which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to authorize the Secretary of Education to award grants to State educational agencies to carry out wellness programs for school personnel, and for other purposes.</official-title></form><legis-body id="HB656A97C07524498B407CDB6FF5DD7AE" style="OLC"><section id="H90FB9622C7F0496BA1D15C0226D4013C" section-type="section-one"><enum>1.</enum><header>Supporting effective instruction</header><subsection id="HF30EC92C80F94FE68BFE47593CF7E35D"><enum>(a)</enum><header>Authorization of appropriations</header><text>Section 2003 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6603">20 U.S.C. 6603</external-xref>) is amended—</text><paragraph id="H75DE07E4940249DE836FFE4F4E4B852F"><enum>(1)</enum><text>in subsection (a), by striking <quote>each of fiscal years 2017 through 2020</quote> and inserting <quote>each of fiscal years 2026 through 2030</quote>;</text></paragraph><paragraph id="HC93478B6FD1440128FB51C18F4D013FA"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H988C271B3D6D4DE4B0D7044D425FD3B8"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>appropriated—</quote> and inserting <quote>appropriated such sums as may be necessary for each of fiscal years 2026 through 2030.</quote>; and</text></subparagraph><subparagraph id="H6391045CBC5345AD9D35BC7D650AA8BA"><enum>(B)</enum><text>by striking paragraphs (1) through (3); and</text></subparagraph></paragraph><paragraph id="HB220B22D280240D78F8ACEE7CFCF2702"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H15BD993EDF964987B1F6D47D4E2E58BC" display-inline="no-display-inline"><subsection id="H4292B700FD9C41DF93C8C81110FAE687"><enum>(c)</enum><header>Grants to States for wellness programs for school personnel</header><text display-inline="yes-display-inline">For the purpose of carrying out part C, there are authorized to be appropriated such sums as may be necessary for fiscal years 2026 through 2030.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H062233B2CC5F477BBCF9D9D7CA1DF0EC"><enum>(b)</enum><header>State allotments</header><text display-inline="yes-display-inline">Section 2101(b)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6611">20 U.S.C. 6611(b)(1)</external-xref>) is amended—</text><paragraph id="HF026EF9D934640019178DC316510B529"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H4960AE6351484CA6A19D821DBCE3155D"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">years 2017 through 2022</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">years 2026 through 2030</header-in-text></quote>; and</text></subparagraph><subparagraph id="H9F7E6B464C7649E8AEBB18CCCE0CAECF"><enum>(B)</enum><text>in the matter preceding clause (i), by striking <quote>each of fiscal years 2017 through 2022</quote> and inserting <quote>fiscal years 2026 through 2030</quote>; and</text></subparagraph></paragraph><paragraph id="H54EDBD625B2042D1ADF14E5C483D760B"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>each of fiscal years 2017 through 2022</quote> and inserting <quote>each of fiscal years 2026 through 2030</quote>.</text></paragraph></subsection><subsection id="H16BE912B28534B93AAAE559BB1C3A6DF"><enum>(c)</enum><header>Local uses of funds</header><text display-inline="yes-display-inline">Section 2103(b)(3) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6613">20 U.S.C. 6613(b)(3)</external-xref>) is amended—</text><paragraph id="HD7079E8A6FC243A6960037148BFB775D"><enum>(1)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H28157C96F00E419C8B0F190891BE26AC"><enum>(2)</enum><text>in subparagraph (P), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HB890F785FDED4327A90E4C721E52F95F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HE56FC60082A44D198EE90E497C771F06" display-inline="no-display-inline"><subparagraph id="H69643BA58EE44824B220E76CD645B01F"><enum>(Q)</enum><text display-inline="yes-display-inline">developing and implementing programs that create healthier and more sustainable working environments for all school personnel, including teachers, principals, other school leaders, specialized instructional support personnel, and paraprofessionals, by measuring and helping to improve the mental, emotional, and physical well-being of such personnel, including with respect to—</text><clause id="HC4E33378B83D4E6AB8C695C5AF49C279"><enum>(i)</enum><text>stress management;</text></clause><clause id="H4A5927C5E2204945A4FEFC4607A8A6B5"><enum>(ii)</enum><text>workplace conditions;</text></clause><clause id="H8204C96C2FA44468A83A0FC4941832FD"><enum>(iii)</enum><text>access to support; and</text></clause><clause id="HDBA468C67A4846A99D9662FDFAD5263D"><enum>(iv)</enum><text>job satisfaction.