<section id="HD2288040383E4FBF9356ADBB2ED46070" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Fossil Fuel Bailouts Act of 2026</short-title></quote>.</text></section> <section id="HBC6BB39F997748F083D8DFBDF1F3D604"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 of title 11 of the United States Code is amended—</text> 
<paragraph id="HB49C4D0D89C84863AEC34302DDE5F985"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after paragraph (5) the following:</text> <quoted-block style="OLC" id="HB62174EFA3474C6DB71909CCD77767D9" display-inline="no-display-inline"> <paragraph id="H35BA80426B8F45BFA6BD38752FBD5E7F"> <enum>(5A)</enum> <text display-inline="yes-display-inline">The term <quote>coal</quote> has the meaning given such term in section 2 of chapter 1156 of the Act of August 31, 1954 (68 Stat. 1009; <external-xref legal-doc="usc" parsable-cite="usc/30/552">30 U.S.C. 552</external-xref>).</text>
          </paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE982C1876B3B4E87ABCE984841910C68"><enum>(2)</enum><text>by inserting after paragraph (17) the following:</text> <quoted-block style="USC" id="H6FFB32C10E314993B34E6A11412315C9" display-inline="no-display-inline"> <paragraph id="HDAA531EA72174947BADB30457A4AF870"><enum>(17A)</enum><text>The term <quote>executive officer</quote> with respect to a fossil fuel company means—</text> 
<subparagraph id="H617BA40A5B2B46E98EF4290B7CA95027"><enum>(A)</enum><text>the president, or any officer in charge, of a principal business unit, division or function of the fossil fuel company, such as sales, administration or finance;</text></subparagraph> <subparagraph id="H0EB1D5CD8ABF4A26AE4D580C40B1A5D1"><enum>(B)</enum><text>any officer of the fossil fuel company who performs a policy-making function; or</text></subparagraph> 
<subparagraph id="H090882FC054143B1A74AB8A6DE79DDE2"><enum>(C)</enum><text>any other individual who performs similar policy making functions for a fossil fuel company.</text></subparagraph></paragraph> <after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H823CACF60C8640D9A526FC5C57B53816"><enum>(3)</enum><text>by inserting after paragraph (26) the following:</text> 
<quoted-block style="USC" id="H488D47563D0C4358B9B4C298FAFE05EA" display-inline="no-display-inline"> 
<paragraph id="HA641AED7530D40F09D3214F0D6B25561"><enum>(26A)</enum><text>The term <quote>fossil fuel company</quote> means an entity that has engaged in the exploration, production, refinement, or distribution of oil, gas, coal, or any derivative of oil, gas, or coal for profit.</text></paragraph> <paragraph id="H6CD42FD97FFC439C95E23BE36DF13A0A"><enum>(26B)</enum><text display-inline="yes-display-inline">The term <quote>gas</quote> means natural gas as defined in section 2(1) of the Natural Gas Policy Act of 1978.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H13AEA01810D04F1EAB4B85910486A686">
                <enum>(4)</enum>
 <text>by redesignating paragraphs (40A) and (40B) as paragraphs (40B) and (40C); and</text>
            </paragraph> 
<paragraph id="H193F1860556044F6991AAC23AF926B53"><enum>(5)</enum><text>by inserting after paragraph (40) the following:</text> <quoted-block style="OLC" id="HA7AD7411DF6C43FB9F934C4AF79A4E55" display-inline="no-display-inline"> <paragraph id="H544C53CD3C244BDCBF4065B2F021AD96"><enum>(40A)</enum><text display-inline="yes-display-inline">The term <quote>oil</quote> has the meaning given such term in section 311(a)(1) of the Federal Water Pollution Control Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HBA46F6B0B74E4767AD5E776DEBC6D2A3"><enum>3.</enum><header>Prioritization of expenses</header> 
<subsection id="H9EE4DC3054064ECF9FFEF663BFA989FD"><enum>(a)</enum><header>Cost recovery</header><text>Section 506 of title 11 of the United States Code is amended—</text> <paragraph id="H109A15A228C1406784AD56DEEE0AA6F1"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c) by inserting <quote>Unless otherwise provided by this section,</quote> before <quote>The trustee may recover from property</quote>; and</text></paragraph> 
