<section id="H79E975655A0D4F60A30CA82E69358B3D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HUD Data Privacy Act of 2026</short-title></quote>.</text></section> <section id="HAA087F3FDC1F43D2932D5DE352622C7E"><enum>2.</enum><header>Limitation on exchange of information</header> <subsection id="HC7F09FCB91BC490190F20B890C061F03"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Housing and Urban Development shall establish a policy providing that any information collected from an individual receiving housing assistance may only be exchanged with another agency or a third-party entity in order to verify that individual’s—</text> 
<paragraph id="HF671176630F045DE9CAB09276F2179BE"><enum>(1)</enum><text>benefit eligibility; or</text></paragraph> <paragraph id="HB5C757589E994F8DB8006AD754E093DC"><enum>(2)</enum><text>benefit determination.</text> </paragraph> </subsection> 
<subsection id="H0B29F6C99CCF44988A5E68045C35B837">
        <enum>(b)</enum>
        <header>Applicability to other agencies and third-Party entities</header>
 <text display-inline="yes-display-inline">Any agency or third-party entity that receives information described in subsection (a) from the Secretary of Housing and Urban Development may not use the information for any purpose other than the purposes described in subsection (a).</text>
      </subsection> 
<subsection id="H3E87437413134503BAB647CBE742F619"><enum>(c)</enum><header>Exceptions</header><text>This section does not apply to—</text> <paragraph id="H52225116C56C4E3E851CE1CD1C21041D"><enum>(1)</enum><text display-inline="yes-display-inline">the sharing of deidentified information between HUD and other agencies or third-party entities for statistical or research purposes; or</text></paragraph> 
<paragraph id="H708CA18AA2B84969A6CDEAE3A7D3020F"><enum>(2)</enum><text>the sharing of data as part of an ongoing criminal investigation, or to prevent an imminent threat to life.</text></paragraph></subsection> <subsection id="H191DAAB9DE244DA88A012913B768E4E5"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>housing assistance</term> means—</text> 
<paragraph id="HF6B083D0D7EE4B65B878933B82D713E4">
          <enum>(1)</enum>
 <text>Federal financial assistance under section 9 of the United States Housing Act of 1937; or</text>
        </paragraph> 
<paragraph id="H0DF38699662A4BC8ABB86865D0D2C9D9"><enum>(2)</enum><text>tenant-based or project-based rental assistance under section 8 of the United States Housing Act of 1937.</text></paragraph> </subsection> <subsection id="H57A5445E9BC54DF4905539C7B4D0FDEB"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to permit the sharing of information for the purpose of civil enforcement of the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)).</text></subsection></section>
