<section id="HDF71FB11F3B24BF19EDB3B968AE6CB96" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating Operational Readiness Through Inter-Baltics Flexibility Act</short-title></quote> or the <quote><short-title>FORTIFY Act</short-title></quote>.</text></section> <section id="H253E0A88EC084C4AA2FDD38D2D4431A1" section-type="subsequent-section"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HBCE9F14B51AF4B419BC6802EDBBAD403"><enum>(1)</enum><text display-inline="yes-display-inline">the Baltic states play an important role in deterring aggression by the Russian Federation due to the strategic geographic location of the Baltic states in relation to—</text> <subparagraph id="HC61C7EC43CAD4DD1AF6C9860C17F12B3"><enum>(A)</enum><text>the ongoing war between Ukraine and the Russian Federation; and</text></subparagraph> 
<subparagraph id="H3CC4A391317D4C46866BF6956D152875"><enum>(B)</enum><text>the Russian Federation’s increasing interest in Europe overall; and</text></subparagraph></paragraph> <paragraph id="H95CA7ED19E6B48A9B1E593A82C4B3F13"><enum>(2)</enum><text display-inline="yes-display-inline">if the Baltic states were given standing permission and the capability to use the defense articles and services of each other Baltic state, and were provided the training to do so, the Russian Federation would likely assume that the entire combined fleet in the Baltic states could operate at any time anywhere in the Baltic region, which would significantly complicate Russian Federation planning and enhance deterrence at no cost.</text></paragraph></section> 
<section id="HA5BBD923845C43D0B843DBD046A6B8BF"><enum>3.</enum><header>Permission to transfers United States defense articles and defense services among Baltic states</header> 
<subsection commented="no" display-inline="no-display-inline" id="HE641665A56D74629820194E8B414616F">
        <enum>(a)</enum>
        <header>Exemptions from requirement for consent To transfer</header>
        <paragraph commented="no" display-inline="no-display-inline"
          id="HA25FF7E6F6554418A221AAD1C788A310">
          <enum>(1)</enum>
          <header>In general</header>
 <text>Notwithstanding section 3(a)(2) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753(a)(2)</external-xref>) and Section 505(a)(1) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2314">22 U.S.C. 2314(a)(1)</external-xref>), retransfers of any defense article or defense service among the Baltic states shall not require prior Presidential consent.</text>
        </paragraph>

          <enum>(2)</enum>
          <header>Prior agreements</header>
          <subparagraph commented="no" display-inline="no-display-inline"
            id="H1A985F13444B436199A0E147513651AF">
            <enum>(A)</enum>
            <header>Consent to transfer not required</header>
 <text display-inline="yes-display-inline">Any agreement between the United States and a Baltic state under section 3 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>) with respect to any defense article or defense service shall not require the Baltic state to seek approval from the United States to transfer such article or service to any other Baltic state.</text>
          </subparagraph>
          <subparagraph commented="no" display-inline="no-display-inline"
            id="H8F84C407E59444F5BACCD64B34E50CB8">
            <enum>(B)</enum>
            <header>Modification</header>
 <text display-inline="yes-display-inline">With respect to any agreement under section 3(a)(2) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753(a)(2)</external-xref>) in effect as of the date of the enactment of this Act that requires the consent of the President before a Baltic state may transfer a defense article or defense service, the United States shall modify such agreement so as to remove such requirement with respect to such a transfer to any other Baltic state.</text>
          </subparagraph>
        </paragraph>
      </subsection> 
<subsection id="HA4EEFB1EF8E74A92989221BA970AB6DD"><enum>(b)</enum><header>Common coalition key</header><text display-inline="yes-display-inline">The Secretary of Defense shall establish among the Baltic countries a common coalition key within the Baltic states for the purpose of sharing ammunition for any defense article or service among the Baltic states for training and operational purposes.</text></subsection> <subsection id="H231D078A44064983ADC7C08D5C88DDBA"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0231F673C031480A9EAF07634A9C8DC3"><enum>(1)</enum><header>Baltic state</header><text>The term <term>Baltic state</term> means the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD77399E1FCFF47B598CFA52E940CA2F4"><enum>(A)</enum><text display-inline="yes-display-inline">Estonia.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H30F4EBAFDB8940899EA42C66294F607A"><enum>(B)</enum><text display-inline="yes-display-inline">Lithuania.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA95C468709E7428A832ED5A5B1C9F842"><enum>(C)</enum><text display-inline="yes-display-inline">Latvia.</text></subparagraph></paragraph> 
<paragraph id="HFCB63D5FAA53453791FA41F1CBE873C0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Defense article; defense service</header><text>The terms <term>defense article</term> and <term>defense service</term> have the meanings given such terms in section 47 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2794">22 U.S.C. 2794</external-xref>).</text></paragraph></subsection></section> </legis-body></bill>