<paragraph id="HD8F3082C482247FB83F1CE85CA08D4B6"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text> <quoted-block id="H04AB75D5D7C849438641DAE97B602077" style="OLC"> <subsection id="H2EAB57F77C60449A927A364606909DD6"><enum>(e)</enum><text>With respect to the accumulated and projected reclamation costs associated with the complete cleanup of fossil fuel operations and retirement of fossil fuel assets pursuant to applicable Federal, State, and local laws and reclamation requirements, the trustee shall—</text> 
<paragraph id="H06083EC1D1724238A5F747D80873C685"><enum>(1)</enum><text>consider such costs as necessary costs and expenses for preserving, or disposing of, such property securing an allowed secured claim pursuant to subsection (c); and</text></paragraph> <paragraph id="H846486E9F1484C5AAAAF72912AF23503"><enum>(2)</enum><text>recover from the property securing an allowed secured claim such sums necessary to fulfill all fossil fuel reclamation costs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H06927C2B0D0248FF810C01B7ADD050C5"><enum>(b)</enum><header>Prioritization of unsecured claims</header><text>Section 507 of title 11 of the United States Code is amended by adding at the end the following:</text> <quoted-block id="HCC49C714DA1B40AC9BB9D2A8F8CBA23E" style="OLC"> <subsection id="H7F9FAC31D3C74302AE0D4B8E7D01BBC1"><enum>(e)</enum><text>With respect to a debtor that is a fossil fuel company, the following expenses and claims have priority in the following order:</text> 
<paragraph id="H548B998CB1494F1D80F810041B04C37C"><enum>(1)</enum><text>Wages, salaries, commissions, and benefits pursuant to subsections (4) and (5) owed to an employee that is not an executive officer of the company.</text></paragraph> <paragraph id="H351CCCF7D267482D9FB0E8C7FA1669F5"><enum>(2)</enum><text>Accumulated and projected reclamation costs associated with the complete cleanup of fossil fuel operations and retirement of fossil fuel assets pursuant to applicable Federal, State, and local laws and reclamation requirements, with priority given to costs in the following order:</text> 
<subparagraph id="HEB088877EF8F4800A587334E3DB1A82B"><enum>(A)</enum><text>Any unfulfilled environmental bond obligation.</text></subparagraph> <subparagraph id="HD54BD184039F4FE18F156216F5996BD0"><enum>(B)</enum><text>Environmental reclamation requirements or administrative or civil penalties administered by Federal, State, or local governments, including requirements or penalties pursuant to—</text> 
<clause id="H5822703B409E4471AA8F6B3485BE8B60"><enum>(i)</enum><text>Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></clause> <clause id="H2E8EDB2AC8F9491CB02B5355B209094F"><enum>(ii)</enum><text>the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>);</text></clause> 
<clause id="H57C6FE144AEB40208268DD7C4DEEBB7A"><enum>(iii)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></clause> <clause id="H8E4806A5110F46E3B147042FDAC2BCBC"><enum>(iv)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause> 
<clause id="H158C662385674EE88726C231736CC72D"><enum>(v)</enum><text>the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1201">30 U.S.C. 1201 et seq.</external-xref>);</text></clause> <clause id="H0BB21F46986D4F62825C2BBE10BB157E"><enum>(vi)</enum><text>the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>);</text></clause> 
<clause id="HFF2C2BC2930D4BC2B11A4FCB630D9488"><enum>(vii)</enum><text>the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>);</text></clause> <clause id="HC873A6FA46F147CFB4E60402D985ECCF"><enum>(viii)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>); or</text></clause> 
<clause id="H8A3456B9B9D24CDB904CE7F324885826"><enum>(ix)</enum><text>any similar environmental law of a State where such operations and assets are situation.</text></clause></subparagraph> </paragraph> <paragraph id="HF8A3F1E29A974A1AB1FA31D310FB8E00"><enum>(3)</enum><text>Any unsecured claim.</text></paragraph> 
