<section id="HA6DC023D745C4EBCBD95AC327A3A0920" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bioindustrial Infrastructure for Open Scale-up, Commercialization, and Accelerated Launch Ecosystems Act</short-title></quote> or the <quote><short-title>BIO-SCALE Act</short-title></quote>.</text></section> <section id="H04D325FC310C453E9F1A0586E690AEDB"><enum>2.</enum><header>Technology maturation facility program</header> <subsection commented="no" display-inline="no-display-inline" id="H398470919D874072B46755E8FCD573B1"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph commented="no" display-inline="no-display-inline" id="H3B6075FD197C4318A124DDDA5C584173"><enum>(1)</enum><header>Bioindustrial sector</header><text>The term <term>bioindustrial sector</term> means industries involved in producing bio-based chemicals, fuels, materials, and other products through biological and biochemical processes.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF0A71CBC7CD0417CB34DD4D2A64EA783"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entity</header><text>The term <term>eligible entity</term> means public and private foundations and nonprofit organizations, including institutions of higher education, that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HC24D7F2A123F4DFEBC2A76EB109954B5"><enum>(A)</enum><text display-inline="yes-display-inline">are incorporated in the United States; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7A9DF8337958417AB4B220A34BF91A35"><enum>(B)</enum><text>operate primarily in the United States. </text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H32C9529E84F047EA86220DDF420046AA"><enum>(3)</enum><header display-inline="yes-display-inline">Facility</header><text>The term <term>facility</term> means a facility established under subsection (c).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF56DC1903A8440DA91736A198ED2D09F"><enum>(4)</enum><header>Feedstock</header><text>The term <term>feedstock</term> means raw material used as input for industrial processes to produce biofuels, chemicals, or materials, such as agricultural byproducts, microbial or algal biomass, synthetic biological products or components, and waste oils.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC1BF6911D56D4113B24175E04097A723"><enum>(5)</enum><header>Open access</header><text>The term <term>open access</term> means the use of infrastructure, data, or research resources that are—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H01B7E936290D46DFACF6B90697E3702C"><enum>(A)</enum><text display-inline="yes-display-inline">available without licensing or intellectual property barriers; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE84E322643A04A7CAB070CA7E66FBD0D"><enum>(B)</enum><text>accessible to public and private entities on an equitable basis.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HAD9D8F739FD44FD68B74DCBBD77EC212"><enum>(6)</enum><header>Product-agnostic</header><text>The term <term>product-agnostic</term>, with respect to a facility, technology, or process means that the facility, technology, or process can accommodate a variety of end products without being limited to a specific output.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6F9347AA4A844B0A906B214CF85E56EB"><enum>(7)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Assistant Secretary for Economic Development. </text></paragraph> <paragraph id="H3C2934EE132F4D77B1B693266B7363D2"><enum>(8)</enum><header>Technology maturation</header><text>The term <term>technology maturation</term> means the development, testing, and scaling of technologies to a level of readiness suitable for commercialization or integration into industrial processes, including activities such as prototyping, pilot-scale testing and demonstration, and early-stage manufacturing and market entry. </text></paragraph></subsection>
<subsection id="HF9950AA75C894A7CA966D4583849156A"><enum>(b)</enum><header>Purpose</header><text>The purpose of this section is to establish technology maturation facilities to provide world-class capabilities, positioning the United States as a leader in bioindustrial innovation and enabling participation in groundbreaking projects through state-of-the-art infrastructure.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H439D2348516C4DE39CF0A06249250F5B"><enum>(c)</enum><header>Establishment</header> <paragraph commented="no" display-inline="no-display-inline" id="H62C23A5147B347EAB1AAE38A89F25CC8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish not less than 3 regional, nonprofit, open access, product-agnostic technology maturation facilities for the bioindustrial sector to ensure the integration of advanced and emerging capabilities such as solid-state, gas, and continuous fermentation methods, biomass processing equipment, and scalable commercial-grade fermentation tanks of capacity ranging from 1,500 to over 75,000 liters.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA482D2AD82D04E5996093171FF402FB2"><enum>(2)</enum><header>Operation</header><text>In carrying out this section, the Secretary shall— </text> <subparagraph commented="no" display-inline="no-display-inline" id="H36499CA5965642D58EE1797D72370914"><enum>(A)</enum><text display-inline="yes-display-inline">use a competitive process to carry out paragraph (1) through the award of—</text>
