which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect U.S. food security, provide the Committee on Foreign Investment in the United States greater jurisdiction over land purchases, impose special guards against foreign adversary purchases of land in the United States near sensitive sites, expand the definition of sensitive sites, and for other purposes.</official-title></form><legis-body id="H0758591BCBF04CD09304CFA51CCCD206" style="OLC"><section id="H044ED757DD844944AFEF6FCDFEA09C42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting U.S. Farmland and Sensitive Sites From Foreign Adversaries Act</short-title></quote>.</text></section><section id="H0C4D62E4AA934A868F577C85BB7915C5"><enum>2.</enum><header>Additional definitions</header><text display-inline="no-display-inline">Section 721(a) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H07488AE46C06481F9A815125DFC5F4E9" display-inline="no-display-inline"><paragraph id="H4A55B2AA9E1D440D815120C4C9DD848D"><enum>(14)</enum><header>Elevated risk real estate transaction</header><text>The term <quote>elevated risk real estate transaction</quote> means a real estate transaction described under paragraph (4)(B)(ii), in which the real estate—</text><subparagraph id="H63F5C66E2E26443EBD90C246D2FC0413" commented="no"><enum>(A)</enum><text>is, is located within, or will function as a part of, an air or maritime port;</text></subparagraph><subparagraph id="H57FA3B6E7E1945C09DDB095829D142FD" commented="no"><enum>(B)</enum><text>is in close proximity to a sensitive site;</text></subparagraph><subparagraph id="H31EB2919AD0B4856BD576E0DCAA9F420" commented="no"><enum>(C)</enum><text>could reasonably provide the foreign adversary person the ability to collect intelligence on activities being conducted at a sensitive site;</text></subparagraph><subparagraph id="H6C78315FBAF54E00B347BA3A371AF684" commented="no"><enum>(D)</enum><text>could otherwise expose national security activities at a sensitive site; or</text></subparagraph><subparagraph id="H8E9C8BC9A8CB41D495AC221D73AD79EF"><enum>(E)</enum><text display-inline="yes-display-inline">is agricultural land that is covered by the reporting requirements under the Agricultural Foreign Investment Disclosure Act of 1978, as implemented by part 781 of title 7, Code of Federal Regulations.</text></subparagraph></paragraph><paragraph id="H98E9C95E602B40689771AF4B67E61A26"><enum>(15)</enum><header>Foreign adversary</header><text display-inline="yes-display-inline">The term <quote>foreign adversary</quote> means—</text><subparagraph id="HF0937521E83F4049A923CC6676248F3C"><enum>(A)</enum><text>the People’s Republic of China, including all Special Administrative Regions;</text></subparagraph><subparagraph id="H2077FE27E798421AA2BE87197E04E200"><enum>(B)</enum><text>the Republic of Cuba;</text></subparagraph><subparagraph id="H0C8B6F1FAD774ED48081906B8C3279D4"><enum>(C)</enum><text>the Islamic Republic of Iran;</text></subparagraph><subparagraph id="HC4458FB04D404739B93D61E990B3A634"><enum>(D)</enum><text>the Democratic People’s Republic of Korea;</text></subparagraph><subparagraph id="HC70B4EFAF991477DB5E467C97C8FC201"><enum>(E)</enum><text>the Russian Federation; and</text></subparagraph><subparagraph id="HD6545C9275AA499CA7D4A171A4C7D658"><enum>(F)</enum><text display-inline="yes-display-inline">the Bolivarian Republic of Venezuela.</text></subparagraph></paragraph><paragraph id="H2715E9769CB34186B8F77042C966B750"><enum>(16)</enum><header>Foreign adversary person</header><text display-inline="yes-display-inline">The term <quote>foreign adversary person</quote> means—</text><subparagraph id="HC7F30FC8A13849B4B1006AD26A7059E7"><enum>(A)</enum><text>a foreign adversary;</text></subparagraph><subparagraph id="H1204C78CC0C44088B29831460B14D88C"><enum>(B)</enum><text>a foreign person subject to the jurisdiction of, or organized under the laws of, a foreign adversary; and</text></subparagraph><subparagraph id="HFEA2938EE79F4A5CBF0E0C821290424E"><enum>(C)</enum><text>a foreign person owned, directed, or controlled by an entity described in subparagraph (A) or (B).