph id="H931FC06D98A347079B5F18B2734D6374"><enum>(A)</enum><text>Instruction on international documents, treaties, and agreements relevant to global energy and critical mineral supply chains.</text></subparagraph><subparagraph id="HE759BC698CFB4020AB02EE7FD0F7F8BD"><enum>(B)</enum><text>United States Government policies and strategies for mitigating vulnerabilities in global supply chains.</text></subparagraph><subparagraph id="H63B07A50B1D74620A5003E9667CB650F"><enum>(C)</enum><text>Basic geological knowledge about critical minerals.</text></subparagraph><subparagraph id="H10F97F44B8904320832D66CA5CCAEB51"><enum>(D)</enum><text>Analysis of the effects of strategic competition, including with the People’s Republic of China, on United States interests.</text></subparagraph><subparagraph id="HD668938994044D20AF28D30EA3F78B5A"><enum>(E)</enum><text>Regional- and country-specific instruction tailored to the resources, economy, and international trade relationships of the receiving country.</text></subparagraph><subparagraph id="H62C09B6261A449E6B31427AB5EE3A18F"><enum>(F)</enum><text>Practical guidance for officers to advance United States foreign policy objectives in diplomacy, trade negotiations, multilateral forums, and crisis scenarios related to supply chains.</text></subparagraph><subparagraph id="H6C23E408BEE6446DA85083D591A82EB8"><enum>(G)</enum><text>Specialized training related to critical minerals as described in subsection (b).</text></subparagraph></paragraph></subsection><subsection id="H0ACEDCE799F54110B8AF81AFFA8E9E2C"> <enum>(b)</enum> <header>Critical mineral-Specific training relating to certain other countries</header> <paragraph id="H042B5F74B14D441A9B09619810B775D2"> <enum>(1)</enum> <header>In general</header> <text>The Secretary shall require specialized training on critical minerals for Service officers identified as Economic Officers prior to deployment to United States presence posts in countries that—</text>

                                    <enum>(A)</enum>
 <text>produce, process, refine, or export significant quantities of critical minerals;</text>
                                </subparagraph>
                                <subparagraph id="HE84279D8A7724B17B15EF762B3B69CAB">
                                    <enum>(B)</enum>
 <text>host critical mineral reserves of strategic importance to the United States; or</text>
                                </subparagraph>
                                <subparagraph id="HC4279BD11F1A4917BFE9CC5359755ACE">
                                    <enum>(C)</enum>
 <text>play a significant role in global critical mineral supply chains, including through transportation, processing, or downstream manufacturing.</text>
                                </subparagraph>

 </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HAE96DA10C83D4A87B38C230585B5F5E2"><enum>612.</enum><header>Training at consular posts</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, and 611, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H49273018232B4DE79E7B823345881AC7" display-inline="no-display-inline"><section id="HACC928FD86904A8088FCF16AEC2E0D2E"><enum>713.</enum><header>Training at consular posts</header><subsection id="HE406D213A8E54DC39B3B4BDD6A32A1FA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall require that each Service officer, including temporary duty assignments and permanent change of stations, assigned to perform consular duties complete mandatory, post-specific consular training—</text><paragraph id="H6B3E51477FB24293A01C5537A5495E89"><enum>(1)</enum><text>upon arrival at post, conducted concurrently with the performance of official duties through supervised, on-the-job, and practical instruction, and building upon the consular training received prior to departure to such post; and</text></paragraph><paragraph id="H58A3B3B7622144EB81BC37E3552B521F"><enum>(2)</enum><text>before independently adjudicating visas, or otherwise performing services for United States citizens.</text></paragraph></subsection><subsection id="H96A2689851F641DF83B25AAEDD612FCE"><enum>(b)</enum><header>Training requirement</header><text>The training required under subsection (a) shall—</text><paragraph id="H4FF2DD81B7D14D7F908CAED54534A60C"><enum>(1)</enum><text>be conducted at post;</text></paragraph><paragraph id="H898901A42CBF47C9958EA76669E090A3"><enum>(2)</enum><text>have a duration of not less than four weeks, unless shortened by the Secretary based on demonstrated prior experience or exigent operational needs;</text></paragraph><paragraph id="HFF40A73A2FC14C239C02FBCA1418D116"><enum>(3)</enum><text>be completed under the supervision of experienced consular officers designated by the chief of mission or principal officer;</text></paragraph><paragraph id="H450B455E90794C42AC384AA41F9A7B98"><enum>(4)</enum><text>be documented as part of the officer’s official training and assignment record; and</text></paragraph><paragraph id="H9974CBFEE0E54226AB2268472CB0532F"><enum>(5)</enum><text display-inline="yes-display-inline">be conducted by an individual at post with an equivalent or superior rank or responsibility level as the officer.