<clause commented="no" display-inline="no-display-inline" id="H36D731ABA64C49C9B3954EDCFD7128C0"><enum>(i)</enum><text display-inline="yes-display-inline">planning grants or cooperative agreements to eligible entities for the design, construction, and operation of the facilities; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HE7DA932D012B44C8A4B443E3FCE540F5"><enum>(ii)</enum><text>implementation grants or cooperative agreements to eligible entities that were awarded and completed a planning grant or cooperative agreement under clause (i); and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H41E7FFBEA4A443729778F898461C0F99"><enum>(B)</enum><text>facilitate commercialization activities and technology transfer in coordination with any applicable programs of the Department of Energy and the Department of Defense.</text></subparagraph></paragraph></subsection> <subsection id="HED54BB4809874DA4BBDE61A2FE35FAFA"><enum>(d)</enum><header>Implementation plan</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to Congress a report on plans to implement this section, including, at a minimum—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H2260818004F54B66993CF2FF4A7E7336"><enum>(1)</enum><text display-inline="yes-display-inline">finalized site selection criteria and a description of the decisionmaking process that will be used, including a timeline for selecting facilities;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEC676F3E12B84DE2B1971528CA696E99"><enum>(2)</enum><text>funding allocation methodologies and a description of the decisionmaking process that was used in developing those methodologies;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2F86A211F1C745E2A4566B591B5F4D99"><enum>(3)</enum><text>design specifications for facilities, including a plan for consulting with entities outside of the Department of Commerce, as appropriate;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE8DDD021FF16408BB784232A41077076"><enum>(4)</enum><text>an outreach strategy for soliciting proposals and engaging key stakeholders across industry, academia, and government, including specific goals to advance the leadership of the United States in the biotechnological and bioindustrial sectors; </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE864FA7C0D7446ACA5A995C0FDCC17E6"><enum>(5)</enum><text>considerations for how facilities may—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HB56CA1B65D754C738E313A87CA865785"><enum>(A)</enum><text display-inline="yes-display-inline">complement existing infrastructure of the Department of Energy, the Department of Defense, and other facilities; </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD606CA10CE4A40FC80B525AD182440AA"><enum>(B)</enum><text>ensure increased production levels by functioning as a connected network, including by providing fermentation capacity that covers the full range needed for precommercial scale-up; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6A1C2067073345E8A66FC9F2C491B64E"><enum>(C)</enum><text>build on existing initiatives to increase local or regional job opportunities and economic growth and competitiveness; and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H158008A7C1BB43D2A7CF96B4A8A25539"><enum>(6)</enum><text>how the Secretary intends to coordinate with other Federal agencies, such as the Department of Energy and the Department of Defense, to ensure the effective usage of funds, development of capabilities, and prioritization of biotechnologies. </text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H95AA552D1D5F4CA1BC7F559339759E07"><enum>(e)</enum><header>Proposals and selection</header> <paragraph commented="no" display-inline="no-display-inline" id="H40BE2501BC624845948F95F12F0D04A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H55BD5E00B3134059AFA92698DF0B1021"><enum>(A)</enum><text>solicit proposals from eligible entities for the design, construction, and establishment of the facilities; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H30EA2FE3DB4B48ACA2CCE0AE6A80A2E8"><enum>(B)</enum><text>select not less than 3 facilities.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD19FC929EB824829B11A13FB1A20F98D"><enum>(2)</enum><header>Considerations</header><text>In selecting facilities under paragraph (1)(B), the Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H3E7D5BB51B9A4B308B9AB9585DC90F2A"><enum>(A)</enum><text>ensure that the facilities are geographically distributed throughout the United States, with preference given to proposals for—</text>
<clause commented="no" display-inline="no-display-inline" id="HC16D146871F24366AFA299944E13B19A"><enum>(i)</enum><text display-inline="yes-display-inline">facilities located near major feedstock sources; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD675ECE15E794967A25F846A00584114"><enum>(ii)</enum><text>facilities located in areas with established bioindustrial capabilities;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBA08F244C2C9476BAA6960E23E2189E7"><enum>(B)</enum><text>give preference to proposals for—</text> <clause commented="no" display-inline="no-display-inline" id="H4ED7FEFF929D42A181BEF204FDFB739E"><enum>(i)</enum><text display-inline="yes-display-inline">facilities in regions with a demonstrated need for enhanced infrastructure, especially in rural areas; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H800E1B4C70EE4CF09785349F5EAE89ED"><enum>(ii)</enum><text>facilities from eligible entities already engaged in biotechnological and bioindustrial activities. </text></clause></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HAE5B0F517E6F40B4900583CD9CDF6D32"><enum>(f)</enum><header>Use of funds</header> <paragraph commented="no" display-inline="no-display-inline" id="H14F997BF759D4189AF0D62DDD0D77C95"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Funds provided for a facility under this section shall be used for construction, equipment procurement, and initial operating expenses of the facility.