<section id="HD75D3A3E49904E8A85F0B3E26A589884" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aquatic Invasive Species Control and Prevention Act of 2026</short-title></quote>.</text> </section> <section id="H187A3A6EE62E42AA92BB767E1945823B"><enum>2.</enum><header>Aquatic nuisance species</header> <subsection id="H0F7E6FE150EE4DBE890DCCB0621C29A6"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1003 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721</external-xref>) is amended—</text> 
<paragraph id="HD222013FA276446FAA522D043B9B6B45">
                    <enum>(1)</enum>
 <text>in paragraph (1), by inserting <quote>and the term <term>aquatic invasive species</term></quote> before <quote>means a nonindigenous</quote>;</text>
                </paragraph> 
<paragraph id="HEAB6DBA321D1489FBA9D23F8BBAC468A"><enum>(2)</enum><text>in paragraph (18), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H66BCD6FEB6EB4212A34A72FBAD23288F"><enum>(3)</enum><text>in paragraph (19), by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="HC1B9F76E16E94A0D9C7F178967BA3AEE"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="H4F8649474569408D97FBECB5380F3021" style="OLC"> <paragraph id="HF5FEF7B171E847FD945FA9227DF9BBD8" commented="no" indent="down1"><enum>(20)</enum><text><quote>rapid response activities</quote> means timely actions taken upon the detection of an aquatic invasive species—</text> 
<subparagraph id="HB1236601D01144AFB23FD3B8FA3F56AC" commented="no"><enum>(A)</enum><text>to—</text> <clause id="H6615D6EB2A3348478DF1AD7BE74F8C9D" commented="no"><enum>(i)</enum><text>eradicate the aquatic invasive species; or</text></clause> 
<clause id="HCC2983C299EB4259878FF5E24A8DC030" commented="no"><enum>(ii)</enum><text>control and prevent the establishment of the aquatic invasive species;</text></clause></subparagraph> <subparagraph id="HC5AEDD6DE09E43DB97FB07F3B1DB7817" commented="no"><enum>(B)</enum><text>to ensure conservation outcomes of noninvasive species and the habitats of such species;</text></subparagraph> 
<subparagraph id="HBB578FEFE5654A4396E994F492F977F5" commented="no"><enum>(C)</enum><text>to maintain ecosystem functions of ecosystems affected by the aquatic invasive species; and</text></subparagraph> <subparagraph id="H97E79DD9BB164103A81C54E536A18B2C"><enum>(D)</enum><text>to avoid, reduce, or mitigate significant economic harms and consequences associated with the aquatic invasive species; and</text></subparagraph></paragraph> 
<paragraph id="HA4712D8A075249EF9DC981C4D63BB9FA" indent="down1"><enum>(21)</enum><text><quote>regional panels</quote> means the regional panels convened pursuant to section 1203, including the—</text> <subparagraph id="H01FEE1A84CD84D53B54C633EFA247C7B"><enum>(A)</enum><text>Great Lakes Regional Panel;</text></subparagraph> 
<subparagraph id="H9089BEC1ECF94A57B09A231B7ECF311C"><enum>(B)</enum><text>Western Regional Panel;</text></subparagraph> <subparagraph id="H9762EFA9FF7B4D5FA3772C72159E11FE"><enum>(C)</enum><text>Gulf and South Atlantic Regional Panel;</text></subparagraph> 
<subparagraph id="HB1AA02E44BA14320B818ABC5FABF0C34"><enum>(D)</enum><text>Northeast Aquatic Nuisance Species Regional Panel;</text></subparagraph> <subparagraph id="H87C33957E3354921A1C44BEA6D5B584D"><enum>(E)</enum><text>Mississippi River Basin Regional Panel; and</text></subparagraph> 
<subparagraph id="HB1FDD680D4A14B3E98C66032D870B53B"><enum>(F)</enum><text>Mid-Atlantic Regional Panel.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HCB063DCFD6774E4C852860C1A7655237"><enum>(b)</enum><header>Grant program for control and eradication of aquatic invasive species</header> <text>Subtitle B of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4712">16 U.S.C. 4712 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H65195E40579041E1B8FCB8D29F4F386B"><enum>1105.</enum><header>Grant program for control and eradication of aquatic invasive species</header> 
