<section id="H64FF31F95B3D415CB6B7834155D1D9EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Worker Rights and Support Act</short-title></quote>.</text></section> <section id="H2C9566E3CFC344E693DEE715A4E40CB7"><enum>2.</enum><header>Required breaks for employees</header> <subsection id="H19D34719E6FD48A582A50E523E616AEE"><enum>(a)</enum><header>In general</header><text>The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by inserting after section 7 (<external-xref legal-doc="usc" parsable-cite="usc/29/207">29 U.S.C. 207</external-xref>) the following:</text>

<section id="HD5A270DEB6DC42269D0BEB05C94B6C21"><enum>8.</enum><header>Required breaks for employees</header>
<subsection id="H40466720CC424116A960DDC29508999B"><enum>(a)</enum><header>Meal breaks</header>
<paragraph id="HC1506762A7234384B07052F1334FCA70"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3)(A) and subsection (e), an employer shall provide, for each 6-hour period of work performed by an employee, a period of break time of not less than 30 minutes during such period of work in which the employee may consume a meal.</text></paragraph> <paragraph id="H0E293A9F30A443FFA79CA3EDE640BD42"><enum>(2)</enum><header>Payment</header><text>—</text>
<subparagraph id="HF2CA3AB08C9B40319C6AB498D66E27AE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an employer shall not be required to compensate an employee for a break required under paragraph (1).</text></subparagraph> <subparagraph id="HC52815F99C9B4A96A6913ACCB2F813D3"><enum>(B)</enum><header>Paid breaks</header><text>In the case in which an employee is not fully relieved of all work or expectation of work, or is not free to leave the premises or work site during a break provided under paragraph (1), the employer shall compensate the employee for the full period of break time under paragraph (1), at a rate that is not less than one and one-half times the regular rate at which the employee is employed by the employer.</text></subparagraph></paragraph>
<paragraph id="H321A2A34E8BC4E9799CF0C886732F2D3" commented="no"><enum>(3)</enum><header>Waiver</header>
<subparagraph id="H4D9180356C9D4C559FB22F0892A88415"><enum>(A)</enum><header>In general</header><text>The period of break time under paragraph (1) may be waived by consent of the employee.</text></subparagraph> <subparagraph id="H9111D7BBB49B4D969BF20AE98F771C5A" commented="no"><enum>(B)</enum><header>Waiver may not be compelled</header><text>An employer may not compel, or attempt to compel, an employee to waive the period of break time provided under paragraph (1).</text></subparagraph></paragraph></subsection>
<subsection id="H2D3967B9D1ED48CD9A0560A9FA644D4A"><enum>(b)</enum><header>Rest and restroom breaks</header>
<paragraph id="H339F4247CA9D4E669D94D525097592AC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (e), an employer shall provide, during each 4-hour period of work performed by an employee, a period of break time that is the longer of—</text> <subparagraph id="H649215FEC9164F6BA361DA50614ED15E"><enum>(A)</enum><text>10 minutes; or</text></subparagraph>
<subparagraph id="H72637673CA0B4C249A7AFE931D115008"><enum>(B)</enum><text>a reasonable period of time to utilize the nearest functioning and accessible restroom.</text></subparagraph></paragraph> <paragraph commented="no" id="H8FF8430C5DAB48F0984F4892126F5504"><enum>(2)</enum><header>Rate of compensation</header><text>An employer shall compensate an employee for the break time described in paragraph (1) at the regular rate at which the employee is employed by the employer.</text></paragraph></subsection>
<subsection id="HA7C688C2DDAE43249ABE7DB4FFBF9C03"><enum>(c)</enum><header>Medical breaks</header>
<paragraph id="H5D506A18BDB34CE0B0CC6B8C2FF16711"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (e), an employer shall provide to an employee periods of break time, not to exceed 20 minutes each, that the employee may reasonably require due to a medical condition communicated to the employer by the health care provider either directly from such provider or indirectly from the employee.</text></paragraph> <paragraph id="H8F9B336C57414D9993EEB9080F428E23"><enum>(2)</enum><header>Rate of compensation</header><text display-inline="yes-display-inline">An employer shall compensate an employee for the break time described in paragraph (1) at the regular rate at which the employee is employed by the employer.</text></paragraph></subsection>
