which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Housing and Community Development Act to prohibit grant funding to Sanctuary Cities and codify ‘Mixed-Status’ rule to prevent the prorating of housing assistance to households with illegal alien residents.</official-title></form><legis-body id="HF1DC5F9871D0440588C807C3A302014B" style="OLC"><section id="HC68CBB4C13EB4A9691EA61A89DD024AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Housing Welfare for Illegal Aliens Act</short-title></quote>.</text></section><section id="H7DD696B1B5A5442994546D59601913CF" display-inline="no-display-inline"><enum>2.</enum><header>Alien Benefit Bans</header><subsection id="H9337A2D7BA60469985DEB292431AC8C9" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Restriction on use of assisted housing</header><text display-inline="yes-display-inline">Section 214(b) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" id="HDF98C59C2A01413293617E4C5306EB52" display-inline="no-display-inline"><paragraph id="HA74BCD118FD441F5952574C745B3FD42" commented="no"><enum>(2)</enum><text>If the eligibility for financial assistance of at least one member of a family has been affirmatively established under the program of financial assistance and under this section, and the ineligibility of one or more family members has not been affirmatively established under this section, the applicable Secretary shall not make any financial assistance available on any prorated basis until eligibility has been affirmatively established for all members of a family regardless of age.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC83CEEFAC92D4599927E01F8B399B81D" commented="no"><enum>(b)</enum><header>Removal of assistance</header><text display-inline="yes-display-inline">Section 214 of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>) is amended by striking subsection (c) and redesignating the following subsections accordingly.</text></subsection><subsection id="H1F3A79B7732B49798BACDD62E5F31A51"><enum>(c)</enum><header>Verification of eligibiliy for housing assistance</header><text display-inline="yes-display-inline">Section 214(i)(1) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a(i)(1)</external-xref>) is amended—</text><paragraph id="HA0A4EEEC10FA450F9B41A315D3E6A756"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>at least the individual or one family member</quote> and inserting <quote>individual and all family members regardless of age</quote>; and</text></paragraph><paragraph id="HFBE35E05B2414B9E8EFE4C394EC58835"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H6D71E4F3E89846868DEF273D5C4E8BEF" display-inline="no-display-inline"><paragraph id="HEAFE5E5891F74EAE9EF93923D7920813"><enum>(4)</enum><header>Prorated assistance</header><text display-inline="yes-display-inline">With respect to pending verification of eligibility as described in paragraph (1), the applicable Secretary may not provide any financial assistance to any individual or family on any prorated basis until verification of eligibility has been confirmed for all individuals or family members regardless of age.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H38B78DD69F8B43699C0FE4995B1BF56A" display-inline="no-display-inline"><enum>(d)</enum><header>Prohibition on assistance for persons not lawfully present</header><text display-inline="yes-display-inline">Section 105 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H50238A0D785B4473A0D9259F4632D86C" display-inline="no-display-inline"><subsection id="HA98A9A3957E545309209991C8D9FDDDC"><enum>(i)</enum><header>Prohibition on use of assistance for persons not lawfully present</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no amount from a grant under section 106 made in fiscal year 2024 or any succeeding fiscal year may be used to assist persons who are neither a national of the United States nor lawfully admitted for permanent residence under section 101(a)(20) of the Immigration and Nationality Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H808C192C41094B1E9694969D440F045D"><enum>(e)</enum><header>Prohibition on grants to entities that provide assistance to persons not lawfully present</header><text>Section 103 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5303">42 U.S.C. 5303</external-xref>) is amended—</text><paragraph id="H6A5188041B814A17A34FF2E05735C3AA"><enum>(1)</enum><text>by striking <quote>The Secretary is authorized to</quote> and inserting:</text><quoted-block style="OLC" id="H5553A41097AC4A0CBCCD5DD85A6F4E9F" display-inline="no-display-inline"><subsection id="HF9B71E8F43474DC69E8749AE2ABC8080"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized to</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H0960EBE5A0A9442DB9DA1E06CDCF1D06"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H6760EDFF2DB547D68689EB693647C66B" display-inline="no-display-inline"><subsection id="H099F2844DCE04A15BEF1DD3814B11ADE"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not make a grant to any State, unit of general local government, Non-Governmental Organization, entity, or Indian Tribe to carry out activities in accordance with the provisions of this title if such State, unit of general local government, Non-Governmental Organization, entity, or Indian tribe carries out any housing or community development related program that provides assistance to persons who are neither a national of the United States nor lawfully admitted for permanent residence under section 101(a)(20) of the Immigration and Nationality Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC73D2D060F8C4EFC9B8FC835A7B92DA1" display-inline="no-display-inline"><enum>(f)</enum><header>CDBG and HOME grants</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development may not provide a grant under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) or title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12721">42 U.S.C. 12721 et seq.</external-xref>) to any State, unit of general local government, entity, or Indian Tribe that—</text><paragraph id="H51B34B64D1A14F94AA4A63C433907148"><enum>(1)</enum><text>does not comply with section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>);</text></paragraph><paragraph id="HC5B288005C0D46A78B25EE087C4A5E0F"><enum>(2)</enum><text>declines to honor requests for detainment from Immigration and Customs Enforcement;</text></paragraph><paragraph id="H32F902C976014558898572A7BB1C44CD"><enum>(3)</enum><text>restricts cooperation with Federal immigration enforcement; or</text></paragraph><paragraph id="H51E2C0BA487D4AC2927C12B2C148597C"><enum>(4)</enum><text>fails to provide advanced notice of release of removable noncitizens.</text></paragraph></subsection></section></legis-body></bill>