</text></subparagraph></paragraph><paragraph id="H644AC34E5B14467D9BFEEDE8CA750738"><enum>(17)</enum><header>Sensitive site</header><text display-inline="yes-display-inline">The term <quote>sensitive site</quote> means—</text><subparagraph id="H9AE62A2BC60C4C00AE8F7EC93E95014F"><enum>(A)</enum><text>military installations;</text></subparagraph><subparagraph id="H0CF92F0CFE164025B8F405FD694A8659"><enum>(B)</enum><text display-inline="yes-display-inline">a military training route, as defined in section 183a(h) of title 10, United States Code;</text></subparagraph><subparagraph id="H5EEE66C385D54F5385C1614427B7E967"><enum>(C)</enum><text display-inline="yes-display-inline">airspace designated as special use airspace under part 73 of title 14, Code of Federal Regulations (or a successor regulation) and managed by the Department of Defense;</text></subparagraph><subparagraph id="H22280F48E4F24BBFB4057DFDBEE74453"><enum>(D)</enum><text display-inline="yes-display-inline">a controlled firing area, as defined in section 1.1 of title 14, Code of Federal Regulations (or a successor regulation) under the jurisdiction of the Secretary of Defense;</text></subparagraph><subparagraph id="H6780EE0E38FF44F7BFBDEE77FC28E097"><enum>(E)</enum><text display-inline="yes-display-inline">a military operations area, as defined in section 1.1 of title 14, Code of Federal Regulations (or a successor regulation);</text></subparagraph><subparagraph id="HDB396565B8C1484FBF0753BF0C838C02"><enum>(F)</enum><text display-inline="yes-display-inline">facilities with respect to which the Secretary of Defense has granted a security clearance;</text></subparagraph><subparagraph id="H7E489017F4C44DC6BD250ACA3EBE61F1"><enum>(G)</enum><text>facilities openly owned or operated by the U.S. intelligence community;</text></subparagraph><subparagraph id="HADCF2B1A5CEA4E7B88B8E9D9CE0F75BC"><enum>(H)</enum><text display-inline="yes-display-inline">facilities owned or operated by the National Aeronautics and Space Administration;</text></subparagraph><subparagraph id="HDBF050CE94E546D9A698D878EF3E8025"><enum>(I)</enum><text>federally funded research and development centers;</text></subparagraph><subparagraph id="HC097CCFF1CF84044946B453F78A2DA2E"><enum>(J)</enum><text display-inline="yes-display-inline">university-affiliated research centers of the Department of Defense;</text></subparagraph><subparagraph id="H93D280C5EF24437EA7762DED7E9B4A1A"><enum>(K)</enum><text display-inline="yes-display-inline">science and technology reinvention laboratories, as designated by the Secretary of Defense under section 4121 of title 10, United States Code;</text></subparagraph><subparagraph id="HB60B90E5F129462B8513F22F6D912174"><enum>(L)</enum><text>airports, as listed on the website of the Federal Aviation Administration;</text></subparagraph><subparagraph id="H4923F25E1787459A9F855224677D9857"><enum>(M)</enum><text display-inline="yes-display-inline">maritime ports, as determined by the Secretary of Transportation;</text></subparagraph><subparagraph id="H443404CBF1214A07B3685064335BD92E"><enum>(N)</enum><text display-inline="yes-display-inline">any electronic or telecommunications facility used to process, store, or transmit information (including fiber-optic nodes, data centers, cloud-computing facilities, satellite ground stations, and wireless transmission equipment) if—</text><clause id="H596963DE8C634212BD6586B76D017D66"><enum>(i)</enum><text>the facility is part of a backbone or core network that serves a significant portion of the United States telecommunications network;</text></clause><clause id="H97DC64D1724F49BEBC7D4C45292AA1AB"><enum>(ii)</enum><text>the facility is located in close proximity to another sensitive site;</text></clause><clause id="H1BC75089CC3F4641844E6E05D9B912FF"><enum>(iii)</enum><text display-inline="yes-display-inline">the facility is a submarine cable landing station (as defined in section 60401(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1741">47 U.S.C. 1741(a)</external-xref>));</text></clause><clause id="HD48E02EE6B4D40798C486ECD3B764B41"><enum>(iv)</enum><text>the facility is used to process or store a large volume of sensitive information (such as classified or encrypted communications) or other data critical to national security, public safety, or economic security; or</text></clause><clause id="HBCAEF026130C402AAFE01C6064565E2A"><enum>(v)</enum><text>the Chairman of the Federal Communications Commission determines the facility to be critical communications infrastructure;</text></clause></subparagraph><subparagraph id="H4419914B48E54C0DB9E04B14616AA3B1"><enum>(O)</enum><text>electric powerplants, as determined by the Secretary of Homeland Security; and</text></subparagraph><subparagraph id="H13C93E9B5D8149FA9EAC07F35231929D"><enum>(P)</enum><text>any other site, as determined by the Secretary of Defense or the Secretary of Homeland Security.