<section id="H4A9DA9284E1E4F01A0539D34926B4834" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ban Chinese Communist and Islamist Home Ownership Act</short-title></quote>.</text></section> <section id="H9EBA1DBFCD1E4B5984233FB51CDC9998"><enum>2.</enum><header>Prohibition on Hostile Foreign Purchase and Ownership of Housing</header> <subsection id="HBB6BAD829B2D46ACAE4B94E823A577DD"><enum>(a)</enum><header>Bans on purchases</header><text>Beginning on the date of enactment of this Act, any covered person may not purchase housing in the United States.</text></subsection> 
<subsection id="H3B90AE6FA06B4004A038ED89676F72A7"><enum>(b)</enum><header>Enforcement</header><text>Notwithstanding any other provision of law, the President shall direct the heads of the Federal departments and agencies to promulgate rules and regulations to prohibit the purchase and ensure divestment of housing located in the United States by a covered person.</text></subsection> <subsection id="HA3C15268A99243A8B07024840FDD7E37"><enum>(c)</enum><header>Forced divestiture</header><text>Not later than 2 years after the date of enactment of this Act, any covered person shall—</text> 
<paragraph id="H07FE109FF9344EE397CF4D3CD85AD4F6"><enum>(1)</enum><text>divest from any housing held by such covered person in the United States; and</text></paragraph> <paragraph id="H97809B356C9C497A9ACCE844D444EF45"><enum>(2)</enum><text>sell such housing to a citizen or corporation of the United States.</text></paragraph></subsection> 
<subsection id="H95318C1D8CA74015B2EE0272506FBB3A"><enum>(d)</enum><header>Definitions</header><text>For the purposes of this section:</text> <paragraph id="HA1EF67F3EAEB42F789319D3AE44C5692"><enum>(1)</enum><header>Covered person</header><text>The term <quote>covered person</quote> means—</text> 
<subparagraph id="H987178AD397846CAB6B950455EDDA476"><enum>(A)</enum><text>an individual that is a citizen of a foreign country of concern, who is not also a citizen of the United States;</text></subparagraph> <subparagraph id="H8C4F0A3FED464A0F8C144A4E3716DE54"><enum>(B)</enum><text>a corporation with any ownership stake by such individual;</text></subparagraph> 
<subparagraph id="H22429BD9B2EA46AB8CC1E981F3DC984C"><enum>(C)</enum><text>a foreign entity of concern, including corporations with any ownership stake by a foreign entity of concern; and</text></subparagraph> <subparagraph id="H9F86831A57B54222B5E2578319514FDA"><enum>(D)</enum><text>a foreign adversary, a state sponsor of terrorism, any agent or instrumentality of a foreign adversary or a state sponsor of terrorism, or any person owned or controlled by, or affiliated with, a foreign adversary or a state sponsor of terrorism;</text></subparagraph></paragraph> 
<paragraph id="HBFEB2979C37C4847A6DEE978A49149E3">
                    <enum>(2)</enum>
                    <header>Foreign adversary</header>
 <text>The term <quote>foreign adversary</quote> means any foreign government or foreign nongovernment person engaged in a long-term pattern or serious instances of conduct significantly adverse to the national security of the United States or security and safety of United States persons.</text>
                </paragraph> 
<paragraph id="HC2B5A0448F874D1D9CC6EF766D22B747"><enum>(3)</enum><header>Foreign country of concern</header><text>The term <quote>Foreign Country of Concern</quote> has the meaning given to it in Section 10612(a)(1) of the CHIPS and Science Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19221">42 U.S.C. 19221</external-xref>).</text></paragraph> <paragraph id="H48DAB6A978974E67B55EFC2938DA1CE7"><enum>(4)</enum><header>Foreign entity of concern</header><text>The term <quote>Foreign Entity of Concern</quote> has the meaning given to it in Section 10612(a)(2) of the CHIPS and Science Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19221">42 U.S.C. 19221</external-xref>).</text></paragraph> 
<paragraph id="HB9959108985140AFAC9D19FD0C36F040"><enum>(5)</enum><header>Housing</header><text>The term <quote>housing</quote> means a structure or portion of a structure, that is designed or used for human habitation and provides living facilities for at least one person.</text></paragraph> <paragraph id="H5E4E88DA0CD84C9EAD15B90453995328"><enum>(6)</enum><header>State sponsor of terrorism</header><text>The term <quote>state sponsor of terrorism</quote> means a country the government of which the Secretary of State determines has repeatedly provided support for international terrorism pursuant to—</text> 
<subparagraph id="HE71FF285A3714E6CAFDC81F164B127AE"><enum>(A)</enum><text>section 1754(c)(1)(A) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4318">50 U.S.C. 4318(c)(1)(A)</external-xref>);</text></subparagraph> <subparagraph id="H8114C4B9BF3D4C75825A249578A526E5"><enum>(B)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></subparagraph> 
<subparagraph id="HD259EE89D57F4C7C88F73C36EA7E80DD"><enum>(C)</enum><text>section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>); or</text></subparagraph> <subparagraph id="H7F3AEFCF141A4BCFB8DB9B34C6EDFE8F"><enum>(D)</enum><text>any other provision of law.</text></subparagraph></paragraph>
<paragraph id="H6A85B79EA6B944D185867CE88B8CEAFC"><enum>(7)</enum><header>United states</header><text>The term <quote>United States</quote> means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, the United States Virgin Islands, and any other territory or possession of the United States.</text></paragraph></subsection></section> <section id="HBEF96538AB5546638A72607583A9267C"><enum>3</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act (or the application of that provision to particular persons or circumstances) is held invalid or found to be unconstitutional, the remainder of this Act (or the application of that provision to other persons or circumstances) shall not be affected.</text></section>
