<section id="H8BA89D754C864B0EB1DA8C9F0A73F4E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No-Cost Breast Examinations in Medicaid Act of 2026</short-title></quote>.</text></section> <section id="H5F6337E945B549C9AC90A7FF29823E23"><enum>2.</enum><header>Requiring that diagnostic and supplemental breast examinations are furnished without cost sharing under the Medicaid program</header> <subsection id="H536CAAF8349244ACA7EB070E8BEA6169"><enum>(a)</enum><header>In general</header> <paragraph id="H40DB4D8FAE0C4CAA8F407B0DA76D0A1A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsections (a)(2) and (b)(2) of section 1916 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o</external-xref>) are each amended—</text> 
<subparagraph id="H8D2A55F7B86E48818E9384B1A6FC0AD5"><enum>(A)</enum><text>in subparagraph (I), by striking <quote>or</quote> at the end;</text></subparagraph> <subparagraph id="HA79538086C584AF78CF0514271DE4140"><enum>(B)</enum><text>in subparagraph (J), by striking <quote>; and</quote> and inserting <quote>, or</quote>; and</text></subparagraph> 
<subparagraph id="H9E996A5E63494EBEB6CC639572A5AD64"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6A5AF7554C6A4870944AAEFD959C17C0"> <subparagraph id="H7F03499B387949ECB73F10672839C38D"><enum>(K)</enum><text display-inline="yes-display-inline">diagnostic breast examinations and supplemental breast examinations (as such terms are defined in section 1905(ll)); and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HAF600E5A70144D16B340ADA959050617"><enum>(2)</enum><header>Application to alternative cost sharing</header><text display-inline="yes-display-inline">Section 1916A(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1(b)(3)(B)</external-xref>) is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H0921A91902744B3E805174D6165C49EE"> <clause id="H034D5FE9C34D4E0AB698EBDAAB2ED809"><enum>(xv)</enum><text display-inline="yes-display-inline">Diagnostic breast examinations and supplemental breast examinations (as such terms are defined in section 1905(ll)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H37F6E0900E014D7F9913B09B7F328DE2"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HA0993E289B23433AA3B4A4F3610E2880" display-inline="no-display-inline"> <subsection id="H6493F88C40A74AA8B26A6281B4742636"><enum>(ll)</enum><header>Definitions relating to breast cancer examinations</header> <paragraph id="H2C413D80F01645A3BF22E7BF019A6DDF"><enum>(1)</enum><header>Diagnostic breast examination</header><text display-inline="yes-display-inline">The term <quote>diagnostic breast examination</quote> means a medically necessary and appropriate (in accordance with National Comprehensive Cancer Network Guidelines) examination of the breast (including, but not limited to such an examination using diagnostic mammography, breast magnetic resonance imaging, or breast ultrasound) that is—</text> 
<subparagraph id="H60574319312C4E7B81BA93629ED86BAA"><enum>(A)</enum><text display-inline="yes-display-inline">used to evaluate an abnormality seen or suspected from a screening examination for breast cancer; or</text></subparagraph> <subparagraph id="HE8956549B9FE40C5BDC64453D0DC6FD0"><enum>(B)</enum><text display-inline="yes-display-inline">used to evaluate an abnormality detected by another means of examination.</text></subparagraph></paragraph> 
<paragraph id="HE9A72267179D4177A326C4E5CE454A8A"><enum>(2)</enum><header>Supplemental breast examination</header><text display-inline="yes-display-inline">The term <quote>supplemental breast examination</quote> means a medically necessary and appropriate (in accordance with National Comprehensive Cancer Network Guidelines) examination of the breast (including, but not limited to such an examination using breast magnetic resonance imaging or breast ultrasound) that is—</text> <subparagraph id="HAFD89AD416354A5F863157C9C535F9CB"><enum>(A)</enum><text display-inline="yes-display-inline">used to screen for breast cancer when there is no abnormality seen or suspected; and</text></subparagraph> 
<subparagraph id="H8F772E02AAC149ED8224341E36C1A448"><enum>(B)</enum><text display-inline="yes-display-inline">furnished based on personal or family medical history or additional factors that may increase the individual’s risk of breast cancer.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HAD0C532FDCCB49C9A692EAFEE79CBCE3"><enum>(c)</enum><header>Inclusion of screening mammography as a mandatory benefit</header> <paragraph id="H836C6FEDA8B5481E9C0DF2BC8DB2DB9B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended, in the matter preceding clause (i), by inserting <quote>(13)(D),</quote> after <quote>(13)(B),</quote>.</text></paragraph> 
<paragraph id="H5BFCA3A33ECD4B889EA273B3F4BE765A"><enum>(2)</enum><header>Medical assistance</header><text>Section 1905(a)(13) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)(13)</external-xref>) is amended—</text> <subparagraph id="HC174DE6DFE68435F8DDEAB8511E654CF"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H725A224818BD40139CA4CBC968CC301B"><enum>(B)</enum><text>in subparagraph (C), by adding <quote>and</quote> at the end; and</text></subparagraph> <subparagraph id="HFCFB079AF0B34CEDB90461FDA707E480"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HC5B7104728B440DBB6A3FF50BB15C74A" display-inline="no-display-inline"> 
<subparagraph id="H6BD4C625A3E64F30BDA978ED0A8899E4"><enum>(D)</enum><text display-inline="yes-display-inline">screening mammography (as defined in section 1861(jj)) assigned a grade of A or B by the United States Preventive Services Task Force;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H358335F573ED42D1933C88F5AE359391"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to medical assistance furnished on or after the date that is 1 year after the date of the enactment of this Act.</text></subsection></section>
