<section id="H12DD4EF29B494D128E243DC8C9797687" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Campaign Event Contract Integrity Act</short-title></quote>.</text> </section> 
<section id="HBE21F8F4C0364963B3D39092D2BFA29C" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HCA0770F1A8DD4C6A81CCA0BC6195451D"><enum>(1)</enum><header>Covered campaign-affiliated individual</header><text display-inline="yes-display-inline">The term <term>covered campaign-affiliated individual</term> means any individual who, directly or indirectly, receives compensation from, acts on behalf of, or provides services to—</text> 
<subparagraph id="HFCEC09626B8E44E58A835D9B41014506">
                    <enum>(A)</enum>
 <text>a candidate for Federal office;</text> </subparagraph> <subparagraph id="H7F50A7CA169F4AD38B176151F217AA6A"><enum>(B)</enum><text>an authorized committee of a candidate for Federal office;</text></subparagraph> 
<subparagraph id="H172A50AA580C4D76AAA2F844705002D9"><enum>(C)</enum><text>a political committee;</text></subparagraph> <subparagraph id="H52A4029CF48F475698205952D4407450"><enum>(D)</enum><text>a political party committee;</text></subparagraph> 
<subparagraph id="H62E3736427E747F8BB09CFE5E6A45B95"><enum>(E)</enum><text>a leadership PAC; or</text></subparagraph> <subparagraph id="HFA705654AD5249ABA578D44FB42EF771"><enum>(F)</enum><text display-inline="yes-display-inline">any entity or organization substantially engaged in campaign-related activity, including any employee, consultant, advisor, pollster, data analyst, strategist, media consultant, fundraiser, vendor, contractor, volunteer with access to confidential information, or any immediate family member acting on behalf of such individual.</text></subparagraph></paragraph> 
<paragraph id="HE9BAC6E3453C430DAB7CB7248AB91C49"><enum>(2)</enum><header>Covered platform</header><text display-inline="yes-display-inline">The term <term>covered platform</term> means any registered entity, designated contract market, swap execution facility, broker, intermediary, or other platform that facilitates trading in political event contracts.</text></paragraph> <paragraph id="HD98279AA5F26407E8A6EED9D3AC4B380"><enum>(3)</enum><header>Material nonpublic campaign information</header><text display-inline="yes-display-inline">The term <term>material nonpublic campaign information</term> means confidential information unavailable to the general public that a reasonable person would consider important in deciding whether to purchase, sell, or trade a political event contract, including—</text> 
<subparagraph id="HBDA6228D9375439693A86CA6BD6E508F"><enum>(A)</enum><text>internal polling;</text></subparagraph> <subparagraph id="H745F2B26F9E74FBDB9CBA0535E9046B7"><enum>(B)</enum><text>turnout projections;</text></subparagraph> 
<subparagraph id="HFC5D3FBE1CB44082910171C045FDE110"><enum>(C)</enum><text>voter targeting data;</text></subparagraph> <subparagraph id="HDA072D996A494F33991746B4C2D66187"><enum>(D)</enum><text>fundraising information;</text></subparagraph> 
<subparagraph id="HBA5B24AAB6384D38A266E70B940923C0"><enum>(E)</enum><text>campaign advertising strategy;</text></subparagraph> <subparagraph id="HF4B90F67E5F841FD981E6046786787BC"><enum>(F)</enum><text>opposition research;</text></subparagraph> 
<subparagraph id="H2A3B8FA647AB452CB8B6839A3D047CC7"><enum>(G)</enum><text>internal campaign analytics;</text></subparagraph> <subparagraph id="H1637BE88CFC4423A8A499934FBE40B4D"><enum>(H)</enum><text>unreleased endorsement information;</text></subparagraph> 
<subparagraph id="H74780454761B47E5B6EFBF39B3A5143A"><enum>(I)</enum><text>candidate withdrawal or suspension plans; or</text></subparagraph> <subparagraph id="H87E9F2103E634CB8BB1C051ABB09AEA1"><enum>(J)</enum><text>any other confidential campaign information designated by rule of the Commodity Futures Trading Commission.</text></subparagraph></paragraph> 
