<section id="H0C5F5719A55747D29BD1727737FBE3A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Timely Agreements Act</short-title></quote>.</text></section> <section id="H610B65325B4A4BEFB12B62588056189D"><enum>2.</enum><header>Requirements for certain agreements between the Department of Veterans Affairs and State veterans homes for the sharing of health-care resources</header> <subsection id="H818E9644B49E4F709181CC0D68814585"><enum>(a)</enum><header>Timely decisions on certain proposals</header> <paragraph id="H001D4F4A71CD4D5BBE83E373770019D5"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">Chapter 81</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/8153">section 8153</external-xref> the following new section:</text> 
<quoted-block style="USC" id="H9174D760366C41529007F68FBCDB0C83" display-inline="no-display-inline"> 
<section id="H9B59DCDB3C5E496A88D7AF8C59F19304"><enum>8153a.</enum><header>Sharing of health-care resources with State homes; timely decisions on certain proposals</header> 
<subsection id="H9D5CA00CAD114E7584EA02D5B446FCC0"><enum>(a)</enum><text>In a case in which a State home submits to the Secretary a proposal for an agreement under section 8153 involving the purchase by the State home of pharmaceuticals or durable medical equipment, or both, the Secretary shall either approve or reject the proposal by the date (in this section referred to as the <quote>decision date</quote>) that is 60 calendar days after the date on which the proposal was received.</text></subsection> <subsection id="H92B0D0D831F64AA9A9728703F7654F2C"><enum>(b)</enum><text>If such a proposal is not approved or rejected by the decision date, the proposal shall be deemed approved and given effect.</text></subsection> 
<subsection id="H76D2FB7D404C439F97C7CA206137092A"><enum>(c)</enum><text>The rejection of such a proposal shall not preclude the State home from submitting, or the Secretary from negotiating or approving, subsequent proposals.</text></subsection> <subsection id="HD94C5E2980B24FC699CD59BFCCB52E38"><enum>(d)</enum><text>The Secretary shall enable State homes to submit such proposals by hand delivery, mail, facsimile, electronic mail, and any other mechanism the Secretary considers appropriate.</text></subsection> 
<subsection id="H9CCBCB41D20A44A0B663623EB3B98251"><enum>(e)</enum><text>The Secretary shall establish and make available a standard template for such proposals.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H85DA89DA657F4DB0B8F075A127CF8A38"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 8153 the following new item:</text>

<paragraph id="HDAA715931C4B4602ACB517863E32B3FD"><enum>(3)</enum><header>Implementation date</header><text>The standard template required by section 8153a of title 38, United States Code, as added by this section, shall be established and made available not later than 180 days after the date of the enactment of this Act.</text></paragraph></subsection> <subsection id="HBA5C08F12401421CA2163866A83037D0"><enum>(b)</enum><header>Provision of care without an agreement not a deficiency</header><text display-inline="yes-display-inline">Section 162 of the Joseph Maxwell Cleland and Robert Joseph Dole Memorial Veterans Benefits and Health Care Improvement Act of 2022 (division U of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>; 136 Stat. 5430; <external-xref legal-doc="usc" parsable-cite="usc/38/1741">38 U.S.C. 1741</external-xref> note) is amended—</text> 
<paragraph id="H825AD1D2F73C480F86207920D027B24D"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> <paragraph id="H6C08D99FF4424CC3B85902FA3AE1E1DE"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text>

<subsection id="H24FC8E5F0AC0493B8D423C2E5625085C"><enum>(d)</enum><header>Provision of care without an agreement not a deficiency</header><text display-inline="yes-display-inline">Notwithstanding section 1742 of title 38, United States Code, the Secretary shall ensure that, if a State home provides care to an eligible veteran when there is no applicable agreement in place with the Department under section 8153 of such title, the fact that no applicable agreement is in place shall not, in and of itself, be treated as an inspection violation or deficiency.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> </section> </legis-body></bill>