<subsection id="H84691C911DD740A5A1525522F92AA218"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this section, the Task Force, in consultation with the regional panels, shall establish a grant program to fund research, development, demonstration, and verification of environmentally sound and cost-effective technologies, methods, and practices to control and eradicate aquatic invasive species.</text></subsection> <subsection id="HFD04039F816B47C5B3D81EC723E6BF69"><enum>(b)</enum><header>Purposes</header><text>Proposals funded under the grant program established under subsection (a) shall—</text> 
<paragraph id="H31396102CB184974B41EEF4FFADC9266"><enum>(1)</enum><text display-inline="yes-display-inline">support Federal, State, Tribal, regional, or local officials or nongovernmental organizations in the control and eradication of aquatic invasive species in an environmentally sound and cost-effective manner;</text> </paragraph> <paragraph id="HBFA2B473A5534804A39737D328DC0089" commented="no"><enum>(2)</enum><text>increase the number of environmentally sound and cost-effective technologies, methods, or practices Federal, State, Tribal, regional or local officials and nongovernmental organizations may use to control or eradicate aquatic invasive species by researching, developing, demonstrating, or verifying such technologies, methods, or practices;</text> </paragraph> 
<paragraph id="HE6D6AC6A1C7E4AD7A848E7A91EFE699D"><enum>(3)</enum><text>provide for the demonstration or dissemination of such technologies, methods, or practices to potential end-users; and</text></paragraph> <paragraph id="HF9BF492C576C45E3A6C117957B47F173"><enum>(4)</enum><text>verify that any such technology, method, or practice meets any appropriate criteria developed for effectiveness, cost-effectiveness, and environmental soundness established by the Task Force.</text> </paragraph></subsection> 
<subsection id="HF85FAF34C77342CCA64EAD94F6EB94F7"><enum>(c)</enum><header>Merit review</header><text>The Task Force shall award grants under this section through a process that is competitive, peer-reviewed, and merit-based.</text></subsection> <subsection id="H304C037F72534AEB9E39684BAD55AC93"><enum>(d)</enum><header>Report</header><text>Not later than 3 years after the date of the enactment of this section, the Task Force shall submit to Congress a report regarding the grant program established under subsection (a), including findings and recommendations with respect to technologies, methods, and practices described in that subsection.</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H030E3BF600BF42A288A4C7A97F8AE6B5"><enum>(c)</enum><header>Prevention and control of aquatic nuisance species dispersal</header> 
<paragraph id="H7073453670E64B0BBA0267C03C8E2A3A"><enum>(1)</enum><header>Aquatic nuisance species task force</header><text>Section 1201 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721</external-xref>) is amended—</text> <subparagraph id="HB576121EB9374277948250E706D29869"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="HB8C734F79E6E45D892315BB86B91EFC8"><enum>(i)</enum><text>in paragraph (9), by striking <quote>and</quote> at the end;</text></clause> <clause id="H63100900D0F9485AB6A6387C9E702414"><enum>(ii)</enum><text>in paragraph (10), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause> 
<clause id="HB9C4C3B36B8E456C984C1E90D3A6C006"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block id="H44318E2AE04B434881AC02CADDD7005F" style="OLC"> <paragraph id="HD88AE5D4DD6B47C394C3E0D207872529"><enum>(11)</enum><text>1 representative from each of the regional panels.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H2FA54ACBDA934AF8855F91AB618DA7DA"><enum>(B)</enum><text>in subsection (c)—</text> <clause id="H828F014DBE0A4767825F602FB69AED94"><enum>(i)</enum><text>by striking <quote>and</quote> after <quote>State agencies</quote> and inserting a comma; and</text></clause> 
<clause id="H67D122D0461943DE8278E1C5710352BA"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>, and nongovernmental organizations engaged in monitoring, prevention, or control of aquatic nuisance species or other impacts relating to aquatic nuisance species, including impacts to outdoor recreation,</quote> after <quote>other governmental entities</quote>;</text></clause></subparagraph> <subparagraph id="HF550154CBE914F84AC0BB89FE446D4CD"><enum>(C)</enum><text>in subsection (f)—</text> 
