<section section-type="section-one" id="H5ABABABC8BFC4600B11F5D9564A6079F"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Wasted Space Act</short-title></quote>.</text></section> 
<section id="HC71D701425254A398737CFAABE6757F4"><enum>2.</enum><header>Establishment of commission</header> 
<subsection id="HF8CAEEA01ED64E6EB10E4D84B7AAEF25"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established the Commission to Study Potential Uses of the Arts and Industries Building on the National Mall (hereafter in this Act referred to as the <quote>Commission</quote>).</text></subsection> <subsection id="HE9457A2FE6064254A41BEF0123B9E741"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The Commission shall be composed of 9 members, of whom—</text> 
<paragraph id="HFF9C0524A1114358B86E4A2F49D00813"><enum>(1)</enum><text>2 voting members shall be appointed by the majority leader of the Senate;</text></paragraph> <paragraph id="HAC363F8AF587452FAE6D66A8A3586409"><enum>(2)</enum><text>2 voting members shall be appointed by the Speaker of the House of Representatives;</text></paragraph> 
<paragraph id="H3637D94CEC7B498E9D505E182F0EE50A"><enum>(3)</enum><text>2 voting members shall be appointed by the minority leader of the Senate;</text></paragraph> <paragraph id="H8F98C378256642BAB5DCA18E1EFB25F9"><enum>(4)</enum><text>2 voting members shall be appointed by the minority leader of the House of Representatives; and</text></paragraph> 
<paragraph id="HE8767490782346AD85E67BFE86212A45"><enum>(5)</enum><text display-inline="yes-display-inline">1 voting member, who may not be a sitting member of the House of Representatives, Senate, or Supreme Court, shall be appointed by the Chair of the Board of Regents of the Smithsonian Institution.</text></paragraph></subsection> <subsection id="H3CB1AC51EF4E4FD79BC7C2A5D98491FF" commented="no"><enum>(c)</enum><header>Qualifications</header><text display-inline="yes-display-inline">Members of the Commission shall be appointed to the Commission from among individuals, or representatives of institutions or entities, who possess experience and familiarity with professional museum associations, tourism for families, urban planning, and educational institutions in the Washington, DC area.</text> </subsection> 
<subsection id="H1FB53FFD8B3847F5B19B8831CA89E836"><enum>(d)</enum><header>Deadline for initial appointment</header><text display-inline="yes-display-inline">The initial members of the Commission shall be appointed not later than the date that is 45 days after the date of the enactment of this Act.</text></subsection> <subsection id="H7D9E3C76D6F14AD9BD16121122C661BF"><enum>(e)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text> 
<paragraph id="H4CFDEFE2995B4B3BB4B7FF5D434EB38F"><enum>(1)</enum><text display-inline="yes-display-inline">shall not affect the powers of the Commission; and</text></paragraph> <paragraph id="HA4A9DCC5753146B5BD2E4848D07F711B"><enum>(2)</enum><text>shall be filled in the same manner as the original appointment was made.</text></paragraph></subsection> 
<subsection id="HFC881DBDB9DA455AB683A93A1CA3DB5B"><enum>(f)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Commission shall, by majority vote of all of the voting members, select 1 member of the Commission to serve as the Chairperson of the Commission.</text></subsection> <subsection id="HAEBD4377337D461A8103FAC180BF6620"><enum>(g)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No employee of the Federal Government may serve as a member of the Commission.</text></subsection></section> 
<section id="H5CC273BA9E6C40E8A9BDF3717DF070DF" commented="no"><enum>3.</enum><header>Duties of commission</header> 
<subsection id="H1138AE5D690344AEA596238A45ECBD55"><enum>(a)</enum><header>Submission requirements to President and Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the first meeting of the Commission, the Commission shall submit to the President and to Congress the report, plan, and recommendations described in subsections (b) through (d).</text> </subsection> <subsection id="HCFF224CB99904F8D8FAEF8D675BE030E" commented="no"><enum>(b)</enum><header>Report on issues</header><text display-inline="yes-display-inline">The Commission shall prepare a report that addresses the following issues relating to the potential uses of the Arts and Industries Building on the National Mall, and its environs (hereafter in this Act referred to as the <quote>Building</quote>):</text> 