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE8BF7503B02D4261AAE5D73424C76E1B"><enum>(d)</enum><header>Reporting</header><text display-inline="yes-display-inline">Section 2104(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6614">20 U.S.C. 6614(a)</external-xref>) is amended—</text><paragraph id="H503D4434305A4005B09F3144FEC87F28"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HA5B618D27415445D89C2C5187467DE9A"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HF6B1CA8F36FF4AD4806BD3180712076A"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H988AC24DF51E4E64932304FEB83C544B" display-inline="no-display-inline"><paragraph id="H3DD96B1BA75141F3ABDCC58346F8CB7B"><enum>(5)</enum><text display-inline="yes-display-inline">a summary of the programs developed and implemented by local educational agencies pursuant to section 2103(b)(3)(Q).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H95606DD728674E36BD68135C8C20794C"><enum>(e)</enum><header>Grants to States for wellness programs</header><paragraph id="H22A6603F8E2C4DED9B8858EAE250E780"><enum>(1)</enum><header>In general</header><text>Title II of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6601">20 U.S.C. 6601 et seq.</external-xref>) is amended—</text><subparagraph id="H1AB16B7E0079471CB0EF63FAD0A37D95"><enum>(A)</enum><text>by redesignating part C as part D; and</text></subparagraph><subparagraph id="HD80D7112A1054C73B6DD20588468096F"><enum>(B)</enum><text>by inserting after part B the following:</text><quoted-block style="OLC" id="H19B4D9B311F14374A6D18A70B44F6C44" display-inline="no-display-inline"><part id="H75AE0D67C878485EAA0C366B0DA88957"><enum>C</enum><header>Wellness programs for school personnel</header><section id="HC0F649F0CA8E4F18ACD74DE9AC5F0913"><enum>2250.</enum><header>Grants to States</header><subsection id="H889A2A2D0D2A4E81AD39B374E1CE687F"><enum>(a)</enum><header>Grants authorized</header><paragraph id="H31F0321713474EC58CA0110FA133704C"><enum>(1)</enum><header>In general</header><text>From the amounts appropriated under section 2003(c), the Secretary shall award, on a competitive basis, grants to State educational agencies to award subgrants to local educational agencies in accordance with section 2251.</text></paragraph><paragraph id="H8427421CC3DE4B6B914CF1063DEC77A2"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to State educational agencies receiving a grant under this part.</text></paragraph><paragraph id="H6DAC11F8F3DA43A493FDA516C094FB60" commented="no"><enum>(3)</enum><header>Grant period</header><text>A grant awarded under this part shall be for a period of 5 years.</text></paragraph></subsection><subsection id="HF9CFDCE2A92C497E809C4474C0F232ED"><enum>(b)</enum><header>Application</header><text>A State educational agency seeking a grant under this part shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary may require, including—</text><paragraph id="H72240168CEFB4156B232258780E32494"><enum>(1)</enum><text>a description of the challenges faced by the State educational agency with respect to—</text><subparagraph id="H5AEB219E13414A9EBDFD3C6431822589"><enum>(A)</enum><text display-inline="yes-display-inline">workforce sustainability, including with respect to—</text><clause id="H0984D58ECE9044F690270AB1F9D76B4A"><enum>(i)</enum><text>workload manageability;</text></clause><clause id="H64DB12E4CEBC4285818A8FFB2B267350"><enum>(ii)</enum><text>support structures;</text></clause><clause id="H25E80A1DCDC54F238D61C2F4E289A3F4"><enum>(iii)</enum><text>morale and workplace climate; and</text></clause><clause id="H9A1BB4CB848C4C1AA7D4B3A93EDDCF1A"><enum>(iv)</enum><text>access to wellness resources; and</text></clause></subparagraph><subparagraph id="HCF731EC365A141E9B462AA81BF7757E0"><enum>(B)</enum><text>workforce retention;</text></subparagraph></paragraph><paragraph id="H8C28B8AB1BBF45A7A149232A2F02C870"><enum>(2)</enum><text>a description of how the State educational agency will consult with superintendents or heads of local educational agencies in accordance with section 2251(a)(2); and</text></paragraph><paragraph id="H4515F56E026843DEB8EC7A4FFE4D68C0"><enum>(3)</enum><text>a description of how the State educational agency will evaluate the effectiveness of programs carried out pursuant to a subgrant awarded under section 2251.