<clause id="HF6DE9C02E1ED49F5B8E20C3141E062F1"><enum>(i)</enum><text>by striking <quote>Each Task Force</quote> and inserting the following:</text> <quoted-block id="H6A000B77D095413093A753A215AE0387" style="OLC"> <paragraph id="HEC05801AAC9D4573A0EDFB20D26368C2"><enum>(1)</enum><header>In general</header><text>Each Task Force</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> 
<clause id="H5620339F86EA41F390A1FE302D47F515"><enum>(ii)</enum><text>by adding at the end the following:</text> <quoted-block id="HD03C7822A317427B92E2EA8FDFA19275" style="OLC"> <paragraph id="H0886AF0488054BB4960A371765F2C04C"><enum>(2)</enum><header>National Invasive Species Council</header><text>In addition to the requirement described in paragraph (1), the Task Force shall develop a plan to enhance coordination of any action to carry out this subtitle with the National Invasive Species Council established by Executive Order 13112 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to Invasive Species).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="HA59C2EE604274785A266B7DE7FEF23CF"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block id="HB4DF05EBE05E4A4AA02D7AD33C1425BB" style="OLC"> <subsection id="HE1528B7A21E8466A9CBA27BFBFA5DADC"><enum>(h)</enum><header>Details from other Federal agencies</header><text>Upon request of the Task Force, and with the concurrence of the head of the Federal agency concerned, the head of any Federal agency may detail, on a reimbursable basis, any of the personnel of such Federal agency to the Task Force to assist the Task Force in carrying out the duties of the Task Force under this subtitle.</text></subsection> 
<subsection id="H706D90AD9EE143D6BAFE79D6E2E9A4A7"><enum>(i)</enum><header>Applicability of Federal Advisory Committee Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>), shall not apply to actions of the Task Force.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> </paragraph> <paragraph id="HD02D90C30D1749E8B4EF86E016FEC616"><enum>(2)</enum><header>Aquatic nuisance species program</header> <subparagraph id="H677E2B9CDAD34ECEBD417DE5D7B62B16"><enum>(A)</enum><header>In general</header><text>Section 1202 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>) is amended—</text> 
<clause id="H979C1DE0842E4821903C5C037427389F" commented="no"><enum>(i)</enum><text>in subsection (c)(1)—</text> <subclause id="H824D10A651E64404AF5B2B37F827F076" commented="no"><enum>(I)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subclause> 
<subclause id="H1B47307769D7457C9132CC8E4F82F17A" commented="no"><enum>(II)</enum><text>in subparagraph (C), by striking the period at the end and inserting a semicolon; and</text></subclause> <subclause id="H61ACCC264C8C47DCBE8208A0191D7964" commented="no"><enum>(III)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H0B73D848616A47DBBFDE1E4F47F7F12E" style="OLC"> 
<subparagraph id="H446C33D71BFD42A4A17A0F172A4CF60C" commented="no"><enum>(D)</enum><text>identification of ecosystems that are particularly susceptible to invasion by aquatic invasive species under changing environmental conditions, which such ecosystems shall be considered in the development of national and regional management control plans for aquatic nuisance species under subparagraph (E); and</text> </subparagraph> <subparagraph id="H9F7EA78F514D466987AD7FCF36274564"><enum>(E)</enum><text>in collaboration with the heads of relevant Federal agencies and stakeholders, development, implementation, and periodic updates of national and regional management control plans for aquatic nuisance species.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause> 
<clause id="H257535C222044D4D8A064854F30C4955"><enum>(ii)</enum><text>by redesignating subsections (j) and (k) as subsections (m) and (n), respectively; and</text></clause> <clause id="H88D4360397E74FA880BF4E0F0BD559DE"><enum>(iii)</enum><text>by inserting after subsection (i) the following:</text> 
