                        from using technology that uses the personal data of a consumer to engage in

<section id="H46115D9EAE614BF59B2C6899FED7BA11" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Rigged Grocery Prices Act</short-title></quote>.</text></section> 
<section id="H4BDD529BB08042AAB57665327BA18B98"><enum>2.</enum><header>Prohibition and requirements for food retailers and third party delivery service providers related to dynamic pricing</header> 
<subsection id="H1D175291B64844A4818DE062F9F19B48"><enum>(a)</enum><header>Prohibition</header> 
<paragraph id="H1DE40661AC9D4233BD1430233B9C6B69"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a covered entity may not use any technology that uses the personal data of a consumer to engage in dynamic pricing.</text></paragraph> <paragraph id="H905FF4C5E603421BA6BC6666AA09612D"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not apply with respect to any of the following:</text> 
<subparagraph id="HD7FCCBC13F334C008B640CF67319F045"><enum>(A)</enum><text>An offer made to a consumer by a covered entity—</text> <clause id="H496913C879D641CC818E8D3B8D085A94"><enum>(i)</enum><text>that is—</text> 
<subclause id="HB9FF7366ACBF46F09B413297FA370369"><enum>(I)</enum><text>a promotional pricing offer, a loyalty program benefit, a reward program benefit, or any other similar membership benefit with respect to which any consumer may voluntarily enroll or consent to participate in; or</text></subclause> <subclause id="HC9EF33C7B0C84C6A83BE31A8E9DC665B"><enum>(II)</enum><text display-inline="yes-display-inline">a temporary discount or price change related to retention of existing customers; or</text> </subclause></clause> 
<clause id="H01C3A4074DB54795BAFC5AC7FB96F260"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to which the consumer consented to provide personal data or other information to the covered entity in exchange for such offer.</text></clause></subparagraph> <subparagraph id="H71BE8C1F7CCE4951836830A32A3C2F26" commented="no"><enum>(B)</enum><text>The price of food set by a covered entity based on objective costs (such as costs related to shipping or taxes) related to different consumers.</text> </subparagraph></paragraph></subsection> 
<subsection id="H5CDF87388FF94CCA948C62A700B963AE"><enum>(b)</enum><header>Requirements</header> 
<paragraph id="H0D9FC6617D7246A4A02BDC98AF4ACFD9"><enum>(1)</enum><header>In general</header><text>With respect to a covered entity that offers to a consumer the option to order a grocery item online, the covered entity shall disclose to the consumer—</text> <subparagraph id="HA5887A9D9DD74E9A85B34D98084D963A" commented="no"><enum>(A)</enum><text>if the availability of the grocery item has changed; or</text></subparagraph> 
<subparagraph id="H4139DE1B7F8A4597A84A7F560FC8B0A2" commented="no"><enum>(B)</enum><text>if the grocery item is weighed to determine the price of the such item.</text> </subparagraph></paragraph> <paragraph id="H7E678E6347F148A4B47BDB73981602F5"><enum>(2)</enum><header>Requirements for third party delivery service providers</header><text>With respect to a third party delivery service provider that offers to a consumer the option to order a grocery item online, the third party delivery service provider shall obtain explicit approval from the consumer to substitute such grocery item before the third party delivery service provider or an agent thereof substitutes such item on behalf of the consumer.</text></paragraph></subsection> 
<subsection id="HAC507E1B1D664674BB6D17BBC3B556FA"><enum>(c)</enum><header>Enforcement</header> 
<paragraph id="HFE2DBF39C8DC4A5E9A8EAB697F84D9F5"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph> <paragraph id="H1216E884909B4D0E9621D36B15B06B5D"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text> </paragraph></subsection> 
<subsection id="H9F251F115E9647D4AC2E565B14F76239"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H6B232BE38EE34811AE48BF0D00876F6B"><enum>(1)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means any of the following:</text> 
<subparagraph id="H0D3B6D5AB6FA4F828B192C82439FFD97"><enum>(A)</enum><text>A food retailer.</text></subparagraph> <subparagraph id="H33B0DAACE3E1478CA9D50F742B215375"><enum>(B)</enum><text>A third party delivery service provider.</text></subparagraph></paragraph> 
<paragraph id="H0C7DCA11C40242168C1251EC5E855639"><enum>(2)</enum><header>Dynamic pricing</header><text>The term <quote>dynamic pricing</quote> means the practice of increasing the price of food offered for sale to a consumer based on the personal data or other information of such consumer.</text></paragraph> <paragraph id="H659D106DC8C54DC6937E2B0658844C1D"><enum>(3)</enum><header>Food retailer</header><text>The term <quote>food retailer</quote> means a business that—</text> 
<subparagraph id="HE59086EE69A646239F2DAB998279D9CF"><enum>(A)</enum><text>is at least 15,000 square feet; and</text></subparagraph> <subparagraph id="HC93137C82B4948CCBF4A2EDF0034EEEE"><enum>(B)</enum><text>sells food to consumers.</text> </subparagraph></paragraph> 
<paragraph id="HC6739BFA3EEE4178AF81928DD8CB97B4"><enum>(4)</enum><header>Third party delivery service provider</header><text>The term <quote>third party delivery service provider</quote> means an entity that facilitates the delivery of food to a consumer.</text> </paragraph> <paragraph id="H7D27922C87FA4E3FA7F5F146A83F4CBE" commented="no"><enum>(5)</enum><header>Personal data</header><text>The term <quote>personal data</quote> means any information that is linked or can be reasonably linked to an identified or identifiable consumer.</text></paragraph></subsection></section> 
<section id="HDE1DADD885EB4F3CB9B7AD785D55061C"><enum>3.</enum><header>Report on the employment effects of electronic shelf labels</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Labor shall submit to Congress a report on any effect of grocery stores adopting the use of electronic shelf labels on the number of individuals employed by such grocery stores.</text></section> </legis-body></bill>
