<section id="HA3D1C7B0CE7A42DDA41D78537B1A1C4A" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Standards and Calibration for American Leadership in Engineering Biology Act</short-title></quote> or the <quote><short-title>SCALE Biology Act</short-title></quote>.</text></section> 
<section id="H93DF7B8E4A0F4CA29A588686DB67160C"><enum>2.</enum><header>NIST biometrology laboratory program</header> 
<subsection id="H5E9924069B414F389AC271590370A8CD"><enum>(a)</enum><header>Certain implementation activities</header><text>Subsection (c) of section 2 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/272">15 U.S.C. 272</external-xref>) is amended—</text> <paragraph id="HCA40C468CCB740D087B67FD7C4EAC08A"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting a comma after <quote>Director</quote>;</text></paragraph> 
<paragraph id="H92CDE0863F1149689638BE9CF3637B57"><enum>(2)</enum><text>by redesignating paragraphs (22) through (32) as paragraphs (23) through (33), respectively; and</text></paragraph> <paragraph id="H33FB01B107AF4E679ED0FF2AAC0866D1"><enum>(3)</enum><text>by inserting after paragraph (21) the following new paragraph:</text>

<paragraph id="H7EE6DD8CDB8E4748B590A29A0C797FE6"><enum>(22)</enum><text>perform research to facilitate and support the development of a voluntary, consensus-based set of technical standards, guidelines, best practices, methodologies, procedures, and processes for engineering biology, biomanufacturing, biotechnology, and biometrology;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF4D97683A83748CDA8F132B71808481A"><enum>(b)</enum><header>Biometrology laboratory program</header><text>The National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/271">15 U.S.C. 271 et seq.</external-xref>) is amended—</text> 
<paragraph id="HEF214B5135FF43948F88843679F2E2D4"><enum>(1)</enum><text>by redesignating section 36 (<external-xref legal-doc="usc" parsable-cite="usc/15/271">15 U.S.C. 271</external-xref> note) as section 37; and</text></paragraph> <paragraph id="H98BF94B942F54B1BBA3E45F10898BD3E"><enum>(2)</enum><text>by inserting after section 35 (<external-xref legal-doc="usc" parsable-cite="usc/15/278t">15 U.S.C. 278t</external-xref>) the following new section:</text>

<section id="H34A6EB82C593471BACBFE5334D5B9603"><enum>36.</enum><header>Biometrology laboratory program</header> 
<subsection id="H7F403E5E53D745F7A4F94656B74F9EA1" commented="no">
                                <enum>(a)</enum>
                                <header>In general</header>
 <text>The Secretary, acting through the Director, shall establish a program of measurement research for engineering biology, biomanufacturing, and biotechnology (in this section referred to as the <quote>biometrology laboratory program</quote>).</text>
                            </subsection> 
<subsection id="H6503E6520197427F96700D603DD545C9"><enum>(b)</enum><header>Purposes</header><text>The purposes of biometrology laboratory program are the following:</text> <paragraph id="H35BAD95F7A8B44749107AD13E4D77BAE" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">To enable innovation and industrial competitiveness in engineering biology, biomanufacturing, and biotechnology.</text></paragraph> 
<paragraph id="H243A376D3A85440897B5411FFD736648"><enum>(2)</enum><text>To improve the accuracy, interoperability, and reliability of biological data and materials.</text></paragraph> <paragraph id="H6BFC82E9645A40819D4311BE610529FF"><enum>(3)</enum><text>To support the safe, secure, and responsible development and application of biological technologies across sectors to support economic and national security.</text></paragraph></subsection> 
<subsection id="HFD472A450AB644A3BFCEE10DD36BC027"><enum>(c)</enum><header>Activities</header><text>In carrying out the biometrology laboratory program, the Director shall carry out the following:</text> <paragraph id="H609987BB8CDD47208577F9FFAA652C47" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Support basic measurement science and technology research for engineering biology, biomanufacturing, and biotechnology to advance the following:</text> 
<subparagraph id="HC47EE6592966435691A9A9E1156BE037" commented="no"><enum>(A)</enum><text>Measurement technologies to support foundational understanding of the mechanisms of conversion of DNA information into cellular function.</text></subparagraph> <subparagraph id="HB7D02ED1C0B24BA385784DA4680D87A0" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Technologies for measurement of biomolecular components and related systems used for engineering biology, biomanufacturing, and biotechnology, including biomolecular components and related systems pertinent to commercial scale and distributed manufacturing of products.</text></subparagraph> 
<subparagraph id="H7CC8D54B903646CA8574D4FCFEF69B5A" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Tools, technical standards, guidelines, best practices, methodologies, procedures, and processes for biological data.</text></subparagraph> <subparagraph id="HCF05502ACAB64BE7B2088DC933200E27" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Life cycle and sustainability assessments of engineering biology, biomanufacturing, and biotechnology products.</text></subparagraph> 