<quoted-block id="HF2218E87FA9B46E6B894E7BC0F3E011B" style="OLC"> 
<subsection id="H2956E1F4B2474A47B18528EE3A7CD003"><enum>(j)</enum><header>Study on Federal laws and regulations and other authorities governing rapid response activities</header> 
<paragraph id="H4E04444A716C49A8AED84E073CD2034B"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this subsection, the Task Force, in consultation with the Secretary, Director, and Under Secretary, shall conduct a comprehensive study of Federal laws and regulations and other authorities that govern rapid response activities.</text></paragraph> <paragraph id="H7D389326D3134AA4BCDAC628E3CB920D"><enum>(2)</enum><header>Requirements</header><text>In conducting the study required by paragraph (1), the Task Force shall—</text> 
<subparagraph id="H116BAB6942954373A5CB09723818B92A"><enum>(A)</enum><text display-inline="yes-display-inline">in coordination with the regional panels and States, identify Federal laws and regulations and other authorities that govern rapid response activities or may impede rapid response activities, including categorical exclusions, waivers, and other regulatory exemptions that facilitate rapid response activities;</text> </subparagraph> <subparagraph id="H04DB4F312DAD45DDB5FE35313AA2E8CD"><enum>(B)</enum><text display-inline="yes-display-inline">review such Federal laws and regulations and other authorities; and</text> </subparagraph> 
<subparagraph id="H668A05A7821F4067A2A6B8A23AB3309A"><enum>(C)</enum><text display-inline="yes-display-inline">recommend changes to such Federal laws and regulations and other authorities to expedite rapid response activities, including the creation of such categorical exclusions, waivers, and other regulatory exemptions.</text> </subparagraph> </paragraph> <paragraph id="HA87402164FDB46BB962F206895D5488D"><enum>(3)</enum><header>Partnerships</header><text>The Task Force may enter into partnerships or contracts with members of the Task Force, regional panels, States, Indian tribes, universities, nongovernmental organizations, or the National Laboratories of the Department of Energy to conduct the study required by paragraph (1).</text> </paragraph></subsection> 
<subsection id="HAC250CCEC97145B5A415194F997BA2B4"><enum>(k)</enum><header>Watercraft inspections and decontaminations</header> 
<paragraph id="HBB925B47E53A401F808C3E4FB8F85593"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H553924E8790B44BC97B3F446853EBC00"><enum>(A)</enum><header>Decontamination</header><text>The term <term>decontamination</term> means an action to remove aquatic invasive species to prevent the introduction or spread of aquatic invasive species into aquatic ecosystems in which the aquatic invasive species is not present or does not have a large presence.</text></subparagraph> 
<subparagraph id="H05AE2A9F11E745D5969B06135B1DAE6C"><enum>(B)</enum><header>Federal land and water</header><text>The term <term>Federal land and water</term> means Federal land and water operated and maintained by the head of a Federal member of the Task Force.</text></subparagraph> <subparagraph id="H0021F1C082054252A6C5D76D55DA4F46"><enum>(C)</enum><header>Inspection</header><text>The term <term>inspection</term> means an action to find aquatic invasive species to prevent the introduction or spread of aquatic invasive species into aquatic ecosystems in which the aquatic invasive species is not present or does not have a large presence.</text></subparagraph> 
<subparagraph id="H52E9201E919943B8907A8F6B08F6DFD3"><enum>(D)</enum><header>Noncontaminated watercraft</header><text>The term <term>noncontaminated watercraft</term> means watercraft that, prior to entering a body of water, is subject to inspection or decontamination.</text></subparagraph> <subparagraph id="H1D2943B314684A2980B53858A029090E"><enum>(E)</enum><header>Watercraft</header><text>The term <term>watercraft</term> means any vessel or other contrivance used or designed for transportation or navigation on, under, or immediately above, water.</text></subparagraph> </paragraph> 
