<section id="H428295DAF52846DDA94F5797D0A4E204" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military and Veterans Fuel Discount Act of 2026</short-title></quote>.</text></section> <section id="H4B76627409844571BCBACFD27D82122F"><enum>2.</enum><header>Program to provide to certain patrons a discount on motor fuel sold at exchange stores</header> <subsection id="H8874A76FC10846C1A843B6F1CDA1C505"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense may, if there is a tax described in subsection (b) applicable to motor fuel, carry out a program to provide to eligible patrons a discount on such motor fuel—</text> 
<paragraph id="HF0DBC571739440C3AEE95401B735C3F8"><enum>(1)</enum><text>sold at an exchange store; and</text></paragraph> <paragraph id="HA46DFE7D0E524463972E831F95352FCB"><enum>(2)</enum><text display-inline="yes-display-inline">dispensed directly into a vehicle owned by an eligible patron.</text></paragraph></subsection> 
<subsection id="HFE7E664A3E2C44CD96B27E3768135BEE"><enum>(b)</enum><header>Amount of discount</header> 
<paragraph id="HBFAF22E6438B4C5D9091B9145E6BAC2E"><enum>(1)</enum><header>Base discount</header><text>A discount provided under subsection (a) shall be an amount not less than—</text> <subparagraph id="H59B9944C954C41D78E9267A46669DC2C"><enum>(A)</enum><text display-inline="yes-display-inline">the rate of tax applicable to gasoline under <external-xref legal-doc="usc" parsable-cite="usc/26/4081">section 4081</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/4081">26 U.S.C. 4081</external-xref>), except that such discount may not be less than 18.4 cents per gallon; and</text></subparagraph> 
<subparagraph id="HCD44392F2F4A4039ABEE07CD29834040"><enum>(B)</enum><text display-inline="yes-display-inline">the rate of tax applicable to diesel fuel under such section 4081, except that such discount may not be less than 24.4 cents per gallon.</text></subparagraph></paragraph> <paragraph id="HCB04F279450B45F29B0C7D5A9A4F6BC6" commented="no"><enum>(2)</enum><header>Authorization of supplemental discount</header><text display-inline="yes-display-inline">The Secretary may, if there is a State or local tax applicable to such motor fuel, provide an additional discount to an eligible patron, with respect to each gallon of motor fuel sold at an exchange store, of such amount as the Secretary determines appropriate.</text></paragraph> </subsection> 
<subsection id="H974DB5624BAD4F58860D65075E3B7491"><enum>(c)</enum><header>Automatic application</header><text display-inline="yes-display-inline">The Secretary shall, to the maximum extent practicable, ensure that a discount provided under this section is applied upon the sale of motor fuel at an exchange store to an eligible patron. </text></subsection> <subsection id="HD718D4C3E9D146B18788A36CA9A9F742"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall update any appropriate regulations to prevent—</text> 
<paragraph id="H9FFC8F5A345A449896FD8C9615A4E4DE"><enum>(1)</enum><text>fraud or abuse of a program carried out under this section; and</text></paragraph> <paragraph id="HE3A4D7225289455194B10783A471BF13"><enum>(2)</enum><text>the resale or commercial use of motor fuel purchased at a discount under this section.</text></paragraph></subsection> 
<subsection id="HAF1535B1AB5B4D85AC9908EC2237FFAC"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The authority of the Secretary to provide a discount under this section shall terminate on September 30, 2029.</text></subsection> <subsection id="HFB9D17486ABC45A5938B7D6F49E6CD75"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Secretary carries out a program under this section, and annually thereafter until the termination under subsection (e), the Secretary shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report on such a program, including—</text> 
<paragraph id="HFCE323D33B1B4F21B3EE07C9ADE71AAD"><enum>(1)</enum><text>the number of exchange stores, disaggregated by exchange system, that sold motor fuel subject to a discount under subsection (b)(1);</text></paragraph> <paragraph id="H75E881992ED34E2AADB2C62F4AD21E27"><enum>(2)</enum><text>the total gallons of such motor fuel sold annually by—</text> 
<subparagraph id="H09A25E3B4AC24FF593BEB361BD19CCAC"><enum>(A)</enum><text>each exchange store;</text></subparagraph> <subparagraph id="H8D0E7670208547B6A61C98FA578EC17F"><enum>(B)</enum><text>all exchange stores; and</text></subparagraph> 
<subparagraph id="H6D7F7ACBBD4D4EB8929A28DD8DF961D4"><enum>(C)</enum><text>all exchange stores, disaggregated by exchange system;</text></subparagraph></paragraph> <paragraph id="H73ACC05398604BC5A8AC6A6C9582EFFB" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">the total annual cost of the discount under subsection (b)(1)(A);</text></paragraph> 
<paragraph id="H5B4A3C967A14447B8A5689A9CB944197" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">the total annual cost of any additional discount under subsection (b)(1)(B);</text></paragraph> <paragraph id="H928D84A2EE4A4715A2EB84F0CBE389CC"><enum>(5)</enum><text>the average amount of motor fuel sold annually by each exchange store before the date of the enactment of this Act;</text></paragraph> 
<paragraph id="HFFA3D0286C854670A9EC9AB85ABB8AA7"><enum>(6)</enum><text display-inline="yes-display-inline">any identified fraud, abuse, or issues with implementation with respect to such program; and</text></paragraph> <paragraph id="HC1F354F5C7774CAF86F5AED89177F0CE" commented="no"><enum>(7)</enum><text>any recommendations with respect to continuing or modifying such program. </text> </paragraph></subsection> 
<subsection id="H3B9198A115E847058A65F4C463E5BE90"><enum>(g)</enum><header>Coordination</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit the Secretary from coordinating with the heads of other Federal departments or agencies to encourage the adoption of similar policies with respect to discounts on motor fuel—</text> <paragraph id="H92DAF67B265F469C9D37B89A0209ECFB"><enum>(1)</enum><text>for members of the uniformed services; or</text></paragraph> 
<paragraph id="H7E461430D1704982A98BAB778390476C"><enum>(2)</enum><text>other persons served by exchange systems outside the Department of Defense.</text> </paragraph></subsection> <subsection id="H42524BED25AD47728ED2D820AD283407"><enum>(h)</enum><header>Eligible patron defined</header><text>The term <term>eligible patron</term> means a person who is authorized under Federal law and applicable regulations to purchase motor fuel from a fuel station operated by an exchange store.</text> </subsection> </section>
