<section id="HD2CBF794B595425FA683E46540AFE5F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating Forest Management Act</short-title></quote>.</text> </section> <section id="H50C85B8FEC014D81A2A4B99111FCCED6" section-type="subsequent-section"><enum>2.</enum><header>Codification of categorical exclusion</header> <subsection id="H79849153067F41EDBC60EBDDF4F7834E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Salvage harvesting activities described in subsection (b) are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection> 
<subsection id="H2C562346154E47C2897FD04CA25345E5"><enum>(b)</enum><header>Salvage harvesting activities designated for categorical exclusions</header> 
<paragraph id="H00AB3345BBE648C0A16F221635391E36"><enum>(1)</enum><header>In general</header><text>The salvage harvesting activities designated under this section for categorical exclusion are—</text> <subparagraph id="HAD674A98AD104D8793F3761D9051A659"><enum>(A)</enum><text>covered actions with respect to dead or dying trees resulting from fire, insects, disease, drought, or other disturbances within treatment areas—</text> 
<clause id="HC8609B81A85846718ED28448FEDD6B89"><enum>(i)</enum><text>not to exceed 1,000 acres where the disturbance affects 3,000 acres of Bureau-managed lands or less; and</text></clause> <clause id="H6A09115E65CF41FBA4326B2FEB8C32FD"><enum>(ii)</enum><text>not to exceed the lesser of 5,000 acres or 1/3 of the disturbance area where the disturbance exceeds 3,000 acres of Bureau-managed lands; and</text></clause></subparagraph> 
<subparagraph id="HE5FB2B89F4D54793BB49FC237F6FBD4B"><enum>(B)</enum><text>carried out in conformance with applicable land use planning decisions.</text></subparagraph></paragraph> <paragraph id="H56F86C21B09F47CCAF3829AC88350486"><enum>(2)</enum><header>Limitations</header><text>In addition to the covered actions under paragraph (1), salvage harvesting activities to which the categorical exclusion applies under this section—</text> 
<subparagraph id="HBCC4298745D84D12A7D492338382652A"><enum>(A)</enum><text>may include construction of up to 1 mile of new permanent road to facilitate covered actions, provided that all segments conform to applicable land use planning decisions with route-specific designations disclosed where travel management planning has been completed;</text></subparagraph> <subparagraph id="H05EC50B392904229A4F59C6B790117FD"><enum>(B)</enum><text>may include maintenance and renovation of existing roads as needed;</text></subparagraph> 
<subparagraph id="H4F45AFCD1E2549BB8807AC68631E8D8A"><enum>(C)</enum><text>may include construction of temporary roads not to exceed a ratio of 2.25 miles per 1,000 acres of harvest area as needed, provided that the temporary roads—</text> <clause id="H8375091C547E4488AAD6A011452C3015"><enum>(i)</enum><text>are not part of the permanent transportation system of the Bureau;</text></clause> 
<clause id="HBCCC226980624A05B8B4CA75F9E2F26B"><enum>(ii)</enum><text>are designed to standards appropriate for their intended use (safety, erosion control, sedimentation prevention, and resource protection);</text></clause> <clause id="HA52F21394B1E40D6872F60BAB456C7DE"><enum>(iii)</enum><text>are not needed for long-term resource management; and</text></clause> 
<clause id="HFF55A341DB374071BCA4CD2697366CF3">
                            <enum>(iv)</enum>
 <text>are decommissioned and stabilized after use to minimize erosion and protect water quality; and</text>
                        </clause></subparagraph> 
<subparagraph id="H2C7FB5460BED46C890EEEE0B7E83CF95"><enum>(D)</enum><text display-inline="yes-display-inline">require the disclosure of design features, in documentation of finding that an action is excluded pursuant to the use of this categorical exclusion, that address the following resource considerations consistent with applicable land use plan decisions, or, where no plan requirements apply, specify how the following resource considerations are addressed:</text> <clause id="HE4C2BE5A84A34699B53EEEF97DAD7E3B"><enum>(i)</enum><text>Snag and downed wood—amount to be created or retained.</text></clause> 