<paragraph id="HCC739FE2B6AE4E498D350704B8724135" display-inline="no-display-inline"><enum>(2)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this subsection, the Task Force, in consultation with the regional panels, shall develop a plan for the heads of the Federal agencies represented on the Task Force, in coordination with States, to conduct inspections and decontaminations of watercraft at stations.</text></paragraph> <paragraph id="H759BE650441E4AA8AC666424C08CC50D"><enum>(3)</enum><header>Requirements</header><text>The plan developed under paragraph (2) shall include—</text> 
<subparagraph id="H5C8C0F5CB9734E9682B4234E26D0FD50"><enum>(A)</enum><text>a process for the installation of stations at boat launches and access points on Federal and non-Federal waterways and roadside locations along Federal highways at which to conduct inspections and decontaminations of watercraft;</text></subparagraph> <subparagraph id="H539DA5346B5C42D389C1FFD41D783C20"><enum>(B)</enum><text display-inline="yes-display-inline">the development of an interagency certification system to reciprocally recognize inspections and decontaminations carried out by the heads of the Federal agencies represented on the Task Force to minimize disruption, to the maximum extent practicable, of public access for boating and recreation in noncontaminated watercraft;</text> </subparagraph> 
<subparagraph id="HA8E57DEF512144B8A45CD45091F0A299"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations for the development of a penalty structure for noncompliance with inspections and decontaminations of watercraft carried out by the heads of Federal agencies represented on the Task Force;</text> </subparagraph> <subparagraph id="H6E603A6411BB446E9E1F062184E912CC"><enum>(D)</enum><text display-inline="yes-display-inline">an analysis of existing studies and research on the siting and effectiveness of decontamination stations, including a plan for recommending and prioritizing siting of such stations at waterways at high risk of introduction of an aquatic invasive species that is not present, or does not have a large presence, in the waterway;</text> </subparagraph> 
<subparagraph id="H481DDE3FCCCB42ADA228F950A8208F64"><enum>(E)</enum><text>recommendations for a process to incentivize watercraft, engine, accessory, fishing gear, equipment and trailer manufacturers to develop and adopt new and innovative designs and models that—</text> <clause id="H3725A716E78C4F289E30EA939B10987C"><enum>(i)</enum><text>limit unwanted transfer of aquatic nuisance species and standing water; and</text></clause> 
<clause id="HDD84AC1BF64846F791C32057BE7A2379"><enum>(ii)</enum><text>aid in safely expediting watercraft inspection and decontamination protocols approved by the regional panels or Task Force;</text></clause></subparagraph> <subparagraph id="HF9554A0BE61E4D9CA09FC8688F392903"><enum>(F)</enum><text>recommendations for the siting of user-operated cleaning stations to supplement decontamination programs carried out by the heads of the Federal agencies represented on the Task Force in coordination with States pursuant to the plan developed under paragraph (2); and</text> </subparagraph> 
<subparagraph id="H36FC19E3355A4FAF99905BABE10781E4"><enum>(G)</enum><text>measures to ensure that, to the maximum extent practicable, inspections and decontaminations carried out pursuant to the plan developed under paragraph (2) do not limit access for recreational watercraft to non-Federal lands and waters or Federal lands and waters.</text></subparagraph></paragraph> </subsection> <subsection id="H1D200C54C42A44BB95FB46F9BD6A5296"><enum>(l)</enum><header>Interbasin and intrabasin monitoring program</header> <paragraph id="H72F03D0DEE274F87847BA9D292F0A28B"><enum>(1)</enum><header>Establishment</header><text>Not later than 2 years after the date of the enactment of this subsection, the Task Force, in coordination with the regional panels and States, shall establish an interbasin and intrabasin monitoring program.</text></paragraph> 
