<section id="HAE22347D443F47C29CC1C3D342E868E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Enlisted and Recruits from Excessive and Catastrophic Trials Act of 2026</short-title></quote> or the <quote><short-title>PERFECT Act of 2026</short-title></quote>.</text></section> <section id="H19A3E81C16D74B92925AAA31B2527EC1"><enum>2.</enum><header>Prohibited dietary supplement ingredients and performance-enhancing substances</header> <subsection id="H4B3C217DE8BD4EF289F9A97C24053EC0"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/49">Chapter 49</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/978">section 978</external-xref> the following new section:</text> 
<quoted-block style="USC" id="H37B286C84C6F4EDFB8599EAB8A67C1CA" display-inline="no-display-inline"> 
<section id="H2D6A7FAE54EB4EEB99D8C6429F9F0949"><enum>978a.</enum><header>Prohibited dietary supplement ingredients and performance-enhancing substances</header> 
<subsection id="H23D3C7157B2249F0ABFDA0F570840A02"><enum>(a)</enum><header>Prohibited ingredient and substance lists</header><text display-inline="yes-display-inline">The Secretary shall publish and, not less frequently than once every 90 days, shall update a list of—</text> <paragraph id="H1E767C86623147DD98ADC9586C37D8F4"><enum>(1)</enum><text display-inline="yes-display-inline">dietary supplement ingredients prohibited for use by members of the armed forces; and</text></paragraph> 
<paragraph id="HAB8DA56DF7B74EFDA90AF9CD016FFE06"><enum>(2)</enum><text display-inline="yes-display-inline">performance-enhancing substances prohibited for use by members of the armed forces.</text></paragraph> </subsection> <subsection id="H561BF1B42E4D4F7F99BEB3AEF21B1F35" commented="no"><enum>(b)</enum><header>Required formats</header><text display-inline="yes-display-inline">The Secretary shall publish the list under subsection (a)—</text> 
<paragraph id="H7DC1BCFE902A4DFEADC4E67C62231CCB" commented="no"><enum>(1)</enum><text>on an internet website where such list may be viewed in full without use of a search function;</text></paragraph> <paragraph id="HC97A94202F73442B80EB8B1E215EBD7A" commented="no"><enum>(2)</enum><text>in a searchable database; and</text></paragraph> 
<paragraph id="H0DB4D95574974BC4B2904A4A273E2F25" commented="no"><enum>(3)</enum><text>in a digital file that may be downloaded from such internet website in a common format.</text></paragraph></subsection> <subsection id="H28477EAA5D7B4CE7BE7BF615B2F46E6C"><enum>(c)</enum><header>Commanding officer may elect not to discipline</header><text display-inline="yes-display-inline">The commanding officer of a member of the armed forces who possesses or uses a dietary supplement containing an ingredient (other than a substance included in the schedule under section 202 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>)) appearing on the list under subsection (a)(1)—</text> 
<paragraph id="HCEF65BE70F954E80A08AC5251243CB59"><enum>(1)</enum><text>may elect not to subject such member to discipline if—</text> <subparagraph id="HBC114FF3148C49738DD1710AB0EF1872"><enum>(A)</enum><text display-inline="yes-display-inline">such possession or use is the first disciplinary offense committed by such member;</text></subparagraph> 
<subparagraph id="H2D72091AA5704EA2B4E28BD5FE7EC81B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">such commanding officer determines that such member satisfies the good faith standard under subsection (e); and</text> </subparagraph> <subparagraph id="H4222E6F7FDF849248D37BA14E81444DC"><enum>(C)</enum><text>such member agrees to participate in education, counseling, or drug testing in lieu of discipline; and</text></subparagraph></paragraph> 
<paragraph id="HC1624CC267B94820A870887CE0E31E0A"><enum>(2)</enum><text>may elect not to subject such member to administrative separation.</text></paragraph></subsection> <subsection id="HB41637B6B9124B469F6FBBC887FC1BE2" commented="no"><enum>(d)</enum><header>Possession of prohibited ingredient not drug abuse</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, possession of a dietary supplement containing an ingredient (other than a substance included in the schedule under section 202 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>)) appearing on the list under subsection (a)(1) shall not constitute drug abuse for purposes of this title.</text></subsection> 
<subsection id="H20CB802DFC6D48E3B2A6465544A8B992" commented="no"><enum>(e)</enum><header>Good faith standard</header><text display-inline="yes-display-inline">A member of the armed forces satisfies the good faith standard under this subsection if such member—</text> <paragraph id="H33C3F78622A94FF4A6EA424B2C86D7D0" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">possesses or uses a dietary supplement containing an ingredient (other than a substance included in the schedule under section 202 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>)) appearing on the list under subsection (a)(1) without actual knowledge that such dietary supplement contains such ingredient;</text></paragraph> 
<paragraph id="H9730D9DC32E84029B60CA8F75491D3BB" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">purchases such supplement from a retail facility affiliated with the Department of Defense;</text></paragraph> <paragraph id="H7E904E27FFEE4905BD5A85E2A1BBEEB6" commented="no"><enum>(3)</enum><text>reasonably relies, prior to purchasing or using such supplement, on a search of the list under subsection (a)(1) that fails to identify such ingredient as prohibited under subsection (a)(1), including due to a misspelling or variation in the name of such ingredient on such list; or</text></paragraph> 
<paragraph id="HD0DB4C56B5344447934333E10B4BF6AD" commented="no"><enum>(4)</enum><text>otherwise demonstrates a reasonable belief that such supplement does not contain such ingredient.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7F897D5F2AC149E6ACEB4F818DAF07F1"><enum>(b)</enum><header>Secretary to update Department of Defense Instruction</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense, acting through the Under Secretary for Personnel and Readiness, shall revise Department of Defense Instruction 6130.06 pursuant to section 978a of title 10, United States Code, as added by subsection (a).</text> </subsection> 
