<section id="H5D05655DFE5042B6A9076CF5857284C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>OPT Fair Tax Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HDC345726B4D84983A1D7C8727E7814B0"><enum>2.</enum><header>Inclusion of optional practical training for F–1 visa holders as employment</header> <subsection id="HE2DB81CB3BCD4601BB39B575B9BBFC41"><enum>(a)</enum><header>Federal Insurance Contribution Act</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/3121">Section 3121(b)(19)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>as the case may be</quote> and inserting <quote>as the case may be, except that this paragraph shall not apply to service performed by an alien present in the United States as a nonimmigrant described in section 101(a)(15)(F)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(F)(i)</external-xref>) who is participating in optional practical training</quote>.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H3227F0FD2C004BC48E46E539C218D80C"><enum>(b)</enum><header>Social Security Act</header><text>Section 210(a)(19) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/410">42 U.S.C. 410(a)(19)</external-xref>) is amended by striking <quote>as the case may be</quote> and inserting <quote>as the case may be, except that this paragraph shall not apply to service performed by an alien present in the United States as a nonimmigrant described in section 101(a)(15)(F)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(F)(i)</external-xref>) who is participating in optional practical training</quote>.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H73088107B9D94B858528378FD2EA58D5"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services performed in calendar months beginning after the date of enactment of this Act.</text></subsection></section>