<paragraph id="H66B640B0B33D45FE9A260D8272FE13F0"><enum>(2)</enum><header>Required elements</header><text>The monitoring program established under paragraph (1) shall—</text> <subparagraph id="H57CD64F8EEA0422DBE2329B223542CB7"><enum>(A)</enum><text>track aquatic invasive species moving through—</text> 
<clause id="H61CF6178B0074458887BE854B27AE578"><enum>(i)</enum><text>the Chicago Sanitary and Ship Canal;</text></clause> <clause id="HEE09D376222842739EDDDABD04B39C5A"><enum>(ii)</enum><text>the Champlain Canal;</text></clause> 
<clause id="H4DB24F4F0B004F15BA4A512D539BAF35"><enum>(iii)</enum><text>other interbasin waterways; and</text></clause> <clause id="HFC37AD03829249AE876BA6B86D21CEDE"><enum>(iv)</enum><text>as recommended by the regional panels, major river systems, such as the Mississippi River, in which interbasin transfers of aquatic invasive species have been shown to pose a significant threat to fish and wildlife resources;</text></clause></subparagraph> 
<subparagraph id="HB81090BF64E549B0AF4E3468F3EB4438"><enum>(B)</enum><text>assess the efficacy of dispersal barriers and other measures in preventing the spread of aquatic invasive species through waterways; and</text></subparagraph> <subparagraph id="H1FDE10A657174A8B9EC9204785E59D3F"><enum>(C)</enum><text>identify waterways suitable for dispersal barrier demonstration projects, in addition to the waterways at which dispersal barrier demonstration projects were carried out before the date of the enactment of this subsection.</text></subparagraph></paragraph> 
<paragraph id="H94A6742D52874B7B8695638F779AE130"><enum>(3)</enum><header>Reports</header><text display-inline="yes-display-inline">The Task Force shall biennially issue a report describing the findings of the monitoring program established under paragraph (1), which shall include a plan to provide for additional dispersal barrier demonstration projects and related research projects.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="HE717B9F956C3410DBD62CED21487DD62"><enum>(B)</enum><header>Aquatic nuisance species national and regional management control plans update</header><text display-inline="yes-display-inline">Not later than 5 years after the date of the enactment of this section, the Aquatic Nuisance Species Task Force established under section 1201 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721</external-xref>), in carrying out the program implemented under section 1202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>), shall update each national and regional management control plan for aquatic nuisance species (as that term is defined in section 1003 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4702">16 U.S.C. 4702</external-xref>)) to incorporate novel and proven practices for the prevention, monitoring, and control of aquatic nuisance species, including best practices submitted by participating Federal, State, and Tribal agencies and researchers.</text></subparagraph></paragraph> 
<paragraph id="H9AD3E9E231704E8D9EF77AD2577AE594"><enum>(3)</enum><header>Aquatic nuisance species management plans</header><text>Section 1204 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4724">16 U.S.C. 4724</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H877EE4713D1C4DE0B0D4A2BA251CEA05" style="OLC"> <subsection id="HFE04BA61D4F2453CA4C29120CCF81E80"><enum>(d)</enum><header>Interstate and regional coordination</header><text>The Director, in coordination with the Task Force, shall facilitate and encourage regional and interstate coordination with respect to the implementation of the comprehensive aquatic nuisance species management plans and public facility management plans developed under this section.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA4DB1FB5BEE143B1B6A716011D46E8D9"><enum>(4)</enum><header>Rapid response activities grant program</header><text>Subtitle C of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H4D9BDB2E4826436BAF6EF8C75AA540C3" style="OLC"> <section id="H7B9FF4D8C16249A3B2292856722909BD"><enum>1210.</enum><header>Rapid response activities grant program</header> <subsection id="H938914F55C7742028684A28B9D5992EF"><enum>(a)</enum><header>In general</header><text>The Task Force shall establish a competitive, merit-based grant program to award amounts to eligible entities to carry out eligible activities.</text></subsection> 