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H29BE440EA3ED4193BE0860BFC50C5C35"><enum>3.</enum><header>Protecting U.S. food security</header><text display-inline="no-display-inline">Section 721(f) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(f)</external-xref>) is amended—</text><paragraph id="HED0327FF7DE14233A8E02AEE62A87680"><enum>(1)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H786D9C3DFE89494992536B79DF6DC6F9"><enum>(2)</enum><text>by redesignating paragraph (11) as paragraph (12); and</text></paragraph><paragraph id="H625227DC46F449569BE69AF0E46CFC28"><enum>(3)</enum><text>by inserting after paragraph (10) the following:</text><quoted-block style="OLC" id="H2FB5538AE016401DABBF0E77CD0B5FB7" display-inline="no-display-inline"><paragraph id="HD2682366A58042D6A5FC418EE51A3B5D"><enum>(11)</enum><text display-inline="yes-display-inline">the current and long-term projection of the requirements for sources of food, water, and other agricultural products in the United States in the aggregate, as well as locally and regionally, and the effects a covered transaction may have on United States food security, including through foreign adversary acquisition of biotechnology related to agriculture; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HA66486D2B7D241DBA45E9931BA5FF639"><enum>4.</enum><header>Expanding the jurisdiction of the Committee on Foreign Investment in the United States over real estate transactions</header><subsection id="H214A111AE20D47DF83C88EAAB057A05E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 721(a)(4) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)(4)</external-xref>) is amended—</text><paragraph id="H27605816F3654D4DB45801DB8D9B3CA6"><enum>(1)</enum><text>in subparagraph (A)(ii), by striking <quote>clauses (ii) through (v)</quote> and inserting <quote>clauses (ii) through (vi)</quote>;</text></paragraph><paragraph id="HB254E1DF1C54441F8062ABDA914F16FC"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="H29538FDC758C40EA91377D666F21A3D1"><enum>(A)</enum><text>by redesignating clauses (ii) through (v) as clauses (iii) through (vi), respectively;</text></subparagraph><subparagraph id="H12AB248AAEF24E06A807DC410AFC0F79"><enum>(B)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" id="HC39B2B76BA5046F9B519E2B916DC2DBA" display-inline="no-display-inline"><clause id="H61F7521A5EF14B18B681B83AA901FEF4"><enum>(ii)</enum><text display-inline="yes-display-inline">Subject to subparagraphs (C) and (E), the purchase or lease by, or a concession to, a person who is a foreign adversary person of private or public real estate located in the United States.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9EA33B32D60F484FA3864E0ACE48C456"><enum>(C)</enum><text>in clause (iii), as so redesignated—</text><clause id="HCB9EAAC0A6064631935A25A0E7A4CC04"><enum>(i)</enum><text>by striking <quote>foreign person of private or public real estate</quote> and inserting <quote>foreign person who is not a foreign adversary person of private or public real estate</quote>; and</text></clause><clause id="HE3AF42CE6DCC47EBBE2D0BE8370999BA"><enum>(ii)</enum><text>in subclause (II)—</text><subclause id="HCE5CAA1646154274BEAF53E157F0436F"><enum>(I)</enum><text>in item (aa), by inserting <quote>that is a sensitive site</quote> before the semicolon; and</text></subclause><subclause id="HC9F46DBDA9C647F3A3946E4F778682A6"><enum>(II)</enum><text>in item (bb)—</text><item id="H457A6C7FFEBE4E1E9BAC7336884A9771"><enum>(aa)</enum><text>in subitem (AA), by striking <quote>a United States military installation or another facility or property of the United States Government that is sensitive for reasons relating to national security</quote> and inserting <quote>a sensitive site</quote>;</text></item><item id="H27739188DF294B40A45D1A49E8584FF4"><enum>(bb)</enum><text>in subitem (BB), by striking <quote>such an installation, facility, or property</quote> and inserting <quote>a sensitive site</quote>; and</text></item><item id="HF74E00527A934DC88900B66D52AABED9"><enum>(cc)</enum><text>in subitem (CC), by striking <quote>such an installation, facility, or property</quote> and inserting <quote>a sensitive site</quote>; and</text></item></subclause></clause></subparagraph><subparagraph id="HAD3DB28AA1D2406993D5BDA0F36965AE"><enum>(D)</enum><text>in clause (v), as so redesignated, in subclause (II), by striking <quote>clause (iii)</quote> and inserting <quote>clause (iv)</quote>;</text></subparagraph></paragraph><paragraph id="H7F00F79ECA7E4DFEAF3223052037DE8A"><enum>(3)</enum><text>in subparagraph (C)—</text><subparagraph id="H9C11D2EB7571499DBC135563F4AF4BD4"><enum>(A)</enum><text>in clause (i), by striking <quote>subparagraph (B)(ii)</quote> and inserting <quote>clause (ii) or (iii) of subparagraph (B)</quote>;</text></subparagraph><subparagraph id="H09263C307CB144D595455519F2ECA40A"><enum>(B)</enum><text>in clause (ii)—</text><clause id="HED848D8A6F8744998B58907D718B6B4B"><enum>(i)</enum><text>by striking <quote>subparagraph (B)(ii)(II)(bb)(AA)</quote> and inserting <quote>subparagraph (B)(iii)(II)(bb)(AA)</quote>; and</text></subparagraph></paragraph><paragraph id="H10CF6588C50E467A841248160C170449"><enum>(5)</enum><text>in subparagraph (E), by striking <quote>clauses (ii) and (iii) of subparagraph (B)</quote> and inserting <quote>clauses (iii) and (iv) of subparagraph (B)</quote>.</text></paragraph></subsection><subsection id="HF1E3FA25D2AE4406A2912F4ADA146431"><enum>(b)</enum><header>Mandatory declarations</header><text display-inline="yes-display-inline">Section 721(b)(1)(C)(v)(IV) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(1)(C)(v)(IV)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD02723B37E924843AD793908D9766546" display-inline="no-display-inline"><item id="HCFCE4402AEA34A90BD134F144BE4CDCA"><enum>(hh)</enum><header>Required declarations for elevated risk real estate transaction</header><text display-inline="yes-display-inline">Notwithstanding item (dd), the parties to an elevated risk real estate transaction shall submit a declaration described in subclause (I) with respect to the transaction.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HECF866ACD27F44FA8921F629769F6247"><enum>5.</enum><header>Presumption of unresolvability of elevated risk real estate transactions</header><subsection id="H879BEED3A34E4B548FCF1ED31BC599C1"><enum>(a)</enum><header>Requirement for national security investigation</header><text display-inline="yes-display-inline">Section 721(b)(2)(B) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(2)(B)</external-xref>) is amended—</text><paragraph id="HD7649A85ACAE4921AF66FA09F43FC036"><enum>(1)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HE4E1E36C2B3047C39980522524665BFC"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H3DDD670F02D743869110045AB59F3066"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4A29682E73CC469BA4F126321D72C753" display-inline="no-display-inline"><clause id="H0925BF5A1FBC4DC7BC3A981FB6A367C2"><enum>(iii)</enum><text display-inline="yes-display-inline">a covered transaction is an elevated risk real estate transaction, unless the Committee—</text><subclause id="H8DC201D8A2F74DD696935E55F4B2D2DE"><enum>(I)</enum><text display-inline="yes-display-inline">determines, by clear and convincing evidence, that the covered transaction is not a risk to national security; and</text></subclause><subclause id="HC367D8EF36AE4FF095E0AEC46891F5EA"><enum>(II)</enum><text display-inline="yes-display-inline">submits a notification to the Committees on Agriculture and Financial Services of the House of Representatives, the Permanent Select Committee on Intelligence of the House of Representatives, the Committees on Agriculture and Banking, Housing, and Urban Affairs of the Senate, and the Select Committee on Intelligence of the Senate containing such determination and the reasons therefore.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA43D662F6ECA44C986D1D01ECA6A1A60"><enum>(b)</enum><header>Consideration of elevated risk real estate transactions</header><text display-inline="yes-display-inline">Section 721(b) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HCFC861B94C15435B878CEF2EB04F0747" display-inline="no-display-inline"><paragraph id="HFE9701954EF04D068E8991BA01BB6F48"><enum>(9)</enum><header>Consideration of elevated risk real estate transactions</header><text display-inline="yes-display-inline">For purposes of a review or investigation of an elevated risk real estate transaction under this subsection, the transaction is presumed to present an unresolvable risk to national security, unless the Committee—</text><subparagraph id="H536978936DFD4632B5CEDD0C1DFE02B9"><enum>(A)</enum><text>determines, by clear and convincing evidence, that the risk to national security of the transaction can be resolved in a manner other than by suspending or prohibiting the transaction; and</text></subparagraph><subparagraph id="HE71190E5BD0D4A08A03965F5D279F048"><enum>(B)</enum><text>submits a notification to the Committees on Agriculture and Financial Services of the House of Representatives, the Permanent Select Committee on Intelligence of the House of Representatives, the Committees on Agriculture and Banking, Housing, and Urban Affairs of the Senate, and the Select Committee on Intelligence of the Senate containing such determination and the reasons therefore.