R. 9007</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260521">May 21, 2026</action-date><action-desc><sponsor name-id="W000797">Ms. Wasserman Schultz</sponsor> (for herself and <cosponsor name-id="H001091">Mrs. Hinson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to establish a pilot program under which the Secretary provides financial assistance to certain individuals to purchase infant formula, and for other purposes.</official-title></form><legis-body id="H28026B7315E245A58B72A8B57F816E68" style="OLC"><section id="HAB5041DC2AB44CCFAE0F9CEFF114E160" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Constance C. McDaniel Medically Necessary Infant Formula and Donor Milk Act</short-title></quote> .</text></section><section id="HCE10E843162D4BF0807A030F89678586"><enum>2.</enum><header>Infant formula assistance</header><subsection id="H4898D74CB3BE4A26AB52A042B250FDF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall establish a 3-year pilot program (to be known as the Medically Necessary Infant Formula Pilot Program and referred to in this Act as the <quote>Program</quote>) under which the Secretary will provide to eligible individuals financial assistance for purposes of purchasing covered infant formula or donor milk. </text></subsection><subsection id="H3E67E9FFD8874478AC6887418923B20A"><enum>(b)</enum><header>Manner of provision of financial assistance</header><text display-inline="yes-display-inline">The Secretary may provide financial assistance through any means determined to be appropriate by the Secretary, including through—</text><paragraph id="H09B9B34FEA0E4D61A519A95A21D7E395"><enum>(1)</enum><text>establishing a voucher program;</text></paragraph><paragraph id="H557CF05681A34F0284F16E8FDEE55CF5"><enum>(2)</enum><text display-inline="yes-display-inline">providing for reimbursement to eligible individuals for expenses incurred in purchasing covered infant formula or donor milk; or</text></paragraph><paragraph id="H5107E209823241489AEB1B8563424CB4"><enum>(3)</enum><text>providing a grant to governmental or nonprofit entities serving eligible individuals at the local level.</text></paragraph></subsection><subsection id="H3C3C045D9DBC43D49212A6E8D437E1C8"><enum>(c)</enum><header>Education</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with health care providers, take such steps as may be necessary to ensure information about the Program is available to families.</text></subsection><subsection id="H0BB5C8F90F6F46199BDAA343069F419B"><enum>(d)</enum><header>Evaluation; report</header><paragraph id="H6F7212E54D65409A89F6F6839E993DE5"><enum>(1)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The Secretary shall conduct an annual evaluation of performance of the Program with respect to delivery of assistance to parents and infants in need, including how many individuals benefitted from the Program and how much covered infant formula or donor milk was provided through the Program. <italic></italic></text></paragraph><paragraph id="HA672A22F5077446D8A6333555ED2558B"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date on which the Program begins and annually thereafter, the Secretary shall submit a report to Congress on the findings of each evaluation conducted under paragraph (1). </text></paragraph></subsection><subsection id="H31D3A767640349329FD58453CF87246C"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4DF25CFA1A9F4A728B5451DB2CF8D98B"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered infant formula</term> means infant formula lawfully sold in the United States in compliance with section 412 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a</external-xref>).</text></paragraph><paragraph id="H6C01E91521414DEABC9A5C11E0140FA1"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>donor milk</term> means human milk that is collected, pasteurized, and dispensed by a donor human milk bank without additives.