<section id="H7B9FDCB516F84A569D199892E606EF5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respect Tribal IDs Act</short-title></quote>.</text></section> <section id="HE51C44646D3A46A7B83A05E74B0110A8"><enum>2.</enum><header>DHS training standards</header><text display-inline="no-display-inline">Section 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HA02805122442450F9B698061532EEF24" display-inline="no-display-inline"> 
<subsection id="H803C13B362964EC9B180C40F5D9E14DF"><enum>(i)</enum> 
<paragraph id="HF4B21A3DB11F45E4AF43C738162A8421" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall, in collaboration with the Bureau of Indian Affairs and in consultation with Indian tribes, develop training curricula for any officer or employee of the Department of Homeland Security on—</text> <subparagraph id="HF803BA1EFA934FF1A4F6247FF7A8E849"><enum>(A)</enum><text display-inline="yes-display-inline">appropriate protocol, as developed by the Secretary, for interacting with all enrolled members of Indian Tribes;</text></subparagraph> 
<subparagraph id="H13C5CA83305B44A185F6EAE2B0A1CCCA"><enum>(B)</enum><text>how to identify a Native American tribal document;</text></subparagraph> <subparagraph id="H85C337EE93064E0DB6F8069946D3F403"><enum>(C)</enum><text display-inline="yes-display-inline">accepting a Native American tribal document as proof of United States citizenship;</text></subparagraph> 
<subparagraph id="H1818C95EA5A0441EA7B01CF3585E8678"><enum>(D)</enum><text display-inline="yes-display-inline">how to access examples of a Native American tribal document; and</text></subparagraph> <subparagraph id="HADE847481AE14CA3800F6E781D3695BA"><enum>(E)</enum><text display-inline="yes-display-inline">the trust responsibility of the United States Government.</text></subparagraph></paragraph> 
<paragraph id="H29835F980F2C48E093575EFD126270E7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The curricula developed under paragraph (1) shall include—</text> <subparagraph id="H298684F978DE43528FDE5BCCB4B37161"><enum>(A)</enum><text display-inline="yes-display-inline">the contact information, names, locations, and Native American tribal document formats of all Indian Tribes in the region where an officer or employee will perform duties relating to enforcement of the immigration laws;</text></subparagraph> 
<subparagraph id="H0B980579E0BB4FFDB48054C5829A435D"><enum>(B)</enum><text>scenario-based exercises;</text></subparagraph> <subparagraph id="H30F9ED3C3AF64681AEF7BEB1BABF04E4"><enum>(C)</enum><text>the development of a database with examples of Native American tribal documents;</text></subparagraph> 
<subparagraph id="HF122F3CE25BB4BAB9EAB96047CCC3D5C"><enum>(D)</enum><text>pre- and post-training assessments; and</text></subparagraph> <subparagraph id="H33C2A87962D44E2484F643737ECB5AEE"><enum>(E)</enum><text>a history with respect to American Indians being granted United States citizenship and the trust responsibility of the United States Government.</text></subparagraph></paragraph> 
<paragraph id="HD16888B165D5424A8A13C4B61594B726" indent="up1"><enum>(3)</enum><text>Before an officer or employee may perform duties relating to enforcement of the immigration laws, such officer or employee shall be required to complete the training curricula developed under paragraph (1) not less than annually and each time the officer or employee is assigned to a new region.</text></paragraph> <paragraph id="HD340366D22004B769486A05AF3CDCC12" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Respect Tribal IDs Act</short-title>, the Secretary shall submit a report on the development of the training curricula established under this subsection to the Committees on the Judiciary, Homeland Security, and Natural Resources of the House of Representatives and the Committees on the Judiciary, Homeland Security and Governmental Affairs, and Indian Affairs of the Senate.</text></paragraph> 
<paragraph id="H141E4CE4392E499BA695595CF0989218" indent="up1"><enum>(5)</enum><text>In this subsection—</text> <subparagraph id="HD2262677A4FC41C4A25F018869429C4D"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>Indian tribe</quote> has the meaning given such term in the Federally Recognized Indian Tribe List Act of 1994; and</text></subparagraph> 
<subparagraph id="H405C9EE255D04A67B1E8BAE06C4E2E96"><enum>(B)</enum><text>the term <quote>Native American tribal document</quote> includes—</text> <clause id="H3E704D93983B41008E23C7769EB219DA"><enum>(i)</enum><text display-inline="yes-display-inline">Native American tribal cards issued pursuant to section 7209 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>);</text></clause> 
<clause id="HE6F7FB84FA044BBFAA83D79A4AD8C35A"><enum>(ii)</enum><text display-inline="yes-display-inline">documentary evidence issued by Federally recognized Indian Tribes, including Tribes located in a State that has an international border, which—</text> <subclause id="H0CAFCAEACE5E418EB18274441400FDB9"><enum>(I)</enum><text display-inline="yes-display-inline">identifies the Federally recognized Indian Tribe that issued the document;</text></subclause> 
<subclause id="H024EBBEF47DB477789179AB4A92A3DD8"><enum>(II)</enum><text display-inline="yes-display-inline">identifies the individual by name; and</text></subclause> <subclause id="HBF1FF0D98E414A2AB5583F69A4BAE905"><enum>(III)</enum><text display-inline="yes-display-inline">confirms the individual's membership, enrollment, or affiliation with the Tribe;</text></subclause></clause> 
<clause id="HFC4DBF45B1844448B3F63D7A514BCBDA"><enum>(iii)</enum><text>other documents approved by the Secretary of Homeland Security as confirming United States citizenship; and</text></clause> <clause id="H51B11F4608F946299E5823FD8DA54A99"><enum>(iv)</enum><text>documents described in subparagraph (B)(ii) include—</text> 
<subclause id="HB45AB72061EA455A9693CB89F7126EF6"><enum>(I)</enum><text>a tribal enrollment card;</text></subclause> <subclause id="HD52026315D53434F8A64E66360520667"><enum>(II)</enum><text>a certificate of degree of Indian blood;</text></subclause> 
<subclause id="HEC5ACE0308A04EB4B00356D983150C8D"><enum>(III)</enum><text>a tribal census document; and</text></subclause> <subclause id="H47F4749E14104FCAB8D55A3CD714872D"><enum>(IV)</enum><text>a document on tribal letterhead, issued under the signature of the appropriate tribal official, that meets the requirements of subparagraph (B)(ii).</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
