<section id="H8509011481274156B8AC3616C3208381" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Prediction Market Ban Act of 2026</short-title></quote>.</text></section> 
<section id="HD323F1D234B544B9B34C64FBC6E82B42"><enum>2.</enum><header>Prohibition on Members of Congress and family members from participation in prediction markets</header> 
<subsection id="H83AC319B4B7146499EEEA9FA2E3D5BB3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H8328AA45207847B18A941A3BCE7553A7" display-inline="no-display-inline"> <subchapter id="H9692894FA87441AD968D07CD68083825"><enum>IV</enum><header>Prohibition on participation in prediction markets</header> <section id="HF05B5E3B3D7F447391B9A7B2CC12F009"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> 
<paragraph id="H365C8596F6224C0EADCF0DD70E22C412"><enum>(1)</enum><header>Member of Congress and congressional ethics committees</header><text>The terms <quote>Member of Congress</quote> and <quote>congressional ethics committees</quote> have the meanings given the terms in section 13101.</text></paragraph> <paragraph id="H5D2521F262A44678834161866F2F40FD"><enum>(2)</enum><header>Covered transaction</header><text display-inline="yes-display-inline">The term <quote>covered transaction</quote> means a purchase, sale, or exchange of a prediction market contract.</text></paragraph> 
<paragraph id="H970BCBDDA7DE4BA3A6ABED5E95B758C3"><enum>(3)</enum><header>Prediction market contract</header><text display-inline="yes-display-inline">The term <quote>prediction market contract</quote>—</text> <subparagraph id="H4388A896409241AA92A8C18783C1B954"><enum>(A)</enum><text>means an agreement, contract, swap, or transaction that provides for any purchase, sale, payment, or delivery of an excluded commodity, as such term is defined in section 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>), that is dependent on the occurrence, nonoccurrence, or the extent of the occurrence of a specific event or contingency; and</text></subparagraph>
<subparagraph id="H507F863A4CCB4F12A994AF887A957B06"><enum>(B)</enum><text>does not include insurance for which the insured holds a lawful insurable interest.</text> </subparagraph></paragraph> </section> <section id="HA090568E02874C82BB93730D9AF24E24"><enum>13152.</enum><header>Prohibition of participation in prediction markets</header> <subsection id="H09E44D36906C46F4B6D9A5B2283A41C2"><enum>(a)</enum><header>Prohibition</header> <paragraph id="HCF68AACD7A2E42EEBD673C31D2DB9C46"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A Member of Congress may not engage in, be a party to, or benefit from, a covered transaction.</text></paragraph>
<paragraph id="HBEAFECDC549D432C803CC88FC715526E"><enum>(2)</enum><header>Benefit from a household member</header><text>A Member of Congress receives a benefit from a covered transaction if—</text> <subparagraph id="HB252C418474844F4B082224EC34F46B5"><enum>(A)</enum><text>an individual in the same household as the Member engages in, or is a party to, a covered transaction; and</text></subparagraph>
<subparagraph id="H15635A0F9D1A46C0BC7C4B4152D420DD"><enum>(B)</enum><text>the transaction results in a payment paid, or benefit given, to the individual or another individual in the household.</text></subparagraph></paragraph></subsection> <subsection id="H83394CDAF68B4A0AA23B2BA9A0C000C5"><enum>(b)</enum><header>Certification</header> <paragraph id="H27A662DA84E840A1A99BF911EA6D67E7"><enum>(1)</enum><header>In general</header><text>Not later than 15 days after the start of a calendar year, a Member of Congress—</text> 
<subparagraph id="H36F3A70F265043AC8B22D51EDE8C1FDC"><enum>(A)</enum><text>who is a Member of the House of Representatives shall certify to the Clerk of the House of Representatives that the Member has complied with subsection (a) with respect to the most recent completed calendar year; and</text></subparagraph> <subparagraph id="H0B7013F737F84F45883CC35EEE011121"><enum>(B)</enum><text>who is a Member of the Senate shall certify to the Secretary of the Senate that the Member has complied with subsection (a) with respect to the most recent completed calendar year.</text></subparagraph></paragraph> 
