<section id="HBFA31847BAFF461DBB137E166F298B75" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>At Home Observation and Medical Evaluation Services Act of 2026</short-title></quote> or the <quote><short-title>At HOME Services Act</short-title></quote> .</text></section> <section id="HADAD24B8D77D4BB490C98F5CE3CF399A"><enum>2.</enum><header>Demonstration program for hospitals to provide outpatient observation services to Medicare beneficiaries at home</header><text display-inline="no-display-inline">Title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) is amended by inserting after section 1866G the following new section:</text>

<section id="HAB938F40426B4FDBA39E444263BD56F1"><enum>1866H.</enum><header>Demonstration program for hospitals to provide outpatient observation services at home</header> 
<subsection id="H64691399AEA447B3A20533E7C9BFE802"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall implement a 2-year demonstration program (in this section referred to as the <quote>Program</quote>) for hospitals to provide outpatient observation services to eligible beneficiaries in the homes of such beneficiaries. In implementing such Program, the Secretary shall grant waivers and flexibilities (as described in <internal-xref idref="H490E32593E6A4241A76A3793565AF9F7" legis-path="1866H.(b)">subsection (b)</internal-xref>) to an individual hospital that submits a request for such waivers and flexibilities and meets specified criteria (as described in <internal-xref idref="H9A4CC3519C9441BC9B0A2D08D890BFE4" legis-path="1866H.(c)">subsection (c)</internal-xref>) in order to participate in the Program.</text></subsection> <subsection id="H490E32593E6A4241A76A3793565AF9F7"><enum>(b)</enum><header>Waivers and flexibilities</header><text display-inline="yes-display-inline">For the purposes of <internal-xref idref="H64691399AEA447B3A20533E7C9BFE802" legis-path="1866H.(a)">subsection (a)</internal-xref>, the waivers and flexibilities described in this paragraph are the following waivers and flexibilities that are made available to individual hospitals under the Acute Hospital Care at Home initiative of the Secretary during the period described in section 1866G(a)(1):</text> 
<paragraph id="H3837DC3721E3412DA554701F3A574DE0"><enum>(1)</enum><text>Subject to <internal-xref idref="H6AB0E9BD4689455DBC48559EAEDF81CD" legis-path="1866H.(c)(2)">subsection (c)(2)</internal-xref>, waiver of the requirements to provide 24-hour nursing services on premises and for the immediate availability of a registered nurse under section 482.23(b) of title 42, Code of Federal Regulations (or any successor regulation), and the waivers of the physical environment and Life Safety Code requirements under section 482.41 of title 42, Code of Federal Regulations (or any successor regulation).</text></paragraph> <paragraph id="H5FBF8B7C07434D58B019FA846E5D2D67"><enum>(2)</enum><text>Waiver of the telehealth requirements under clause (i) of section 1834(m)(4)(C), as amended by section 4113(a) of the Health Extenders, Improving Access to Medicare, Medicaid, and CHIP, and Strengthening Public Health Act of 2022, such that the originating sites described in clause (ii) of such section shall include the home or temporary residence of the individual.</text></paragraph> 
<paragraph id="H2FE02669F3564171A33E3651EAA6E219"><enum>(3)</enum><text>Other waivers and flexibilities that, as of the date of enactment of this section, were in place for such initiative during such emergency period.</text></paragraph></subsection> <subsection id="H9A4CC3519C9441BC9B0A2D08D890BFE4"><enum>(c)</enum><header>Specified criteria</header><text>For purposes of subsection (a), the specified criteria for granting such waivers and flexibilities to individual hospitals are:</text> 
<paragraph id="H307A5908206742ED9BCD7BF57AC3B73F"><enum>(1)</enum><text>The hospital and any other entities providing services under arrangements with the hospital shall ensure that the standard of care to treat an eligible beneficiary at home is the same as the standard of care to treat such beneficiary as an inpatient of the hospital.</text></paragraph> <paragraph id="H6AB0E9BD4689455DBC48559EAEDF81CD"><enum>(2)</enum><text>The hospital shall meet all patient safety standards determined appropriate by the Secretary, in addition to those that otherwise apply to the hospital, except those for which the waivers and flexibilities under this subsection apply.</text></paragraph> 