<subparagraph id="H4D12B07A90E54C958BF3E370F55D317F" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">The development of technical standards, guidelines, best practices, methodologies, procedures, and processes that can inform and address biorisk, biosafety, and biosecurity concerns.</text></subparagraph> <subparagraph id="HD7FBE9F92C95434E85D81D1EE72813CC" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Other areas of measurement science and technology research determined by the Director to be critical to the development and deployment of biometrology.</text></subparagraph></paragraph> 
<paragraph id="HB17CDFD7EBEE4976A1F41F848301134F" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Inform and expand the development of measurements infrastructure needed to develop technical standards to establish interoperability and facilitate commercial development of the following:</text> <subparagraph id="HBD21627B6EE248ECA6A30BFE01D96B67" commented="no"><enum>(A)</enum><text>Biometrology technology.</text></subparagraph> 
<subparagraph id="HC77BDEF27DA3459BA56EC09580A4A6A2" commented="no"><enum>(B)</enum><text>Engineering biology, biomanufacturing, and biotechnology.</text></subparagraph></paragraph> <paragraph id="H35617CF4AD15440B964F110631FDF7F7" commented="no"><enum>(3)</enum><text>Seek to convene representatives of industry, institutions of higher education, nonprofit organizations, Federal laboratories, and other Federal agencies engaged in engineering biology, biomanufacturing, and biotechnology research and development to develop coordinated technical roadmaps for authoritative measurement of the molecular components of the cell.</text></paragraph> 
<paragraph id="H1A9C3E850E7F46ED8758955B153AC36C" commented="no"><enum>(4)</enum><text>Provide access to user facilities with advanced or unique equipment, services, materials, and other resources to industry, institutions of higher education, nonprofit organizations, and Federal, State, and Tribal government agencies to perform research and testing.</text></paragraph> <paragraph id="H9CEC1BE7A23048F0BA8BE8641598BD8F" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Establish or expand, as appropriate, collaborative partnerships or consortia with other Federal agencies engaged in engineering biology, biomanufacturing, and biotechnology research and development, institutions of higher education, Federal laboratories, and industry to advance engineering biology, biomanufacturing, and biotechnology applications.</text></paragraph> 
<paragraph id="H79F7B8DC86F446EFBE0BBAE7F2DF81FA" commented="no"><enum>(6)</enum><text>Support graduate and postgraduate research and training in biometrology.</text></paragraph> <paragraph id="HDBBF717B76C94B13B688D86A1988A8FD" commented="no"><enum>(7)</enum><text>Establish and periodically update, as appropriate, common definitions and terminology pertaining to engineering biology, biomanufacturing, biotechnology, and the bioeconomy, and maintain a publicly available lexicon of such definitions and terminology.</text></paragraph> 
<paragraph id="H5A59A3DAD0554169920CC736D054DA43" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">Support extramural research, as appropriate, that helps the Institute in advancing measurement science, standards, and guidelines for biometrology, engineering biology, biomanufacturing, and biotechnology.</text></paragraph> <paragraph id="HABB07F4A6BD743DAABDC4C83721B50E6" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">In coordination with the heads of relevant Federal agencies, as appropriate, identify where technical standards, standardized assessments, or other governance pathways are needed to manage risks and support the commercialization of novel engineering biology, biomanufacturing, and biotechnology.</text></paragraph></subsection> 
<subsection id="H5E8ECCD47242434ABF8B14D39CE652D1" commented="no"><enum>(d)</enum><header>Engineering biology foundry</header><text>In carrying out the biometrology laboratory program, and in partnership with industry, institutions of higher education, and nonprofit organizations, the Director shall support the development of engineering biology related foundries to improve measurement assurance and make the engineering of living measurement systems more predicable, scalable, and routine.</text></subsection> <subsection id="HF966016B58064F6BAF9618701FC83619" commented="no"><enum>(e)</enum><header>Outreach</header><text display-inline="yes-display-inline">In carrying out the activities under subsection (c), the Director shall seek input from other Federal agencies, institution of higher education, nonprofit organizations, and industry, on an ongoing basis, to help inform research and development priorities, including through workshops and other multistakeholder activities.</text></subsection> 
<subsection id="H75592DF5B87840938B682A6619A6E51B"><enum>(f)</enum><header>Coordination</header> 
<paragraph id="H53B9FCEFB99046538997D6644B12CA2C"><enum>(1)</enum><header>Federal departments and agencies</header><text display-inline="yes-display-inline">In carrying out the activities under subsection (c), the Director shall coordinate with the heads of appropriate Federal departments and agencies, including the Executive Office of the President and the National Engineering Biology Research and Development Initiative established pursuant to section 10402 of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19132">42 U.S.C. 19132</external-xref>).</text></paragraph> <paragraph id="H9ED8C5223E494D21A110313D75AAC657"><enum>(2)</enum><header>Manufacturing USA Program</header><text>The Director shall coordinate the activities carried out pursuant to subsection (c) with the Manufacturing USA Program, as the Director considers appropriate, to support United States leadership in biomanufacturing.</text></paragraph> 
