which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to promote Medicare program integrity with respect to certain medical equipment and supplies.</official-title></form><legis-body id="H71EC71CB76E240698F5649CE1E8D1CC0" style="OLC"><section id="HBD747B2EE87344B59FA8D31077F2F9B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DME Scammer Prevention Act of 2026</short-title></quote>. </text></section><section id="H40A4DD0CA20842E5875B0AF4968A6439"><enum>2.</enum><header>Promoting Medicare program integrity with respect to certain medical equipment and supplies</header><subsection id="H8C92404CEACC415594834D737FD46539"><enum>(a)</enum><header>Electronic submission of claims by all providers and suppliers</header><text display-inline="yes-display-inline">Section 1862(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(h)</external-xref>) is amended—</text><paragraph id="HFE126BBA41E3465BB85295CAE6F53D50"><enum>(1)</enum><text>in paragraph (1)(A)(ii), by striking <quote>the entity</quote> and inserting <quote>except in the case of claims for specified items (as defined in paragraph (3)), the entity</quote>; and</text></paragraph><paragraph id="H939A90C7CB1E4EC2BEBA488C18AEDD8F"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H9365ECF38A654A5FAF34599D20B05FC6" display-inline="no-display-inline"><paragraph id="HD66BC328F1F24FD3A0B003584099210F" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1)(A)(ii), the term <quote>specified items</quote> means medical equipment and supplies (as defined in section 1834(j)(5)) furnished on or after January 1, 2027, that are included on the Master List described in section 1834(a)(23).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6CF10FCE0F764BAD86DC535F0544F6D5"><enum>(b)</enum><header>Submission of claims within 90 days</header><text>Section 1842(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(3)</external-xref>) is amended—</text><paragraph id="H874C07EA421C45C5892476916F54C788"><enum>(1)</enum><text>in subparagraph (B), in the flush matter following clause (ii), by inserting <quote>(or, in the case of claims for applicable items, the period ending 90 days after such date of service)</quote> after <quote>date of service</quote>; and</text></paragraph><paragraph id="HC879548EF5B146809C8F4716A95114C3"><enum>(2)</enum><text>in the flush matter following subparagraph (L)—</text><subparagraph id="HA2D9F244DA06471AB255CD27A9D957EF"><enum>(A)</enum><text>in the sixth sentence—</text><clause id="HCF27E3D689284951A41A974C1414AAF4"><enum>(i)</enum><text>by inserting <quote>or end of the 90-day period specified in such subparagraph (as applicable)</quote> after <quote>close of the following calendar year</quote>; and</text></clause><clause id="HBB7872F835B7492AB2C7C282D0FF28D1"><enum>(ii)</enum><text>by inserting <quote>or end of such period (as applicable)</quote> after <quote>close of such year</quote>;</text></clause></subparagraph><subparagraph id="H933C264AAA164FEE8531585D0FE7896A"><enum>(B)</enum><text>in the ninth sentence, by inserting <quote>or 90-day period (as applicable)</quote> after <quote>1 calendar year period</quote>; and</text></subparagraph><subparagraph id="H3F8813FD926740ED9BD35158D45E7A6A"><enum>(C)</enum><text>by adding at the end the following new sentence: <quote>For purposes of subparagraph (B), the term <quote>applicable items</quote> means specified items (as defined in section 1862(h)(3)), other than any such item that is included on the Required Face-to-Face Encounter and Written Order Prior to Delivery List described in section 410.38(c)(8) of title 42, Code of Federal Regulations (or a successor regulation) or on the Required Prior Authorization List described in section 414.234(c)(1) of title 42 of such Code (or a successor regulation) or for which payment is made on a monthly rental basis.</quote>. </text></subparagraph></paragraph></subsection><subsection id="H2E0AAF7F22474D3F9B77D3A94E4CD44E" display-inline="no-display-inline"><enum>(c)</enum><header>Report</header><paragraph id="H0D9C8F346FF24BB3956DFF435F7CEF75"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2030, the Comptroller General of the United States shall submit to Congress a report on the technology used by medicare administrative contractors to screen claims for specified items to identify errors or indicators of potential waste, fraud, or abuse. Such report shall include, with respect to the 1-year period beginning on January 1, 2027—</text><subparagraph id="H0E6D0AB8E52E44D895B4A7F0B88E3412" commented="no"><enum>(A)</enum><text>an examination of—</text><clause id="HE99DCCC36A63464AA9DE7E0F2643B4B8" commented="no"><enum>(i)</enum><text>the total number of such claims submitted during such period for which payment was initially denied on the basis of such screening technology; and</text></clause><clause id="H985E31652E6B4B28A440A2804EAFCDE1" commented="no"><enum>(ii)</enum><text>the total number of claims so denied for which payment was ultimately made; and</text></clause></subparagraph><subparagraph id="H75F57BDE8AEA45419421C8C6BD4B4BD4"><enum>(B)</enum><text>an examination of the extent to which the use of such screening technology (taking into account the amendments made by subsections (a) and (b)) assists in the identification of—</text><clause id="H52B761ED25724A4EAA3C5BDE5D93E1B2"><enum>(i)</enum><text>suspicious claims or aberrant billing practices that may be indicative of improper payments; and</text></clause><clause id="H5FAB5D9DC55C41FB915F53CB3D8B89D5"><enum>(ii)</enum><text>the basis of claims denials.</text></clause></subparagraph></paragraph><paragraph id="H0D79EBAE46B047C09EF5A425ADDB2633"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H10879B45FB684600BA1A05EC043A4AED"><enum>(A)</enum><header>Medicare administrative contractor</header><text display-inline="yes-display-inline">The term <quote>medicare administrative contractor</quote> has the meaning given such term in section 1874A(a)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395kk-1">42 U.S.C. 1395kk–1(a)(3)</external-xref>).</text></subparagraph><subparagraph id="H72A3D9AFD67342E989589C592083486B"><enum>(B)</enum><header>Specified items</header><text>The term <quote>specified items</quote> has the meaning given such term in section 1862(h)(3) of the Social Security Act, as added by subsection (a).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
