<official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, to maximize value of taxpayer dollars by providing regulatory relief for transit agencies, and for other purposes.</official-title>

<section id="H4463EC58EE704E3E9CF27340D4C7B11B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Streamlined Apportionment, Flexibility, and Efficiency Transit Act</short-title></quote>.</text></section> <section id="HA44E22F9462146AA8F08F7DFF57B78F7"><enum>2.</enum><header>Regulatory relief for transit agencies</header> <subsection id="H789735DCA9D74EDB92196CD0D37B401E"><enum>(a)</enum><header>Formula funds apportionment streamlining</header><text>Section 5336(d) of title 49, United States Code, is amended—</text>
<paragraph id="HDE24FB54A1F24C54B5C64A74283B4EEF"><enum>(1)</enum><text>in paragraph (1) by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H1CBC834C62EF499AA09A331936BB7E69"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph>
<paragraph id="HDB324184855940389C497911C4DB413D"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text> <quoted-block id="H6487B7B09E8D4E3E8770612318F097B7" style="OLC"> <paragraph id="H4894A916DC5443F4AB3374622B3B7EEA"><enum>(2)</enum><text>notwithstanding paragraph (1), apportion amounts to the States and recipients in urbanized areas under 1,000,000 in population appropriated under section 5338(a)(2) to carry out sections 5307, 5310, and 5311 not later than December 1 of the fiscal year for which any amounts are appropriated; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H8751860C75F541358872EDD7F20BBB71"><enum>(b)</enum><header>Bus formula 5-Year availability</header><text>Section 5339(a)(8) of title 49, United States Code, is amended—</text> <paragraph id="H9A1FA85619714883979B6B19D5493424"><enum>(1)</enum><text>by striking <quote>3 fiscal years</quote> and inserting <quote>5 fiscal years</quote>; and</text></paragraph>
<paragraph id="H10C9BBBDDD464ADE85894C2A577B7727"><enum>(2)</enum><text>by striking <quote>3-fiscal-year</quote> and inserting <quote>5-fiscal-year</quote>.</text></paragraph></subsection> <subsection id="H336DE9F65DC6413FA2D9B030FB854D2B"><enum>(c)</enum><header>Asset disposition</header><text>Section 5334(h)(4)(B)(ii)(II)(bb) of title 49, United States Code, is amended by inserting <quote>, except in the case of a recipient or subrecipient that certifies to the Secretary that the remaining amounts are to be used for capital projects under section 5307, 5310, or 5311</quote> before the period at the end.</text></subsection>
<subsection id="H8076AFD37B4943038B661D03CE5BE432"><enum>(d)</enum><header>General provisions</header><text>Section 5323 of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block id="HF98C7702CBD94FEEA60BFA21BFDB1749" style="OLC"> <subsection id="H45B262638937456295E9445C526BD650"><enum>(w)</enum><header>Categorical exclusion documentation</header><text>The Secretary shall minimize the requirements for documentation, studies, and memos to the greatest extent possible for any project seeking to be categorically excluded from requirements for environmental assessments or environmental impact statements.</text></subsection>
<subsection id="H701EF136F8FF4308A191E574315DDF64"><enum>(x)</enum><header>Early collaboration with state historic preservation offices</header><text>The Secretary shall encourage early consultation between the project sponsor and State historic preservation offices before the process under section 206108 of title 54 begins.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF7968D53801E45DDAACE2F7E56C549B2"><enum>(e)</enum><header>Reporting frequency and consolidation</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall—</text>
<paragraph id="H33218A97843F4C0FA572B7771B8A520B"><enum>(1)</enum><text>review all the reporting requirements that the Administrator of the Federal Transit Administration requires discretionary grant recipients to meet;</text></paragraph> <paragraph id="HE256D81EAAA24852AFD793737F194A5E"><enum>(2)</enum><text>evaluate which such requirements can be eliminated, consolidated, or reduced in scope; and</text></paragraph>
<paragraph id="HC6FB51F577674CE496A33E86746FB07A"><enum>(3)</enum><text>direct the Administrator to—</text> <subparagraph id="HBDBAB51B9A754879ADE59C2080760ABC"><enum>(A)</enum><text>implement the recommendations of this review; and</text></subparagraph>
<subparagraph id="H6FDEB84F1E7E4A1E804211FDFB5F0D43"><enum>(B)</enum><text>submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a list of the reporting requirements that will be eliminated, consolidated, or reduced in scope pursuant to this subsection.</text></subparagraph></paragraph></subsection> <subsection id="H401E0A8FE3CB4F40B94EDE286BD876FD"><enum>(f)</enum><header>FTA triennial review streamlining</header><text>Section 5307(f)(2) of title 49, United States Code, is amended—</text>
<paragraph id="HFB6A321CF38A402AAEF4BA6E4EDEA9BB"><enum>(1)</enum><text>by striking <quote>completely</quote>; and</text></paragraph> <paragraph id="HCB3EEA6C43D14E8CAC2EC19CEB9B6D50"><enum>(2)</enum><text>by adding <quote>The Secretary shall focus the review on previous deficiencies by the recipient and the most common deficiencies by all recipients, as identified by the Secretary. The Secretary shall randomly sample the remaining areas of compliance, not to exceed 5 categories in the random sample.</quote> at the end.</text></paragraph></subsection></section>
