<section id="H970A3736A8AA440B91F28EC124C8FED9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Developing Oversight for Nutrition through the Official Regulation of Milk Act</short-title></quote> or the <quote><short-title>DONOR Milk Act</short-title></quote>.</text></section> <section id="HA907844403974D69981584D409CCFEBC"><enum>2.</enum><header>Regulation of pasteurized donor human milk</header> <subsection id="H2EBA33AC315F4EFD938BB597410CB655"><enum>(a)</enum><header>Definitions</header><text>Section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>) is amended—</text> 
<paragraph id="H156308DB008C482F99A14D8130DC6FB4"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (ss)—</text> <subparagraph id="H14F342E9874E47F2A771EC088E67A2B7"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="H71695498125D4367B085F905822A73EE"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph> <subparagraph id="HC15B428F9CA849ED87066191666A04B5"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H00B9AF8F3DDE4A8FB224EDBE918C7E18"><enum>(3)</enum><text>pasteurized donor human milk.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H5347F5EE00A34634A3352917177E0ED6"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H5C25BD6D26334A56ADCD50FDA9157327" display-inline="no-display-inline"> 
<subsection id="H21E64EFA1D3F4527B8A9DFC5F3FF3275"><enum>(tt)</enum><text>The term <term>pasteurized donor human milk</term> means human milk which—</text> <paragraph id="HEA86AC7007A54ADFB6788DFC77B293E5"><enum>(1)</enum><text display-inline="yes-display-inline">is expressed by a mother and donated for use by a recipient that is not the mother’s own infant; and</text></paragraph>

                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">has been collected, pasteurized, and dispensed without additives. </text>
                            </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="HE5BF2808240A454485958E5E1020C265"><enum>(b)</enum><header>Clarification of food manufacturer registration requirement</header><text>Section 415(c)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350d">21 U.S.C. 350d(c)(1)</external-xref>) is amended by adding at the end the following: <quote>Beginning on the date of the enactment of the <short-title>DONOR Milk Act</short-title>, a food establishment that manufactures, processes, packs, or holds critical foods shall not be considered a nonprofit food establishments in which food is prepared for or served directly to the consumer and the exception in the preceding sentence shall no longer apply to such a facility</quote>.</text></subsection> <subsection id="H4E10E4C4630B4068825FC5C0CE88E586"><enum>(c)</enum><header>Annual inspections of donor human milk manufacturers</header><text>Section 412 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H8FA09F8478A94DFFA9D588FCE8A09C44"><enum>(n)</enum><header>Annual inspections of donor human milk manufacturers</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of the enactment of this subsection, and not less frequently than once each year thereafter, the Secretary shall conduct inspections, including unannounced inspections, of the facilities of each entity that manufactures, processes, packs, or holds pasteurized donor human milk in accordance with a risk-based approach to ensure compliance with relevant food safety and food labeling requirements under this Act or any other provision of law administered by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HC8B41683501E4B52AA542BC21D653262"><enum>(d)</enum><header>Compliance grants for donor human milk manufacturers</header><text>Section 412 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a</external-xref>), as amended by subsection (c) of this section, is further amended by adding at the end the following:</text>

<subsection id="HF0C8080DC8C34AD59E5A38F36353001F"><enum>(o)</enum><header>Compliance grants for donor human milk manufacturers</header> 
<paragraph id="HFA3110D4664F456CA5D097CAD7400B5B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make grants to nonprofit entities that manufacture, process, pack, or hold pasteurized donor human milk and are registered under section 415(c) to assist such entities in complying with this Act, including through assisting such entities with respect to making any upgrades in equipment, obtaining necessary certifications, and entering into contracts with third parties for food safety quality consultations.</text></paragraph> <paragraph id="H7C080EC63E504A878D303328156C1A4B"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $8,000,000, to remain available until expended, to carry out paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
