<section id="H026406E451C542469D83889F5DB80928" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Campaign Funds Integrity Act of 2026</short-title></quote>.</text></section> 
<section id="HE0F58EAE058744D4ADCA4E6A313884F5"><enum>2.</enum><header>Prohibition on use of campaign funds for certain financial transactions</header> 
<subsection id="HAE002FF82A1845CB955B264905163102"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 324 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30126">52 U.S.C. 30126</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H83190455A13540BAA90D9849B81DD2E4" display-inline="no-display-inline"> <section id="H7B73DABA4DF74256907347316867195B"><enum>324.</enum><header>Prohibition on use of campaign funds for certain speculative financial transactions</header> <subsection id="HEFC306EDE231405687A9662AEAE15101"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A candidate, authorized committee, or other political committee shall not use campaign funds to participate in any prediction market or event contract, including any contract or instrument whose value is derived from the outcome of an election, legislative action, regulatory decision, or other political or economic event.</text> </subsection> 
<subsection id="H137824067D4B49198A25D1BD60991145"><enum>(b)</enum><header>Enforcement and penalties</header> 
<paragraph id="HCDCE366340EE41A1BD08AA278421AD37"><enum>(1)</enum><header>In general</header><text>Any violation of this section shall be considered pursuant to the enforcement procedures under section 309, including with respect to the civil penalties authorized under such section.</text></paragraph> <paragraph id="H5151A607D7AC4A95A6ADE23BD5E41708"><enum>(2)</enum><header>Knowing and willful violations</header><text display-inline="yes-display-inline">Any person who knowingly and willfully commits a violation of this section shall be subject to criminal penalties under section 309(d), which may include fines under title 18, United States Code, imprisonment of not more than 5 years, or both.</text></paragraph></subsection> 
<subsection id="HA2F2D8713B50464B9FBD4D7EC8E70584" commented="no"><enum>(c)</enum><header>Referral to Department of Justice</header><text display-inline="yes-display-inline">The Federal Election Commission may refer apparent knowing and willful violations to the U.S. Department of Justice for criminal prosecution in accordance with section 309(a)(5)(C).</text></subsection> <subsection id="H44D277D32648497A8F2AFAF7A73A00EA"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Federal Election Commission shall promulgate regulations to carry out this section, including guidance on permissible financial instruments and compliance requirements.</text></subsection> 
<subsection id="HC8E7FD2F73844A19A7623E2101195915"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit the use of campaign funds for—</text> <paragraph id="HB306E2FCF2F6474F8C6DB9685E48DE13"><enum>(1)</enum><text>deposits in insured depository institutions;</text></paragraph> 
<paragraph id="H8D7C06061A69460086DE7A06CFE16DAF"><enum>(2)</enum><text>investments in diversified mutual funds or exchange-traded funds; or</text></paragraph> <paragraph id="HB1DFA9F96DAB443ABE6D253AABD134A1"><enum>(3)</enum><text>other low-risk financial instruments as may be permitted by the Commission.</text></paragraph></subsection> 
<subsection id="H9027DBBC45354D019C7BACC2464D7DD3"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section:</text> <paragraph id="H84131BF85E114F349FFCBE62E00C7644"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>campaign funds</term> means contributions or donations received by a candidate, authorized committee, or other political committee subject to this Act.</text></paragraph> 
<paragraph id="HA5FC694C40744C5EA8EB997C4D29EA30"><enum>(2)</enum><text>The term <term>prediction market</term> or <term>event contract</term> means any agreement, contract, transaction, or instrument that provides for payment based on the outcome of a future event, including political, economic, or regulatory events.</text></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7A8DD2D8754C4C379A13316CBF6D8D10"><enum>(b)</enum><header>Effective date</header><text>This section and the amendment made by this section shall take effect on the date that is 120 days after the date of the enactment of this Act.</text></subsection></section>
