<official-title display="yes">To amend the Homeland Security Act of 2002 and titles 10 and 32, United States Code, to authorize the National Guard to protect certain facilities and assets from unmanned aircraft, and for other purposes.</official-title>

<section id="HDC13BD3D82D443FCA01B95302B4DC79D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guard the Skies Act</short-title></quote>.</text></section> <section id="H359FE1760DD24C099C12FFD98549DC16"><enum>2.</enum><header>Authorization of the National Guard to protect certain facilities and assets from unmanned aircraft</header> <subsection id="HDE1EB6CB04FA4CB3AB20C41852F3BE0D" commented="no"><enum>(a)</enum><header>Homeland Security Act of 2002</header><text display-inline="yes-display-inline">Section 210G of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n</external-xref>) is amended—</text> 
<paragraph id="H7DDE49E8D46D428183EDAF1B30EF1C0C"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H27919BC9DB5748FEB45B06DBBA3E7FBF"><enum>(A)</enum><text>in paragraph (2), by inserting <quote>and the Secretary of Defense</quote> before the period; and</text></subparagraph> 
<subparagraph id="H9953C848D85846159A89480AA9B6D91E"><enum>(B)</enum><text>in paragraph (4)—</text> <clause id="H9BE3231F446F4E7CB02F36A612B4F818"><enum>(i)</enum><text>by striking <quote>Administrator of the Federal Aviation Administration</quote> and inserting </text> 
<quoted-block style="OLC" id="HC0C9EE080970491F83A1644D8C4DF93F" display-inline="yes-display-inline"><text display-inline="yes-display-inline">following:</text> <subparagraph id="HD31B2A1F7CA746EEBC02174CAAAAD565"><enum>(A)</enum><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration,</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> 
<clause id="H324E0F6B3D684AA5AC1BDE5C4E6E7F85"><enum>(ii)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H326032BB4AA9440A8C9133BE0A56A30B" display-inline="no-display-inline"> <subparagraph id="H8B5D729BB7F64F9FB87A15C344CE7B50"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary of Defense, if an action under subsection (l)(3)(C)(iii) is requested by the chief executive officer of a State pursuant to section 130j of title 10, United States Code.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="HEA272EBF1A894F7395EBDF7F8E765572"><enum>(2)</enum><text>in subsection (d)(3)—</text> <subparagraph id="HEF908CF611A242DE91E091C8A29155CC"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="H45AA01B829634C7ABF8BD61DE1F05073"><enum>(i)</enum><text>in the heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">and Department of Defense</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">Department of Transportation</header-in-text></quote>; and</text></clause> <clause id="H3737DBD5BBC74924AB6EB6E1396DDDB0"><enum>(ii)</enum><text>by inserting <quote>and the Secretary of Defense</quote> before the period; and</text></clause></subparagraph> 
<subparagraph id="HD209CEA9D8F84AE08381BF7C4877F9C9"><enum>(B)</enum><text>in subparagraph (B)—</text> <clause id="H6FC6D36AF8DE47D1B8A1EAE2A3FDDC8D"><enum>(i)</enum><text>in the heading, by inserting <quote><header-in-text level="subparagraph" style="OLC">and Defense</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">Safety</header-in-text></quote>;</text></clause> 
<clause id="HFE89458AA8AF4879A282FD195581D450"><enum>(ii)</enum><text>by striking <quote>Secretary of Transportation and the Administrator of the Federal Aviation Administration</quote> and inserting </text> <quoted-block style="OLC" id="H0E7C413A2DF144E4BE04C5133432E35C" display-inline="yes-display-inline"><text display-inline="yes-display-inline">following:</text> 
<clause id="HF1C972E68A6B41EE950EB353293D1C6B"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of Transportation and the Administrator of the Federal Aviation Administration,</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause> <clause id="H882D43D446E549F68CF4B60C506DCC10"><enum>(iii)</enum><text>by adding at the end the following new clause:</text>