</text></paragraph></subsection><subsection id="H3CB7937671714E78AADDF66E158C6E19"><enum>(c)</enum><header>Training content</header><text>The required training shall include instruction and supervised practice in—</text><paragraph id="H15E9FD0EB26B42B4A5CFCE96E7EFC152"><enum>(1)</enum><text>country- and post-specific visa adjudication trends, risks, and fraud patterns;</text></paragraph><paragraph id="H2295A30DB96048179BD09602E20A258B"><enum>(2)</enum><text>applicable immigration law, regulations, and Department guidance as applied at post;</text></paragraph><paragraph id="HB4C27FBFF1D84AACBB0BB93EFEFA49BB"><enum>(3)</enum><text>local processing procedures and workflow;</text></paragraph><paragraph id="H7E424A467158489D92FFC9219DF800E0"><enum>(4)</enum><text>use of consular information systems;</text></paragraph><paragraph id="HDF60D2A0946640C1BDDECDFA02007832"><enum>(5)</enum><text>coordination with locally employed staff and relevant host-nation entities;</text></paragraph><paragraph id="H4C294DCEB6C14F09848A6CA047A30399"><enum>(6)</enum><text>national security screening considerations; and</text></paragraph><paragraph id="H80B22B857F034C26B108B29B1BBA53CC"><enum>(7)</enum><text>quality assurance and error prevention measures.</text></paragraph></subsection><subsection id="H5EB3E28C59ED4F35B20413EE8A982CA4"><enum>(d)</enum><header>Limitation on independent adjudication</header><text>A Service officer may not independently adjudicate visas or perform unsupervised consular functions until the officer has—</text><paragraph id="H8032155506CB489F9B28BC5392F40B0C"><enum>(1)</enum><text>completed the training required under subsection (b); or</text></paragraph><paragraph id="HFA0C40AA78D1452A87A712917D61C808"><enum>(2)</enum><text>received a written waiver from the chief of mission or principal officer based on prior consular experience and demonstrated proficiency.</text></paragraph></subsection><subsection id="HE020B8834B9D43228BC472393F9A0156"><enum>(e)</enum><header>Responsibilities</header><paragraph id="HC5F90C048A1149D1A11483307208A242"><enum>(1)</enum><header>Chiefs of mission and principal officers</header><text display-inline="yes-display-inline">Chiefs of mission and Principal officers shall ensure compliance with the training requirements of this section at post.</text></paragraph><paragraph id="HAD00086D45DA442E8F9F16638E9560DA"><enum>(2)</enum><header>Consular section leadership</header><text display-inline="yes-display-inline">Consular Section Leadership shall develop, maintain and update as necessary post-specific training plans of this section consistent with Department standards.</text></paragraph><paragraph id="H50CDCA2B79BE4117BE841979E57F30ED"><enum>(3)</enum><header>Secretary</header><text>The Secretary shall issue Department-wide guidance to standardize minimum expectations with respect to training under this section and provide for post-level flexibility.</text></paragraph></subsection><subsection id="H1179979E757844CDB79ED721F3AD8E2E"><enum>(f)</enum><header>Performance and workload considerations</header><text>The time spent by a Service officer in required post-specific consular training—</text><paragraph id="H4541036738E54DA1AB5B95339F848D58"><enum>(1)</enum><text>shall be considered official duty time; and</text></paragraph><paragraph id="HBB378906010543ECB8040BB84C2CEC65"><enum>(2)</enum><text>shall not be treated as a negative factor in performance evaluations.</text></paragraph></subsection><subsection id="H481056AE52F1428B860A2CC2F3496610"><enum>(g)</enum><header>Oversight</header><text>The Secretary—</text><paragraph id="H32D6192B812F4605993F583617667328"><enum>(1)</enum><text>shall periodically review compliance with the requirements of this section; and</text></paragraph><paragraph id="H550FD9C26F0347909DB779C3F72EDB75"><enum>(2)</enum><text>may take corrective action in cases in which training requirements are not being adequately implemented.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC2D94A30F6F043F9AC345832360C1425"><enum>613.</enum><header>Strengthening diplomatic security training standards</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, 611, and 612, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HC98F9C70854647E9A38849903E5D08E6" display-inline="no-display-inline"><section id="H922CA54F4BF14C20B21DA8CEDE8DEBF5"><enum>714.</enum><header>Strengthening diplomatic security training standards</header><subsection id="H3B193839E8734C7EB71C671FDCABBB35"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State, acting through the Director of the National Foreign Affairs Training Center, shall establish and maintain Department-wide standards for diplomatic security training to ensure such training is mission-relevant, integrated across threat vectors, and responsive to evolving risk environments.