</text></paragraph><paragraph id="HD3AAAD5B2F2F470A9B49D05287F04913"><enum>(3)</enum><text>The term <term>donor human milk bank</term> means an organization that—</text><subparagraph id="H52E7DC5129AC4B2FAF6A0375CBBC25BE"><enum>(A)</enum><text>meets standards established by the Food and Drug Administration for purposes of ensuring the safety of donor human milk and human milk banks; and</text></subparagraph><subparagraph id="H90185EC8DC3F48D7A56D35CDFC65BDC3"><enum>(B)</enum><text>collects, tests, processes, pasteurizes, and distributes donor human milk, in compliance with applicable Federal and State law.</text></subparagraph></paragraph><paragraph id="H8819E85CBE44449281261CA568479BCD"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>eligible individual</quote> means an individual who—</text><subparagraph id="HEFABEF77C6FD4578A02B75385911ED8E"><enum>(A)</enum><text display-inline="yes-display-inline">is not eligible to participate in the special supplemental nutrition program for women, infants, and children under section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>); </text></subparagraph><subparagraph id="H8493FFAB398E4AF38D9D8C556F2CE5DE"><enum>(B)</enum><text>is the parent or legal guardian of a child who is less than one year of age (or such older age as may be necessary due to a medical issue diagnosed by a medical professional); and</text></subparagraph><subparagraph id="H12106DCDA2504CBCBCA48137EFFAD6C7"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H05543A6192C4436D88CBF1405797A5E8"><enum>(i)</enum><text>is a postpartum woman who has an inability to breastfeed, as diagnosed by a medical professional, due to—</text><subclause id="HD50332B249614E68897CE52643B8D7FA" indent="up1"><enum>(I)</enum><text>a physical factor as a result of a diagnosed medical condition;</text></subclause><subclause id="HBE5355E114BC49D5B2D76FF71C63C643" indent="up1"><enum>(II)</enum><text>a chronic disease, such as cancer;</text></subclause><subclause id="HD4479822BB2F48BB9A042BEF0B342FDC" indent="up1"><enum>(III)</enum><text>a behavioral or mental health issue; or</text></subclause><subclause id="HB263BD0B4C854E5EAB96BDE5933FA477" indent="up1"><enum>(IV)</enum><text>such other medical issue, as may be determined by the Secretary;</text></subclause></clause><clause id="H33407E1711224E59897E91822BE84BAB" indent="up1"><enum>(ii)</enum><text>has an inability to breastfeed due to—</text><subclause id="HB45CD049C74C4F228E210407C2502671"><enum>(I)</enum><text>adoption; </text></subclause><subclause id="HE703AC1ED0D2468CAC6C4C5AE18551B2"><enum>(II)</enum><text>maternal mortality; or</text></subclause><subclause id="H4BA49BA950F14AEF80167527B259192D"><enum>(III)</enum><text display-inline="yes-display-inline">surrogacy following diagnosis of a medical condition; or</text></subclause></clause><clause id="H5CF33B6B2D07424F9135B61D45327FEE" indent="up1"><enum>(iii)</enum><text>has a child who has—</text><subclause id="HB1094CEBCC4348EFBAB534045677BFB3"><enum>(I)</enum><text>feeding tubes;</text></subclause><subclause id="H586403B6C0794CE0A1453B089C09B4DA"><enum>(II)</enum><text>digestive issues;</text></subclause><subclause id="HA09FBE2A2D014BEF9B7D9C8962F91032"><enum>(III)</enum><text>latching issues (including anatomical issues, such as Ankyloglossia);</text></subclause><subclause id="H327A5C41CE03498C9AE39252A8230015"><enum>(IV)</enum><text>an allergy or intolerance; or</text></subclause><subclause id="H28D11703ADE340E58B55EE7016E9D701"><enum>(V)</enum><text>such other medical issue, as may be determined by the Secretary.</text></subclause></clause></subparagraph></paragraph><paragraph id="H1130B6FE8375442081C47ADB213BAC75"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>medical professional</term> includes a pediatrician, an obstetrician-gynecologist, a general practitioner, or a nurse practitioner.</text></paragraph></subsection><subsection id="HF36271E2440D4FCDA2ADF8B413CA5069"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $15,000,000 for each of fiscal years 2027 through 2031.</text></subsection><subsection id="HE00DBFC8884C48D9A4F73B52D00619BF"><enum>(g)</enum><header>Sunset</header><text>The authority of the Secretary to carry out this section shall terminate on the date that is 3 years after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