<paragraph id="H0F3FF7E25FF84A37A56BA0CD1BBC15A2"><enum>(3)</enum><text>The hospital shall provide to the Secretary, at a time, form and manner determined by the Secretary, any data and information the Secretary determines necessary to do the following:</text> <subparagraph id="HBF00F37CA0EB4E7CBF24F63B5799B57A"><enum>(A)</enum><text>Monitor the quality of care furnished, and to the extent practicable ensure the safety of, eligible beneficiaries and analyze costs of such care.</text></subparagraph> 
<subparagraph id="HDF921838571B492ABB9E513921A11AEF"><enum>(B)</enum><text>Undertake the study described in <internal-xref idref="HECB3E63265C744A88F09746D83AA8925" legis-path="1866H.(e)">subsection (e)</internal-xref>.</text></subparagraph></paragraph> <paragraph id="H7F3CDF82CC504C80BC25349099470FBB"><enum>(4)</enum><text>The hospital meets such other requirements and conditions as the Secretary determines appropriate.</text></paragraph></subsection> 
<subsection id="HE50E809F1B02472892DA165B0022A6EE"><enum>(d)</enum><header>Termination</header><text>The Secretary may terminate a hospital from participation in the Program (and the waivers and flexibilities applicable to such hospital) if the Secretary determines that the hospital no longer meets the criteria described in <internal-xref idref="H9A4CC3519C9441BC9B0A2D08D890BFE4" legis-path="1866H.(c)">subsection (c)</internal-xref>.</text></subsection> <subsection id="HECB3E63265C744A88F09746D83AA8925"><enum>(e)</enum><header>Study and report</header> <paragraph id="HA3EC9EEE8C704709991D05118D64233C"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct a study to—</text> 
<subparagraph id="H2BDCBDE0114F47FEB1752CABCB878105"><enum>(A)</enum><text>analyze, to the extent practicable, the criteria established by hospitals to determine which beneficiaries may be furnished services under the Program; and</text></subparagraph> <subparagraph id="HBC119550F0EA44B3978D55B72326F0C7"><enum>(B)</enum><text>analyze and compare, to the extent practicable—</text> 
<clause id="H40F68B257BAE4AEBBEBD3382EC881B4C"><enum>(i)</enum><text>the quality of care furnished to beneficiaries with similar conditions and characteristics in the hospital setting and through the Program, including health outcomes, hospital readmission rates, hospital mortality rates, length of stay, infection rates, and patient experience of care;</text></clause> <clause id="H2E379C3ACA234986962CA6E1F37EAA19"><enum>(ii)</enum><text>clinical conditions treated and diagnosis-related groups of discharges from the hospital setting and under the Program;</text></clause> 
<clause id="HC7F8A069AF6845E48FF94DD82F498E72"><enum>(iii)</enum><text>costs incurred by furnishing care in the hospital setting and through the Program;</text></clause> <clause id="H5B459DA61843457FB0610293F4408652"><enum>(iv)</enum><text>the quantity, mix and intensity of such services (such as in-person visits and virtual contacts with patients) furnished under the Program and furnished in the hospital setting; and</text></clause> 
<clause id="H6F1A57F045BF42958C6D8468D954622B"><enum>(v)</enum><text>socioeconomic information on beneficiaries treated under the Program, including racial and ethnic data, income, and whether such beneficiaries are dually eligible for benefits under this title and title XIX.</text></clause></subparagraph></paragraph> <paragraph id="HFE9FA3ECBD2E4C28B36D06D8B94FF76B"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the completion of the Program, the Secretary shall post on a website of the Centers for Medicare &amp; Medicaid Services a report on the study conducted under paragraph (1).</text></paragraph></subsection> 
<subsection id="H63B69217891E445D90BB76449E8529CB"><enum>(f)</enum><header>Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary may implement this section by program instruction or otherwise.</text></subsection> <subsection id="H3E5A2163EBBD4F579922127391222AC2"><enum>(g)</enum><header>Publicly available information</header><text>The Secretary shall, as feasible, make the information collected under subsections (c)(3) and (e)(1) available on the Medicare.gov Internet website (or a successor website). </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