</text></subsection><subsection id="HED2B620538794B019E247EA7E044CDEE"><enum>(b)</enum><header>Required elements</header><text>The training standards established pursuant to subsection (a) shall—</text><paragraph id="H13D83944C8B640BDB35882B482EAA0E1"><enum>(1)</enum><text display-inline="yes-display-inline">integrate physical security, counterintelligence, cybersecurity, technical security and countersurveillance, legal and use of force requirements, and fraud-related threats into a unified training framework;</text></paragraph><paragraph id="H9940F4122D2B40F4A055473357449B48"><enum>(2)</enum><text>incorporate post-specific risk factors, including high-risk, high-threat environments;</text></paragraph><paragraph id="H2B180B571747430EB39E9E4810468EB5"><enum>(3)</enum><text>ensure consistency in training quality and requirements across bureaus, posts, and personnel categories; and</text></paragraph><paragraph id="H7FFC5119836D495F85AE2114C528289F"><enum>(4)</enum><text>be reviewed and updated not less frequently than once every three years.</text></paragraph></subsection><subsection id="H7C9CBE98797C4089A6A5BDCCDC207D2B"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall ensure that the Bureau of Diplomatic Security, the Bureau of Diplomatic Technology, the National Foreign Affairs Training Center, and other relevant bureaus of the Department coordinate in the establishment and implementation of training standards under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H18525759BE8540DCA7A6F9FD45F4865A" commented="no"><enum>614.</enum><header>Mandatory crisis leadership and emergency management training program for senior personnel</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, 611, 612, and 613, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H937DD8CC11CE4A1ABEA478F16FC466FA" display-inline="no-display-inline"><section id="HBB3C78F81B394580AE9456E0DCE6171D"><enum>715</enum><header>Mandatory crisis leadership and emergency management training program for senior personnel</header><subsection id="HE2AD93FCEC054368B67CB1633F36517E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish and implement a mandatory crisis leadership and emergency management training program for members of the Service assigned to senior leadership positions at United States diplomatic and consular posts.</text></subsection><subsection id="H8211151B0E7D4F9399C5F1C300EFD58D"><enum>(b)</enum><header>Covered positions</header><text>The training program required by subsection (a) applies to—</text><paragraph id="HFDF76B62AAE0493F917DE534AA6DD83B"><enum>(1)</enum><text>chiefs of mission;</text></paragraph><paragraph id="H35DD2E769C864C49BE61470F45976702"><enum>(2)</enum><text>deputy chiefs of mission;</text></paragraph><paragraph id="H556774C3C3E54D7A85DDFC071F10FF34"><enum>(3)</enum><text>principal officers; and</text></paragraph><paragraph id="HE9657B1911E74AD88A0E24AC86821405"><enum>(4)</enum><text>such other senior positions as the Secretary may designate.</text></paragraph></subsection><subsection id="HE7DB1BE66A83491F92E9F5FE1C3676EA"><enum>(c)</enum><header>Condition of assignment</header><paragraph id="HC2B21E89F37C4A6FACE35AA35025306E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an individual may not be assigned to a position described in subsection (b) unless the individual has successfully completed the training required under this section.</text></paragraph><paragraph id="H86ED973F55224E83A54689874895C111"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the requirement under paragraph (1) on a case-by-case basis in exigent circumstances, except that an individual granted such a waiver shall complete the required training as soon as practicable after assignment.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1E3B204C2E2C438A93173C79EAA73AD6" commented="no"><enum>615.</enum><header>Cybersecurity, technology, and artificial intelligence training</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, 611, 612, 613, and 614, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H2ABEE4EF463442B895F3E3CDE1ADAF65" display-inline="no-display-inline"><section id="HD94F94F91D0C4761B4B37E19603CF1FD"><enum>716.</enum><header>Cybersecurity, technology, and artificial intelligence training</header><subsection id="H85B21A16DBDF495DA67F92875989D83F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall require each member of the Service, including a career member, a career candidate, a non-career appointee, a chief of mission, and a deputy chief of mission, to complete, on an annual basis, training on cybersecurity, technology use, and artificial intelligence governance.</text></subsection><subsection id="H523A013A5F85425A8CF36552D9EAA50E"> <enum>(b)</enum> <header>Matters To be included</header> <text>The training required under subsection (a) shall include, at a minimum—</text>

                                <enum>(1)</enum>
 <text>cybersecurity hygiene and threat awareness;</text> </paragraph> <paragraph id="H2EB5E40569AA4B2FA95C127B32C6B8DC"> <enum>(2)</enum> <text>phishing, social engineering, and insider threat risks;</text>
                            </paragraph>
                            <paragraph id="H599374BADFE5402BB89F48B1AD3B761E">
                                <enum>(3)</enum>