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF604C5B3C5B54FB5BEE1D49B2918580B"><enum>(c)</enum><header>Presumption that the risks of elevated risk real estate transactions cannot be mitigated or resolved</header><text display-inline="yes-display-inline">Section 721(l)(3) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(l)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB3B37F3E1384442DA16239FD7CD03CD5"><subparagraph id="H4AA189B4F4DE4224BDD7495D09BB8BDE"><enum>(E)</enum><header>Application to elevated risk real estate transactions</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), an elevated risk real estate transaction shall be presumed to present a risk to national security that cannot be resolved through any agreement or condition, unless the Committee—</text><clause id="H476029AAEA664B2FA04CCDB2787756FE"><enum>(i)</enum><text>determines, by clear and convincing evidence, that the risk to national security of the transaction can be so resolved through such an agreement or condition; and</text></clause><clause id="HA43DA21027AC4842AA8FF4BF4D7BC78B"><enum>(ii)</enum><text display-inline="yes-display-inline">submits a notification to the Committees on Agriculture and Financial Services of the House of Representatives, the Permanent Select Committee on Intelligence of the House of Representatives, the Committees on Agriculture and Banking, Housing, and Urban Affairs of the Senate, and the Select Committee on Intelligence of the Senate containing such determination and the reasons therefore.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H6E2781693E184FFDB599EADBC0796692"><enum>6.</enum><header>Agriculture representative</header><text display-inline="no-display-inline">Section 721(k)(2) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(k)(2)</external-xref>) is amended—</text><paragraph id="H58844A10706B492087EC8C694C5DC812"><enum>(1)</enum><text>by redesignating subparagraphs (H), (I), and (J) as subparagraphs (I), (J), and (K), respectively; and</text></paragraph><paragraph id="HF710A9355F3B42B090777A42B64BF2CA"><enum>(2)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" id="H411E8075600B4F43A0754EAB9A2B8756" display-inline="no-display-inline"><subparagraph id="HC291096F21444B0BB30615BF6A13F929"><enum>(H)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture, on all transactions related to the purchase of agriculture land, agriculture biotechnology, and any other transaction related to the agriculture industry in the United States, as determined by the Secretary of Agriculture.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H947BD9A37A41445BA61272B0E54D3EC9"><enum>7.</enum><header>Preservation of State authority</header><text display-inline="no-display-inline">Section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HE7D86DDC0C8841178E8DA478917805B2" display-inline="no-display-inline"><subsection id="H2ECA198DD72345AB8D2B0AC5C9DAE6BC"><enum>(r)</enum><header>Preservation of State authority</header><paragraph id="HD3A8144247C141049750FBAD3ADEB0CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this section may be construed to preempt or supersede any law of a State that—</text><subparagraph id="H719C15C2B98849D68E092E24D44448B5"><enum>(A)</enum><text>restricts or prohibits the purchase, lease, or acquisition of real estate or agricultural land by a foreign adversary person; and</text></subparagraph><subparagraph id="H8E88282DD78349C8ACEE6881206AD81E"><enum>(B)</enum><text>is of general applicability within that State and does not purport to apply to any specific transaction or party.</text></subparagraph></paragraph><paragraph id="H795E3B71AC2A473DB65B697E073BA390"><enum>(2)</enum><header>State defined</header><text>In this subsection, the term <quote>State</quote> means each of the several States, the District of Columbia, and each territory of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H584AA96DB34E4BBB9AD67EB3116DE332"><enum>8.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than the end of the 120-day period beginning on the date of enactment of this Act, the Committee on Foreign Investment in the United States shall issue rules to carry out the amendments made by this Act.</text></section></legis-body></bill>
