<section section-type="section-one" changed="not-changed" id="H0315A92E7CE145D6B1816A0C8B98F42E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Passenger Rail Crew Protection Act</short-title></quote>.</text></section> <section changed="not-changed" id="H362DB5C430C544E0AC8025666549D47C"><enum>2.</enum><header>Interference with passenger train crew members</header> <subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="HA10905A6FDE741FBB8D900F9414A3724"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/281">Chapter 281</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="H3CB9D6970A2E4137A275809AFBAD1EA7" changed="not-changed"><enum>28104.</enum><header>Interference with passenger train crew members</header>
<subsection id="HED67084A38734C8983805383EB3AD81C" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H3C55D7B8C02B42EF96F163A4E41B3E7F" changed="not-changed"><enum>(1)</enum><header>Crew member</header><text>The term <term>crew member</term> means any of the following employees:</text>
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H139DADC381C146ABBD444704B151FA98"><enum>(A)</enum><text display-inline="yes-display-inline">An engineer.</text></subparagraph> <subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H63DA8E837DB840C1A712D9C445DD484B"><enum>(B)</enum><text display-inline="yes-display-inline">A conductor.</text></subparagraph>
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H6E4F6D6896B746FE835C872F396806E0"><enum>(C)</enum><text display-inline="yes-display-inline">Onboard personnel.</text></subparagraph> <subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HA0E0924CEE80495297AD1DB220F1ABB3"><enum>(D)</enum><text display-inline="yes-display-inline">An employee performing, or responsible for, a safety-sensitive function.</text></subparagraph>
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HEF63DB93D3EB45DCBE52EEE03B4FC84A"><enum>(E)</enum><text display-inline="yes-display-inline">An employee performing a function at a rail station in service of a passenger train, including with respect to ticketing, check-in, baggage claim, or boarding.</text></subparagraph></paragraph> <paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="H6B5716BF28D646A4895DD0E6C07D980E"><enum>(2)</enum><header display-inline="yes-display-inline">Dangerous weapon</header><text>The term <term>dangerous weapon</term> has the meaning given such term in section 1992(d) of title 18.</text></paragraph>
<paragraph id="H958FF603D5F141CB99200605BA6D5522" changed="not-changed"><enum>(3)</enum><header>Passenger train</header><text>The term <term>passenger train</term> means a passenger train in intercity rail passenger transportation (as defined in section 24102) or commuter rail passenger transportation (as defined in section 24102).</text></paragraph> <paragraph id="HC02CC4FC968F4700BC508FD6E248E0E9" changed="not-changed"><enum>(4)</enum><header>Serious bodily injury</header><text>The term <term>serious bodily injury</term> has the meaning given such term in section 1365(h) of title 18.</text></paragraph></subsection>
<subsection id="HB9F2D807B92F4E9A9D6582F4D893394D" changed="not-changed"><enum>(b)</enum><header>Offense</header><text>It shall be unlawful for any person onboard a passenger train in operation, on a platform serving a passenger train in operation, or in a rail station that serves passenger trains—</text> <paragraph id="H318F576F8F62402289DD0F487BB293ED" changed="not-changed"><enum>(1)</enum><text>to assault a crew member and thereby interfere with the performance of the duties of a crew member or lessen the ability of a crew member to perform those duties; or</text></paragraph>
<paragraph id="H3D68475A26624A51903C076CEC8BB96B" changed="not-changed"><enum>(2)</enum><text>to attempt or conspire to perform an act described in paragraph (1).</text></paragraph></subsection> <subsection id="H61061C9A66FD45FD961356549D22016E"><enum>(c)</enum><header>Penalties</header> <paragraph commented="no" display-inline="no-display-inline" id="H5ABD39C1AF6C40B19B4417EBF7A6591B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in paragraph (2), any person who violates subsection (b) shall be fined under title 18, imprisoned for not more than 6 months, or both.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE33FC14A303945FC92D1550E49820899"><enum>(2)</enum><header>Aggravated penalties</header><text display-inline="yes-display-inline">If a person violates subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HEA884FF1D11B42C5BAF050315C502E1B"><enum>(A)</enum><text display-inline="yes-display-inline">by striking, beating, or wounding, the maximum term of imprisonment under paragraph (1) shall be 1 year;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6A73DC08B8EC401096A916698C7BC2FF"><enum>(B)</enum><text display-inline="yes-display-inline">with intent to commit any crime punishable by more than 1 year of imprisonment, except murder, the maximum term of imprisonment under paragraph (1) shall be 10 years;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1DEAAB91131A4684893CA9A02868D894"><enum>(C)</enum><text display-inline="yes-display-inline">with a dangerous weapon or with intent to cause bodily harm, the maximum term of imprisonment under paragraph (1) shall be 10 years;</text></subparagraph>
<subparagraph id="HE7C1DBD0A4A24A6784644A1A5A3C5F15"><enum>(D)</enum><text>and the violation results in serious bodily injury, the maximum term of imprisonment under paragraph (1) shall be 10 years; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H3A05027A9D944A55B0B4A82E33F935B8"><enum>(E)</enum><text display-inline="yes-display-inline">with intent to commit murder, the maximum term of imprisonment under paragraph (1) shall be 20 years.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H34C2C48A9854415C9328FAAAE43F05B3" changed="not-changed" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/281">chapter 281</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" changed="not-changed" id="HB32C4069535747BD9AF02D1D1FEF19B3"> <toc changed="not-changed"> <toc-entry bold="off" level="section" changed="not-changed">§ 28104.