<clause id="H8BC14F6866F54071848ABCCF9D5291F2"><enum>(ii)</enum><text>Erosion control—specifications or measures (e.g., water bars, dispersed slash).</text></clause> <clause id="H647A681A31A246B0BAEDA8176D2EF2D9"><enum>(iii)</enum><text>Soil compaction—criteria for avoidance, minimization, or remediation.</text></clause> 
<clause id="H0B954239F75745CBB04836D93DEF37FF"><enum>(iv)</enum><text>Logging systems—types and scope of constraints (e.g., seasonal, location, extent, etc.).</text></clause> <clause id="H671E13FC8B1C4534A102E69FE9A80AA8"><enum>(v)</enum><text>Seasonal operations—purpose and extent of operating restrictions.</text></clause> 
<clause id="H09586C579613412C9AC973E31B225883"><enum>(vi)</enum><text>Invasive species—measures to prevent or limit spread.</text></clause> <clause id="H2451FD2B96D842B89A9472AD222690EC"><enum>(vii)</enum><text>Riparian areas—buffer widths and/or operating restrictions.</text></clause> 
<clause id="H8BDA98C0E1364404B2FDE1FCE2A6E331"><enum>(viii)</enum><text>Prescribed fire—operating constraints for underburning or pile burning.</text></clause> <clause id="H50AABC96DFD84ABDA52A2DFFA8C79835"><enum>(ix)</enum><text>Temporary roads—decommissioning standards.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H985607521CDF4EE0AC361F04833AA07A"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H5C0EE042EE024AC9925CA31453087900"><enum>(1)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph> 
<paragraph id="HAB55A2EAB787425886317C3EA55EC8BC"><enum>(2)</enum><header>Covered actions</header><text display-inline="yes-display-inline">The term <term>covered actions</term> means the one or more of the following actions:</text> <subparagraph id="HA4D82E0F029F4E1997D45393FEC9532E"><enum>(A)</enum><text>Cutting, yarding, and removal of dead or dying trees.</text></subparagraph> 
<subparagraph id="HBDD495942791462BBD89471FDFFA1102">
                        <enum>(B)</enum>
 <text>Cutting, yarding, and removal of live trees needed for operations, landings, skid trails, or road clearing.</text>
                    </subparagraph> 
<subparagraph id="H6CB6C2172BDB40B8A3015FD3276B6586"><enum>(C)</enum><text>Chipping/grinding or removal of residual slash.</text></subparagraph> <subparagraph id="HB713C346DD704FCAB01B083F6B684D3B"><enum>(D)</enum><text>Jackpot burning, pile burning, and underburning.</text></subparagraph> 
<subparagraph id="H62FEC258611E46CD892F5A88AB8A4019"><enum>(E)</enum><text>Seeding or planting necessary to accelerate native species re-establishment.</text></subparagraph></paragraph> <paragraph id="H33BD1A5BE1174C10AAAFAE06FF2B8177"><enum>(3)</enum><header>Dying tree</header><text>The term <term>dying tree</term> means a standing tree severely damaged by disturbance (such as fire, wind, insects, disease, drought) and, in the judgment of a forestry professional or someone technically trained for the work, is likely to die within two years.</text></paragraph> 
<paragraph id="HDC1D85AA8B8C467FB4945B90D2868B15"><enum>(4)</enum><header>Permanent road</header><text>The term <term>permanent road</term> means a road constructed or reconstructed for use, as part of the permanent transportation system of the Bureau.</text></paragraph> <paragraph id="H910E3715EACF4D9C8D300F7A0BF57CDF"><enum>(5)</enum><header>Temporary road</header><text>The term <term>temporary road</term> means a road authorized by contract, permit, lease, written authorization, or emergency operation, not added to the permanent system, and decommissioned after use.</text></paragraph></subsection></section> 
<section id="HC389C8E841AE44C29167869F33E8BA4B"><enum>3.</enum><header>Extension of Forest Ecosystem Health and Recovery Fund</header><text display-inline="no-display-inline">Title I of the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/88">Public Law 111–88</external-xref>) is amended in the text under the heading <quote>FOREST ECOSYSTEM HEALTH AND RECOVERY FUND</quote> by striking <quote>2020</quote> each place it appears and inserting <quote>2033</quote>.</text></section> </legis-body></bill>