 <text>safeguarding classified information and sensitive but unclassified information;</text>
                            </paragraph>
                            <paragraph id="HE6C8486E30474ABD9641CDEB023E358D">
                                <enum>(4)</enum>
 <text>secure handling, storage, and transportation of Government-issued hardware and electronic devices, including while assigned to a post abroad;</text>
                            </paragraph>
                            <paragraph id="H2DB98FA901764AEC85DECAA754465039">
                                <enum>(5)</enum>
 <text>requirements for the use of Department-approved software, cloud systems, and collaboration platforms;</text>
                            </paragraph>
                            <paragraph id="HEBD094B1324F425DAFBF47589C5E8FF4">
                                <enum>(6)</enum>
 <text>risks associated with the use of personal devices, removable media, and foreign telecommunications networks;</text>
                            </paragraph>
                            <paragraph id="H5C709BBF82304B5D964CD7CED2634DFC">
                                <enum>(7)</enum>
 <text>reporting requirements for a suspected cyber incident or technology compromise;</text>
                            </paragraph>
                            <paragraph id="H4A02DC2B1B564779A277E9DAFEB12480">
                                <enum>(8)</enum>
 <text>responsible use, security implications, and data protection requirements relating to artificial intelligence systems and automated tools;</text>
                            </paragraph>
                            <paragraph id="HBE9A69438F744F45A6DBA36AEB9240B1">
                                <enum>(9)</enum>
 <text>semiconductor supply chain security, technology dependency risks, and foreign sourcing vulnerabilities relevant to diplomatic operations and national security; and</text>
                            </paragraph>
                            <paragraph id="H31D6C8282265462AACB979D4D7B7EA77">
                                <enum>(10)</enum>
 <text>responsibilities of personnel under Department cybersecurity, technology management, and artificial intelligence governance policies.</text>
                            </paragraph>
                        </subsection><subsection id="H3F3FF3E5874C41A7B37CEE89FDF42F81">
                            <enum>(c)</enum>
                            <header>Role-Specific and advanced training</header>
 <text>The Secretary shall establish enhanced cybersecurity and technology training requirements for—</text>
                            <paragraph id="H777261375EA649DABE804F28FD1701AF">
                                <enum>(1)</enum>
 <text>a chief of mission and a deputy chief of mission, including training on post-level technology risk management and artificial intelligence oversight;</text>
                            </paragraph>
                            <paragraph id="H5D31D9366EE04F6683B15F29F9AE9FE5">
                                <enum>(2)</enum>
 <text>senior bureau leadership, including governance responsibilities and technology risk accountability;</text>
                            </paragraph>
                            <paragraph id="H830DA7E37B744CAA869A0F90A91E692B">
                                <enum>(3)</enum>
 <text>personnel with system administrator or other privileged network access;</text>
                            </paragraph>
                            <paragraph id="HBF8345C8BDAE4C7D88C4E524973E314B">
                                <enum>(4)</enum>
 <text>personnel assigned to a high-risk or high-threat post;</text> </paragraph> <paragraph id="H3A75CF8EEA944D38839C682B130C3100"> <enum>(5)</enum> <text>personnel serving in information technology, cybersecurity, artificial intelligence, data management, or security-related career tracks; and</text>
                            </paragraph>
                            <paragraph id="H3F93D7EA21564170B39F3FDC27D0D2A7">
                                <enum>(6)</enum>
 <text>personnel responsible for the procurement, management, or oversight of an information technology system or an artificial intelligence tool.</text>
                            </paragraph>
                        </subsection><subsection id="H71489115628B4B4293B70E012923C48F">
                            <enum>(d)</enum>
                            <header>Pre-Assignment and device security abroad</header>
 <text>The Secretary shall ensure that a member of the Service assigned to a post abroad receives pre-assignment training on—</text>
                            <paragraph id="HB462D093B46941619289C47F776C192A">
                                <enum>(1)</enum>
 <text>secure device usage in a foreign environment;</text> </paragraph> <paragraph id="HA4F2436E60E64DF89C8335C9B2B70539"> <enum>(2)</enum> <text>counterintelligence risks associated with foreign infrastructure;</text>
                            </paragraph>
                            <paragraph id="HD8A2AC49526740FF8D212C423E8A6C80">
                                <enum>(3)</enum>
