<section id="H8D3AAF1F8E9342ABB40660D65CB08ABA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Revitalization for a Better Tomorrow Act</short-title></quote>.</text> </section> <section id="H2D5A2B86A18F43379B3832EF6DBAA36E"><enum>2.</enum><header>Brownfields revitalization funding</header> <subsection id="H79F0FB7ADE524EA798CCD86AF1CF6D34" commented="no"><enum>(a)</enum><header>Definition of eligible entity</header><text>Section 104(k)(1)(I) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(1)(I)</external-xref>) is amended by inserting <quote>or 501(c)(6)</quote> after <quote>section 501(c)(3)</quote>. </text></subsection> 
<subsection id="H81DE7F36C6B74959B666C49A8649FB87"><enum>(b)</enum><header>Grants and loans for brownfield remediation</header><text>Section 104(k)(3)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)(A)(ii)</external-xref>) is amended by striking <quote>$500,000</quote> and all that follows through the period at the end and inserting <quote>$1,000,000 for each site to be remediated.</quote>.</text> </subsection> <subsection id="H524507230ED7461EA02EA7360056B291"><enum>(c)</enum><header>Multipurpose brownfields grants</header><text display-inline="yes-display-inline">Section 104(k)(4)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(4)(B)</external-xref>) is amended by striking <quote>$1,000,000</quote> and inserting <quote>$2,000,000</quote>.</text></subsection> 
<subsection id="HC96E802FF7374C6D875B4BD1D99632C4"><enum>(d)</enum><header>General provisions</header><text>Section 104(k)(5) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(5)</external-xref>) is amended—</text> <paragraph id="HEB4BF8F88241471FAF8CA8AB014A64AA"><enum>(1)</enum><text>in subparagraph (A), by amending clause (i) to read as follows:</text> 
<quoted-block id="H996108EFF12F4046ADAC389FB29AD679" style="OLC"> 
<clause id="H5801192A00B34BC4B7BC3FD40FD49FCA"><enum>(i)</enum><header>Brownfield site characterization and assessment</header><text>A grant under paragraph (2) may be awarded to an eligible entity on a community-wide or site-by-site basis, and shall not exceed, for any individual brownfield site covered by the grant, $500,000.</text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph> <paragraph id="H6CBFC4B878EB4393ABBD95E6B8DA3371"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HD6DEB8271A8A48CBA916B3CFB6139480" style="OLC"> 
<subparagraph id="HD39411871BBC4CCD9DF212BC81EFD01B" commented="no"><enum>(F)</enum><header>Demolition</header><text display-inline="yes-display-inline">A recipient of a grant or loan under paragraph (2), (3), or (4) may use up to 10 percent of the amounts made available under the grant or loan for demolition activities as needed to carry out the purpose for which the grant or loan was provided, subject to the approval of the Administrator.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H3BF2703DF9A548F2AB212E1642B101CE" commented="no"><enum>(e)</enum><header>Ranking criteria</header><text>Section 104(k)(6)(C) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(6)(C)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2AB3EE8C188B4F0F80C3FE1C4DC2DA17" display-inline="no-display-inline"> 
<clause id="HF6BE4DCC13604E15A7C0827350364D69" commented="no"><enum>(xiii)</enum><text display-inline="yes-display-inline">The extent to which a grant would facilitate the redevelopment and reuse of a brownfield site located in whole or in part on a former military installation.</text></clause> <clause id="H991A7438CCF6492492B9C7B75CFAD6A9" commented="no"><enum>(xiv)</enum><text display-inline="yes-display-inline">The extent to which a grant could facilitate the remediation and reuse of a brownfield site for any activity described in the matter preceding clause (i) of section 41001(6)(A) of the FAST Act (regardless of whether the activity is described in any of clauses (i) through (iv) of such section).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBD5B9597E04141F48A243FF464F7EAF1"><enum>(f)</enum><header>Implementation of brownfields programs</header><text>Section 104(k)(7) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(7)</external-xref>) is amended—</text> <paragraph id="H8FA006E2C70943E4B9EE154C5A184F1D"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="HD5BB8B5B4234484D9842FC82D96BE6F9"><enum>(A)</enum><text>by striking <quote>The Administrator may provide</quote> and inserting the following:</text> <quoted-block style="OLC" id="HBF7DDFF18B364741915C8660034C8E52" display-inline="yes-display-inline"><text display-inline="yes-display-inline">The Administrator—</text> 
