<section id="HF78FB429E42B4E7DA9853EE340551F7E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Celiac Safety Act of 2026</short-title></quote>.</text></section> <section id="H1DE6A607D8584E71AC9E689448D6D5FC"><enum>2.</enum><header>Inclusion of gluten-containing grain in definition of a major food allergen</header> <subsection id="HA1C0D14FC3AD419EA60D70B2CB954B19"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 201(qq) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(qq)</external-xref>) is amended—</text>
<paragraph id="HD5EE6D9F68564443872ACD54387F51DD"><enum>(1)</enum><text>by striking <quote>(1) Milk</quote> and inserting <quote>(1)(A) Milk</quote>;</text></paragraph> <paragraph id="HAE882D2B4CBB429B9F3CA7A1F86EB67B"><enum>(2)</enum><text>by inserting <quote>gluten-containing grain,</quote> after <quote>wheat,</quote>; and</text></paragraph>
<paragraph id="H49AD343F84AC4E56A62F3DF7FB108CBF"><enum>(3)</enum><text>by adding at the end of subparagraph (1) the following:</text> <quoted-block style="OLC" id="HAEFE548C577D4D08942F8055EEAEAB4A" display-inline="no-display-inline"> <subparagraph id="H1CAB8C8B23004B83ABE5B34C5C1C21F6" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>gluten-containing grain</term> means any one of the following grains or their crossbred hybrids (such as triticale):</text>

                                <enum>(i)</enum>
 <text>Wheat, including any species belonging to the genus Triticum.</text>
                            </clause>

                                <enum>(ii)</enum>
 <text>Rye, including any species belonging to the genus Secale.</text>
                            </clause>

                                <enum>(iii)</enum>
 <text>Barley, including any species belonging to the genus Hordeum. </text>

<subsection id="H795D5C866966432495FC31367FDFD5D4"><enum>(b)</enum><header>Delayed applicability</header><text>The amendment made by subsection (a) applies only with respect to food that is introduced or delivered for introduction into interstate commerce on or after the date that is 18 months after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