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE8C38690425C47258734BD1C5E0ACD46"><enum>(2)</enum><header>Deadline</header><text>Funds provided for a facility under this section shall be expended by—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HDC449ECF6D294C808665626D957124E6"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 2 years after the date on which the amounts were provided to the facility, in the case of a facility that has existing infrastructure and resources, as determined by the Secretary; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC7B81265672F469489ACD73620E359B7"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 3 years after the date on which the amounts were provided to the facility, in the case of a facility that is to be constructed. </text></subparagraph></paragraph></subsection> <subsection id="HC9D8EC32510E4EE7930CDE33233A54C7"><enum>(g)</enum><header>Facility goals and activities</header><text>A facility shall seek—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HE153CF6E4D4545D1A31012A114581D9A"><enum>(1)</enum><text display-inline="yes-display-inline">to advance and promote technological innovation in bioindustrial processes, including fermentation, biomass processing, and downstream processing;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H54C94406A48A4B5DB6BE8366984B2892"><enum>(2)</enum><text>to strengthen national security by de-risking and accelerating the scaling up of emerging biotechnology processes and technologies;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H610897EB6487457780B529098DC02D84"><enum>(3)</enum><text>to enhance the leadership of the United States in biotechnology through the promotion of innovation, economic growth, workforce development, and job creation;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1597F031173E46218C80F972F7BBD30F"><enum>(4)</enum><text>to establish a secure digital infrastructure for data sharing and process analysis; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H998BE224773C41548FD5C6ADA5B5BEBE"><enum>(5)</enum><text>to provide unique technical capabilities to sustain the cutting-edge position of the United States in biotechnology in order to enhance economic growth and international competitiveness.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H9D4FA195346F47AE8651F17F1D78D381"><enum>(h)</enum><header>Oversight and interagency coordination and collaboration</header><text>In carrying out this section, the Secretary shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HA71298295B7946E59261147B53FAD902"><enum>(1)</enum><text display-inline="yes-display-inline">if applicable, oversee the design, construction, and establishment of the facilities to ensure the integration of advanced and emerging capabilities;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6FD3C187C08E4C9F9C118A3F23DC3998"><enum>(2)</enum><text>establish partnerships with industry, institutions of higher education, and other Federal agencies to maximize the impact and utilization of the facilities;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA1FC144A715F482F8218663DF4570BAF"><enum>(3)</enum><text>develop and implement policies to ensure equitable and open access to the facilities for public and private sector entities, with a focus on inclusion of rural communities;</text></paragraph> <paragraph id="H4E00C993810E493296E421B96E7CB3B3"><enum>(4)</enum><text>pursue cost-sharing and co-funding arrangements or opportunities with private sector stakeholders to supplement Federal funding and promote financial sustainability; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H876157374D5C4020BD6FE744299252AD"><enum>(5)</enum><text>coordinate and consult with relevant stakeholders to identify suitable locations and capabilities objectives for the facilities, which stakeholders may include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HA756346A57CE4053854733457B7EB8DA"><enum>(A)</enum><text display-inline="yes-display-inline">other Federal agencies, such as the Department of Energy, including the National Laboratories;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H8D86CFCBBDE44AD5B5647C5A4DD1F588"><enum>(B)</enum><text>the defense community, including the Department of Defense and BioMADE;</text></subparagraph> <subparagraph id="HBBE8E778D081434EADA9DA3C2991ED54"><enum>(C)</enum><text>industry partners, including nonprofit organizations;</text></subparagraph>
<subparagraph id="H2DC11B92D4F84D81A69C3A57EA073188"><enum>(D)</enum><text>the agricultural community and relevant Federal agencies, including the Department of Agriculture;</text></subparagraph> <subparagraph id="HD8B8A0B8F4994B83A403EE3DCC8C24B9"><enum>(E)</enum><text>the transportation sector and relevant Federal agencies, including the Department of Transportation;</text></subparagraph>