<subsection id="H8C88F4A4896A497F9CE62E5AC1DF45A6"><enum>(b)</enum><header>Identification of aquatic invasive species</header><text>In awarding amounts under the grant program established under subsection (a), the Task Force may only award amounts to an eligible entity to carry out an eligible activity if the Task Force determines the eligible entity has confirmed identification of the aquatic invasive species that is the subject of the eligible activity.</text> </subsection> <subsection id="H970DE758169B4C468C0EB6A5AEF8B01A"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H06766BBEE5B64706A8C0A6909E06D857"><enum>(1)</enum><header>Eligible activity</header><text>The term <term>eligible activity</term> means each of the following activities:</text> <subparagraph id="H97FEA0D4BC8C42BDB340D1CA8209C9D1" display-inline="no-display-inline"><enum>(A)</enum><text>The implementation of an action that supports or leads to the eradication of an aquatic invasive species.</text></subparagraph> 
<subparagraph id="HCCA74B11ABE94831AE9DE60B43996628"><enum>(B)</enum><text>Determining the spatial extent and abundance of an isolated aquatic invasive species population.</text> </subparagraph> <subparagraph id="H62FC2954BECF4CF5B6B1A3BAFAE41F2B"><enum>(C)</enum><text display-inline="yes-display-inline">Analyzing and assessing potential response measures with respect to the eradication or containment of an aquatic invasive species.</text></subparagraph> 
<subparagraph id="H03695033AABA4DFF88DDC050AB7FF412"><enum>(D)</enum><text>Developing measures to contain a population of an aquatic invasive species during an assessment of the aquatic invasive species or while a long-term response plan for the aquatic invasive species is formulated.</text></subparagraph> <subparagraph id="HF4A85FC7C35E43A9A951C7237FDF8448"><enum>(E)</enum><text>Monitoring the population of an aquatic invasive species and the effectiveness of response measures applied with respect to the population.</text></subparagraph></paragraph> 
<paragraph id="HAFF7C0A3153B4E409D6BB5E6C57B6AAE"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H845BA4BB6C9E423CAE59E0320B3432E6" display-inline="no-display-inline"><enum>(A)</enum><text>an entity participating in a Federal program other than the grant program established under subsection (a);</text> </subparagraph> 
<subparagraph id="HB836FEF25E3D4D06B14FA50E7F392ADB"><enum>(B)</enum><text>an interstate organization;</text></subparagraph> <subparagraph id="H7A4BD90A524C47F7BFDDC78528A987EF"><enum>(C)</enum><text>a State or political subdivision thereof;</text></subparagraph> 
<subparagraph id="H37741DAAA1CC4317B50E56A643043FD3"><enum>(D)</enum><text>an Indian tribe;</text></subparagraph> <subparagraph id="H0A95AD3E50BC4EC9A941E91790750724"><enum>(E)</enum><text>a university; and</text></subparagraph> 
<subparagraph id="H08B03F8851A2447B9AFCA41F4009DA22"><enum>(F)</enum><text>a nongovernmental organization engaged in activities related to the prevention and control of aquatic invasive species.</text> </subparagraph></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> <subsection id="HE0699BBEBB8D49309DF8A1E9A80DDB7E"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 1301 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4741">16 U.S.C. 4741</external-xref>) is amended—</text>

<section id="H14D1D19E776546DDBE05D5B4AE0F410F"><enum>3.</enum><header>Use of grant awards under coastal aquatic invasive species mitigation grant program to encourage installation of certain ballast water management systems</header><text display-inline="no-display-inline">Section 903(f)(2)(C)(i) of the Frank LoBiondo Coast Guard Authorization Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/16/4729">16 U.S.C. 4729(2)(C)(i)</external-xref>) is amended—</text> <paragraph id="HA9F99B02551C4D79AB8503A524F659EA"><enum>(1)</enum><text>in subclause (IV), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph>
