<section id="H6510ED8A618D44FDBB18BCCFC8A75510" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blood Pressure Mandated Accessible Telemetry Tracking for Eclampsia Risk Safeguards Act</short-title></quote> or the <quote><short-title>Blood Pressure MATTERS Act</short-title></quote>.</text></section> <section id="HBDC35DC5B674477590BAC3652B52E1A1"><enum>2.</enum><header>Requiring coverage of self-measured blood pressure monitoring for pregnant and postpartum individuals</header> <subsection id="H221BD44B163643BD968BD53E643120F8"><enum>(a)</enum><header>Coverage under Medicaid</header> <paragraph id="H5652E926AD444D7E92D749B553B8FDB3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text> 
<subparagraph id="H818B8084EDE74882BE835EF4DA0ECA77"><enum>(A)</enum><text>in subsection (a)—</text> <clause id="H8FBBF14058FC41CD95225BDFB7F1E97A"><enum>(i)</enum><text>in paragraph (31), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="HF7B67E4C41204242AB72109B4C637989"><enum>(ii)</enum><text>by redesignating paragraph (32) as paragraph (33); and</text></clause> <clause id="H7D6C2EA7566545D99CB40D30EA04035C"><enum>(iii)</enum><text>by inserting after paragraph (31) the following new paragraph:</text>

<paragraph id="H75265395F90144C0B19E1567DCAE2CF6"><enum>(32)</enum><text display-inline="yes-display-inline">self-measured blood pressure monitoring for pregnant and postpartum individuals (as defined in subsection (ll)(1)); and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H57B7699EB1F84291A2133A22D39619E5"><enum>(B)</enum><text>by adding at the end the following new subsection:</text>