<clause id="H7CD47B205ECE40229A1ACA1E8801E43C"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary of Defense, before issuing any guidance, or otherwise implementing this section, if such guidance or implementation might affect actions pursuant to section 130j of title 10, United States Code.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="H76931CD2394C494AA9BDE78C7E0FFF3C" commented="no"><enum>(3)</enum><text>in subsection (e)(5), by inserting <quote>, the Department of Defense,</quote> after <quote>Department of Homeland Security</quote>; and</text></paragraph> 
<paragraph id="H53BC7E37672A4E23B67A44B279FFAF23" commented="no"><enum>(4)</enum><text>in subsection (l)(3)(C)(iii)(I), by inserting <quote>(as such term is defined in section 2001)</quote> after <quote>National Special Security Event</quote>.</text> </paragraph></subsection> <subsection id="HF8E3E96CEE9E4B30BAC2E92B6CC38BAE"><enum>(b)</enum><header>Title 10, United States Code</header> <paragraph id="H51F9E9587BA440FAA04662069DB714AF"><enum>(1)</enum><header>National Guard authorization for protection of certain facilities and assets from unmanned aircraft</header><text display-inline="yes-display-inline">Title 10, United States Code, is amended by inserting after section 130i the following new section:</text> 
<quoted-block style="USC" id="H9744EA9A33F64302B434525B85989744" display-inline="no-display-inline"> 
<section id="HE2F5D0342F20410EA7160628204E4951"><enum>130j.</enum><header>National Guard authorization for protection of certain facilities and assets from unmanned aircraft</header><text display-inline="no-display-inline">Notwithstanding section 46502 of title 49 or sections 32, 1030, 1367 and chapters 119 and 206 of title 18, the Secretary of Defense may, at the request of the chief executive officer of a State with respect to a mission described in subsection (l)(3)(C)(iii) of section 210G of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n</external-xref>), authorize members of the National Guard to take the actions authorized by subsection (a)(1) of such section 210G, if such members satisfy the following requirements:</text> <paragraph id="H3400AD531FB547DAB8C4C3F3D98A61DF"><enum>(1)</enum><text>Are ordered to duty under this title or title 32.</text></paragraph> 
<paragraph id="HD38AFBCAA0AB45909FDD4C6E1A10DDB5" commented="no"><enum>(2)</enum><text>Are assigned duties referred to in subsection (a) of section 130i.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> <paragraph id="HCF02B703246F4EB490ED484FF8ACD87D"><enum>(2)</enum><header>Selected Reserve and certain Individual Ready Reserve members; order to active duty other than during war or national emergency</header><text>Subsection (b) of section 12304 of title 10, United States Code, is amended—</text> 
<subparagraph id="H87A9077133424732B02ACBDEE1758BB4"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and moving such subparagraphs, as so redesignated, two ems to the right; and</text></subparagraph> <subparagraph id="H254AECA6E21A49F282A57C304BB29324"><enum>(B)</enum><text>by striking <quote>in responding to an emergency involving—</quote> and inserting </text> 
<quoted-block style="USC" id="HD4EF9C8CA68741B98257A46883CADFF5" display-inline="yes-display-inline"><text display-inline="yes-display-inline">in—</text> <paragraph id="HC1BAD0681E464ACBB22B7EAB44725FA0"><enum>(1)</enum><text display-inline="yes-display-inline">taking actions pursuant to section 130j; or</text></paragraph> 
<paragraph id="H7E45421F96E9492B947E708CEABCA626"><enum>(2)</enum><text>responding to an emergency involving—</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H9BEA7A6F172F4602B02BF1AA7E0892C3"><enum>(c)</enum><header>Title 32, United States Code</header><text>Subsection (f)(2) of section 502 of title 32, United States Code, (relating to required drills and field exercises) is amended by adding at the end the following new subparagraph:</text>