<paragraph id="H3473D1035AC340A282E85076168F9EC2"><enum>(4)</enum><text>A claim by a shareholder of the fossil fuel company debtor.</text></paragraph> <paragraph id="H772487E29E8348B98F57606AB43F2037"><enum>(5)</enum><text>The order of claims described in section 507(a).</text></paragraph></subsection> 
<subsection id="HF5D7A11A5918467281837F9A4EF22F66"><enum>(f)</enum><text>With respect to a debtor that is a fossil fuel company, the estate of which has insufficient funds to cover the claims described in paragraphs (1) and (2) of subsection (e)—</text> <paragraph id="HD62EF1EBBBF74DF9B670D69BF63D079C"><enum>(1)</enum><text>the court may recover the compensation of the executive officers of the debtor that is a fossil fuel company during the 5-year period preceding the date of the filing of the petition; and</text></paragraph> 
<paragraph id="H63C12D78896F4B07AFA0656D8CCECB92"><enum>(2)</enum><text>the following entities shall be strictly liable under the rules of joint and several liability to cover those claims:</text> <subparagraph id="H3BA856C4F939453B8CED30FF16B6E8D2"><enum>(A)</enum><text>A private equity firm that owns a share in the fossil fuel company debtor.</text></subparagraph> 
<subparagraph id="HD6CC9E0007D342D6A05CF05F367561CE"><enum>(B)</enum><text>A parent company of the fossil fuel company debtor.</text></subparagraph> <subparagraph id="HDE48266F8F684F89A01E4441587C3F04"><enum>(C)</enum><text>A hedge fund that owns a share in the fossil fuel company debtor.</text></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="HD5608155244E4DDF95F308F36401F9FD"><enum>4.</enum><header>Limitations on dischargeability</header><text display-inline="no-display-inline">Section 523(a) of title 11 of the United States Code is amended—</text> <paragraph id="HBAE369EDEBA545C19FD53173A46FF588"><enum>(1)</enum><text>in paragraph (19) by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H65DB98A72CCD4DA2BE75AE79ED95769A"><enum>(2)</enum><text>in paragraph (20) by striking the period at the end and inserting a semicolon; and</text></paragraph> <paragraph id="HED559019B07146BC9EB2C6A54D95AE6D"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block id="H921D12AB2EEB4FBFA0A01025A7AB4838" style="OLC"> 
<paragraph id="H3AAE56D80A774ECF990602B473A8FC03"><enum>(21)</enum><text>for an environmental bond; or</text></paragraph> <paragraph id="HB76B1E8FE2374FFEBDA448CE1A3C8B5A"><enum>(22)</enum><text>for the accumulated and projected reclamation costs associated with the complete cleanup of fossil fuel operations and retirement of fossil fuel assets pursuant to applicable Federal, State, and local laws and reclamation requirements, including—</text> 
<subparagraph id="H702F9D13C5D44929A95A8F4048FB05A6"><enum>(A)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></subparagraph> <subparagraph id="H67E2D188C9B54CAF954E5B8AD174E4B4"><enum>(B)</enum><text>the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HEF8CBD65D6A249F2AFD864DB3C13C611"><enum>(C)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph> <subparagraph id="H46484E00DAE9411BABB9A53925835A27"><enum>(D)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HE60974EA0B1446A5B84F0465BC25050B"><enum>(E)</enum><text>the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1201">30 U.S.C. 1201 et seq.</external-xref>);</text></subparagraph> <subparagraph id="H3724ACF2620A4B0099DE4B047A09F7BF"><enum>(F)</enum><text>the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="H7D98E605A48141BE91EA020C424C0F5A"><enum>(G)</enum><text>the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>);</text></subparagraph> <subparagraph id="HFB7C898E10254197AFC6B233E6D305D9"><enum>(H)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>); and</text></subparagraph> 