 <text>secure communications practices; and</text> </paragraph> <paragraph id="HEC9DDB98DC25451EB59E0ADC803716C0"> <enum>(4)</enum> <text>protection of Government hardware from compromise, tampering, or unauthorized access.</text>
                            </paragraph>
 </subsection><subsection id="H0939AA6705974AD6A5B1E733F6767030"><enum>(e)</enum><header>Integration into career development</header><text>The requirements under this section shall be incorporated into pre-assignment training, leadership training, tradecraft instruction, and professional development programs under this chapter.</text></subsection><subsection id="H312D6767B22A4F9BB5084604BF2211F9"><enum>(f)</enum><header>Compliance and accountability</header><text>The Secretary shall ensure that completion of required training under this section is tracked and recorded and may consider such completion as part of performance evaluations and eligibility for leadership assignments.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8008BE4720AA43018CA9D41A087936C3"><enum>616.</enum><header>Veterans Innovation Partnership Fellowship Program; placement and conversion support</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, 611, 612, 613, 614, and 615, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HE6DA01918E3241FFA5161FD78981BE02" display-inline="no-display-inline"><section id="HFEAAC9776FE145638F3047AE6DD986D2"><enum>717.</enum><header>Veterans Innovation Partnership Fellowship Program; placement and conversion support</header><subsection id="H358F13B16E9D4F35A2AFD65BA0148FCB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish policies and procedures to improve placement and hiring outcomes for participants in the Veterans Innovation Partnership Fellowship, including structured pathways to employment within the Department.</text></subsection><subsection id="HC3E1BE1304954ACFA23BF878FA76C470"><enum>(b)</enum><header>Elements</header><text>The policies and procedures required under subsection (a) should include—</text><paragraph id="HF0DE04A6B68E4838A74478C780D7A140"><enum>(1)</enum><text>designation of a bureau or office responsible for coordinating post-fellowship placement efforts;</text></paragraph><paragraph id="HBD20ADC6CE214DE1BBE4014C379B52BA"><enum>(2)</enum><text>procedures to match a fellow with employment opportunities in the Service, as appropriate;</text></paragraph><paragraph id="H5152EAB1748E4BDFA5D1B0BBB51DB927"><enum>(3)</enum><text>guidance to bureaus on the use of existing hiring authorities to facilitate the conversion of a fellow into a permanent or term position;</text></paragraph><paragraph id="HF8C252A58C6F4C50BC95E5780471CF29"><enum>(4)</enum><text>mentorship and career counseling for a fellow during and after the fellowship period;</text></paragraph><paragraph id="HB2D2E14C988C4B0E9DA8AE71F5A5D0C6"><enum>(5)</enum><text>tracking and evaluation of conversion rates and employment outcomes; and</text></paragraph><paragraph id="H18FD0F61837B4299ACD83434FBDB6A41"><enum>(6)</enum><text>procedures to facilitate placement of a fellow into a position under the Veterans and Foreign Service Pathway Program, where applicable.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H25E30A510D8E4C1CA16BA8B132A20454"><enum>617.</enum><header>Reviews of the Foreign Service career tracks</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, 611, 612, 613, 614, 615, and 616, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H56E951054B444ED392419B840DF5F925" display-inline="no-display-inline"><section id="H64F82E9C2CF5497EB6167BAFD3A4537B"><enum>718.</enum><header>Reviews of the Foreign Service career tracks</header><subsection id="HC677A084752B46E6B0B0509564C8C0E1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall convene an independent commission to review the structure, relevance, and effectiveness of the Service’s career tracks.</text></subsection><subsection id="H20E0869AC28A4A6E8755CC2A68EF7DDB"><enum>(b)</enum><header>Composition</header><paragraph id="HE197AF058F82416EA342C89E0D160BAC"><enum>(1)</enum><header>In general</header><text>The commission shall be composed of individuals who are to be selected from—</text><subparagraph id="HD6757CD38DAC462A9466FA623A7E0935"><enum>(A)</enum><text>the Department, including personnel other than those assigned to the Bureau of Human Resources;</text></subparagraph><subparagraph id="H36844A0F388B4634B64858C9A6F6F34C"><enum>(B)</enum><text>other relevant Federal departments and agencies as the Secretary determines appropriate;</text></subparagraph><subparagraph id="HADDD4FF47DA74449A10DDE6D994AC06F"><enum>(C)</enum><text>former Service officers;</text></subparagraph><subparagraph id="HE62B16592AA14B6392F8A9C89D0E3E88"><enum>(D)</enum><text>academia; and</text></subparagraph><subparagraph id="HDBCE747EAA7F4018872B8B6B1635B047"><enum>(E)</enum><text>the private sector.</text></subparagraph></paragraph><paragraph id="H0616A71E55854DCD87EA0C5A127DD37C"><enum>(2)</enum><header>Congressional selection</header><text display-inline="yes-display-inline">The chair and ranking member of the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate shall each select one individual to be a member of the commission.