</text></paragraph></subsection><subsection id="HF4048358B3C546B5924D86A43D1E97AE"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this part, if the number of satisfactory applications exceeds the number of grants that can be awarded from the amounts appropriated under section 2003(c) based on grant amounts determined by the Secretary, the Secretary shall give priority to State educational agencies experiencing administrator or educator shortages as determined by the Secretary using the most recent publicly available State-level data.</text></subsection></section><section id="HD20A32BC4D13447D93FBAE6357064CD4"><enum>2251.</enum><header>Subgrants to local educational agencies</header><subsection id="H4D64B0EAAEF141F58AE585051A17E158"><enum>(a)</enum><header>Subgrants authorized</header><paragraph id="H388CD0C7DDA94200A9B04741782EF714"><enum>(1)</enum><header>In general</header><text>A State educational agency receiving a grant under this part shall use such grant funds to award subgrants to local educational agencies served by such State educational agency.</text></paragraph><paragraph id="H111B9A1FFA5A409EBB82EAE446FCEFCF"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">Prior to awarding a subgrant under this section, a State educational agency shall consult with the superintendents or heads of local educational agencies served by the State educational agency to—</text><subparagraph id="H8DFCFA5B9E6F44D0BB022A00F13830B6"><enum>(A)</enum><text>understand the factors that impact workplace sustainability (as described in section 2250(b)(1)(A)) and workplace retention in the State; and</text></subparagraph><subparagraph id="H557E7D0D46914F768C8767004C3AEC9F"><enum>(B)</enum><text>for purposes of subsection (c), identify local educational agencies serving high-need student populations.</text></subparagraph></paragraph></subsection><subsection id="HFFC1CB50887649969DF63E65737988DD"><enum>(b)</enum><header>Application</header><text>A local educational agency seeking a subgrant under this section shall submit to the State educational agency an application in such form, at such time, and containing such information as the State educational agency may require, including—</text><paragraph id="H042B690D18CB42DE9AB03378B713F947"><enum>(1)</enum><text>a description of the challenges faced by the local educational agency with respect to workforce sustainability (as described in section 2250(b)(1)(A)) and workforce retention;</text></paragraph><paragraph id="HA8167979B98C4F2C8DF5C744D94817B6"><enum>(2)</enum><text>a description of how the local educational agency will—</text><subparagraph id="HF0082A2299AA49DE809991715CA03032"><enum>(A)</enum><text>implement a program described in subsection (d); and</text></subparagraph><subparagraph id="HCA32CAE087554601ACE90A09EC9A2077"><enum>(B)</enum><text>consult with the State educational agency to develop such program; and</text></subparagraph></paragraph><paragraph id="HB274927028964F10AC9FDE88E810CCBB"><enum>(3)</enum><text>a description of how the local educational agency will evaluate the effectiveness of such program.</text></paragraph></subsection><subsection id="H7380EC8571234CB2848007B8A4479901"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding subgrants under this section, a State educational agency shall give priority to local educational agencies serving high-need student populations (as determined in accordance with subsection (a)(2)).