<subparagraph id="H507434C19C3C4D74B44E312FDEF71F85"><enum>(I)</enum><text>any similar environmental law of a State where such operations and assets are situated.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HEA21B15A197546BF9DFE8BFAD7CD4B9C"><enum>5.</enum><header>Prohibition on abandonment of fossil fuel assets</header><text display-inline="no-display-inline">Section 554 of title 11 of the United States Code is amended by adding at the end the following:</text> 
<quoted-block id="H9215E68588C6487C953B377B5AC1C1EA" style="OLC"> 
<subsection id="HE4AF8D3080D044829C69CBC920AF1890"><enum>(e)</enum><text>No property of the estate may be abandoned as burdensome to the estate under this section if the property was or may be utilized to facilitate the exploration, production, refinement, or distribution of oil, gas, coal, or any derivative of oil, gas, or coal.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H2F88F94DC4C2458EB20C244A924BC734"><enum>6.</enum><header>Extension to look-back period for fraudulent transfers and obligations</header><text display-inline="no-display-inline">Section 548(a) of title 11 of the United States Code is amended—</text> 
<paragraph id="H4CD52FCBAE23445DA41D0C175F679275"><enum>(1)</enum><text>in paragraph (1) by striking <quote>The trustee</quote> and inserting <quote>Unless specified otherwise in this section, the trustee</quote>; and</text></paragraph> <paragraph id="H8840D8ECC8AA4B88A626669E19D98D19"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H2BBB06667B9C474FBAA5ED959BCF0D15" style="OLC"> 
<paragraph id="HD565BE8B8985435C8A00B0F441FC2488"><enum>(3)</enum><text>With respect to a debtor that is a fossil fuel company, the trustee may avoid any transfer (including any transfer to or for the benefit of an insider under an employment contract) of an interest of the debtor in property, or any obligation (including any obligation to or for the benefit of an insider under an employment contract) incurred by the debtor, that was made or incurred on or within 10 years before the date of the filing of the petition if the debtor acted pursuant to subparagraphs (A) and (B) of paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H7467C84FAA9B426990CD91FB1D1C97A4"><enum>7.</enum><header>Limitation on transfer of certain leases</header> <subsection id="H4E8DAADE1DE3469883EEF11DDB281374"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H653DD0C38BEF4B7CB578ABE65EDB7ED6"><enum>(1)</enum><header>Covered lease</header><text>The term <quote>covered lease</quote> means—</text> <subparagraph id="H6E5992ECC86C4A8887361E10788B8501"><enum>(A)</enum><text>an oil, gas, or coal lease issued under the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>); and</text></subparagraph> 
<subparagraph id="HD00F5D4007F5481C966C05E549765E68"><enum>(B)</enum><text>a lease issued under the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph id="H870766D5C9194A339285B5C29609FB8A"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></subsection> 
<subsection id="HFFA21CA7FB944C8E881DF98F86FE7828"><enum>(b)</enum><header>Limitation</header><text>The Secretary shall include in each covered lease issued after the date of enactment of this Act a provision prohibiting the leaseholder from transferring the covered lease to another person if the lessee has filed a petition for bankruptcy under title 11 of the United States Code.</text></subsection> </section> <section id="H5A6DAA243405489E80935E6B5375D732" commented="no"><enum>8.</enum><header>Effective date; Application of amendments</header> <subsection id="HDC1EC72C3D6B4C4D83EF7421881A2168"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act and the amendments made by this Act shall take effect on the date of the enactment of this Act.</text></subsection> 
<subsection id="HC2FD5368187C4DB2A66F34C21B5B1592"><enum>(b)</enum><header>Application of amendments</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply only to cases commenced under title 11 of the United States Code on and after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