<paragraph id="H7959E354FDEF4B67AA3D6953ED1C4460" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Educational institutions currently serving families visiting Washington, DC with high levels of success.</text></paragraph> <paragraph id="H1B58B4A2A56140B3BE910AD5AAE9A674" commented="no"><enum>(2)</enum><text>Museums and other cultural institutions not currently located near the National Mall.</text></paragraph> 
<paragraph id="HF03AC014F58D4D9687A3835C68E42794" commented="no"><enum>(3)</enum><text>Washington, DC based museums not currently housed in Smithsonian buildings.</text></paragraph> <paragraph id="H4F76EA195175485DA48C7B1716716F13" commented="no"><enum>(4)</enum><text>Tenants in Federally owned buildings impacted by Federal office relocations.</text></paragraph> 
<paragraph id="H8AEDC2D9FB224CC489EDF7B0F44A23FC" commented="no"><enum>(5)</enum><text>The cost of converting the Smithsonian Institution’s Arts and Industries Building into a modern museum.</text></paragraph> </subsection> <subsection id="H689EB23B8EC04616BAA8E37E957F19B8" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Fund-Raising plan</header><text>The Commission shall prepare a fund-raising plan that addresses the following topics:</text> 
<paragraph id="H03E2E5CDDFFF4018828A94CD9C356708" commented="no"><enum>(1)</enum><text>The ability to support the operation and maintenance of the Building through contributions from the public, including potential charges for admission.</text></paragraph> <paragraph id="HD3E66101B90A4E8B90F955479EF71558" commented="no"><enum>(2)</enum><text>Any potential issues with funding the operations and maintenance of the Building in perpetuity without reliance on appropriations of Federal funds.</text></paragraph></subsection> 
<subsection id="HD807C98FFD594FD2A2257DAA6DBF3953" commented="no"><enum>(d)</enum><header>Legislative recommendations</header><text>The Commission shall prepare a report containing recommendations regarding a legislative plan for the operations and maintenance of the Building, which shall include each of the following:</text> <paragraph id="HB8608B3664D844F8928657E02B12F72D" commented="no"><enum>(1)</enum><text>Proposals regarding the time frame, one-time appropriations level, and continuing appropriations levels that might be included in such legislation.</text></paragraph> 
<paragraph id="H728A72812B5A42E2B236949E0D1611F1" commented="no"><enum>(2)</enum><text>Recommendations for the future name of the Building.</text></paragraph></subsection> </section> <section id="HDBB57FB03B844F158398F95A4642172A"><enum>4.</enum><header>Administrative provisions</header> <subsection id="H6A59A67505C5452F930D14B6E9F3F94E"><enum>(a)</enum><header>Compensation</header> <paragraph id="H33BF058142C24F78BFA87684862D5F0C"><enum>(1)</enum><header>In general</header><text>A member of the Commission—</text> 
<subparagraph id="H0CC1128720084514BB5379230A4D3CF5"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be considered to be a Federal employee for any purpose by reason of service on the Commission; and</text></subparagraph> <subparagraph id="HE7555FE0E47849AA984B9546EBA7FC69"><enum>(B)</enum><text>shall serve without pay.</text></subparagraph></paragraph> 
<paragraph id="H224F88A0373042059DEF2705028A27A1"><enum>(2)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">A member of the Commission shall be allowed a per diem allowance for travel expenses, at rates consistent with those authorized under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></paragraph> <paragraph id="HE018A56ACE8C48378F4C512595E9C424"><enum>(3)</enum><header>Gifts, bequests, and devises</header><text display-inline="yes-display-inline">The Commission may solicit, accept, use, and dispose of gifts, bequests, or devises of money, services, or real or personal property for the purpose of aiding or facilitating the work of the Commission. Such gifts, bequests, or devises may be from the Building.</text></paragraph></subsection> 