</text></subsection><subsection id="H1C30D4CB053C4E63BC6BFB02A60A1D71"><enum>(d)</enum><header>Uses of funds</header><text display-inline="yes-display-inline">A local educational agency receiving a subgrant under this section shall use such subgrant funds to, in each elementary school and secondary school served by the agency, develop and implement new, or enhance existing, wellness programs for all school personnel (including teachers, principals, other school leaders, specialized instructional support personnel, and paraprofessionals) that—</text><paragraph id="H5ED7E98D85FD4B9C866DB4A745D30EB4"><enum>(1)</enum><text display-inline="yes-display-inline">that create healthier and more sustainable working environments for such personnel;</text></paragraph><paragraph id="H7B205C89B55D43529B4442FC5337BD65"><enum>(2)</enum><text>increase rates of retention; and</text></paragraph><paragraph id="H395BEDDCCB0C4F6A83B46866912A249C"><enum>(3)</enum><text>measure and help to improve the mental, emotional, and physical well-being of such personnel, including with respect to—</text><subparagraph id="H8781007F2CC04986837F52A3A7F80B59"><enum>(A)</enum><text>stress management;</text></subparagraph><subparagraph id="H0735638DE7FC49FCB238A0F171141421"><enum>(B)</enum><text>workplace conditions;</text></subparagraph><subparagraph id="H72B342FD3337412A95DEE0A99549C507"><enum>(C)</enum><text>workload manageability;</text></subparagraph><subparagraph id="HE20372E8AFBA40DA8802969BF80695E1"><enum>(D)</enum><text>access to support; and</text></subparagraph><subparagraph id="H86C507267C7248459BC8ABBB020FDD90"><enum>(E)</enum><text>job satisfaction.</text></subparagraph></paragraph></subsection></section><section id="H71AFA177B4174F2C90FC9895EE8EC9D7"><enum>2252.</enum><header>State report</header><subsection id="HA277BF436B91455EB29DCA8CF542F9FF"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">For each of the first 4 years of the grant period described in section 2250(a)(3), a State educational agency receiving a grant under this part shall, not later than 180 days after the conclusion of each such year, submit to Congress and the Secretary a report that includes, with respect to the year for which the report is submitted—</text><paragraph id="HB9D0210B228E46B28B82138809E5553D"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the wellness programs carried out by the local educational agencies receiving a subgrant under section 2251, including updates on the implementation of such program; and</text></paragraph><paragraph id="H17BDFE4D4D654333AE6450E312CD492F"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the school personnel described in section 2251(d), rates of retention and vacancy, including any change in such rates from the beginning of such year to the date of submission of the report.</text></paragraph></subsection><subsection id="H7DA5D91698E34875BFFD242F5B3F2226"><enum>(b)</enum><header>Final report</header><text display-inline="yes-display-inline">A State educational agency receiving a grant under this part shall, not later than 180 days after the conclusion of the grant period described in section 2250(a)(3), submit to Congress and the Secretary a report that—</text><paragraph id="H1B1B5E7A3AFB4F86AEDCF24B72DD7750" commented="no"><enum>(1)</enum><text>describes the wellness programs carried out by local educational agencies receiving a subgrant under section 2251;</text></paragraph><paragraph id="H58DD6F5D019E49BFBFF8F06D1254DAFE" commented="no"><enum>(2)</enum><text>measures whether such wellness programs impacted, with respect to the school personnel described in section 2251(d)—</text><subparagraph id="HD365B7401002407491956914F9C46209" commented="no"><enum>(A)</enum><text>rates of retention and vacancy (including whether personnel intend to remain in their positions); and</text></subparagraph><subparagraph id="H22DA80EB65364A47BA40AE8A33AE7E71"><enum>(B)</enum><text>school climate, including with respect to workload manageability, morale, and well-being, as determined by staff climate surveys; and</text></subparagraph></paragraph><paragraph id="H11BDDD35B04C4C7E8F236635343AFE54"><enum>(3)</enum><text>outlines best practices for developing and implementing such wellness programs.</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD6285ED374844ECE8A3AC99DE0333F0F"><enum>(2)</enum><header>Table of contents</header><text>The table of contents of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) is amended—</text><subparagraph id="H841313A9583D4EFF8805BBAF613BF4F3"><enum>(A)</enum><text>by inserting after the item relating to section 2245 the following:</text><quoted-block style="OLC" id="HD06A7C859BBA48B793DB5BA99CF2AE9B" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="part">Part C—Wellness Programs for School Personnel</toc-entry><toc-entry level="section">Sec. 2250.