<subsection id="H8709500BCE0C409D88F8952D4F7A04D4"><enum>(c)</enum><header>Secretary to update Operation Supplement Safety internet website</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary shall—</text> <paragraph id="H65C412855FF24EDEB7337EEF38AAD06C" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">update the Operation Supplement Safety internet website to enhance functionality for—</text> 
<subparagraph id="H62AE1766F1F3433EB7567B15F1131D0C" display-inline="no-display-inline"><enum>(A)</enum><text>vendors of dietary supplements; and</text></subparagraph> <subparagraph id="HFCEBE0F58CAC475294A7B8D6F869F7BD"><enum>(B)</enum><text>members of the Armed Forces; and</text></subparagraph></paragraph> 
<paragraph id="H5E6C413E4301499792FC909C79CFAE2F"><enum>(2)</enum><text display-inline="yes-display-inline">review possible improvements to such internet website, including with respect to—</text> <subparagraph id="H23B950CD9D0946F1980E3C314AAB99BE"><enum>(A)</enum><text>search tools that employ—</text> 
<clause id="HB748ADEA4AA34393B1ED277B341AC54E"><enum>(i)</enum><text>autofill functionality; and</text></clause> <clause id="HA9770C1770A548C58C2905044611A8CE"><enum>(ii)</enum><text>autocorrect functionality;</text></clause></subparagraph> 
<subparagraph id="H3F3505F785B04685B13ADBBD1D379B5C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">artificial intelligence tools that can—</text> <clause id="H05F7732FF033400EBDE75BC2E0FA20B6"><enum>(i)</enum><text>scan product labels; and</text></clause> 
<clause id="HD623E3F6F858494CB1DF3743E9E1C220"><enum>(ii)</enum><text>search such internet website for information on the ingredients found on such labels; and</text></clause></subparagraph> <subparagraph id="H048816F703104BAF8BEBD7B7902D8863" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">capacity to allow a user to register to receive a notification when a dietary supplement ingredient is added to the list under section 978a(a)(1) of title 10, United States Code, as added by subsection (a).</text></subparagraph></paragraph></subsection> 
<subsection id="HCD63902B86094F7192A316EEFBF0F2EE" commented="no"><enum>(d)</enum><header>Secretary to review dietary supplement safety education opportunities</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary shall review opportunities for incorporating into existing training programs for members of the Armed Forces education concerning—</text> <paragraph id="H6E383785B12D4159B1545FED1F35495F" commented="no"><enum>(1)</enum><text>dietary supplement safety; and</text></paragraph> 
<paragraph id="H7FB7F85F4D7349E0B4F3513E77AB6BDF" commented="no"><enum>(2)</enum><text>the list under section 978a(a) of title 10, United States Code, as added by subsection (a).</text> </paragraph></subsection> <subsection id="H69017809DF124073A5F52A9DCB1F67B7"><enum>(e)</enum><header>Reports</header> <paragraph id="H6A65C5889BD1416F861879BDFB12D09C"><enum>(1)</enum><header>Initial implementation report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report describing efforts made to ensure that retail facilities affiliated with the Department of Defense do not sell any products containing an ingredient appearing on the list under section 978a(a) of title 10, United States Code, as added by subsection (a).</text></paragraph> 
<paragraph id="H49E7E99E14524343907CB279544810D6"><enum>(2)</enum><header>Final implementation report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Secretary shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report describing steps taken to implement section 978a of title 10, United States Code, as added by subsection (a).</text></paragraph> <paragraph id="H4BB92775553A4A2B82FE7EF7DCD24B9C" commented="no"><enum>(3)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter for a period of five years, the Secretary shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report—</text> 
<subparagraph id="H8C8C9B27A66745BDAF7CB414A7C978F6" commented="no"><enum>(A)</enum><text>listing, for the one-year period ending on the date on which such report is submitted—</text> <clause id="HC01503B09FD445FB893C77682E17FB24" commented="no"><enum>(i)</enum><text>the total number of administrative separation actions initiated for possession or use of a dietary supplement containing an ingredient appearing on the list under section 978a(a)(1) of title 10, United States Code, as added by subsection (a), disaggregated by—</text> 
<subclause id="HB255D1A4DC9A425C8207CD1FB864760C" commented="no"><enum>(I)</enum><text>armed force;</text></subclause> <subclause id="HA631CF8E08CB43AFA4350E49ED34D4E0" commented="no"><enum>(II)</enum><text>pay grade;</text></subclause> 
<subclause id="HF5E8B9E7296F4E23AEF849CBA327FDAB" commented="no"><enum>(III)</enum><text>characterization of discharge sought;</text></subclause> <subclause id="H0E5EA8CE047A48ACBE1E7DDBA0D614D7" commented="no"><enum>(IV)</enum><text>whether the member subject to the administrative separation action contested such action; and</text></subclause> 
<subclause id="HC4A7DACCE2E34F0CAD7B1330E18BD826" commented="no"><enum>(V)</enum><text>outcome; and</text></subclause></clause> <clause id="H32F1C2675060499BA65C2E66F9137BDD" commented="no"><enum>(ii)</enum><text>the number of commanding officers who elected not to subject a member of the Armed Forces to discipline under section 978a(c) of such title; and</text></clause> </subparagraph> 
<subparagraph id="H69DA3BD6F6584903A967C7CC59B50BF7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">assessing the effectiveness of efforts to provide education relating to dietary supplement safety to members of the Armed Forces.</text></subparagraph></paragraph></subsection> </section> </legis-body></bill>