<subsection id="HE0B08BEE159B4900B5B3CF95AF55518F"><enum>(d)</enum><header>Time worked</header><text>Break time paid under this section shall be considered as time worked.</text></subsection> <subsection id="HB5F09C40D5594BBAA23F3C1AA68BC73B"><enum>(e)</enum><header>Collective bargaining agreements; State laws</header><text display-inline="yes-display-inline">The requirements under this section shall not—</text>
<paragraph id="HE0E39629426540BAA769E5D424733A6D"><enum>(1)</enum><text>supersede any provision in a collective bargaining agreement; or</text></paragraph> <paragraph id="H51B9B88ED36C4C28A8CB3452C894AD8A"><enum>(2)</enum><text>preempt any State law that provides greater protections to employees than the protections provided to employees under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H88C0C532915D46FDB3D11F678A4D2936"><enum>(b)</enum><header>Enforcement</header>
<paragraph id="H061544E98ED94F2EA21756E3D6FB3499"><enum>(1)</enum><header>Prohibited act</header><text>Section 15(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/215">29 U.S.C. 215(a)</external-xref>) is amended—</text> <subparagraph id="HFC118B7314E2491096D8BE8291B6985F"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or section 7</quote> and inserting <quote>, section 7, or section 8</quote>;</text></subparagraph>
<subparagraph id="H8DB2E69C8420497FB12AFA6270DEDB26"><enum>(B)</enum><text>in paragraph (6), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H161B2A8454F142449CC868648096B6AC"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H9E1FC607EE914DFA8D387454DF433368" style="OLC">
<paragraph id="HD876868CFC454DE1A93F8D8AB93CD5FD"><enum>(7)</enum><text>to violate any of the provisions of section 8.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H7338086F5D204FB48903C1A74428084E"><enum>(2)</enum><header>Penalties</header><text>Section 16 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216</external-xref>) is amended—</text>
<subparagraph id="H1BE4D6588BFB4B518754580B9473E921"><enum>(A)</enum><text>in subsection (b), by inserting after the third sentence the following: <quote>Any employer who violates the provisions of section 8 shall be liable for such legal or equitable relief as may be appropriate to effectuate the purposes of such section.</quote>;</text></subparagraph> <subparagraph commented="no" id="H726FC0B6C98B4635B32FCB98399B3650"><enum>(B)</enum><text>in subsection (c), by adding at the end the following: <quote>The authority and requirements described in this subsection shall also apply with respect to a violation of section 8, as appropriate, and the employer shall be liable for such legal or equitable relief as may be appropriate to effectuate the purposes of such section.</quote>; and</text></subparagraph>
<subparagraph id="H1ECEF1DCA7B34FFE87BD7F94C4D6845F"><enum>(C)</enum><text>in subsection (e)(2), by striking <quote>section 6 or 7, relating to wages,</quote> and inserting <quote>section 6, 7, or 8, relating to wages or break time,</quote>.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4D7169E2DB2B4C07B0172251DC3034B9"><enum>(3)</enum><header>Statute of limitations</header><text>Section 6 of the Portal-to-Portal Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/255">29 U.S.C. 255</external-xref>) is amended, in the matter preceding subsection (a), by inserting <quote>(and any cause of action to enforce section 8 of such Act)</quote> after <quote>under the Fair Labor Standards Act of 1938, as amended</quote>.</text></paragraph></subsection>
<subsection id="HC10FF12E5CA544F982C69042046E796E"><enum>(c)</enum><header>Conforming amendment</header><text>Section 10 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/210">29 U.S.C. 210</external-xref>) is repealed.</text></subsection></section> </legis-body></bill>