                <enum>(ll)</enum>
                <header>Self-Measured blood pressure monitoring for pregnant and postpartum
                  individuals</header>
                <paragraph id="H12FD852895F84A3CA5035CA0A8AA68A8">
                  <enum>(1)</enum>
                  <header>In general</header>
 <text display-inline="yes-display-inline">For purposes of subsection (a)(32), the term <term>self-measured blood pressure monitoring for pregnant and postpartum individuals</term>—</text>
                  <subparagraph id="H889AAA8E02ED42479FC2AEFF9737D9E2">
                    <enum>(A)</enum>
 <text>means a specified blood pressure measurement device furnished to an individual during pregnancy (and during the 12-month period beginning on the last day of the pregnancy, or, in the case of an individual who is eligible for medical assistance under the State plan under paragraph (5) or (16) of section 1902(e), during the period for which such individual remains so eligible), without regard to whether such individual is diagnosed with a hypertensive disorder; and</text>
                  </subparagraph>
                  <subparagraph id="HA2E4EE401D9941DB8CBE125288444C54">
                    <enum>(B)</enum>
 <text>does not include more than 1 such device furnished to an individual during a 2-year period.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="HB56A6D40B091441EA59F931ADDF25975">
                  <enum>(2)</enum>
                  <header>Specified blood pressure management device defined</header>
 <text>In this subsection, the term <term>specified blood pressure management device</term> means a device that—</text>
                  <subparagraph id="HFAED1ED906CB40FC933560E54E170D4C">
                    <enum>(A)</enum>
 <text>can be used by an individual to measure their own blood pressure without the assistance of a health care provider;</text>
                  </subparagraph>
                  <subparagraph id="HCA8B264929544DE3A7809299EB3AB49B">
                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">has been cleared for market under section 510(k) of the Federal Food, Drug, and Cosmetic Act; and</text>
                  </subparagraph>
                  <subparagraph id="H681A5B8314D0433BAB8E01C14F5AAE8F">
                    <enum>(C)</enum>
 <text>is listed as a validated device on the Validated Device Listing website maintained by the American Medical Association.</text>
                  </subparagraph>
                </paragraph>
              </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0021ED86A28A4E68A8B42354FF85FE17"><enum>(2)</enum><header>Mandatory coverage</header> 
<subparagraph id="H366F0FC049D74A9FBDB82C876AAFD64A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended by striking <quote>and (30)</quote> and inserting <quote>(30), and (32)</quote>.</text></subparagraph> <subparagraph id="H7C5CA2B7C65143F8B07A52231B18B8F8"><enum>(B)</enum><header>Alternative benefit plans</header><text>Section 1937(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-7">42 U.S.C. 1396u–7(b)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HCCA2B4F227674BD08A9DE54AD95C6CF2"> 
<paragraph id="HA9C17E5654644055B918937696ABA102"><enum>(9)</enum><header>Self-measured blood pressure monitoring for pregnant and postpartum individuals</header><text display-inline="yes-display-inline">Notwithstanding the previous provisions of this section, a State may not provide for medical assistance through enrollment of an individual with benchmark coverage or benchmark-equivalent coverage under this section unless, beginning on the date that is 120 days after the date of enactment of this paragraph, such coverage includes, for any pregnant or postpartum individual, medical assistance for self-measured blood pressure monitoring in accordance with section 1905(ll).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HE51864011D794A49B8D8D65C436C6AD8"><enum>(3)</enum><header>Prohibition of cost sharing</header> <subparagraph id="H5273C12D2E22454EACDED9B59E1DAD8B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subsections (a)(2) and (b)(2) of section 1916 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o</external-xref>) are each amended—</text> 
<clause id="H1576CF18F40C4932A309FB05545C4C81"><enum>(i)</enum><text>in subparagraph (I), by striking <quote>or</quote> at the end;</text></clause> <clause id="H37E677EF097D4EFBA263D99E804F0A4F"><enum>(ii)</enum><text>in subparagraph (J), by striking <quote>; and</quote> and inserting <quote>, or</quote>; and</text></clause> 
<clause id="HF8FC978D16A0480F8199B0F311649A4D"><enum>(iii)</enum><text>by adding at the end the following subparagraph:</text> <quoted-block style="OLC" id="HA6B5928154C34DFEBEE910ADBEFADB0A" display-inline="no-display-inline"> <subparagraph id="HD42A6D656347438CA41D5678D613A89C"><enum>(K)</enum><text display-inline="yes-display-inline">self-measured blood pressure monitoring for pregnant and postpartum individuals (as defined in section 1905(ll)(1)); and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H268B5A5579A04460BC823FDE59AD07EC"><enum>(B)</enum><header>Application to alternative cost sharing</header><text>Section 1916A(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1(b)(3)(B)</external-xref>) is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H4D0DBA621511446D8028EBE7F2B1AA41" display-inline="no-display-inline"> <clause id="H03C8261ACAC643408BDC164599EAFBD2"><enum>(xv)</enum><text display-inline="yes-display-inline">Self-measured blood pressure monitoring for pregnant and postpartum individuals (as defined in section 1905(ll)(1)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H434122E5452042238F054BC0FAB524CE"><enum>(4)</enum><header>Effective date</header> 
<subparagraph id="H1B26CEF016FA42ACAF4D3D4E254752F8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="HDC2839438F9B4ACD8654D6226B8F39CB" legis-path="2.(a)(3)(B)">subparagraph (B)</internal-xref>, the amendments made by this subsection shall apply with respect to items and services furnished on or after the date that is 120 days after the date of enactment of this section.</text></subparagraph> <subparagraph id="HDC2839438F9B4ACD8654D6226B8F39CB"><enum>(B)</enum><header>Exception if State legislation required</header><text display-inline="yes-display-inline">In the case of a State plan for medical assistance under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirement imposed by the amendments made by this subsection, the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this subsection. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></subparagraph></paragraph></subsection> 
<subsection id="H2A75B4F38C804207A07EA714716D0689" commented="no"><enum>(b)</enum><header>Coverage under CHIP</header> 
<paragraph id="HFD33E398BEEE40678A0217A95CE538BE" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2103(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)</external-xref>) is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HD0A1D7A994F74D5DB0C3B3E0A6C83388" display-inline="no-display-inline"> <paragraph id="HB0A20CB7881C4587A7B4C25F7DC8D506" commented="no"><enum>(13)</enum><header>Required coverage of self-measured blood pressure monitoring for pregnant and postpartum individuals</header><text display-inline="yes-display-inline">Regardless of the type of coverage elected by a State under subsection (a), in the case of a State that elects to provide pregnancy-related assistance pursuant to section 2112, the pregnancy-related assistance provided for a targeted low-income pregnant woman (as such terms are defined for purposes of such section), shall include coverage of self-measured blood pressure monitoring in accordance with section 1905(ll).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H085E9E74A19B46DDA600C3B93BD8D11E" commented="no"><enum>(2)</enum><header>Effective date</header> 
<subparagraph id="H3A237F3A3F46431FB4A2883DF7D0F587" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="H0951ED9106224ADA99CE2ED58F61EC85" legis-path="2.(b)(2)(B)">subparagraph (B)</internal-xref>, the amendments made by this subsection shall apply with respect to items and services furnished on or after the date that is 120 days after the date of enactment of this section.</text></subparagraph> <subparagraph id="H0951ED9106224ADA99CE2ED58F61EC85" commented="no"><enum>(B)</enum><header>Exception if State legislation required</header><text display-inline="yes-display-inline">In the case of a State child health plan for child health assistance under title XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>) which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirement imposed by the amendments made by this subsection, the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this subsection. <subsection id="H4FEEA6C1B68E44D7AC873D4062FA1297"><enum>(c)</enum><header>Coverage under private health insurance</header> 
<paragraph id="H02035925C80E4974B42DAEA1FA6E8587"><enum>(1)</enum><header>Amendments to the Public Health Service Act</header><text display-inline="yes-display-inline">Part D of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111 et seq.</external-xref>) is amended by adding at the end the following new section:</text> <quoted-block style="OLC" id="H8E7A84465B4F4FF0A546327DB87243F8" display-inline="no-display-inline"> <section id="H2C67BFFFD7EC41318923590A9D620D5B"><enum>2799A–12.</enum><header>Coverage of self-measured blood pressure monitoring for pregnant and postpartum individuals</header> <subsection id="HFFBF76587DE540FC8585A4423EA03541"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the limitation under <internal-xref idref="H763294B82A5E4B9AA1C5B3FC89892FC1" legis-path="2730.(b)">subsection (b)</internal-xref>, a group health plan, and a health insurance issuer offering group or individual health insurance coverage—</text> 
<paragraph id="HE761F6A0EBEA4B4388D0E2A2D9B25AB8"><enum>(1)</enum><text display-inline="yes-display-inline">shall provide coverage of, and may not impose any cost sharing requirements for, specified blood pressure management devices furnished to an individual during pregnancy (and during the 12-month period beginning on the last day of the pregnancy); and</text> </paragraph> <paragraph id="HC247EF1DA35844679E5E13068A663D7C"><enum>(2)</enum><text>may not require that such individual be diagnosed with a hypertensive disorder as a condition of such coverage.</text></paragraph></subsection> 
<subsection id="H763294B82A5E4B9AA1C5B3FC89892FC1"><enum>(b)</enum><header>Limitation</header><text>A group health plan or health insurance issuer offering group or individual health insurance coverage is not required under this section to provide coverage of more than 1 specified blood pressure management device furnished to an individual during a 2-year period.</text></subsection> <subsection id="HE43E5407B4B2430ABBC634D8BBEC9BC4"><enum>(c)</enum><header>Specified blood pressure management device defined</header><text>In this section, the term <term>specified blood pressure management device</term> has the meaning given such term in section 1905(ll)(2) of the Social Security Act.</text> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4DC653BC7F1D4A11A4EF5DEC8A4880C6"><enum>(2)</enum><header>Amendments to the Employee Retirement Income Security Act of 1974</header> 
<subparagraph id="H728A05F0C87C4C6BB3F3C5205D08425C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185 et seq.</external-xref>) is amended by adding at the end the following new section:</text> <quoted-block style="OLC" id="H49D34B9D228E4E9792025FDD707E6D91" display-inline="no-display-inline"> <section id="H68945AABA00245ECBEC0B5175FA49DE7"><enum>727.</enum><header>Coverage of self-measured blood pressure monitoring for pregnant and postpartum individuals</header> <subsection id="HCF0008A9E77A4A0EBB2E039E668972A8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the limitation under <internal-xref idref="HE4193258879148D0B9879E506829BCAA" legis-path="2730.(b)">subsection (b)</internal-xref>, a group health plan, and a health insurance issuer offering group health insurance coverage—</text> 
<paragraph id="H8F8AA297BBC44E4BA5CEEA40A7FE42ED"><enum>(1)</enum><text display-inline="yes-display-inline">shall provide coverage of, and may not impose any cost sharing requirements for, specified blood pressure management devices furnished to an individual during pregnancy (and during the 12-month period beginning on the last day of the pregnancy); and</text> </paragraph> <paragraph id="HF676E140690B4869990D35B331500527"><enum>(2)</enum><text>may not require that such individual be diagnosed with a hypertensive disorder as a condition of such coverage.</text></paragraph></subsection>