</text></paragraph><paragraph id="H0F237DD7B7B04534B5DC2204EB14DBE9"><enum>(3)</enum><header>Balanced perspective requirement</header><text>Individuals shall be selected to be members of the commission to ensure a balanced perspective on diplomatic priorities, Department personnel needs, and evolving global challenges.</text></paragraph></subsection><subsection id="H5FDAFF18D26A4D57931B709F9FAB7783"><enum>(c)</enum><header>Scope of review</header><text>The commission shall—</text><paragraph id="H9CD1FE5690694074AC1462A718583A93"><enum>(1)</enum><text>assess the alignment of existing career tracks with current and anticipated United States diplomatic priorities, national security objectives, and global trends;</text></paragraph><paragraph id="H568322C5860A47FAA6DC96EAE835DC2A"> <enum>(2)</enum> <text>evaluate recommendations to add, consolidate, eliminate, modify, or otherwise affect, career tracks of the Service; and</text>
 </paragraph><paragraph id="H8A87311E86234D8AB8BEC042ADE585F0"><enum>(3)</enum><text>consider any other matters related to career track structure, qualifications, standards, assignment processes, promotion precepts, track-specific training, or workforce planning that the commission determined relevant to the effectiveness of the Service.</text></paragraph></subsection><subsection id="HC569E62BCA5E41AEAF9BD4DAA90CB825"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date on which the commission is convened, the commission shall submit to the Secretary, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Foreign Relations of the Senate a report containing—</text><paragraph id="H9BC2F7C18E9F463A83166064100DCCDE"><enum>(1)</enum><text>the findings and assessments under subsection (c);</text></paragraph><paragraph id="HA81A6838551242CE9E0FFE887A33F162"><enum>(2)</enum><text>any recommendations for regulatory, or administrative action to improve the Service; and</text></paragraph><paragraph id="HCEBB6AA2989A411D98BA64C0C9D69CE6"><enum>(3)</enum><text>a description of the composition of the membership of the commission as required by subsection (b).</text></paragraph></subsection><subsection id="HE4A56C5E8D8A4AF6A90A4C88FD0FA616" commented="no"><enum>(e)</enum><header>Inapplicability of other law</header><text display-inline="yes-display-inline">The provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, shall not apply to either the composition or the operation of the Commission.</text></subsection><subsection id="HEB04797CF4C84B5BBC842B59D7117482"><enum>(f)</enum><header>Sunset</header><text>The commission shall terminate on the date that is 30 days after the date on which the report required by subsection (d) has been submitted in accordance with such subsection.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HCACAE9F137994B6FA3DFAA22E3C8E7E5"><enum>618.</enum><header>Integration of Foreign Service recruitment into military transition programs</header><text display-inline="no-display-inline">Chapter 7 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4021">22 U.S.C. 4021 et seq.</external-xref>), as amended by sections 608, 609, 610, 611, 612, 613, 614, 615, 616, and 617, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HB1D8D3506A204FCF9739D76EE8824C58" display-inline="no-display-inline"><section id="HBEEECAC7161041508A23BA18049477FA"><enum>719.</enum><header>Integration of Foreign Service recruitment into military transition programs</header><subsection id="H147415644D854B5290A3C7647D0F9090"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Defense and the Secretary of Veterans Affairs, shall establish a formal recruitment program within military transition programs to support entry into the Service of veterans.</text></subsection><subsection id="HAEB45E6657334F45BEDBFC221D8E04BD"> <enum>(b)</enum> <header>Matters To be included</header> <text>The program required by subsection (a) shall—</text>
                            <paragraph id="H740F2B3C25C0414AAA3FBB0832F47B2F">
                                <enum>(1)</enum>
 <text>provide information, guidance, and preparatory resources to facilitate participation in the Veterans and Foreign Service Pathway Program established under section 313; and</text>
                            </paragraph>
                            <paragraph id="HE305E61A7114422DA75CF10DFB0FFBCD">
                                <enum>(2)</enum>
 <text>support the development of a sustained pipeline of candidates aligned with workforce needs of the Department.</text>
                            </paragraph>
