<section id="HF5A734099D354CBC9AB7FF0045918CE7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Americans Insist on Political Agent Clarity Act</short-title></quote> or the <quote><short-title>AIPAC Act</short-title></quote>.</text></section> <section id="H236076FCD5CD446987EDA5A05B0A1665"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H44DC8E49CE86466FA9611A9946CBDAA9"><enum>(1)</enum><text display-inline="yes-display-inline">The Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>) serves compelling interests in national security and transparency.</text></paragraph> <paragraph id="HFAF893ED65194A448265D51488E8E7C1"> <enum>(2)</enum> <text>Disclosure requirements do not abridge free speech or association, as upheld in Meese v. Keene (1987) as well as Attorney General v. Irish Northern Aid Committee (1972).</text>
            </paragraph> 
<paragraph id="H5017E1DEF9DE46BFA0733683AA3BBE00"><enum>(3)</enum><text>Entities engaged in substantial advocacy aligned with foreign state interests should disclose such alignment to the public.</text></paragraph></section> <section id="HDB36A39CD0974AF185ABB03B352E19F4"><enum>3.</enum><header>Clarification of foreign principal status</header> <subsection id="HEEBF906B72814FF69488E839300EAE56"><enum>(a)</enum><header>Definition of foreign principal</header><text display-inline="yes-display-inline">Section 1(b) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(b)</external-xref>) is amended—</text> 
<paragraph id="H30C5590312D64AEFA2B6D2546E49543C"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> after <quote>United States;</quote>;</text></paragraph> <paragraph id="H5801DD54DF374C9989AA1841E98806DE"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H12CF65EEDC3D4181A3EF837DB6879905"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text> <quoted-block id="H84A4A6189C4948A288D14BAE8E877EA0" style="USC"> <paragraph id="H7C039EEC46BC407F80585BB22D9A6DDB"><enum>(4)</enum><text>any organization, association, corporation, or other entity—</text> 
<subparagraph id="H5C23945B15E644BB80E97D5DEB91DC65"><enum>(A)</enum><text>that is organized under the laws of the United States or any State;</text></subparagraph> <subparagraph id="H2F5CC156AB164AC28FB2F0BFD494CE53"><enum>(B)</enum><text>that does not directly receive funding or instruction from a foreign government, recognized state-affiliated political entities, or foreign entity otherwise described in paragraph (1), (2), or (3);</text></subparagraph> 
<subparagraph id="HD6B06A58CA7740A5AB0E4C297869AC47"><enum>(C)</enum><text>whose lobbying activities or stated mission is, either wholly or in part, to influence United States public policy or government action in furtherance of the political or economic interests of a foreign country or recognized state-affiliated political entity; and</text></subparagraph> <subparagraph id="H6DDD7CFC0DAC48A29BFC6A99B3A0537B"><enum>(D)</enum><text>where such foreign country or recognized state-affiliated political entity is identified as a principal beneficiary of such lobbying activity as demonstrated by a preponderance of objective indicia, including—</text> 
<clause id="HDE14A44E67F24DE49652FCF89E8F5CFD"><enum>(i)</enum><text>repeated advocacy of legislation or executive action that aligns with the foreign country’s official diplomatic objectives;</text></clause> <clause id="H8EC4C56F2D7042ABBA9EFBC15EF30553"><enum>(ii)</enum><text>coordination with foreign officials or foreign-funded institutions;</text></clause> 
<clause id="H108808FD6FD74477A8375D5B6B2996BC"><enum>(iii)</enum><text>receipt of material support, strategic direction, or advisory participation by persons domiciled or operating in a foreign country; or</text></clause> <clause id="H5A1034684BCB4D6F96C4822E35EB3971"><enum>(iv)</enum><text>the namesake of the lobbying activity includes the name of a foreign nation.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H73F2B19E4CF149E587AA913FF45EE1CA"><enum>(b)</enum><header>Private right of action</header><text display-inline="yes-display-inline">Section 8 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/618">22 U.S.C. 618</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HBDA8D4B8866140248643E954222B1F9C" display-inline="no-display-inline"> <subsection id="H5F5C6BCD9D8D4AA5B53E961271841040"><enum>(i)</enum><text display-inline="yes-display-inline">Any citizen of the United States may file a complaint with the Department of Justice requesting investigation of potential violations of this Act by an agent of a foreign principal (as described in section 1(b)(4)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H0FE602BE7D1D413AA86F27AE05A35C03"><enum>4.</enum><header>Implementation guidance</header><text display-inline="no-display-inline">Not later than 180 days after the enactment of this Act, the Attorney General shall issue public guidance to clarify the application of the amended definition of <quote>foreign principal</quote> under section 1(b)(4) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(b)(4)</external-xref>), which shall include illustrative examples, objective indicia of foreign political alignment, and compliance expectations for affected organizations.</text></section> </legis-body></bill>
