<section id="H8C328A8C6A4143EEA6AC6740BA8998CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jersey Pride Tax Credit Act of 2026</short-title></quote>.</text></section> <section id="H3DA61C3D73224D389C0DC171340A5F3F"><enum>2.</enum><header>Jersey pride tax credit</header> <subsection id="H9B0377E773694A148B0932C37880A8F5"><enum>(a)</enum><header>New Jersey promotion tax credit</header><text display-inline="yes-display-inline">Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>

<section id="H8BA1027670484973959A1D07794497D2"><enum>45BB.</enum><header>Jersey pride tax credit</header> 
<subsection id="HF7FD414F2A204910A1E48811F8937858"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of section 38, the Jersey pride tax credit is an amount equal to 25 percent of the aggregate amount for which the taxpayer sold eligible products in the course of the trade or business of the taxpayer to unrelated parties during the taxable year.</text></subsection> <subsection id="H4D48157469B24B2DA37F80703A6B6BEB"><enum>(b)</enum><header>Eligible product</header><text display-inline="yes-display-inline">In this section, the term <quote>eligible product</quote> means any product that promotes the State of New Jersey.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE84951F56C01403A8394BF3C3C5DFDE6"><enum>(b)</enum><header>Credit made part of general business credit</header><text display-inline="yes-display-inline">Section 38 of subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986, is amended—</text> <paragraph id="H22FF11CDF3E54A50A118D6B119F8FF48"><enum>(1)</enum><text>by striking <quote>plus</quote> at the end of paragraph (40),</text></paragraph> 
<paragraph id="HC0CF25AEDDF2447AB25998E79F14D51C"><enum>(2)</enum><text>by striking the period at the end of paragraph (41) and inserting <quote>, plus</quote>, and</text></paragraph> <paragraph id="H242C51F3F0DB45959AB4F5B80B36513F"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H8EEA861A738A48DFBEDA5E6259E89B3B"><enum>(42)</enum><text display-inline="yes-display-inline">the Jersey pride tax credit determined under section 45BB.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H7E7589D60ACD4C8D864EB1C6524790B9"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart D of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following new item:</text>

<toc-entry idref="H8BA1027670484973959A1D07794497D2" level="section">Sec. 45BB. Jersey pride tax credit.</toc-entry> </toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H81DDEBE66424459F89FBEEAB6715834E"><enum>(d)</enum><header>Effective date</header><text>The amendment made by this section shall apply to products sold after December 31, 2025.</text> </subsection></section> <section id="H6B336DE5486F4D3BB64853526775C4CD"><enum>3.</enum><header>Port Authority preference</header> <text display-inline="no-display-inline">In renting a commercial space to a business, a port authority (as defined in section 340.2 of title 46, Code of Federal Regulations) shall give preference to any business that sells an eligible product (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45BB">section 45BB</external-xref> of the Internal Revenue Code of 1986).</text></section>