 </subsection><subsection id="H569315CD6001477CB4747354CE5A8027"><enum>(c)</enum><header>Implementation</header><text>In carrying out the program required by subsection (a), the Secretary shall—</text><paragraph id="HC041E3D98FE64158B67953EA21F76DB5"><enum>(1)</enum><text>integrate Service career information, including Diplomatic Security roles, into Transition Assistance Program curriculum and materials;</text></paragraph><paragraph id="H30BDF3A8B02B41199DF6113F2989F22F"><enum>(2)</enum><text>conduct targeted outreach at military installations and transition centers;</text></paragraph><paragraph id="H47D9F8B2DE174A8DACBCB339FD34BAAF"><enum>(3)</enum><text>identify and refer qualified candidates to the program required by subsection (a) and any pilot hiring authority established under section 313; and</text></paragraph><paragraph id="HC9DC8A8DB80E4C0EB5DDACD1472525E7"><enum>(4)</enum><text>provide pre-application guidance and onboarding support to prospective candidates.</text></paragraph></subsection><subsection id="HC0D1A0FBD23341ABB8790B7805F56F41"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to create a separate or noncompetitive hiring process for members of the Armed Forces or veterans.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H95453A4A80A245608C98B9036CBAA9F3"><enum>VII</enum><header>Other matters</header><section id="H9DF967E72664460389249E3F47FA07C0"><enum>701.</enum><header>Tax residency for Foreign Service Officers</header><text display-inline="no-display-inline">Chapter 9 of title I (<external-xref legal-doc="usc" parsable-cite="usc/22/4081">22 U.S.C. 4081 et seq.</external-xref>) is amended by inserting after section 906 the following:</text><quoted-block style="OLC" id="HCD5D6907421646FB8E58A002E97C6F23" display-inline="no-display-inline"><section id="H1C9B90BCA065486A8B35047075CF86BA"><enum>906A.</enum><header>Tax residency for Foreign Service Officers</header><subsection id="H48213BD99DE343EDA25AB20E6AF82BA4"><enum>(a)</enum><header>Preservation of domicile</header><text display-inline="yes-display-inline">A member of the Service shall neither lose nor acquire a residence or domicile for purposes of taxation with respect to the person, personal property, or income of the member solely by reason of being absent from or present in any tax jurisdiction of the United States in compliance with official orders assigning the member to duty.</text></subsection><subsection id="H2F17009403C44C74AE6C67A4DC58C920"><enum>(b)</enum><header>Situs of personal property</header><text>The personal property of a member of the Service shall not be deemed to be located or present in, or to have a situs for taxation in, any jurisdiction in which the member is assigned pursuant to official orders.</text></subsection><subsection id="H4B9CF610A3BE4E3BBCF1F10579CB250A" commented="no"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="H4E574E17B50B46DC894E8C5E3A0F0054" commented="no"><enum>(1)</enum><text>the term <quote>personal property</quote> includes motor vehicles; and</text></paragraph><paragraph id="H565828A0D55E4F249F7D43CB475EF04B" commented="no"><enum>(2)</enum><text>the term <quote>taxation</quote> includes licenses, fees, or excises imposed with respect to motor vehicles and their use, if such license, fee, or excise is paid by the member in the member’s State of domicile or residence.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H4406129EF1864B94850A83A1CF6A18EF"><enum>702.</enum><header>Internships for part-time students</header><text display-inline="no-display-inline">Section 1202(c) (<external-xref legal-doc="usc" parsable-cite="usc/22/4141a">22 U.S.C. 4141a(c)</external-xref>) is amended—</text><paragraph id="H67151F1FB3D44AEFA2DA0066B355775C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>Students enrolled full-time in institutions of higher education</quote> and inserting <quote>Students enrolled, whether full-time or at least half-time, in institutions of higher education,</quote>; and</text></paragraph><paragraph id="H7829199454044932AF2630510802C06A"><enum>(2)</enum><text>by adding at end the following:</text><quoted-block style="OLC" id="HCFEAAB0CD49F4675BAC3779AF2F8ED63" display-inline="no-display-inline"><paragraph id="HBA21174B440F48DF99D0A5D0017147C8"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary shall, to the extent practicable, ensure that recruitment efforts include outreach to potential applicants enrolled at community colleges, vocational or technical institutions, and other nontraditional institutions of higher education.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1ED59416D32F47849E2F6DA95801F749"><enum>703.</enum><header>Diplomatic Reserve Corps Pilot Program</header><subsection id="H44D61E18C69D438AA28122CD4513CFF5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than nine months after the date of the enactment of this Act, the Secretary of State shall establish a Diplomatic Reserve Corps Pilot Program (in this section referred to as the <quote>Pilot Program</quote>) in the Department of State to assess the feasibility and effectiveness of maintaining a reserve cadre of trained personnel available for temporary active service in support of foreign affairs contingencies.