<subparagraph id="HE73A5092FF624786B1DF9342D2B13D2B"><enum>(B)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001 et seq.</external-xref>) is amended by inserting after the item relating to section 726 the following:</text> <quoted-block style="OLC" id="HF55B7F7586AE49F287679771368E778A" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 727. Coverage of self-measured blood pressure monitoring for pregnant and postpartum individuals.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HA9EFC0C291B645DE8F2FBB68747C9362"><enum>(3)</enum><header>Amendments to the Internal Revenue Code of 1986</header> <subparagraph id="HE1F83A39AF8347518C78F1F423E4838F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>

<subsection id="HB4449F3A7F8A4017B42FF00D315F7F36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the limitation under <internal-xref idref="HEAA3E8D7E5CB42E08CD4CB4BB6432A03" legis-path="2730.(b)">subsection (b)</internal-xref>, a group health plan—</text> <paragraph id="H9D472685BD944C24A448EF6D7EA3C57A"><enum>(1)</enum><text display-inline="yes-display-inline">shall provide coverage of, and may not impose any cost sharing requirements for, specified blood pressure management devices furnished to an individual during pregnancy (and during the 12-month period beginning on the last day of the pregnancy); and</text> </paragraph>

<subsection id="HE85A0C7DDFA940B99B9D8BAA41B95E3B"><enum>(c)</enum><header>Specified blood pressure management device defined</header><text>In this section, the term <term>specified blood pressure management device</term> has the meaning given such term in section 1905(ll)(2) of the Social Security Act.</text> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H0461F7B6160B476FBDC61DD409592585"><enum>(B)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text>