<paragraph id="HF6E04163460B4097BD837D6255A652F6"><enum>(2)</enum><header>Report</header><text>The Clerk of the House of Representatives and the Secretary of the Senate shall make available on the public website of the Clerk and the Secretary, respectively, any certification made under this subsection.</text></paragraph></subsection> </section> <section id="H928F8D3D4CBC4247979D6958FB4E1DC1"><enum>13153.</enum><header>Penalties</header> <subsection id="HDF79FDDA121642538FF2D793F963D8CA"><enum>(a)</enum><header>Investigation</header><text>A congressional ethics committee shall promptly investigate any Member of Congress subject to the jurisdiction of the committee concerned who—</text> 
<paragraph id="H7884A44CAA87441990627C7CE8DC94D7"><enum>(1)</enum><text>does not comply with section 13152(b) for a calendar year; or</text></paragraph> <paragraph id="H2E3B063628E54694A49C1F3F7CFA21F6"><enum>(2)</enum><text>is subject to a credible report of a violation of section 13152(a).</text></paragraph></subsection> 
<subsection id="HA824BF910C074265AC8BD21CEE98DB32"><enum>(b)</enum><header>Penalty</header><text>In accordance with the rules of the House of Congress concerned, a Member of Congress who is found to have violated section 13152(a) shall be fined an amount determined by the House of Congress that shall be the greater of—</text> <paragraph id="HE6C37745EC3D450C8649F04D720D93EA"><enum>(1)</enum><text>$10,000; or</text></paragraph> 
<paragraph id="HD2CD62DE3B32432A9C409434268B8684"><enum>(2)</enum><text>the amount equal to triple the profit made by the Member of Congress as a result of the violation.</text></paragraph></subsection> <subsection id="H43ABB62E1BD34DAAAD6D6D6134F37444"><enum>(c)</enum><header>Deposit in the Treasury</header><text>The amounts paid by a Member of Congress for a fine under subsection (b) shall be deposited in the miscellaneous receipts of the Treasury.</text></subsection> 
<subsection id="HFB849837FF9C423984B2BCAC6E211F7B"><enum>(d)</enum><header>Additional measures</header><text>Subject to the rules of the House of Congress concerned, a congressional ethics committee may pursue, advise, or recommend additional sanctions or remedies with respect to a violation of section 13152(a) by a Member of Congress who is subject to the jurisdiction of the committee.</text></subsection></section> <section id="HD6D4E6EC1D8B43B1B366789E2E4C088E"><enum>13154.</enum><header>Duties of congressional ethics committees</header><text display-inline="no-display-inline">The congressional ethics committees shall carry out the following:</text> 
<paragraph id="H3A191531ECC74F64ABE745D9A664D956"><enum>(1)</enum><text display-inline="yes-display-inline">Establish procedures with respect to the certification requirements under section 13152(b) and the reporting requirements under section 13152(c).</text></paragraph> <paragraph id="H4152EB47FB7D49B8AF563357F4A5F851"><enum>(2)</enum><text>Issue guidance with respect to compliance with the requirements under this subchapter.</text></paragraph> 
<paragraph id="H498261A89B59479CAF2A54EF50AAA028"><enum>(3)</enum><text>Make available, on a public website under the authority of each congressional ethics committee, the procedures and guidance under this section and other such materials necessary or appropriate to assist Members of Congress in complying with the requirements under this subchapter.</text></paragraph></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H519E8C25CA454ADB8C19680C8E64BBF8"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of such chapter is amended by adding at the end the following:</text>

<section id="HA619359438FF46D5A6B47DF996B034D9"><enum>3.</enum><header>Transition provisions</header> 
<subsection id="H636D6B50DF214E3F9065C2D022F2F7C1"><enum>(a)</enum><header>Procedures and guidance</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the congressional ethics committees shall carry out the duties of the committees under paragraphs (1) and (2) of section 13154 of title 5, United States Code, as added by this Act.</text></subsection> <subsection id="HDE632AB7CE8046D7838E9A5390A0727B"><enum>(b)</enum><header>Start of compliance</header><text>Not later than 180 days after the date of the enactment of this Act, a Member of Congress shall comply with section 13152 of such title, as added by this Act.</text></subsection> 
<subsection id="HE756FF650EA54FF4917D0FD719668EE6"><enum>(c)</enum><header>Definitions</header><text>In this section, the terms <quote>Member of Congress</quote> and <quote>congressional ethics committees</quote> have the meanings specified in section 13151 of such title, as added by this Act.</text></subsection></section> </legis-body></bill>
