<section id="H7370FC292C524CF29D2C3F9FFF0BE833" section-type="section-one"><enum>1.</enum><header>Gender identity content descriptor for video programming</header> <text display-inline="no-display-inline">Title VII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/601">47 U.S.C. 601 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H710E0E640F414E9BB929B744848866A3" display-inline="no-display-inline"> <section id="H078F306D26D14FF49CB0EB63ED27E0A7"><enum>723.</enum><header>Gender identity content descriptor for video programming</header> <subsection id="H96208D77202F46D7931DC7CEDA4C69CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, the Commission shall—</text> 
<paragraph id="HA9B908251D8F467DA028424726270EEC"><enum>(1)</enum><text>determine if the conditions of subsection (b) have been met; and</text></paragraph> <paragraph id="HB7D3777354C348FDA90E3FAE00CCB02E"><enum>(2)</enum><text>if the Commission determines under paragraph (1) that such conditions have not been met, promulgate regulations that—</text> 
<subparagraph id="H0BA157F118E54039987F95259F0A4026"><enum>(A)</enum><text display-inline="yes-display-inline">establish a content descriptor for video programming that depicts, discusses, or promotes gender identity, gender transition, transgender identity, or non-binary identity; and</text></subparagraph> <subparagraph id="H33AB856E050545BF88874A54675C46A5"><enum>(B)</enum><text>require distributors of video programming to transmit the content descriptor described in subparagraph (A)—</text> 
<clause id="H47033E30C03B49DA930CA58D7AB70691"><enum>(i)</enum><text>with any video programming that—</text> <subclause id="HBE98E0C70AD8478BB2A06E1AB51C83A3"><enum>(I)</enum><text>contains the content described in such subparagraph; and</text></subclause> 
<subclause id="H78AE85FB339E4762B5DCC43D9CE44227">
                    <enum>(II)</enum>
 <text display-inline="yes-display-inline">is marketed to children (such as programming that is rated TV–Y, TV–Y7, or TV–G under the TV Parental Guidelines); and</text>
                  </subclause></clause> 
<clause id="HAFD5DFCCB6BC47F69D800FEB666D3ACF"><enum>(ii)</enum><text>in a manner that, to the maximum extent technically feasible, can be used with the feature described in section 303(x) (commonly known as the <quote>V-chip</quote>) and other parental-control technologies.</text></clause></subparagraph></paragraph> </subsection> <subsection id="H7061ECE896A446F5AD948DF38B6CE224"><enum>(b)</enum><header>Voluntary compliance</header><text display-inline="yes-display-inline">The conditions of this subsection are the following:</text> 
<paragraph id="H5AC9A6C3650C443981883B960DC51130"><enum>(1)</enum><text display-inline="yes-display-inline">The TV Parental Guidelines have been revised so as to include a content descriptor for video programming that depicts, discusses, or promotes gender identity, gender transition, transgender identity, or non-binary identity.</text></paragraph> <paragraph id="H6E9151E3DBF74EB79A5D5E54D8AED361"><enum>(2)</enum><text>The content descriptor described in paragraph (1) is being consistently transmitted with the rating under the TV Parental Guidelines for video programming that—</text> 
<subparagraph id="H52E2AD6696994B668DD839E7B75B15AA"><enum>(A)</enum><text>contains content described in such paragraph; and</text></subparagraph> <subparagraph id="H6F89517D60CB4A3B9E24602BAE03C718"> <enum>(B)</enum> <text>is rated TV–Y, TV–Y7, or TV–G under the TV Parental Guidelines or is otherwise marketed to children.</text>
              </subparagraph></paragraph> </subsection> 
<subsection id="H6CF8F5FB359E433B96539829C8F985C1"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to ban or censor any video programming.</text></subsection> <subsection id="HC88E713D8DA74052B6B45B42C35E6CE7"><enum>(d)</enum><header>TV Parental Guidelines defined</header><text>In this section, the term <quote>TV Parental Guidelines</quote> means the voluntary ratings (or any successor to such ratings) for video programming maintained by the TV Parental Guidelines Monitoring Board (or any successor to such Board).</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></section>