<paragraph id="H71325CB7725C4ED6805FE55667962143"><enum>(3)</enum><header>Biomass feedstock utilization</header><text>The Director, as practicable and appropriate, shall support efforts relating to the coordination and development of biomass feedstock utilization with the Secretary of Energy and the Biomass Research and Development Board established pursuant to section 9008 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8108">7 U.S.C. 8108</external-xref>).</text></paragraph></subsection> <subsection id="HB6F507CCD4984428950E3FC5A28D34FD" commented="no"><enum>(g)</enum><header>Controls</header><text>In carrying out the biometrology laboratory program, the Director shall ensure proper security controls are in place to protect sensitive information, as appropriate.</text></subsection> 
<subsection id="H89935938C67947349FD21AB093DDBBC9" commented="no"><enum>(h)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than three years after the date of the enactment of this section, the Director shall submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Institute, a report regarding the implementation by the Institute of the biometrology laboratory program.</text></subsection> <subsection id="HD18487E3D05C405494C2547D0B7DF927" commented="no"><enum>(i)</enum><header>Implementation plan</header><text display-inline="yes-display-inline">Not later than the end of the first fiscal year after the date of the enactment of this section, the Director shall submit to the Committee on Science, Space, and Technology and the Committee on Appropriations of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Appropriations of the Senate, and make available on a public website of the Institute, a plan to carry out the biometrology laboratory program, including the following:</text> 
<paragraph id="H71E18ECF258E45F08BB203D9FA046F21" commented="no"><enum>(1)</enum><text>A plan for establishing the Biometrology Laboratory Program within the Institute as described by this section, including in relation to the Institute’s Material Measurement Lab and Physical Measurement Lab.</text></paragraph> <paragraph id="HE26C241178D34F9F8E5C93C6426FA2A6" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A plan of how the Institute will carry out the biometrology laboratory program’s activities under section.</text></paragraph> 
<paragraph id="H72D68F3919414EA99A949B19531CCC32" commented="no"><enum>(3)</enum><text>A plan of how to leverage existing Institute infrastructure and expertise to drive international cooperation for the advancement of voluntary consensus standards.</text></paragraph></subsection> <subsection id="H1E3910D52F5D4B38B44F8C24280BEE98"><enum>(j)</enum><header>Authorizations</header><text>There are authorized to be appropriated to the Director to carry out this section as follows:</text> 
<paragraph id="H26C3C62B56EF4753A80B13B41312DC97" commented="no"><enum>(1)</enum><text>$55,000,000 for fiscal year 2026.</text></paragraph> <paragraph id="H53D5DE8FF10A4526B35C8C95D306F8AA"><enum>(2)</enum><text>$60,000,000 for fiscal year 2027.</text></paragraph> 
<paragraph id="H050FC4AD7EE44E42A7BD5D1FB625882D"><enum>(3)</enum><text>$70,000,000 for fiscal year 2028.</text></paragraph> <paragraph id="H20DD9C385E0541F5A8C8C0EBF5212049"><enum>(4)</enum><text>$78,000,000 for fiscal year 2029.</text></paragraph>

<subparagraph id="HEA3D7A17BDBE46128211840DC61E4179"><enum>(D)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such code.</text></subparagraph> <subparagraph id="H8AF42389F1AC41B195B9E73805455706"><enum>(E)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></subparagraph> 
<subparagraph id="H7534AFF664864F7A8B5A3A392EF10122"><enum>(F)</enum><header>Technical standard</header><text>The term <term>technical standard</term> has the meaning given such term in section 12(d)(5) of the National Technology Transfer and Advancement Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/15/272">15 U.S.C. 272</external-xref> note).</text></subparagraph></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H3A912775529C4EA5A0B8AC74A19F140E"><enum>3.</enum><header>Technical and conforming amendments</header> <subsection id="H95B5C49DEC1041A386F6A84D9D194DA6"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 10221 of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18931">42 U.S.C. 18931</external-xref>) is repealed, and the item relating to such section in the table of contents in sections 1 and 10000 for such Act is struck.</text></subsection>

<paragraph id="H2AF2DCFE60AE493F845BC9472C4F1063" commented="no"><enum>(1)</enum><header>Bioeconomy</header><text>The term <term>bioeconomy</term> means the economic activity derived from the life sciences, particularly in the areas of biotechnology and biomanufacturing, including industries, products, services, and the workforce.</text></paragraph> <paragraph id="H2C1B1C077C134CBDA5F9383F019D49BD" commented="no"><enum>(2)</enum><header>Biological data</header><text>The term <term>biological data</term> means the information, including associated descriptors, derived from the structure, function, or process of a biological system(s) that is measured, collected, or aggregated for analysis.</text></paragraph>
