<section id="HDF5682248320446EBFA416371BB93067" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Practitioner Enforcement and Tracking of Substances Act</short-title></quote> or the <quote><short-title>PETS Act</short-title></quote>.</text></section> 
<section id="HE3F131C243FE421A860499500161CFC6"><enum>2.</enum><header>Increasing compliance with PDMP requirements</header> 
<subsection id="H434CC6A1D0E14F4D96B982AA8D615168"><enum>(a)</enum><header>Increasing compliance by veterinarians</header> 
<paragraph id="HEDD94D03D44C412BB82B18DED58FA9E1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 399O(h)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3(h)(1)</external-xref>) is amended—</text> <subparagraph id="H5D4C9482476A4E978FA7AF2FCF61D7B7"><enum>(A)</enum><text>by striking <quote>Nothing in this section</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="HA6CE9E72527C4CCD95F4B33DA2E266D4" display-inline="no-display-inline"> 
<paragraph id="H2D45F4AD07D3457B8EE2BA546B8F8AD1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as specified in paragraph (2), nothing in this section</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HE7DFE5C8B6C84C95B3C1FFC635A941FA"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H917B43DCDA5B4F38B69A0AA6CCBEFBE6" display-inline="no-display-inline"> 
<paragraph id="HDC3FEF1657E5474AAF131FD6DCA4A4E1"><enum>(2)</enum><header>Veterinary patients</header> 
<subparagraph id="H9D97ABA2D39A47C6A090E08D33949D37"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to the authority of a State to prohibit reporting to the PDMP of the dispensing of a controlled substance to a minor patient, if—</text> <clause id="H857A96133C3740989A2E5FBFCA331316"><enum>(i)</enum><text>the prescribing or dispensing practitioner is a veterinarian licensed in such State; and</text></clause> 
<clause id="H6A8D0D1A27794003812AF4F6D46E6FEB"><enum>(ii)</enum><text>the patient to whom the controlled substance is prescribed or dispensed is a veterinary patient.</text> </clause></subparagraph> <subparagraph id="H80BCE157C8AB4E2CAC5299B1F147D50E"><enum>(B)</enum><header>Information to be reported</header><text>A veterinarian described in subparagraph (A) shall report to the PDMP, in lieu of information required under this section relating to the veterinary patient involved, such information relating to the owner or primary caretaker of the veterinary patient. </text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HBC52BB632F08471D8C07A9BB9729BBF4">
                    <enum>(2)</enum>
                    <header>Definition of dispenser</header>
 <text>Section 399O(k)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3(k)(3)</external-xref>) is amended by striking <quote>physician,</quote> and inserting <quote>physician, veterinarian,</quote>.</text>
                </paragraph> 
<paragraph id="H33451FFC757C407EBC79CC9F4DC4ACB0"><enum>(3)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, notwithstanding State law, a veterinarian is required to comply with the requirements of section 399O of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3</external-xref>) with respect to consulting the PDMP (as defined in section 399O(k) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3(k)</external-xref>)) prior to prescribing any controlled substance, and reporting any dispensing of a controlled substance to the PDMP to the same extent as any other practitioner (as defined in subsection (k) of such section) is required to comply with such requirements.</text></paragraph></subsection> <subsection id="H1E1CE2DD1E724669BBD00C0369C33B28"> <enum>(b)</enum> <header>Reporting of non-Fatal overdoses</header> <text display-inline="yes-display-inline">Section 399O(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3(b)</external-xref>) is amended—</text>

                    <enum>(1)</enum>
 <text>in paragraph (5), by striking <quote>and</quote> at the end;</text> </paragraph> <paragraph id="HBAC0FDE94B514DF68D188CDA3B9793F6"> <enum>(2)</enum> <text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text>
                </paragraph>
                <paragraph id="HFBC3207DEE7D4C8390A197026B576150">
                    <enum>(3)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="OLC" id="H05B835E2B26D46F88BD4416559415EF8" display-inline="no-display-inline"> <paragraph id="H23640EB51FDA4923B63DB104ED93B39D"> <enum>(7)</enum> <text display-inline="yes-display-inline">the reporting to the PDMP by each prescribing or dispensing practitioner, or their designee, of any instance of a non-fatal overdose event that required intervention by such practitioner (or designee), not later than 72 hours after such overdose event occurred.</text>

            </subsection> 
<subsection id="H82FE85A3B8094E049D2609A80A0E89E2"><enum>(c)</enum><header>Drug misuse and abuse</header><text display-inline="yes-display-inline">Section 399O(c)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3(c)(2)</external-xref>) is amended by striking <quote>may</quote> and inserting <quote>shall</quote>.</text> </subsection> </section> </legis-body></bill>