<clause id="H47D4B83693F348B8A12947F9D5AE0A6E"><enum>(i)</enum><text display-inline="yes-display-inline">may provide</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H0344BC3E9B8044FF855889528969FF68"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H92DB0CA35A4F48F2B0BA40E149051E1C"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H9A143DD5AE784B04AFE77E6DE75637FC" display-inline="no-display-inline"> <clause id="H6B38F6EC12F84DBE93D51AB15690FFB5" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">shall provide, on a noncompetitive basis, one grant to a covered entity in each of fiscal years 2028 and 2029, which grant shall be used to provide technical assistance to five covered applicants, selected by the Administrator, for purposes of applying for a grant under this subsection for activities to be carried out in a small community.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3C071872F0784677A1A362FEDF8A9B41"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H9A47195B6A21467EBDC09283BB0AEF87" style="OLC"> <subparagraph id="HE396CB4742F94BF28940ADFA8B93CD32"><enum>(C)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="H853B084836B64851814D8BCCECE94648"><enum>(i)</enum><header>Covered applicant</header><text>The term <term>covered applicant</term> means an eligible entity—</text> <subclause id="HC82972D8EB664A1E9938A3451AC8ACEE" commented="no"><enum>(I)</enum><text>that applied for, but did not receive, a grant under this subsection in the fiscal year immediately preceding the fiscal year for which the Administrator is selecting covered applicants under subparagraph (A)(ii) for activities to be carried out in a small community; and</text></subclause> 
<subclause id="H4BC80B24E5B9428FB2FF4B9823EC28F7"><enum>(II)</enum><text>for which the provision of technical assistance under this paragraph would help secure a grant under this subsection.</text></subclause></clause> <clause id="HAF1D5873B16A4DA6944AA60920342FDB"><enum>(ii)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means an eligible entity or nonprofit organization with relevant experience and expertise in applying for and securing Federal assistance that is receiving funding under subparagraph (A)(i).</text></clause> 
<clause id="HFDE68649DCB24525989812B99463AFF9" commented="no"><enum>(iii)</enum><header>Small community</header><text>The term <term>small community</term> has the meaning given such term in section 128(a)(1)(B)(iv).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HA103046C6CEB420780D4CC993134B746"><enum>(g)</enum><header>Audits</header><text>Section 104(k)(8) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(8)</external-xref>) is amended—</text> 
<paragraph id="H4067CDA71987476481F2171A68471E89"><enum>(1)</enum><text>by amending subparagraph (A) to read as follows:</text> <quoted-block id="H29B365DCEB9B4A0D8B122F37E7A1B055" style="OLC"> <subparagraph id="HECE36FAC672548DA8464ACA2E46FDACB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Brownfields Revitalization for a Better Tomorrow Act</short-title>, and every 2 years thereafter, the Inspector General of the Environmental Protection Agency shall conduct reviews or audits of the use of—</text> 
<clause id="H15C11773FA78459AA29984FBB712A019"><enum>(i)</enum><text>Federal funds by the Administrator under this subsection; </text></clause> <clause id="HF0C3479D7C9644E6AC954BE8B74BA978"><enum>(ii)</enum><text>grants and loans made under this subsection; and</text></clause> 
<clause id="H4011FCE073254D3B840DAF3CDD689C50"><enum>(iii)</enum><text>grants made to a State or Indian tribe under section 128(a) and activities carried out using such grants, including grants made to a State or Indian tribe using amounts made available under paragraph (7) of this subsection to carry out section 128(a)(1)(B)(ii)(III).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H7DA2F832141245F1897C046FB693CB47"><enum>(2)</enum><text>in subparagraph (D), by striking <quote>September 30, 2022</quote> and inserting <quote>2 years after the date of enactment of the Brownfields Revitalization for a Better Tomorrow Act, and every 2 years thereafter</quote>.</text></paragraph></subsection> 