<subparagraph id="H20A1D47DC0924DEC9BD890377DA4A84E"><enum>(F)</enum><text>Federal education and workforce development programs, including the National Science Foundation;</text></subparagraph> <subparagraph id="H2EECB5E41B954D7792DF5990FB726263"><enum>(G)</enum><text>institutions of higher education;</text></subparagraph>
<subparagraph id="H09679680F4CE4B8887D76B0CEC6C25E1"><enum>(H)</enum><text>rural community stakeholders;</text></subparagraph> <subparagraph id="H96C1582041004832A480BB30E18FC0F6"><enum>(I)</enum><text>State and local governments; and</text></subparagraph>
<subparagraph id="H81D47ABD3193480FA65A77E89ACE13B1"><enum>(J)</enum><text>international bodies with relevant scientific expertise.</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H42498B941AD1429EBD9416EB03535EAA"><enum>(i)</enum><header>Intellectual property protections</header> <paragraph commented="no" display-inline="no-display-inline" id="H980FE1EA56254AC7930CEAE9C258ACDD"><enum>(1)</enum><header display-inline="yes-display-inline">Federal employee contributions</header><text>Any intellectual property created by a Federal employee at a facility in the performance of the duties of that employee shall be considered to be part of the public domain. </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9A4452B9D2B94C6A8A86974296BBF373"><enum>(2)</enum><header>Other entities</header><text>Any intellectual property created by an individual at a facility who is not described in paragraph (1) shall be protected under applicable intellectual property laws, subject to the terms of the agreement that the individual has entered into with the Secretary.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF8E544994A104460890D973215B84BC6"><enum>(3)</enum><header>Data sharing</header><text>To the maximum extent practicable, the facilities shall establish secure, interoperable digital systems to facilitate data exchange across government, academia, and industry. </text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H0D0D1D5D42764BE18D0D8F3ADFC4B52A"><enum>(j)</enum><header>Reports</header><text>Not less frequently than annually, the Secretary shall submit to Congress a report that includes—</text> <paragraph commented="no" display-inline="no-display-inline" id="HE1D83527B1C14AEDB8B91327D114096E"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the progress on the construction and operation of the facilities;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC254F4646B154043A4CF0F816009686A"><enum>(2)</enum><text>metrics on facility activities, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H5E20525A152142D8B7707BC8CEB3C8CA"><enum>(A)</enum><text display-inline="yes-display-inline">data on usage and participation by public and private sector entities; </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HAAA540C1329E4305AAF152C3ECE3C59E"><enum>(B)</enum><text>a description of ongoing and completed projects of the facilities related to scale-up and commercialization of biotechnologies; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5A56AC2F36974E99B1BE7B2B49684290"><enum>(C)</enum><text>any additional relevant metrics, such as—</text>
<clause commented="no" display-inline="no-display-inline" id="H7E5E677817CD492E93A174A49ABDB140"><enum>(i)</enum><text display-inline="yes-display-inline">workforce training and development, including engagement with local or regional academic institutions; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H8EDA717B13954ED686F1CAAD2608C8DF"><enum>(ii)</enum><text>domestic and local job creation;</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H66CF58EF2B2541D08B992AE30F8EE4A7"><enum>(3)</enum><text>financial reports that detail expenditures and cost-sharing contributions of the facilities, including access to private capital; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB7D7F03709F3418BB2813C39E9514722"><enum>(4)</enum><text>a description of any obstacles encountered by the facilities in carrying out facility activities and achieving the goals described in subsection (g). </text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H26CDC94ED2764AD09250DBC60F82B714"><enum>(k)</enum><header>Authorization of appropriations</header>
<paragraph commented="no" display-inline="no-display-inline" id="HF2640A41B13D4B8880C2CB729D1C83E9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary to carry out this section—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD0D9F7C95C6246F98155EE413B118933"><enum>(A)</enum><text>$345,000,000 for the period of fiscal years 2026 through 2028; and</text></subparagraph>

<paragraph commented="no" display-inline="no-display-inline" id="H17CA1C7F79184ACFA073C1FD113F83D6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the authority to establish and operate a facility under this section shall terminate on the date that is 10 years after the date of enactment of this Act.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCBF4C653E15D4AEC942DE9F490EF8F8A"><enum>(2)</enum><header>Continued operation</header><text display-inline="yes-display-inline">The Secretary may allow a facility that demonstrates successful performance to continue to operate after the date described in paragraph (1), subject to ongoing oversight by the Secretary. </text></paragraph></subsection></section>