</text></subsection><subsection id="HE546AAD4BF624B80A817BB1AA4C16991"><enum>(b)</enum><header>Purpose</header><text>The Pilot Program shall—</text><paragraph id="H61E5352BC7AB4B51A462039EAA6A44E2"><enum>(1)</enum><text>provide a surge workforce to support diplomatic operations during crises, evacuations, armed conflicts, natural disasters, and other contingencies affecting United States interests abroad;</text></paragraph><paragraph id="H6CEDD44964E24A56A75564CA68A00F57"><enum>(2)</enum><text>assess recruitment, training, readiness, deployment, and retention requirements for a permanent Diplomatic Reserve Corps; and</text></paragraph><paragraph id="HB3BC2E5BFEBD49998EB0D31CE8FF5B45"><enum>(3)</enum><text>identify authorities, resources, and organizational structures necessary to sustain such a corps.</text></paragraph></subsection><subsection id="H6A2BB7BC5D4E4C8AA279FB562D2C1766"><enum>(c)</enum><header>Membership</header><text>The Secretary of State may appoint to the Pilot Program retired members of the Foreign Service.</text></subsection><subsection id="HBD409E47EE1F4299AF29E7AC921AA97F"><enum>(d)</enum><header>Initial strength</header><text>The Secretary of State shall recruit and maintain not fewer than 250 members in the Pilot Program during the first year of the Pilot Program and may increase membership by up to 250 additional members annually for the following three fiscal years.</text></subsection><subsection id="H35CBCD43D2AC4BDC8F9C1FE146BDF885"><enum>(e)</enum><header>Reserve Corps structure</header><text>Of the members of the Pilot Program appointed by the Secretary of State pursuant to subsection (c)—</text><paragraph id="H99BF31B7EFB14EA28879DC808043CF6F"><enum>(1)</enum><text>not more than 30 percent shall be appointed at ranks equivalent to salary class 1 and salary class 2 of the Foreign Service schedule; and</text></paragraph><paragraph id="HFAC6DEE7DA4745E19033AE4249F4486F"><enum>(2)</enum><text>those not appointed at ranks equivalent to salary class 1 and salary class 2 of the Foreign Service schedule shall be appointed at ranks equivalent to salary class 3 and salary class 4 of the Foreign Service schedule.</text></paragraph></subsection><subsection id="H45AB24A7BA1B45E4AED14BF20B2A7809"><enum>(f)</enum><header>Training</header><text>Members of the Pilot Program shall complete such orientation, security, medical, and readiness training as the Secretary of State determines appropriate, including training conducted through the National Foreign Affairs Training Center, the Foreign Affairs Security Training Center, and other Department of State facilities.</text></subsection><subsection id="HB297341DE68F4C5FB202AE4E5CF4A097"><enum>(g)</enum><header>Activation</header><text>The Secretary of State may activate members of the Pilot Program for temporary service in support of diplomatic operations, crisis response, evacuation efforts, disaster response, consular surge requirements, or other foreign affairs contingencies.</text></subsection><subsection id="H88A2B1A431254C9FAFEAAEBEFFAB731B"><enum>(h)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The Secretary of State shall establish readiness standards and conduct annual evaluations of the training status and availability for deployment of each member of the Pilot Program.</text></subsection><subsection id="H22F6C23B6F1C4E8C8D9F71EB26D8A9BE"><enum>(i)</enum><header>Initial plan to Congress</header><text display-inline="yes-display-inline">Not later than six months after the date of the enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report detailing the Secretary’s plans and timeline to establish, structure, and implement the Pilot Program.</text></subsection><subsection id="HC89D1399462E4FBEB106952967F5E5E9"><enum>(j)</enum><header>Final report to Congress</header><paragraph id="H2CFDFE53276B4974BBD912E31F7FEFE9"><enum>(1)</enum><header>In general</header><text>Not later than three years after the establishment of the Pilot Program, the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report evaluating the Pilot Program and providing recommendations regarding establishment of a permanent Diplomatic Reserve Corps.</text></paragraph><paragraph id="HF773CDAAA9224C31805F15C1D8F7E1E9"><enum>(2)</enum><header>Matters to be included</header><text>The report required by paragraph (1) shall additionally include an assessment on expanding eligible appointment to the Diplomatic Reserve Corps to—</text><subparagraph id="H059FA487270543C38E1858A3CEA0C4C5"><enum>(A)</enum><text>retired Civil Service employees of the Department of State;</text></subparagraph><subparagraph id="H2EC74EA66CEC4C0DA00746DDC00D3592"><enum>(B)</enum><text>retired employees of other Federal agencies possessing relevant skills and experience; and</text></subparagraph><subparagraph id="H5B9EC0B7B6CE4D1B947F058A7BC607F5"><enum>(C)</enum><text>qualified individuals from outside the Federal Government possessing critical language, regional, technical, medical, security, consular, management, or diplomatic expertise.</text></subparagraph></paragraph></subsection><subsection id="H5E89767881C84FF5B25EBCDE1FFD71B0"><enum>(k)</enum><header>Termination</header><text>The Pilot Program shall terminate on the date that is three after the date of the enactment of this Act, unless reauthorized by Congress.</text></subsection></section></title></legis-body></bill>