<subsection id="HEC374E7D0994476CA4B91073D047258A"><enum>(h)</enum><header>Agreements</header><text>Section 104(k)(10)(B)(iii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(10)(B)(iii)</external-xref>) is amended—</text> <paragraph id="H55E6E235B9F941E68A4BB5DC360D136B" display-inline="no-display-inline"><enum>(1)</enum><text>by inserting <quote>the eligible entity is located in a small community or disadvantaged area (as those terms are defined in section 128(a)(1)(B)(iv)) or</quote> after <quote>unless</quote>; and</text></paragraph> 
<paragraph id="H5A900ECF69EC4954BC8413F1317035E5"><enum>(2)</enum><text>by inserting <quote>, in which case the Administrator shall waive the matching share requirement under this clause</quote> before <quote>; and</quote>.</text></paragraph></subsection> <subsection id="H6B125D4AF0BE453BA7EC728543AD0B26"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 104(k)(13) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(13)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H952065E83D644CCD8477E0703E363642" display-inline="no-display-inline"> 
<paragraph id="HB82297C783B44A549D73ECCDAB9B4F93"><enum>(13)</enum><header>Authorization of appropriations</header> 
<subparagraph id="H3D32AA7512A14D369442BB9B299DF486"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this subsection $123,500,000 for each of fiscal years 2027 through 2031.</text></subparagraph> <subparagraph id="HA9055B48E83E4F61821C4B79EF1CAD65"><enum>(B)</enum><header>Funding for oversight</header><text>Of the amounts made available under this paragraph for each fiscal year, 0.5 percent shall be available to carry out paragraph (8).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="H3DBB933C27F74070A2E62DBE6B849F8A" commented="no"><enum>3.</enum><header>Reauthorization of funding for certain assistance to States</header><text display-inline="no-display-inline">Section 128(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9628">42 U.S.C. 9628(a)</external-xref>) is amended—</text> <paragraph id="HEEE436D1512B4FAA974175895F5FA5CB"><enum>(1)</enum><text>in paragraph (1), by adding at the end the following:</text> 
<quoted-block style="OLC" id="H67C733EAAAFF428B8BE60C541C938DFC" display-inline="no-display-inline"> 
<subparagraph id="HA809E208C0EC48CAB272F6A0D141C6DE"><enum>(C)</enum><header>Brownfields inventory</header><text display-inline="yes-display-inline">Each State or Indian tribe receiving a grant under this subsection shall maintain, update not less than annually, and make available to the public, by location, an inventory of all brownfield sites within that State on which activities authorized and funded pursuant to that grant have occurred.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> <paragraph id="H14353511B20243F7963AD394F647DF42" commented="no"><enum>(2)</enum><text>in paragraph (3), by striking <quote>$50,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$46,250,000 for each of fiscal years 2027 through 2031</quote>.</text></paragraph> </section> 
<section id="HBE41A14B228046DAB965EBFF9B3B4352"><enum>4.</enum><header>Studies, reports, and guidance</header> 
<subsection id="H74A91B8BF4474F919F04D5B8B4720ED0"><enum>(a)</enum><header>Capitalization of revolving loan funds study</header><text display-inline="yes-display-inline">Not later than September 30, 2028, the Comptroller General shall submit to Congress a report containing a review of revolving loan funds that were capitalized using a grant received under subparagraph (A)(i) of section 104(k)(3) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)</external-xref>) during any of fiscal years 2015 through 2025, including information on—</text> <paragraph id="H6084CA2614E44EF6B3B99E3A545CC8C8"><enum>(1)</enum><text>the status and balance of each such revolving loan fund;</text></paragraph> 
<paragraph id="HB0C290A6AF0643A3A27B0E1E313A6C49"><enum>(2)</enum><text>each loan or grant provided by an eligible entity under subparagraph (B) of such section; and</text></paragraph> <paragraph id="HF7F261C7FCB346B8B6A3CB5CAECC4F25"><enum>(3)</enum><text>any barriers to the eligible entity providing additional loans or grants under such subparagraph (B).</text></paragraph></subsection> 
<subsection id="H82E582D53DB44162B21FAB54F9D3F4D8"><enum>(b)</enum><header>Report on funding for covered entities and covered applicants</header> 