<paragraph id="HBBF8AE04C3C84E75922F1915C278F7CC"><enum>(4)</enum><header>Political event contract</header><text display-inline="yes-display-inline">The term <term>political event contract</term> means any agreement, transaction, swap, option, contract, derivative, or event contract that allows a person to purchase, sell, trade, or otherwise obtain financial exposure based on the outcome of—</text> <subparagraph id="H53BC1E034EDD46A9B28FC3ABB07B6805"><enum>(A)</enum><text>a Federal election;</text></subparagraph> 
<subparagraph id="H4D49C3367B104B5A86C59D86443B4C41"><enum>(B)</enum><text>a primary election;</text></subparagraph> <subparagraph id="H0BB8607E4A144E218AF3D097AEC9C790"><enum>(C)</enum><text>a caucus;</text></subparagraph> 
<subparagraph id="H7F24580E21B44E32BAEB38FC74C0B361"><enum>(D)</enum><text>the nomination of a candidate;</text></subparagraph> <subparagraph id="HA5C10D4A80B2452AA3CC42E31C0C574B"><enum>(E)</enum><text>control of Congress;</text></subparagraph> 
<subparagraph id="H68BA4A10E6664690A2DF5A79E0FC5BFF"><enum>(F)</enum><text>the approval or rejection of legislation; or</text></subparagraph> <subparagraph id="H35BB2FFF8DD64A518C7776FCE47D0E08"><enum>(G)</enum><text>any other political or governmental event designated by the Commodity Futures Trading Commission.</text></subparagraph></paragraph> </section> 
<section id="H56CCA7120E20424A8A8FCAFFCB6D6058"><enum>3.</enum><header>Trading by campaign-affiliated individuals</header> 
<subsection id="H927475E98FB145E8BBE8474CC419BAE4" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct during campaign affiliation</header><text display-inline="yes-display-inline">No covered campaign-affiliated individual may, directly or indirectly, purchase, sell, trade, or otherwise transact in a political event contract while knowingly in possession of material nonpublic campaign information.</text> </subsection> <subsection id="HA31BD8DC942D4FFA90B0FFF0BF4F0EFB"><enum>(b)</enum><header>Tipping prohibition</header><text display-inline="yes-display-inline">No covered campaign-affiliated individual may communicate, provide, or disclose material nonpublic campaign information to another person when it is reasonably foreseeable that such information may be used to trade a political event contract.</text></subsection> 
<subsection id="H6066BC01E4FA4456B7B95B392700E5FF"><enum>(c)</enum><header>Evasion prohibition</header><text display-inline="yes-display-inline">No person may knowingly trade political event contracts on behalf of, at the direction of, or for the benefit of a covered campaign-affiliated individual for the purpose of evading this Act.</text></subsection></section> <section id="H984E13F3709A4FCD94597F897E73B84A"><enum>4.</enum><header>Platform safeguards and compliance requirements</header> <subsection id="H017A0AA47D8A46B0B94A6141797AAE17"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each covered platform shall establish and maintain reasonable policies, procedures, and controls reasonably designed to—</text> 
<paragraph id="HDA329A0DE60D4E339DB4FA42074F2175"><enum>(1)</enum><text>detect and prevent trading prohibited under this Act;</text></paragraph> <paragraph id="H2417F5F0F7E14704B5D00AAF923C75C3"><enum>(2)</enum><text>identify suspicious trading activity involving campaign-affiliated individuals;</text></paragraph> 
<paragraph id="HBAF9C69B290C47818C939718FB6674FA"><enum>(3)</enum><text>monitor concentrated or coordinated trading activity connected to campaigns, political committees, or affiliated entities;</text></paragraph> <paragraph id="H8C51773F6FA6489E92CB300204D99C26"><enum>(4)</enum><text>maintain records sufficient to assist in the detection and investigation of violations of this Act; and</text></paragraph> 
<paragraph id="HC11B2F6FA6BA440CBDFE907B4129234B"><enum>(5)</enum><text>report suspicious activity to the Commodity Futures Trading Commission, as appropriate.</text></paragraph></subsection> <subsection id="HA5914A55FFBD4ED09C427D4AB52B3E17"><enum>(b)</enum><header>Campaign affiliation disclosure</header><text>A covered platform shall require any trader engaging in political event contract trading above thresholds established by the Commodity Futures Trading Commission to disclose whether such trader—</text> 