<subsection id="H95B924882E9046A487595290B2EE4862"><enum>(b)</enum><header>Termination</header><text display-inline="yes-display-inline">The Commission shall terminate on the date that is 30 days after the date on which the final versions of the report, plan, and recommendations required under section 3 are submitted.</text></subsection> <subsection id="H1F1BB1B60ED34C55BDEE84A0FD0D6638"><enum>(c)</enum><header>Funding</header><text display-inline="yes-display-inline">The Commission shall be solely responsible for acceptance of contributions for, and payment of the expenses of, the Commission.</text></subsection> 
<subsection id="HAD56BC2159734DDE8EF6B516CE771B3B"><enum>(d)</enum><header>Director and staff of commission</header> 
<paragraph id="H577B279DE89D4189A92E4E121FAF51A0"><enum>(1)</enum><header>Director and staff</header> 
<subparagraph id="H5E4FD583FBA849E8BD030B80C68EBDF2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may employ and compensate an executive director and any other additional personnel that are necessary to enable the Commission to perform the duties of the Commission.</text></subparagraph> <subparagraph id="HCAF3DF369961404ABFBB2A0E6C65EDFD"><enum>(B)</enum><header>Rates of pay</header><text display-inline="yes-display-inline">Rates of pay for persons employed under subparagraph (A) shall be consistent with the rates of pay allowed for employees of a temporary organization under section 3161 of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H06E43ACC11614F46A81CB47BA44406C4"><enum>(2)</enum><header>Not Federal employment</header><text display-inline="yes-display-inline">Any individual employed under this subsection shall not be considered a Federal employee for the purpose of any law governing Federal employment.</text></paragraph> <paragraph id="HD273EDB655144200B56C40BC0CE3E6A3"><enum>(3)</enum><header>Technical assistance</header> <subparagraph id="HEC5A6DC02A314ED8B2E1D02D606426B3"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), on request of the Commission, the head of a Federal agency shall provide technical assistance to the Commission.</text></subparagraph> 
<subparagraph id="H92065620D8844EA3B630A57258AB8CAA"><enum>(B)</enum><header>Prohibition</header><text>No Federal employees may be detailed to the Commission.</text></subparagraph></paragraph> <paragraph id="H59B2F6E893714784A25F0F9891BA3636"><enum>(4)</enum><header>Volunteer services</header><text>Notwithstanding section 1342 of title 31, United States Code, the Commission may accept and use voluntary and uncompensated services as the Commission determines necessary.</text></paragraph></subsection> 
<subsection id="H7A8BCC3D128648AA8CCEE02478127871"><enum>(e)</enum><header>Administrative support services</header><text>Upon request of the Commission, the Administrator of the General Services Administration shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out its responsibilities under this Act. The involvement of the General Services Administration shall be limited to providing administrative support to the Commission, and such involvement shall terminate upon termination of the Commission.</text></subsection> <subsection id="H49087C8090B0416081C779F22F59235D"><enum>(f)</enum><header>Meeting location</header><text>The Commission may meet virtually or in person.</text></subsection> 
<subsection id="HE632111D62D44FDB9AD2711CABDC3DF4"><enum>(g)</enum><header>Appointment delays</header><text>The Commission may begin to meet and carry out activities under this Act before all members of the Commission have been appointed if—</text> <paragraph commented="no" display-inline="no-display-inline" id="H546B8D7D2A2243F5A7C55201D7BF13E2"><enum>(1)</enum><text display-inline="yes-display-inline">90 days have passed since the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBFBC9AAC8E9044EABF414A8E008DF8DA"><enum>(2)</enum><text display-inline="yes-display-inline">a majority of the members of the Commission have been appointed.</text></paragraph></subsection></section> </legis-body></bill>