<paragraph id="HA1F34CCC40DC4BD7AA999D854FDCCD49"><enum>(1)</enum><header>In general</header><text>Not later than September 30, 2030, the Administrator shall submit to Congress a report on—</text> <subparagraph id="H421D78AE6F9443B2BE03790797F77E4C"><enum>(A)</enum><text display-inline="yes-display-inline">the effect of providing a grant under subparagraph (A)(ii) of section 104(k)(7)(A) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(7)(A)</external-xref>) (as amended by this Act);</text></subparagraph> 
<subparagraph id="H8CE03F8AD64247998F0741DB0EEABF40"><enum>(B)</enum><text>the covered applicants selected by the Administrator under such subparagraph; and</text></subparagraph> <subparagraph id="H6523AF19231840F2A17C7C08DF118E65"><enum>(C)</enum><text>the status of—</text> 
<clause id="H4FFBF4912E3C43A0AD2242C023D692A2"><enum>(i)</enum><text display-inline="yes-display-inline">any applications for a grant under section 104(k) of such Act submitted by a covered applicant that received technical assistance pursuant to such subparagraph (A)(ii); and</text></clause> <clause id="HC1EA462105274F0D8B7CF95A97F47801"><enum>(ii)</enum><text>any activities for which a grant was provided pursuant to such an application.</text></clause></subparagraph></paragraph> 
<paragraph id="HB877D08018294CA7906CB70FF7659531"><enum>(2)</enum><header>Updated report</header><text>Not later than September 30, 2032, the Administrator shall submit to Congress an update to the report submitted under paragraph (1).</text></paragraph> </subsection> <subsection id="H78F5E97D3D214ED5AEFF58BFB7B8ED4D" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Report on loan programs for assessment, remediation, and reuse of brownfield sites</header><text display-inline="yes-display-inline"></text> 
<paragraph id="H74AA48733EF74B918DF370DACF1C4E49"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than two years after the date of enactment of this Act, the Administrator shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report containing—</text> <subparagraph id="H9C09918D709D4E1689E9B34FFDB8FC42"><enum>(A)</enum><text display-inline="yes-display-inline">an analysis of whether establishing and implementing a loan program for the assessment, remediation, and reuse of brownfield sites, consistent with section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>), would be feasible and useful, including consideration of—</text> 
<clause id="HC0571F4C64114A82A791391163CC6171" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the demand for larger loans for which the amount of the loan is equal to or greater than the largest loan currently offered by eligible entities under section 104(k)(3)(B) of such Act;</text></clause> <clause id="H8AF23A4B379444EE8EF9963D27BFE321" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the extent to which such a program would facilitate the remediation and reuse of brownfield sites at which potential contamination is particularly extensive or complex; and</text></clause> 
<clause id="HB568DE37CB854638AD387282607DD342" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the extent to which such a program could facilitate the remediation and reuse of one of more brownfield sites at an earlier date than such activities would otherwise proceed; and</text></clause></subparagraph> <subparagraph id="H3D2CF4296F4E485CBD6098D33EA87FB2"><enum>(B)</enum><text>if the Administrator finds such a program will be feasible and useful, recommendations for statutory changes needed to authorize such a program.</text></subparagraph></paragraph> 
<paragraph id="HA67CD4E9FCC848998199C814D9F52DDB" commented="no"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out this subsection, the Administrator shall consult with other Federal agencies, eligible entities, site owners, site developers, and any other entities the Administrator considers appropriate.</text> </paragraph></subsection> <subsection id="HBF3CC9BA2AE54576B3E458553643E125" commented="no"><enum>(d)</enum><header>National Priorities List deletion study</header><text display-inline="yes-display-inline">The Comptroller General shall conduct a study with respect to the process for the deletion or partial deletion of sites from the National Priorities List established under section 105 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605</external-xref>), in order to identify any barriers to such deletion or partial deletion, including a review of the following:</text> 