<paragraph id="H70A91764678F44629FF8438D661960DD"><enum>(1)</enum><text>is employed by, compensated by, or affiliated with a Federal campaign, political committee, or political party committee; or</text></paragraph> <paragraph id="H70FE982F3A5A47DC94F3664B337E183B"><enum>(2)</enum><text>possesses access to material nonpublic campaign information.</text></paragraph></subsection> 
<subsection id="H7873F46322684D0ABA14922FD5960206"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of the enactment of this Act, the Commodity Futures Trading Commission shall promulgate rules implementing this section.</text></subsection></section> <section id="H0320E51A13AC41958211D8DA6919D50E"><enum>5.</enum><header>Enforcement</header> <subsection id="H2A3FAEAC276648D9BB75D12B7DD2FDC2"><enum>(a)</enum><header>Authority</header><text>The Commodity Futures Trading Commission may investigate potential violations of this Act and bring civil enforcement actions in an appropriate United States district court.</text></subsection> 
<subsection id="H2C7620CD69754DC58BEB13F3660F56B7"><enum>(b)</enum><header>Civil penalties</header><text>Any person who violates this Act shall be subject to—</text> <paragraph id="H4290E3E225DC4883BCC3BCE0D75A9BDC"><enum>(1)</enum><text>a civil penalty not to exceed the greater of—</text> 
<subparagraph id="HB48E0C19286A454F9E602CC733D0C0FB"><enum>(A)</enum><text>$250,000; or</text></subparagraph> <subparagraph id="H32E347B5471044669730C977FF8495CA"><enum>(B)</enum><text>three times the profit gained or loss avoided as a result of the violation;</text></subparagraph></paragraph> 
<paragraph id="H85BE4C1BA457416B99921A0A7B0CC136"><enum>(2)</enum><text>disgorgement of profits obtained through prohibited trading activity; and</text></paragraph> <paragraph id="H024D2C61310F4E458FB5AA172631D536"><enum>(3)</enum><text>temporary or permanent trading bans relating to political event contracts.</text></paragraph></subsection> 
<subsection id="HF22A012C083C480A950FDC741074EA99"><enum>(c)</enum><header>Referral authority</header><text>The Commodity Futures Trading Commission may refer evidence of willful misconduct, fraud, conspiracy, false statements, or other criminal violations to the Attorney General.</text></subsection></section> <section id="H835D3F03A0EB487FB65BD67BBDBA7135"><enum>6.</enum><header>Safe harbor</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to prohibit—</text> 
<paragraph id="HC11D21BB5AD24935AEEFACAC9FE500FD"><enum>(1)</enum><text>lawful political analysis based exclusively on publicly available information;</text></paragraph> <paragraph id="H650D427453D841A5A5D736D78576469B"><enum>(2)</enum><text>journalism, academic research, or public commentary;</text></paragraph> 
<paragraph id="H50295FA6CC0642E5ADFABF5B296A6826"><enum>(3)</enum><text>trading activity by persons without access to material nonpublic campaign information; or</text></paragraph> <paragraph id="H4B6FA1EF1BB04C9AA00029B5C6C2DF78"><enum>(4)</enum><text>the lawful operation of political event contracts otherwise permitted under Federal law.</text></paragraph></section> 
<section id="H0EF0C00A27044C93B036033A0D03850C"><enum>7.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to—</text> <paragraph id="HF086456BF9064DB5BD365CEA179BBBFB"><enum>(1)</enum><text>alter, limit, expand, or otherwise affect the authority of the Commodity Futures Trading Commission under the Commodity Exchange Act;</text></paragraph> 
<paragraph id="H25F23A7150B44634B8D5214FC93D944A"><enum>(2)</enum><text>modify, supersede, or preempt any existing Federal securities, commodities, campaign finance, fraud, ethics, or anti-corruption laws;</text></paragraph> <paragraph id="HE8263687A3A9458DB5388F6DC0AACE82"><enum>(3)</enum><text>prohibit or authorize the prohibition of political event contracts otherwise permitted under Federal law; or</text></paragraph> 
<paragraph id="HB18889AEEA4040D3BEB42BC5E5135EC3"><enum>(4)</enum><text>limit the authority of any Federal agency to investigate, enforce, or prosecute conduct otherwise prohibited under Federal law.</text> </paragraph></section> </legis-body></bill>