<paragraph id="H928774F3FDA644BEB7BC443130727A75" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The process of coordination between Federal and State entities with respect to such deletion or partial deletion.</text></paragraph> <paragraph id="H67669ABE733C4804AD45ECC059B1B684" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Any impediments to timely and efficient deletion or partial deletion of sites.</text></paragraph> 
<paragraph id="H2D6E401412B64087928EF8105E0466A8" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Opportunities to expedite the deletion or partial deletion of sites with respect to which applicable remedial action has been completed. </text></paragraph></subsection> <subsection id="H00B7258AF07B4E3BAB4E86A1CCF1FCF0" commented="no"><enum>(e)</enum><header>Guidance for permitting on brownfield sites</header> <paragraph id="H318B835DED434F089CE5652F9C36132B" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall develop guidance to assist Federal agencies in more efficiently issuing Federal authorizations, and conducting environmental reviews for such authorizations, with respect to projects relating to brownfield sites.</text></paragraph> 
<paragraph id="HA475FDDA4A404EC980D18C71AA7A3D63" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing or updating guidance under this subsection, the Administrator shall consider matters related to—</text> <subparagraph id="HC9948A12711C42A39869C59AEE02A1D2" commented="no"><enum>(A)</enum><text>the availability of historic site-specific environmental data;</text></subparagraph> 
<subparagraph id="HB5B084541F6F4503B3A0BDF6F93A2BFB" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">previously completed environmental reviews required by the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph> <subparagraph id="H3EA48E2BC7C341098ED5189F8EC85F40" commented="no"><enum>(C)</enum><text>data or information collected as part of assessment or remediation activities under section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>); </text></subparagraph> 
<subparagraph id="HA49735A570EC477F99286CC0F5BB1715" commented="no"><enum>(D)</enum><text>community engagement and historical experience with previous uses; and</text></subparagraph> <subparagraph id="H7BE9A6600A5648D3BFF4EC4CADEFA0F4" commented="no"><enum>(E)</enum><text>any other matters the Administrator determines appropriate.</text> </subparagraph></paragraph> 
<paragraph id="HDB15DC70CD0A4D1EBA476E1B74DA0340" commented="no"><enum>(3)</enum><header>Updates</header><text display-inline="yes-display-inline">The Administrator shall update the guidance developed under this subsection periodically.</text></paragraph> </subsection> <subsection id="HC2F3D64EE357492CA2A5E46C391987AC" commented="no"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8B38BBEBEC3A467FAE127836B1340D9E"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> <paragraph id="H6D3E6E416847454881E7C54DF6D927E8" commented="no"><enum>(2)</enum><header>Brownfield site</header><text display-inline="yes-display-inline">The term <term>brownfield site</term> has the meaning given that term in section 101(39) of the Comprehensive Environmental Response, Compensation, and Liability Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(39)</external-xref>).</text></paragraph> 
<paragraph id="H3953387DDFE9464A984A0E458BF91298" commented="no"><enum>(3)</enum><header>Federal authorization</header><text>The term <term>Federal authorization</term>, with respect to a project—</text> <subparagraph id="H0721C25978984C7881A3609E9EFC5094" commented="no"><enum>(A)</enum><text>means any authorization required under Federal law for the project; and</text></subparagraph> 
<subparagraph id="H049F1C1A5FAE412E83BC5CC101FC53DC" commented="no"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law for such project.</text></subparagraph></paragraph> <paragraph id="HB688A7CF0AEC4D788EDF684207344373"><enum>(4)</enum><header>Remedial action</header><text display-inline="yes-display-inline">The term <term>remedial action</term> has the meaning given that term in section 101(24) of the Comprehensive Environmental Response, Compensation, and Liability Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(24)</external-xref>).</text></paragraph></subsection></section>
